The U.S. Army Corps of Engineers (Corps) Seattle District is preparing an Environmental Impact Statement (EIS) to analyze the environmental effects of replacing an existing barge loading dock to facilitate resumption of sand and gravel mining operations at Northwest Aggregates' Maury Island facility. The Corps issued a permit to Northwest Aggregates for the dock replacement project on July 2, 2008, under Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act. Northwest Aggregates has been enjoined by the U.S. District Court for the Western District of Washington from conducting any further marine construction work under the Corps' permit, until the Corps completes an EIS on the project. A portion of this marine construction work was done prior to the Court's 2009 ruling; the balance remains incomplete at this time. The EIS will analyze the environmental effects of the issuance of the Corps permit, including additional analysis of potential impacts of the project on the marine environment, including endangered species (Chinook salmon, Southern Resident Killer whales, rockfish, eulachon, and other listed species) and forage fish, additional analysis and evaluation of the no action and other alternatives to achieve the project purpose, and additional analysis of cumulative impacts associated with the permit project.

The Department of the Army intends to prepare an EIS to analyze environmental and socioeconomic impacts connected with the proposed acquisition of up to 82,800 additional acres of land for training in the vicinity of Fort Benning, Georgia. The land is needed to provide Fort Benning's Soldiers and units with the capability to conduct realistic maneuver training exercises through the battalion level as they train at home station to deploy to support operations abroad. This action will also support the training requirements of the Maneuver Center of Excellence (MCoE). The EIS will analyze four alternatives that are deemed feasible and meet the purpose and need for this Proposed Action, as well as the no action alternative of not acquiring more training land.

The Department of the Army announces the availability of the ROD that documents and summarizes the decision to proceed with implementing the Preferred Alternative (Alternative (1) identified in the Final Environmental Impact Statement (FEIS), including the following proposed land use changes: expansion of the Main Post and alterations in authorized uses of range areas; development of new and expanded infrastructure throughout the installation, and increase in the level of test activities; development of six new Specialized Areas (four for test operations and two to support small-scale military training); establishment of a Land Use and Airspace Strategy Plan and siting process for facilitating future tests and training activities at WSMR; and continued stationing of the Engineer Battalion and continued Main Post expansion for the Engineer Battalion, Brigade Combat Team (BCT) Modernization, and other ongoing tenant programs.

The U.S. Army Corps of Engineers (Corps) is amending its regulations to establish a naval danger zone in the waters of the Pacific Ocean extending offshore from the small arms range at the Naval Base Coronado (NBC), in Coronado, San Diego County, California. The danger zone will provide an appropriate and enforceable zone in which the Navy may conduct small arms test firing to qualify military personnel.

The U.S. Army Corps of Engineers, Los Angeles District (Corps) is examining the environmental consequences associated with the proposed construction, operation, and closure of a new Class III landfill in northern San Diego County, in connection with Gregory Canyon, Ltd.'s application for a Department of the Army permit under Section 404 of the Clean Water Act to construct the proposed Gregory Canyon Landfill and associated facilities, which would discharge fill materials into approximately 2 acres of waters of the U.S. (less than 1 acre would be affected by permanent discharges of fill) in the San Luis Rey River to construct a bridge and in Gregory Canyon to construct the landfill liner, stability berm, and ancillary facilities.

The Military Surface Deployment and Distribution Command (SDDC) is providing notice that it released an interim change to the MFTURP No. 1 on April 26, 2010. The interim change adds safety requirements for Motor Carriers authorized to provide Satellite Motor Surveillance (SNS) (and DDP and PSS) for 1.1 to 1.3 Ammunition and Explosives (A&E) to Section A, Part II, Paragraph D, Transportation Protective Service (TPS) for Sensitive Conventional Arms, Ammunition and Explosives (AA&E), Classified (Secret and Confidential), and Controlled Cryptographic Items.

Pursuant to the National Environmental Policy Act of 1969, as amended, the U.S. Army Corps of Engineers, Sacramento District (Corps) intends to prepare a draft Environmental Impact Statement (EIS) for the Federal action to remediate seismic, seepage, and hydrologic dam safety concerns at the Martis Creek Dam. Martis Creek Dam is located about two miles upstream of the confluence of Martis Creek and the Truckee River, and about three miles east of Truckee, in Nevada County, CA. The Truckee River flows through Reno, Nevada and into Pyramid Lake, NV. The proposed action is being conducted through the Corps' Dam Safety Assurance Program (DSAP) for the evaluation of existing dams.

