Federal Acquisition Regulation; FAR Case 2007-013, Employment Eligibility Verification
The Department of Defense, General Services Administration, and National Aeronautics and Space Administration have agreed to delay the applicability date of FAR Case 2007-013, Employment Eligibility Verification, to May 21, 2009.
Notice of Record of Decision for Southern California Range Complex
The Department of the Navy (DON), after carefully weighing the operational, and environmental consequences of the proposed action, announces its decision to support and conduct current, emerging, and future military readiness activities in the Southern California (SOCAL) Range Complex, to include San Clemente Island (SCI), as necessary to achieve and sustain Fleet readiness, including Navy training; Department of Defense (DoD) or other federal agency research, development, test, and evaluation (RDT&E) activities; and investment in range resources and range infrastructure, all in furtherance of the Navy's statutory obligations under Title 10 of the United States Code governing the roles and responsibilities of the Navy. In its decision, the Navy considered applicable executive orders, including an analysis of the environmental effects of its actions outside the United States or its territories under the provisions of Executive Order (EO) 12114, Environmental Effects Abroad of Major Federal Actions, and the requirements of EO 12898, Federal Actions to Address Environmental Justice in Minority Populations and Low Income Populations. The proposed action will be accomplished as set out in Alternative 2, described in the Final Environmental Impact Statement/Overseas Environmental Impact Statement (EIS/ OEIS) as the preferred alternative. Implementation of the preferred alternative could begin immediately. Because of the Navy's Title 10 requirements to organize, train, equip, and maintain combat-ready forces, ongoing training and RDT&E activities within the SOCAL Range Complex will continue at current levels in the event that the preferred alternative is not implemented.
Notice of Record of Decision for Atlantic Fleet Active Sonar Training
The Department of the Navy (DON), after carefully weighing the operational and environmental consequences of the proposed action, announces its decision to designate areas along the East Coast of the United States and in the Gulf of Mexico where mid- and high-frequency active (MFA and HFA) sonar and the improved extended echo ranging (IEER) system training; maintenance; and research, development, test, and evaluation (RDT&E) activities will occur, and to conduct these activities. The Navy's decision regarding MFA sonar activities includes the advanced extended echo ranging (AEER) system as a replacement for the IEER system. The Navy considered applicable executive orders, including an analysis of the environmental effects of its actions outside the United States or its territories under Executive Order (EO) 12114, Environmental Effects Abroad of Major Federal Actions, and the requirements of EO 12898, Federal Actions to Address Environmental Justice in Minority Populations and Low Income Populations. The proposed action will be accomplished as set forth in the No- Action Alternative, described in the Final Environmental Impact Statement/Overseas Environmental Impact Statement (EIS/OEIS) as the preferred alternative. Implementation of the preferred alternative could begin immediately. The preferred alternative represents the active sonar training and RDT&E activities necessary for Navy to meet its Title 10 obligation to organize, train, equip and maintain combat- ready naval forces and to successfully fulfill its current and future global mission of winning wars, deterring aggression, and maintaining freedom of the seas.
Defense Representative Guam, Commonwealth of the Northern Mariana Islands, Federated States of Micronesia and Republic of Palau; Notice of Public Hearings for the Mariana Islands Range Complex Draft Environmental Impact Statement/Overseas Environmental Impact Statement
Pursuant to section 102(2)(c) of the National Environmental Policy Act (NEPA); the Council of Environmental Quality (CEQ) Regulations for implementing the procedural provisions of NEPA (Title 40 Code of Federal Regulations [CFR] Parts 1500-1508); and Executive Order (EO) 12114, Environmental Effects Abroad of Major Federal Actions, on behalf of the Department of Defense Representative Guam, Commonwealth of the Northern Mariana Islands, Federated States of Micronesia and Republic of Palau (DoD REP), the U.S. Navy (Navy) has prepared and filed with the U.S. Environmental Protection Agency a Draft Environmental Impact Statement/Overseas Environmental Impact Statement (EIS/OEIS) for the Mariana Islands Range Complex (MIRC) for public release on January 30, 2009. The National Marine Fisheries Service (NMFS), the U.S. Department of the Interior, Office of Insular Affairs, the Federal Aviation Administration, the United States Marine Corps, and the United States Air Force (USAF) are cooperating agencies in the preparation of this EIS/OEIS. The Draft EIS/OEIS evaluates the potential environmental impacts associated with the military readiness training; research, development, testing, and evaluation (RDT&E) activities; and associated range capabilities enhancements within the existing MIRC. A Notice of Intent for this Draft EIS/OEIS was published in the Federal Register on June 1, 2007 (72 FR 30557). The Navy will conduct five public hearings to receive oral and written comments on the Draft EIS/OEIS. Federal agencies, state agencies, and local agencies and interested individuals are invited to be present or represented at the public hearings. This notice announces the dates and locations of the public hearings for this Draft EIS/OEIS.
