2005 Base Closure and Realignment (BRAC) Recommendations for the Joint Strike Fighter Initial Joint Training Site at Eglin Air Force Base, FL
On February 5, 2009, the United States Air Force signed the ROD for the implementation of the BRAC 2005 recommendations for the Joint Strike Fighter (JSF) Initial Joint Training Site (IJTS) at Eglin Air Force Base (AFB), Florida. The ROD states the Air Force decision to implement portions of the Alternative 1 cantonment and Alternative 1 flight training action alternatives, by allowing delivery of 59 aircraft, associated cantonment construction, and limiting flight training operations until a Supplemental Environmental Impact Statement (EIS) is completed. The decision was based on matters discussed in the Final EIS, inputs from the public and regulatory agencies, and other relevant factors. On October 17, 2008 the Final EIS Notice of Availability was published in the Federal Register (Volume 73, Number 202, Page 61859) with the waiting period for signing the ROD ending on November 17, 2008.
Analysis of National Security Issues Associated With Specialty Metals
Specialty metals are not ``critical materials.'' There is no national security reason for the Department to take action to ensure a long term domestic supply of specialty metals.
Office of the Secretary of Defense (Health Affairs)/TRICARE Management Activity
This notice is to advise interested parties of the extension of a Military Health System (MHS) demonstration project entitled ``TRICARE Demonstration Project for the State of Alaska.'' The original demonstration notice was published on May 18, 2004 (69 FR 28124-28125) and described a demonstration project to exempt from the TRICARE managed care support contract for the Western Region the underwriting provisions for the cost of civilian health care in the State of Alaska. The demonstration was to be conducted for up to five years after the start of health care delivery under the contract and therefore is scheduled to end on March 31, 2009. The demonstration project will now be extended for one additional year (March 31, 2010).
Publication of Housing Price Inflation Adjustment Under 50 U.S.C. App. 531
The Servicemembers Civil Relief Act, as codified at 50 U.S.C. App. 531, prohibits a landlord from evicting a Service member (or the Service member's family) from a residence during a period of military service except by court order. The law as originally passed by Congress applied to dwellings with monthly rents of $2400 or less. The law requires the Department of Defense to adjust this amount annually to reflect inflation, and to publish the new amount in the Federal Register. We have applied the inflation index required by the statute. The maximum monthly rental amount for 50 U.S.C. App. 531(a)(1)(A)(ii) as of January 1, 2009, will be $2,932.31.

Suspension of the Price Evaluation Adjustment for Small Disadvantaged Businesses
The Director of Defense Procurement has suspended the use of the price evaluation adjustment, as required by 10 U.S.C. 2323(e)(3)(B), because DoD exceeded its 5 percent goal described in 10 U.S.C. 2323(a) in fiscal year 2008. The suspension will be in effect for 1 year and will be reevaluated in fiscal year 2009 based on the level of DoD contract awards established in 10 U.S.C. 2323(a).

U.S. Air Force Academy Board of Visitors Notice of Meeting
Pursuant to 10 U.S.C. 9355, the U.S. Air Force Academy (USAFA) Board of Visitors (BoV) will meet in Harmon Hall, 2304 Cadet Drive, Suite 3300 at the United States Air Force Academy in Colorado Springs, CO on 6-7 March 2009. The meeting session will begin at 9 a.m. on 6 March. The purpose of this meeting is to review morale and discipline, social climate, curriculum, instruction, physical equipment, fiscal affairs, academic methods, and other matters relating to the Academy. Pursuant to 5 U.S.C. 552b, as amended, and 41 CFR 102-3.155, the Administrative Assistant to Secretary of the Air Force has determined that portions of this meeting shall be closed to the public. The Administrative Assistant to the Secretary of the Air Force, in consultation with the Office of the Air Force General Counsel, has determined in writing that the public interest requires that two portions of this meeting be closed to the public because they will involve matters covered by subsection (c)(6) of 5 U.S.C. 552b. Public attendance at the open portions of this USAFA BoV meeting shall be accommodated on a first-come, first-served basis up to the reasonable and safe capacity of the meeting room. In addition, any member of the public wishing to provide input to the USAFA BoV should submit a written statement in accordance with 41 CFR 102-3.140(c) and section 10(a)(3) of the Federal Advisory Committee Act (FACA) and the procedures described in this paragraph. Written statements must address the following details: the issue, discussion, and a recommended course of action. Notice of Public Hearing of the Draft Environmental Impact Statement (DEIS) for the West Coast Basing of the MV-22
Pursuant to section (102)(2)(c) of the National Environmental Policy Act (NEPA) of 1969 (NEPA), and regulations implemented by the Council on Environmental Quality (40 CFR Parts 1500-1508), Department of Navy (DoN) NEPA regulations (32 CFR Part 775), and U.S. Marine Corps (USMC) NEPA directives (Marine Corps Order P5090.2A, change 1), DON and USMC have prepared and filed with the U.S. Environmental Protection Agency (EPA) a Draft Environmental Impact Statement (DEIS). The USMC is initiating the public period and has scheduled three public comment meetings. Intent To Prepare a Draft Environmental Impact Statement for the Proposed Honolulu Seawater Air Conditioning Project, Honolulu, O'ahu, Hawai'i, Department of the Army Regulatory File Number POH-2004-1141
The Honolulu Seawater Air Conditioning, LLC proposes to construct a seawater air conditioning system (SWAC) at Kaka'ako on the south shore of O'ahu in order to provide a renewable-energy air conditioning system for downtown Honolulu buildings. The applicants propose to construct intake and return pipelines in adjacent coastal waters to utilize available deep, offshore cold seawater for their planned onshore cooling plant. The proposed pipeline staging and installation sites are located within the navigable waters of the United States and the proposed activity is subject to the regulatory jurisdiction of the U.S. Army Corps of Engineers.

