The National Archives and Records Administration is establishing a new Part 2600 in 2 CFR that adopts the Office of Management and Budget's (OMB's) guidance in 2 CFR Part 180, as supplemented by this new part, as NARA's policies and procedures for nonprocurement and debarment and suspension. NARA is removing 36 CFR part 1209, the part containing NARA's implementation of the government- wide common rule on nonprocurement debarment and suspension. The new part in 2 CFR part 2600 will serve the same purpose as the common rule in a simpler way. This regulatory action is an administrative simplification that would make no substantive change in NARA's policy or procedures for nonprocurement debarment and suspension.

The first information collection is the Applicant Background Survey, NA Form 3035, which is used to obtain source of recruitment, ethnicity, race, and disability data on job applicants. The information is used to determine if the recruitment is effectively reaching all aspects of the relevant labor pool. The information is also used to determine if there are proportionate acceptance rates at various stages of the recruitment process. The second information collection is the Personal Identity Verification (PIV) Request, NA Form 6006, used by NARA employees, on- site contractors, volunteers, Foundation members, Interns, and others in order to obtain a Federal Identity Card (FIC). Public Meeting on Non-Trial Civil Court Case Files

The National Archives and Records Administration (NARA) is holding a public meeting to gather input to help NARA decide how to identify post-1970 non-trial civil cases with sufficient historical value to warrant permanent preservation. Pursuant to the U.S. District Court records schedule issued in 1983, the National Archives preserves all civil cases prior to 1970 and all cases filed after January 1, 1970 that went to trial. Cases filed after January 1, 1970 that did not reach the trial stage are eligible for disposal twenty years after they are transferred to inactive storage. Trial cases are routinely transferred to the legal custody of the National Archives twenty-five years after closure. No non-trial cases in records center storage have been destroyed. NARA must develop a methodology to review a representative portion of the non-trial case files in order to determine which files should be preserved. The meeting is designed to elicit advice from the public, and the legal, judicial, and historical communities on the review methodology.

This final rule revises NARA's policy on the inspection of personal property in the possession of a contractor, employee, student intern, visitor, volunteer or other person on NARA properties. Because NARA's current regulations apply specifically only to visitors on NARA property, the final rule clarifies that all persons arriving on, working at, visiting, or departing from NARA property are subject to the inspection of their personal property. The final rule also amends NARA's current regulations to include additional properties under NARA control. This rule will affect members of the public, members of Federal agencies, NARA employees, NARA contract-employees and NARA volunteers.

Changes in NARA Research Room Hours

NARA is further modifying the research room hours at its facilities in the Washington, DC, area to retain, on a monthly basis, Saturday and some evening hours. We are taking this action in response to the many comments received on the interim final rule on this subject published in July. As noted in the previous rulemaking, NARA is reducing the research room hours as one of several measures the agency must take in Fiscal Year 2007 to ensure that our expenditures are in line with our expected resources. This regulation will affect individuals who use our archival research rooms in the National Archives Building and National Archives at College Park facility.

The National Archives and Records Administration (NARA) publishes notice at least once monthly of certain Federal agency requests for records disposition authority (records schedules). Once approved by NARA, records schedules provide mandatory instructions on what happens to records when no longer needed for current Government business. They authorize the preservation of records of continuing value in the National Archives of the United States and the destruction, after a specified period, of records lacking administrative, legal, research, or other value. Notice is published for records schedules in which agencies propose to destroy records not previously authorized for disposal or reduce the retention period of records already authorized for disposal. NARA invites public comments on such records schedules, as required by 44 U.S.C. 3303a(a).