Intent To Prepare a Joint Environmental Impact Statement/Environmental Impact Report for the Sacramento River Bank Protection Project Phase II Supplemental Authority providing for implementation of up to 80,000 linear feet of additional bank protection in the Sacramento River Flood Control Project area, Butte, Colusa, Contra Costa, Glenn, Placer, Sacramento, Solano, Sutter, Tehama, Yolo, and Yuba Counties, CA
The action being taken is the preparation of a joint environmental impact statement/environmental impact report (EIS/EIR) for the Sacramento River Bank Protection Project (SRBPP) Phase II Supplemental Authority. The SRBPP Phase II Supplemental Authority will result in the implementation of an additional 80,000 linear feet of bank protection in the Sacramento River Flood Control Project area, as authorized by the Water Resources Development Act (WRDA) of 2007. The SRBPP Phase II Supplemental Authority is located in the Sacramento River Flood Control Project (SRFCP) area, consisting of the Sacramento River and its Tributaries, CA.

Notice of Intent To Prepare an Environmental Impact Statement/Environmental Impact Report for the West Sacramento Levee Improvements Program, West Sacramento, CA
The action being taken is the preparation of a programmatic and project-specific Environmental Impact Statement/Environmental Impact Report (EIS/EIR) for the West Sacramento Levee Improvements Program (WSLIP) in Yolo County and Solano County, CA. Under 33 U.S.C. 408, the Chief of Engineers grants permission to alter an existing flood control structure if it is not injurious to the public interest and does not impair the usefulness of such work. Under Section 404 of the Clean Water Act, the District Engineer permits the discharge of dredged or fill material into waters of the United States if the discharge meets the requirements for the Environmental Protection Agency's 404(b)(1) guidelines and is not contrary to the public interest. The U.S Army Corps of Engineers (Corps) will consider granting both 408 permission to the Central Valley Flood Protection Board (CVFPB) and 404 permit to West Sacramento Area Flood Control Agency (WSAFCA) for their work on the WSLIP. The CVFPB and WSAFCA are requesting this permission and permit in order to reduce flood risk the City of West Sacramento by meeting the following objectives for the project: Achieve a minimum of a 200-year level (an event that has a 0.5% chance of occurring in any given year) of flood protection for the entire City by improving approximately 50 miles of levees that protect it; Construct levee improvements as soon as possible to reduce flood risk as quickly as possible; and, Provide recreational and open space elements for the City that are compatible with flood improvement actions.
Foreign Overseas Per Diem Rates
The Per Diem, Travel and Transportation Allowance Committee is publishing Civilian Personnel Per Diem Bulletin Number 262. This bulletin lists revisions in the per diem rates prescribed for U.S. Government employees for official travel in Alaska, Hawaii, Puerto Rico, the Northern Mariana Islands and Possessions of the United States. AEA changes announced in Bulletin Number 194 remain in effect. Bulletin Number 262 is being published in the Federal Register to assure that travelers are paid per diem at the most current rates.

Notice of Intent To Prepare an Environmental Impact Statement for the Missouri River Ecosystem Restoration Plan, Missouri River Basin, United States
Pursuant to the National Environmental Policy Act of 1969 (NEPA), as amended and in furtherance of the Water Resources Development Act of 2007, the U.S. Army Corps of Engineers, Kansas City and Omaha Districts, intend to prepare the Missouri River Ecosystem Restoration Plan and Environmental Impact Statement (plan/EIS). In developing the plan, the Corps must study actions required to mitigate habitat losses of aquatic and terrestrial habitat, recover federally listed species under the Endangered Species Act and restore ecosystem functions to prevent further declines among other native species. During an extended scoping process, we will invite comment on the draft purpose and need statements for the plan/EIS. The plan/EIS will describe a range of alternatives for achieving the purpose of the plan and assess the effects of those alternatives, including a preferred alternative, on the human environment as defined by NEPA. The goal of this planning effort is to develop and implement a single, comprehensive and integrated plan to guide the implementation of programs associated with mitigation, recovery, and restoration activities in the Missouri River Basin.