Intent To Prepare a Supplemental Draft Environmental Impact Statement for the Proposed Northern Integrated Supply Project in Northeastern Colorado
The U.S. Army Corps of Engineers (COE) is preparing a Supplemental Draft Environmental Impact Statement (SDEIS) to further analyze the direct, indirect and cumulative effects of the Northern Integrated Supply Project (NISP). Construction of the proposed Project will result in temporary and permanent impacts to jurisdictional waters of the United States, thereby requiring a Clean Water Act Section 404 permit. The COE released a Draft Environmental Impact Statement (DEIS) for NISP April 30, 2008. Significant comments were received during three public hearings held for the Draft Environmental Impact Statement (DEIS) as well as submitted during the comment period. The COE has determined that substantial additional analysis is required and that the purposes of the National Environmental Policy Act would be furthered through the preparation of the SDEIS.

Draft Comprehensive Plan and Integrated Programmatic Environmental Impact Statement for the Mississippi Coastal Improvement Program, Jackson, Harrison, and Hancock Counties, MS
This notice of availability announces the public release of the Draft Comprehensive Plan and Integrated Programmatic Environmental Impact Statement (EIS) for the Mississippi Coastal Improvements Program (MsCIP), Jackson, Harrison, and Hancock Counties, MS. The Mobile District, U.S. Army Corps of Engineers (Corps) published in the Federal Register, August 9, 2006, (71 FR 45537) a Notice of Intent to Prepare a Draft EIS to address the potential impacts associated with actions to comprehensively address hurricane and storm damage reduction, prevention of saltwater intrusion, preservation of fish and wildlife, prevention of erosion, and other related water resource purposes in coastal Mississippi. These actions are related to the consequences of hurricanes in the Gulf of Mexico in 2005. The Corps will forward recommendations to Congress as authorized by the Department of Defense Appropriations Act, 2006 (Pub. L. 109-148) dated December 30, 2005. The tentatively selected comprehensive plan elements for construction include ecosystem restoration of the barrier islands, mainland beaches, and sites at Admiral Island, Turkey Creek, Dantzler, Bayou Cumbest, Franklin Creek, Deer Island, and submerged aquatic vegetation in Bayou Cumbest which will restore approximately 3,210 acres of emergent tidal marsh, wet pine savannah, scrub/shrub, submerged aquatic vegetation, and beach and dune habitats. In conjuction with the ecosystem restoration efforts, the Draft Comprehensive Plan/Integrated Programmatic EIS recommends tentatively selected flood damage reduction elements, including Forrest Heights Levee, High Hazard Area Risk Reduction Plan Phase I, Waveland Flood Proofing Pilot Projects, and Moss Point Municipal Facility relocation. The EIS will be used as a basis for ensuring compliance with the National Environmental Policy Act (NEPA).
Intent To Hold an Open Meeting of the South Dakota River Task Force Established by the Missouri River Restoration Act of 2000 (Title IX)
The duties of the Task Force are to prepare and approve a plan for the use of the funds made available under Title IX to promote conservation practices in the Missouri River watershed, control and remove the sediment from the Missouri River, protect recreation on the Missouri River from sedimentation, and protect Indian and non-Indian historical and cultural sites along the Missouri River from erosion.

