Defense Nuclear Facilities Safety Board – Federal Register Recent Federal Regulation Documents

This final rule revises the Defense Nuclear Facilities Safety Board's (DNFSB or Board) Freedom of Information Act (FOIA or Act) fee schedule and makes conforming amendments to two related provisions of its FOIA regulations.

The Defense Nuclear Facilities Safety Board has made a Recommendation to the Secretary of Energy concerning the U.S. Department of Energy's (DOE) regulatory safety framework related to onsite transportation and safety deficiencies in Los Alamos National Laboratory's transportation safety document. Pursuant to the requirements of the Atomic Energy Act of 1954, as amended, the Defense Nuclear Facilities Safety Board is publishing the Recommendation and associated correspondence with DOE and requesting comments from interested members of the public.

The Defense Nuclear Facilities Safety Board (DNFSB or Board) is proposing to revise its Freedom of Information Act (FOIA) fee schedule and to make conforming amendments to two related provisions of its FOIA regulations.

The Defense Nuclear Facilities Safety Board (Board) is issuing interim regulations to govern the collection of debts owed to the Board and to the United States by federal employees.

The Debt Collection Act, as amended, requires federal agencies to either adopt existing regulations or promulgate their own regulations governing the collection of debts owed to the federal government. The Defense Nuclear Facilities Safety Board (Board) is a federal agency and has decided to adopt the regulations jointly issued by the Treasury Department and the Department of Justice.

Notice is hereby given that the Defense Nuclear Facilities Safety Board (DNFSB) will hold a Public Hearing regarding legacy cleanup activities, nuclear safety, and increased production activities at Los Alamos National Laboratory (LANL). The purpose of this Public Hearing is to gather information on activities and plans of the Department of Energy's Office of Environmental Management (EM) and the National Nuclear Security Administration (NNSA).

The Defense Nuclear Facilities Safety Board (DNFSB or Board) is confirming the effective date of November 29, 2021, for the direct final rule that was published in the Federal Register on August 30, 2021. The direct final rule amended the DNFSB's regulation implementing the Government in the Sunshine Act to include changes included in the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (NDAA).

The William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (NDAA) amended the Atomic Energy Act of 1954 (AEA) to grant the Defense Nuclear Facilities Safety Board (Board or DNFSB) relief from certain limitations under the Government in the Sunshine Act (Sunshine Act). The Sunshine Act generally requires all Board meetings to be open to public observation unless certain exemptions apply. The NDAA added a provision to the AEA that permits the Board to hold nonpublic collaborative discussions without following the requirements of the Sunshine Act, so long as certain requirements are met. The Board is publishing this direct final rule to revise the Board's Sunshine Act regulations consistent with the new AEA provisions for nonpublic collaborative discussions.

Notice is hereby given that the Defense Nuclear Facilities Safety Board (Board) will hold a Public Meeting and Hearing regarding the status of the Savannah River Site (SRS). The purpose of this Public Meeting and Hearing is to gather information and discuss Department of Energy (DOE) and National Nuclear Security Administration (NNSA) operations in a constrained environment and actions that could impact the safety posture of particular operations at SRS.

The Defense Nuclear Facilities Safety Board has made a Recommendation to the Secretary of Energy concerning implementation of Nuclear Safety Management requirements and the need to address specific hazards at the National Nuclear Security Administration's Pantex Plant. Pursuant to the requirements of the Atomic Energy Act of 1954, as amended, the Defense Nuclear Facilities Safety Board is publishing the Recommendation and associated correspondence with the Department of Energy and requesting comments from interested members of the public.