Flood Control, Mississippi River & Tributaries, Yazoo River Basin, Yazoo Headwaters Project, Mississippi Tributaries Unit
The U.S. Army Corps of Engineers, Vicksburg District, in conjunction with the Yazoo-Mississippi Delta Levee District, the non- Federal sponsor, is undertaking studies to evaluate the authorized Yazoo Headwaters Project. As part of this work, a Supplemental Environmental Impact Statement (SEIS) is being prepared to update existing National Environmental Policy Act documentation.

Establishment of Department of Defense Federal Advisory Committees
Under the provisions of section 596 of Public Law 110-417, the Federal Advisory Committee Act of 1972 (5 U.S.C. Appendix, as amended), the Government in the Sunshine Act of 1976 (5 U.S.C. 552b, as amended), and 41 CFR 102-3.65, the Department of Defense gives notice that it is establishing the Military Leadership Diversity Commission (hereafter referred to as the Commission). The Commission is a non-discretionary federal advisory commission established under the authority of section 596 of Public Law 110-417 and 41 CFR 102-3.50(a) to conduct a comprehensive evaluation and assessment of policies that provide opportunities for the promotion and advancement of minority members of the Armed Forces, including minority members who are senior officers. In carrying out the study, the commission shall examine the following: 1. The efforts to develop and maintain diverse leadership at all levels of the Armed Forces. 2. The successes and failures of developing and maintaining a diverse leadership, particularly at the general and flag officer positions. 3. The effect of expanding Department of Defense secondary educational programs to diverse civilian populations, to include military service academy preparatory schools. 4. The ability of current recruitment and retention practices to attract and maintain a diverse pool of qualified individuals in sufficient numbers in officer pre-commissioning programs. 5. The ability of current activities to increase continuation rates for ethnic- and gender-specific members of the Armed Forces. 6. The benefits of conducting an annual conference attended by civilian military, active-duty and retired military, and corporate leaders on diversity, to include a review of current policy and the annual demographic data from the Defense Manpower Data Center. 7. The status of prior recommendations made to the Department of Defense and to Congress concerning diversity initiatives within the Armed Forces. 8. The incorporation of private sector practices that have been successful in cultivating diverse leadership. 9. The establishment and maintenance of fair promotion and command opportunities for ethnic- and gender-specific members of the Armed Forces at the 0-5 grade level and above. 10. An assessment of pre-command billet assignments of ethnic- specific members of the Armed Forces. 11. The development of a uniform definition, to be used throughout the Department of Defense, of diversity that is congruent with the core values and vision of the Department of Defense for the future workforce. 12. The existing metrics and milestones for evaluating the diversity plans of the Department of Defense (including the plans of the Military Departments) and for facilitating future evaluation and oversight. 13. The existence and maintenance of fair promotion, assignment, and command opportunities for ethnic- and gender-specific members of the Armed Forces at the levels of warrant officer, chief warrant officer, company and junior grade, field and mid-grade, and general and flag officer. 14. The current institution structure of the Office of Diversity Management and Equal Opportunity of the Department of Defense, and of similar officers of the Military Departments, and their ability to ensure effective and accountable diversity management across the Department of Defense. 15. The option available for improving the substance or implementation of current plans and policies of the Department of Defense and the Military Departments. No later than 12 months after the date on which the commission first meets, the commission shall submit to the President and Congress a report on the commission's study. The report shall include, as a minimum, the following: 1. The findings and conclusions of the commission; 2. The recommendations of the commission for improving diversity within the Armed Forces; and 3. Such other information and recommendations as the commission considers appropriate. In addition, the commission may submit interim reports to the President and Congress as the commission considers appropriate. The commission, pursuant to section 596(d)(3) of Public Law 110- 417, may consult with appropriate private, for profit, and non-profit organizations and advocacy groups to learn methods for developing, implementing, and sustaining senior diverse leadership within the Department of Defense. In addition, the commission, pursuant to section 596(f)(1) of Public Law 110-416, may hold such hearings, sit and act at such times and places, take such testimony, and receive such evidence as the commission considers appropriate. Members shall be appointed for the life of the commission. Any vacancy in the commission shall be filled in the same manner as the original appointment. The commission, pursuant to section 596(b) of Public Law 110-416, shall be composed of the following members: 1. The Director of the Defense Manpower Data Center; 2. The Commandant of the Director of the Defense Equal Opportunity