The action being taken is the preparation of an environmental impact statement/environmental impact report (EIS/EIR) for Phase 3 of Reclamation District No. 17's (RD 17) 100-year Levee Seepage Area Project (LSAP). To implement Phase 3 of the LSAP, RD 17 is requesting permission from the U.S. Army Corps of Engineers pursuant to Section 14 of the Rivers and Harbors Act of 1899 (33 U.S.C. 408, referred to as ``Section 408'') for alteration of Federal project levees and Section 404 of the Clean Water Act (33 U.S.C. 1344) for placement of fill into jurisdictional waters of the United States. Under Section 408, the Chief of Engineers may grant permission to alter an existing Federal project if it is not injurious to the public interest and does not impair the usefulness of the project. Portions of the RD 17 levee system including the section of levee along the south bank of French Camp Slough, along the east bank of the San Joaquin River, and along the northerly bank of Walthall Slough are Federal project levees. Therefore, Section 408 permission is required for structural improvements to these portions of the RD 17 levee system and would be issued to the Central Valley Flood Protection Board. Under Section 404, the District Engineer permits the discharge of dredged or fill material into waters of the United States if the discharge meets the requirements of the Environmental Protection Agency's 404(b)(1) guidelines and is not contrary to the public interest. As the landside levee improvements would result in a discharge of fill material into waters of the United States, permission under Section 404 is needed and would be issued directly to RD 17. RD 17 is located in San Joaquin County, California in the cities of Stockton, Lathrop, and Manteca.

The United States Government, as represented by the Secretary of the Army, has rights to this invention.

The Department of the Army proposes to revise its regulations concerning radiation sources on Army land. The Army requires Non-Army agencies (including their civilian contractors) to obtain an Army Radiation Permit (ARP) from the garrison commander to use, store or possess ionizing radiation sources on an Army Installation. For the purpose of this proposed rule, ``ionizing radiation source'' means any source that, if held or owned by an Army organization, would require a specific Nuclear Regulatory Commission (NRC) license or Army Radiation Authorization (ARA). The purpose of the ARP is to protect the public, civilian employees and military personnel on an installation from potential exposure to radioactive sources. The U.S. Army Safety Office which is the proponent for the Army Radiation Safety Program is revising the regulation to reflect the Nuclear Regulatory Commission changes to licensing of Naturally-Occurring and Accelerator-Produced Radioactive Material (NARM). Executive Order 12866 Regulatory Planning and Review and Executive Order 13422 Further Amendment to Executive Order 12866 on Regulatory Planning and Review were followed to rewrite this rule.

The U.S. Army Corps of Engineers (Corps), Jacksonville District, intends to prepare a Draft Supplemental Environmental Impact Statement (DSEIS) for the Broward County Shore Protection Project(Segment I) General Re-Evaluation Report. The project is being sponsored locally by the city of Deerfield Beach.

The Department of the Army has prepared a DEIS to analyze the environmental and socioeconomic impacts resulting from the proposed construction of 12 range projects and 2 garrison support facilities at Fort Stewart, Georgia. Completion of these projects will better allow the Army to support Soldier training requirements and will support Fort Stewart's existing and future units. Construction of these projects will help to ensure Fort Stewart can meet unit training requirements if and when the pace of operational deployments slows.

The Military Surface Deployment and Distribution Command (SDDC) is providing notice that it will release an interim change to the MFTURP No. 1 on March 29, 2010. The interim change updates Section A, Paragraph N, Fuel Surcharge, in accordance with Section 884 of the National Defense Authorization Act.

The Department of the Army has prepared an FEIS that analyzes environmental and socioeconomic impacts connected with the proposed acquisition (hereinafter to mean including purchase and lease) and use of up to 100,000 additional acres of commercial and private lands for training in the vicinity of Fort Polk, Louisiana. This Proposed Action to acquire additional lands supports the training requirements of the Joint Readiness Training Center (JRTC) and Fort Polk's current and future resident units. The FEIS analyzes three alternatives that are deemed feasible and meet the purpose and need for this Proposed Action.

The Department of the Army announces the availability of a DEIS that describes and analyzes the potential environmental effects associated with the U.S. Army Alaska (USARAK) proposal to strengthen unit preparedness and improve Soldier and Family quality of life by maximizing live-fire training capacity at Fort Richardson. Current restrictions cause a shortage of live-fire training opportunities at Fort Richardson, resulting in the need for units to travel to other installations for required training. The Proposed Action is to restore year-round live-fire training capabilities at Fort Richardson in order to allow active duty units to achieve and maintain combat readiness, reduce deployment hardships on Soldiers and their Families, and to reduce annual expenditures associated with travel to distant facilities to conduct training.

The interim change removes Motor Surveillance Service (MVS) from Item 107 and replaces Item 107 with Trailer Tracking Service (DCS). The change also updates Item 111, Satellite Motor Surveillance Service (SNS).
