Department of Defense 2009 – Federal Register Recent Federal Regulation Documents

Pursuant to section 102 of the National Environmental Policy Act of 1969, and the regulations implemented by the Council on Environmental Quality (40 CFR parts 1500-1508), the Department of Navy (Navy) announces its intent to prepare an Environmental Impact Statement (EIS) to evaluate the potential environmental impacts associated with the construction and operation of a proposed new Explosives Handling Wharf (EHW) located adjacent to, but separate from, the existing EHW on Hood Canal, NBK-Bangor, WA, to support TRIDENT submarines.

In compliance with section 3506(c)(2)(A) of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), DoD announces the proposed extension of a public information collection requirement and seeks public comment on the provisions thereof. DoD invites comments on: (a) Whether the proposed collection of information is necessary for the proper performance of the functions of DoD, including whether the information will have practical utility; (b) the accuracy of the estimate of the burden of the proposed information collection; (c) ways to enhance the quality, utility, and clarity of the information to be collected; and (d) ways to minimize the burden of the information collection on respondents, including the use of automated collection techniques or other forms of information technology. The Office of Management and Budget (OMB) has approved this information collection for use through July 31, 2009. DoD proposes that OMB extend its approval for use for three additional years.

Under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), the Federal Acquisition Regulation (FAR), Regulatory Secretariat (VPR) will be submitting to the Office of Management and Budget (OMB) a request to review and approve an extension of a currently approved information collection requirement concerning Freight Classification Description. A request for public comments was published in the Federal Register at 73 FR 74711, on December 9, 2008. No comments were received. Public comments are particularly invited on: Whether this collection of information is necessary; whether it will have practical utility; whether our estimate of the public burden of this collection of information is accurate and based on valid assumptions and methodology; ways to enhance the quality, utility, and clarity of the information to be collected; and ways in which we can minimize the burden of the collection of information on those who are to respond, through the use of appropriate technological collection techniques or other forms of information technology.

The CNO Executive Panel will report on the findings and recommendations to the Chief of Naval Operations of the Subcommittee on Navy's Industrial Baseline in the Economic Downturn. The discussion of such information would be exempt from public disclosure as set forth in section 552b(c)(5), (6), and (7) of title 5, United States Code. For this reason the executive session of this meeting will be closed to the public.

The public scoping comment period for the Intent to Prepare an Environmental Impact Statement for the Regional Watershed Supply Project by Million Conservation Resource Group, published in the Federal Register on Friday, March 20, 2009 (74 FR 11920), required comments be submitted by May 19, 2009 following publication in the Federal Register. The comment period has been extended to July 27, 2009. In addition, the COE will be conducting two additional public scoping meetings to describe the Project, preliminary alternatives, the NEPA compliance process, and to solicit input on the issues and alternatives to be evaluated and other related matters.

The next meeting of the Defense Acquisition University (DAU) Board of Visitors (BoV) will be held at Defense Acquisition University South Region, Huntsville, AL. The purpose of this meeting is to report back to the BoV on continuing items of interest.

The Department of Defense announces completion of the review and disposition of comments received in connection with Federal Register Notice April 1, 2008 (73 FR 17327) Phase II Interim Final Business Rules for the Families First Personal Property Program. The Department of the Army announces the availability of a DEIS that assesses environmental impacts associated with new mission requirements and new test and training capabilities at WSMR. It analyzes the impacts of land use changes that provide for increased research, development, and testing activities. The impacts of expanded off-road maneuver and facilities needed to support increased Future Combat Systems testing and the stationing and training of a Heavy Brigade Combat Team (HBCT) of approximately 3,800 Soldiers is also analyzed.

The Department of Defense published an announcement of a open meeting of the Defense Advisory Board for Employer Support of the Guard and Reserve on April 17, 2009 (74 FR 17829). The meeting was scheduled for May 7, 2009. This meeting has been canceled. The meeting will be rescheduled and announced at a later date.

The Civilian Agency Acquisition Council (CAAC) and the Defense Acquisition Regulations Council (DARC) propose to amend the Federal Acquisition Regulation (FAR) to revise the withholding-of-payment requirements under FAR clause 52.232-10, Payments Under Fixed-Price Architect-Engineer Contracts.

The St. Paul District Corps of Engineers, in partnership with the City of Fargo, North Dakota and City of Moorhead, Minnesota is conducting a flood risk management feasibility study for the Fargo- Moorhead metropolitan area. The feasibility study will focus on reducing flood risk in the entire Fargo-Moorhead Metropolitan area and surrounding areas. The study will evaluate several alternative measures, including but not limited to; levees and floodwalls, diversion channels, non-structural flood-proofing, relocation of flood- prone structures, and flood storage.

The U.S. Army Corps of Engineers, Los Angeles District (Regulatory Division), in coordination with the California Department of Fish and Game, has completed a Draft Environmental Impact Statement/ Environmental Impact Report (EIS/EIR) for the Newhall Ranch Resource Management and Development Plan and Spineflower Conservation Plan. The project proponent and landowner, The Newhall Land and Farming Company, requires a long-term Section 404 permit from the Corps of Engineers for permanent impacts to approximately 82.3 acres of waters of the United States, including 8.69 acres of wetlands, for the construction of various facilities in waters of the United States associated with the development of a new community composed of a broad range of residential, mixed-use and nonresidential land uses in the 12,000-acre project area located in Santa Clarita, Los Angeles County, California.

The Department of the Navy hereby gives notice of its intent to grant to Signal Laboratories, Inc., a revocable, nonassignable, partially exclusive license to practice worldwide the Government-owned inventions described in U.S. Patent No. 5,627,521 issued on May 6, 1997, entitled ``Personal Microwave and Radio Frequency Detector''.

The Defense Logistics Agency (DLA) executes the DoD Procurement Technical Assistance Program by awarding cost sharing cooperative agreements to assist states, local governments, private nonprofit organizations, tribal organizations and economic enterprises in establishing or maintaining procurement technical assistance centers (PTACs) pursuant to Chapter 142 of title 10, United States Code. These centers help business firms market their goods and services to the Department of Defense (DoD), other federal agencies, and state and local governments. The Consolidated Security, Disaster Assistance, and Continuing Appropriations Act, 2009 (Pub. L. 110-329) provided funds for the continuance of the program in FY 2009, requiring DoD to make available not less than $3.6 million for applicants that meet the definition of 10 U.S.C 2411 (1) (D).

The Department of the Navy is amending its certifications and exemptions under the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), to reflect that the Deputy Assistant Judge Advocate General (Admiralty and Maritime Law) has determined that USS NEW YORK (LPD 21) is a vessel of the Navy which, due to its special construction and purpose, cannot fully comply with certain provisions of the 72 COLREGS without interfering with its special function as a naval ship. The intended effect of this rule is to warn mariners in waters where 72 COLREGS apply.
