Procedures for Safety Investigations
The Defense Nuclear Facilities Safety Board (Board) is promulgating a final rule which establishes procedures for conducting preliminary and formal safety investigations of events or practices at Department of Energy (DOE) defense nuclear facilities that the Board determines have adversely affected, or may adversely affect, public health and safety. The Board's experience in conducting formal safety investigations necessitates codifying the procedures set forth in this final rule. Among other benefits, these procedures will ensure a more efficient investigative process, protect confidential and privileged safety information, and promote uniformity of future safety investigations. The rule also promotes public awareness through greater transparency in the conduct of Board investigations.
Extension of Hearing Record Closure Date
The Defense Nuclear Facilities Safety Board (Board) published a document in the Federal Register on September 25, 2014, (79 FR 57543) concerning notice of a public hearing and meeting on October 7, 2014, regarding safety culture at Department of Energy defense nuclear facilities. The Board stated in that notice that the hearing record would remain open until November 7, 2014, for the receipt of additional materials. The Board made the same representation at the conclusion of the hearing on October 7, 2014.

The Board invites any interested persons or groups to present any comments, technical information, or data concerning safety issues related to the matters to be considered.
Emergency Preparedness and Response
Pursuant to 42 U.S.C. 2286a(b)(5), the Defense Nuclear Facilities Safety Board has made a recommendation to the Secretary of Energy concerning the need to take actions to improve the emergency preparedness and response capability at the Department of Energy's (DOE) defense nuclear facilities.

The Defense Nuclear Facilities Safety Board (Board) published a proposed rule in the Federal Register (77 FR 44174) on July 27, 2012. The proposed rule established procedures for conducting preliminary and formal safety investigations of events or practices at Department of Energy (DOE) defense nuclear facilities that the Board determines have adversely affected, or may adversely affect, public health and safety. The Board's experience in conducting formal safety investigations necessitates codifying the procedures set forth in the final rule. Among other benefits, these procedures will ensure a more efficient investigative process, protect confidential and privileged safety information, and promote uniformity of future safety investigations. The rule also promotes public awareness through greater transparency in the conduct of Board investigations. The Board's enabling legislation, 42 U.S.C. 2286 et seq., was amended on January 2, 2013, by the National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2013. The amendments appeared before the final rule was published. This second notice of proposed rule incorporates changes necessitated by those amendments.
Rules Implementing the Government in the Sunshine Act; Correction
The Defense Nuclear Facilities Safety Board (Board) published a document in the Federal Register on March 7, 1991 (56 FR 9609), implementing the provisions of the Government in the Sunshine Act. Subsequently, the Fiscal Year 2013 National Defense Authorization Act further amended the Atomic Energy Act of 1954, changing and renumbering the Board's enabling legislation. This document corrects the final regulations by changing the referenced sections in the Board's rules implementing the Government in the Sunshine Act.
Public Availability of Defense Nuclear Facilities Safety Board FY 2012 Service Contract Inventory Analysis/FY 2013 Service Contract Inventory
In accordance with Section 743 of Division C of the Consolidated Appropriations Act of 2010 (Pub. L. 111-117), DNFSB is publishing this notice to advise the public of the availability of (1) its analysis of the FY 2012 Service Contract inventory and (2) the FY 2013 Service Contract inventory. This inventory provides information on service contract actions over $25,000 that were made in FY 2013. The information is organized by function to show how contracted resources are distributed throughout the agency. The inventory has been developed in accordance with guidance issued on November 5, 2010, and on December 19, 2011, by the Office of Management and Budget's Office of Federal Procurement Policy (OFPP). Proposed FOIA Fee Schedule Update
Pursuant to the Board's regulations, the Defense Nuclear Facilities Safety Board is publishing its proposed Freedom of Information Act (FOIA) Fee Schedule Update and solicits comments from interested organizations and individual members of the public.
Extension of Hearing Record Closure Date
The Defense Nuclear Facilities Safety Board (Board) convened a public meeting and hearing on December 10, 2013, as noticed in the Federal Register on August 13, 2013 (78 FR 49262), as amended, November 12, 2013 (78 FR 67344). The hearing concerned safety-related matters at defense nuclear facilities at the Y-12 National Security Complex. The Board stated at the conclusion of the hearing that the hearing record would remain open until January 10, 2014. Extension of Time: The Board now extends the period of time for which the hearing record will remain open to February 10, 2014, to further accommodate submission of an answer to a question taken for the record during the course of the public hearing.