Management Institute; 3. A commissioned officer from each of the Army, Navy, Air Force, and Marine Corps who serves or has served in a leadership position with either a Military Department command or combatant command; 4. A commissioned officer or noncommissioned officer of the Coast Guard on active duty; 5. A retired general or flag officer from each of the Army, Navy, Air Force and Marine Corps; 6. A retired flag officer of the Coast Guard; 7. A retired noncommissioned officer from each of the Army, Navy, Air Force and Marine Corps; 8. Five retired commissioned officers who served in leadership positions with either a Military Department command or combatant command, of who no less than three shall represent the views of minority veterans; 9. Four individuals with expertise in cultivating diverse leaders in private or non-profit organizations; and 10. An attorney with appropriate experience and expertise in constitutional and legal matters related to the duties and responsibilities of the committee. The appointment of the Director of the Defense Manpower Data Center and the Commandant of the Defense Equal Opportunity Management Institute shall be based upon their ex-officio position within the Department of Defense. Representatives for the incumbents may attend committee meetings; however, they shall not exercise any authority unless they have been appointed in writing, pursuant to DoD policies and procedures, as the Acting Director. With the exception of the representatives of the U.S. Coast Guard, the Secretary of Defense shall appoint the commission members. Commission members appointed by the Secretary of Defense, who are not full-time or permanent part-time employees of the federal government, shall be appointed as experts and consultants under the authority of 5 U.S.C. 3109, and these individuals shall serve as special government employees. Pursuant to section 596(g)(1) of Public Law 110-416, the Secretary of Homeland Security, in consultation with the Commandant of the Coast Guard, shall appoint two individuals to represent the interests of the U.S. Coast Guard. Commission members, who are not full-time or permanent part-time federal employees, shall serve without compensation. All commission members shall be provided travel and per diem for official commission travel. These experts and consultants shall be considered Special Government Employees, and their appointments, regardless of their term of office, shall be renewed by the Secretary of Defense on an annual basis. The Secretary of Defense, pursuant to section 596(b)(3) of Public Law 110-416, shall designate one member as the chairman of the commission. The commission, pursuant to section 596(c)(2) of Public Law 110- 416, shall meet at the call of the chairman. Pursuant to section 596(b)(6) of Public Law 110-416, fifteen committee members shall constitute a quorum, but a lesser number may hold hearings. The Department of Defense, pursuant to 41 CFR 102-3.105(i) and DoD policies and procedures, shall appoint a full-time or permanent part- time DoD employee to serve as commission's Designated Federal Officer. The Designated Federal Officer shall comply with existing federal statutes and regulations governing federal advisory committees, and shall attend all commission and subcommittee meetings. The commission shall be authorized to establish subcommittees, as necessary and consistent with its mission, and these subcommittees or working groups shall operate under the provisions of the Federal Advisory Committee Act of 1972, the Government in the Sunshine Act of 1976 (5 U.S.C. 552b, as amended), and other appropriate federal regulations. Such subcommittees or workgroups shall not work independently of the chartered commission, and shall report all their recommendations and advice to the commission for full deliberation and discussion. Subcommittees or workgroups have no authority to make decisions on behalf of the chartered commission nor can they report directly to the Department of Defense or any federal officers or employees who are not commission members.
Notice of Public Information Meeting for the Draft Environmental Impact Statement for the Proposed Dredging of the Norfolk Harbor Channel in Norfolk and Portsmouth, VA
Pursuant to section 102(2)(c) of the National Environmental Policy Act (NEPA), and the Council on Environmental Quality regulations implementing the procedural provisions of NEPA (Title 40 Code of Federal Regulations Parts 1500-1508), the Department of the Navy (Navy), in cooperation with the U.S. Army Corps of Engineers (USACE), has prepared and filed with the U.S. Environmental Protection Agency a Draft Environmental Impact Statement (DEIS) on January 8, 2008, to evaluate the environmental consequences of deepening approximately five miles of the Norfolk Harbor Federal Navigational Channel in the Southern Branch of the Elizabeth River, separating Norfolk and Portsmouth, Virginia. Dredging will extend from the Lamberts Point Deperming Station in the Lamberts Bend Reach south to the Norfolk Naval Shipyard (NNSY) in the Lower Reach. A Notice of Intent for this EIS was published in the Federal Register on September 19, 2006, (71 FR 54803). The Navy will conduct a public information meeting to receive oral and written comments on the DEIS. Federal, state, and local agencies and interested individuals are invited to be present or represented at the public information meeting. This notice announces the date and location of the public information meeting for this DEIS.
