The Department of the Navy (DON) is amending its rules to update existing sections relating to the professional conduct of attorneys practicing under the cognizance and supervision of the Judge Advocate General (JAG) for clients with diminished capacity. The amendment comports with current policy reflected in JAG Instruction 5803.1 (Series), Professional Conduct of Attorneys Practicing Under the Cognizance and Supervision of the Judge Advocate General.

The Chief of Naval Operations (CNO) Executive Panel will report on the findings and recommendations of the Cyber Warfare Subcommittee to the CNO. The meeting will consist of discussions of current and future Navy strategy, plans, and policies in support of the organizing, manning, training, and equipping of Cyber Warfare forces for current and future operations.

The Department of the Navy hereby gives notice of the availability of exclusive or partially exclusive licenses to practice worldwide under the following pending patents. Any license granted shall comply with 35 U.S.C. 209 and 37 CFR part 404. Pursuant to Section 102(2)(C) of the National Environmental Policy Act, (NEPA), of 1969 (42 United States Code 4332(2)(C)), as implemented by the Council on Environmental Quality Regulations (40 Code of Federal Regulations [CFR] Parts 1500-1508), Department of the Navy (DoN) NEPA regulations (32 CFR Part 775), and United States Marine Corps (USMC) NEPA directives (Marine Corps Order P5090.2A, changes 1 and 2), the DoN intends to prepare an Environmental Impact Statement (EIS) and conduct public scoping meetings for the proposed basing and operation of MV-22 tiltrotor (MV-22) Osprey aircraft and H-1 Cobra and Huey attack helicopters in support of III Marine Expeditionary Force (MEF) training and readiness operations in Hawaii. The EIS will evaluate a proposal to introduce up to two Marine Medium Tiltrotor (VMM) squadrons with a total of 24 MV-22 aircraft and one Marine Light Attack Helicopter (HMLA) squadron composed of 18 AH-1Z and 9 UH-1Y helicopters. Because the proposed squadrons will train on land currently owned or controlled by the Department of the Army (Army), the DoN has requested that the Army be a cooperating agency for the preparation of this EIS.

The Department of the Navy gives notice of its intent to grant METOCEAN Data System a revocable, nonassignable, partially exclusive license, with exclusive fields of use in portable acoustic scoring, acoustic sounding and simulator control, in the United States to practice the Government-owned invention, U.S. Patent 6,995,707 B2, issued February 7, 2006, entitled ``Integrated Maritime Portable Acoustic Scoring and Simulator Control and Improvements.''

Pursuant to section 102 of the National Environmental Policy Act (NEPA) of 1969, as implemented by the Council on Environmental Quality Regulations (40 Code of Federal Regulations [CFR] Parts 1500- 1508), and Executive Order 12114, the Department of the Navy (DON) announces its intent to prepare an Environmental Impact Statement (EIS) and Overseas EIS (OEIS) to evaluate the potential environmental effects associated with military readiness training and research, development, testing, and evaluation (RDT&E) activities (hereinafter referred to as ``training and testing'' activities) conducted within the Hawaii- Southern California Training and Testing (HSTT) study area. The HSTT study area combines the at-sea portions of the Hawaii Range Complex, the Southern California Range Complex (including the San Diego Bay); the Silver Strand Training Complex; areas where vessels transit between the Hawaii Range Complex and the Southern California Range Complex; and select Navy pierside locations. This EIS and OEIS is being prepared to renew and combine current regulatory permits and authorizations;

The Naval Research Advisory Committee (NRAC) will meet from July 19-23, 2010, and July 26-30, 2010, to discuss materials presented at the NRAC Summer Study. All sessions on Monday, July 19, 2010, and the Executive Sessions led by Panel Chair and Vice Chair from 8 a.m. to 8:30 a.m. on July 20-23, 2010, will be open to the public. The sessions from 8:30 a.m. to 5 p.m. on July 20-23, 2010, and all of the sessions on July 26-30, 2010, will be closed to the public. The closed sessions will be devoted to discussions and technical examination of classified information, For Official Use Only (FOUO) information, and vendor proprietary briefings related to the study: ``Status and Future of Naval Research & Development Enterprise.'' These closed session discussions will assess the current technical core competencies of the Warfare Centers employed by the Systems Commands (SYSCOMs) and Program Executive Offices (PEOs) (as well as the stewardship provided for those competencies and the technical core competencies that are provided by the Navy University Affiliated Research Centers (UARCs)); will consider the technical quality of the workforce and physical infrastructure; will review proprietary information regarding technology applications and systems under development in the private sector between competing companies; will assess emerging concepts of operations in each of these areas and evaluate appropriate options in such areas as: Personnel, training, R&D funding allocation, technology monitoring, progress assessments, probable time frames for transformation and implementation; and will assess challenges with the utilization and fielding of various technology applications.

In compliance with the requirement of section 3506(c)(2)(A) of the Paperwork Reduction Act of 1995 the Naval Health Research Center (NHRC), Department of the Navy, announces a proposed extension of a public information collection and seeks public comment on the provisions thereof.

The Department of the Navy (DoN) published a Notice in the Federal Register (75 FR 100) on May 25, 2010, concerning a policy that would establish a Preferred Supplier Program (PSP) with contractors that have demonstrated exemplary performance, at the corporate level; in the areas of cost, schedule, performance, quality, and business relations. DoN is formally withdrawing this Notice as of June 11, 2010.

The Department of the Navy published a document in the Federal Register on August 6, 2009, announcing the intent to grant to AmberWave Systems Corporation, a revocable, nonassignable, exclusive license. The scope of the intent to license has been revised.

The Department of the Navy is amending its certifications and exemptions under the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), to reflect that the Deputy Assistant Judge Advocate General (Admiralty and Maritime Law) has determined that USS GRAVELY (DDG 107) is a vessel of the Navy which, due to its special construction and purpose, cannot fully comply with certain provisions of the 72 COLREGS without interfering with its special function as a naval ship. The intended effect of this rule is to warn mariners in waters where 72 COLREGS apply.

Under the PSP, contractors that have demonstrated exemplary performance, at the corporate level; in the areas of cost, schedule, performance, quality, and business relations would be granted Preferred Supplier Status (PSS). Contractors that achieved PSS would receive more favorable contract terms and conditions in DON contracts. Upon approval of the policy by the Assistant Secretary of the Navy for Research, Development and Acquisition, DON will initiate the pilot phase of the PSP.