The purpose for this Request For Information (RFI) is to identify (1) near-term industry solutions that could provide the Department of Defense (DoD) the capability to rapidly deliver military capabilities via space, and (2) long-term advanced space transport concepts that could evolve from near-term capabilities. Interested sources should provide a white paper describing current space transport technologies and capabilities, and commercial visions for future capabilities that are projected to evolve from those current space transport technologies. The vision in the white paper should be tailored towards the interests of the U.S. Government that are outlined in the questions listed below. In order to clarify the DoD's need in this area and to develop a technology assessment for these capabilities, the National Security Space Office (NSSO) and Headquarters, Air Force Security Forces Center (HQ AFSFC) are co-hosting a Technology Forum for the Rapid Delivery of Military Capabilities via Space on 24-26 Feb 2009 at Lackland Air Force Base, San Antonio, TX. This Technology Forum is open to all industry, U.S. Government, and military interested in assisting in the development of a technology assessment for this capability. This RFI is being released prior to the Technology Forum in order to help generate thought for discussion at the event. Responses are due 15 Mar 09, after the Technology Forum, so the combination of this solicitation and the events at the Technology Forum will help to refine responses. The concept of Rapid Delivery of Military Capabilities via Space was based initially on the Marine Corps' Small Unit Space Transport and Insertion (SUSTAIN) concept which would provide the Joint Force Commander (JFC) the capacity to rapidly transport operationally relevant capabilities to any point on the globe, effectively instantaneously. The SUSTAIN capability spans the full spectrum of conflict, from strategic Special Forces employment to a full range of specialized manned and unmanned warfighting payloads. The formal need for a SUSTAIN capability is documented in the Marine Corps SUSTAIN Universal Need Statement dated 22 July 2002, and the USSOCOM Space Enabling Concept dated 25 March 2004.
Notice of Intent To Grant a Partially Exclusive Patent License; Intellikine, Inc.
The Department of the Navy hereby gives notice of its intent to grant to Intellikine, Inc., a revocable, nonassignable, partially exclusive license to practice worldwide the Government owned inventions described in U.S. Patent 6,632,789 entitled ``Methods for Modulating T Cell Responses by Manipulating Intracellular Signal Transduction'' issued 14 October 2003 and related foreign filings in the fields of diagnosis, prevention and/or treatment of disease in humans and/or animals utilizing methods for modulating T cell responses by manipulating intracellular signals associated with T cell costimulation.
TRICARE; Hospital Outpatient Prospective Payment System (OPPS): Delay of Effective Date and Additional Opportunity for Public Comment
On December 10, 2008, DoD published a final rule implementing the TRICARE Hospital Outpatient Prospective Payment System (OPPS), with an effective date of February 9, 2009 (73 FR 74945). Since that date, DoD has determined that in order for administrative claims processing procedures to be fully in place to implement effectively the new OPPS payments, TRICARE's OPPS will begin to apply to health care services provided on or after May 1, 2009. In the meantime, a memorandum of January 20, 2009, from the Assistant to the President and Chief of Staff, entitled ``Regulatory Review,'' published in the Federal Register on January 26, 2009, calls for agencies to consider delaying effective dates of rules not yet effective and inviting new public comment. In view of both of these developments, the Department is delaying the effective date of TRICARE's OPPS until May 1, 2009, and is inviting additional public comment on the final rule. Any timely public comments received will be considered and any changes to the final rule will be published in the Federal Register.

Notice of Record of Decision for the Final Supplemental Environmental Impact Statement for Developing Homeport Facilities for Three NIMITZ-Class Aircraft Carriers in Support of the U.S. Pacific Fleet at Naval Air Station North Island, Coronado, CA
The Department of the Navy (Navy), after carefully weighing the operational and environmental consequences of the proposed action, announces its decision to upgrade carrier berthing (Berth LIMA) at Naval Air Station (NAS) North Island to comply with current nuclear- powered aircraft carrier (CVN) facility requirements. The minor infrastructure improvements include construction of: A fender system, mooring bollards, security building, and antiterrorism (AT)/force protection (FP) improvements, as well as the installation of information systems, electrical and mechanical utility upgrades, paving, drainage, and site improvements. In addition, the Navy announces its intent to implement additional vehicular traffic mitigation measures to address new facts and circumstances relevant to traffic. Although the 2008 Traffic Study included in the 2008 Final Supplemental Environmental Impact Statement (SEIS) shows that direct traffic impacts have not changed significantly since they were studied in the 1999 Final Environmental Impact Statement (FEIS), additional traffic mitigation measures minimize the cumulative effects of vehicular traffic when three homeported aircraft carriers are simultaneously in port.

The Department of the Army announces the availability of an FEIS for the implementation of the decision to station a new Infantry Brigade Combat Team (IBCT) and other combat support units at Fort Carson, Colorado, and the potential stationing of a Combat Aviation Brigade (CAB) at Fort Carson in the future.
Proposed Collection; Comment Request
In accordance with Section 3506(c)(2)(A) of the Paperwork Reduction Act of 1995, the Office of the Assistant Secretary of Defense for Health Affairs announces the proposed extension of a public information collection and seeks public comment on the provisions thereof. Comments are invited on: (a) Whether the proposed extension of collection of information is necessary for the proper performance of the functions of the agency, including whether the information shall have practical utility; (b) the accuracy of the agency's estimate of the burden of the information collection; (c) ways to enhance the quality, utility, and clarity of the information to be collected; and (d) ways to minimize the burden of the information collection on respondents, including through the use of automated collection techniques or other forms of information technology.