Notice of Intent to Grant Partially Exclusive License; Sigma Technologies International
The Department of the Navy gives notice of its intent to grant Sigma Technologies International a revocable, nonassignable, partially exclusive license, with exclusive field of use in passivation of aluminum flake pigments that have a flake thickness of 5 nm to 2 micron and an area of 10 nm to 500 microns in diameter, in the United States to practice the Government-owned invention, U.S. Patent 7,193,649 entitled ``Passivation Layer on Aluminum Surface and Method Thereof.''

These meetings will assess the effectiveness of the processes used by the Department of Defense for the generation of urgent operational need requirements and the acquisition processes used to fulfill such requirements. Consequently, this Task Force will have access to all levels of classified information needed to develop its assessment and recommendations.

Intent To Prepare a Draft Environmental Impact Statement (DEIS) for the Proposed Beluga to Fairbanks (B2F) Natural Gas Transportation Pipeline Proposed by the Alaska Natural Gas Development Authority (ANGDA)
The Alaska District, U.S. Army Corps of Engineers (Corps) intends to prepare a Draft Environmental Impact Statement (DEIS) to address the potential impacts associated with the construction of the proposed Beluga to Fairbanks (B2F) Alaska natural gas transportation pipeline. The Corps will be evaluating a permit application for work under Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act. The Environmental Impact Statement (EIS) will be used as a basis for the permit decision and to ensure compliance with the National Environment Policy Act.
Notice of Record of Decision for Homeporting of Additional Surface Ships at Naval Station Mayport, FL
The Department of the Navy (DON), after carefully weighing the strategic, operational, and environmental consequences of the proposed action, announces its decision to homeport one nuclear-powered aircraft carrier (CVN) at Naval Station (NAVSTA) Mayport. Today's decision does not relocate a specific CVN to NAVSTA Mayport. It does initiate a multi-year process for developing operational, maintenance, and support facilities at NAVSTA Mayport to support homeporting of one CVN. This multi-year process includes implementing projects for dredging and dredged material disposal, construction of CVN nuclear propulsion plant maintenance facilities, wharf improvements, transportation improvements, and construction of a parking structure to replace existing parking that would be displaced by development of the CVN nuclear propulsion plant maintenance facilities. The projects necessary to create the capacity to support CVN homeporting could be completed as early as 2014. No CVN homeport change will occur before operational, maintenance, and support facility projects are completed. Selection of the CVN to be homeported at NAVSTA Mayport would not occur until approximately one year prior to the ship's transfer to NAVSTA Mayport. Selection of a specific CVN for homeporting at NAVSTA Mayport will be based upon then current operational needs, strategic considerations, and maintenance cycles. The DON environmental analysis included extensive studies regarding impacts associated with dredging, facility construction, and homeport operations. The environmental analysis undertaken by the DON included lengthy and detailed consultations with regulatory agencies, such as the U.S. Fish and Wildlife Service (USFWS) and the National Marine Fisheries Service (NMFS), regarding impacts to endangered and threatened species, and the U.S. Army Corps of Engineers (USACE) and the Environmental Protection Agency (EPA) regarding dredging operations and the in-water disposal of dredged materials. Public awareness and participation were integral components of the Environmental Impact Statement (EIS) process.

Multi-Agency Radiation Survey and Assessment of Materials and Equipment Manual
The Department of Defense (DoD), Department of Energy (DOE), U.S. Environmental Protection Agency (EPA), and the U.S. Nuclear Regulatory Commission (NRC) are announcing the availability of the final ``Multi-Agency Radiation Survey and Assessment of Materials and Equipment manual'' (MARSAME). MARSAME provides information on planning, conducting, evaluating, and documenting radiological surveys for demonstrating compliance with measurable action levels. The MARSAME manual is a multi-agency consensus document. The agencies previously have sought public comment in order to receive feedback from the widest range of interested parties and to ensure that all information relevant to developing the document was received. The agencies reviewed public comments received on the draft MARSAME as well as comments from a concurrent, independent, technical peer review. Suggested changes were incorporated, where appropriate, in response to those comments.
