Advisory Committee on Veterans' Employment, Training and Employer Outreach (ACVETEO): Meeting
This notice sets forth the schedule and proposed agenda of a forthcoming meeting of the ACVETEO. The ACVETEO will discuss the DOL core programs and services that assist veterans seeking employment and raise employer awareness as to the advantages of hiring veterans. There will be an opportunity for individuals or organizations to address the committee. Any individual or organization that wishes to do so should contact Mr. Gregory Green at 202-693-4734. In this notice, VETS is soliciting comments concerning the proposed information collection request for the VETS USERRA/VP Form 1010.
Fiscal Year (FY) 2016 Through FY 2017 Stand Down Grant Requests
The U.S. Department of Labor (USDOL), Veterans' Employment and Training Service (VETS) supports local Stand Down events that help homeless veterans attain meaningful civilian employment. Authority to support such events is in 38 U.S.C. Section 2021, which provides that the ``Secretary of Labor shall conduct, directly or through grant or contract, such programs as the Secretary determines appropriate to provide job training, counseling, and placement services (including job readiness and literacy and skills training) to expedite the reintegration of homeless veterans into the labor force.'' A Stand Down is a local community event where homeless veterans are provided a wide variety of services and incentives to reintegrate into their community, such as housing opportunities, healthcare, and employment opportunities, Stand Down funding is provided in the form of non- competitive grants that are awarded on a first-come, first-served basis until available funding is exhausted. VETS anticipates that approximately $600,000 will be available to award approximately 70 grants in each Federal FY covered by this solicitation. The Federal FY begins on October 1 and ends on September 30 of the next calendar year. Awards will be made for a maximum of $10,000 per multi-day event or $7,000 per one-day event. VETS is now accepting applications for grant awards to fund Stand Down events in FY 2015. All applications for Stand Down grant funding must be submitted to the appropriate state Director for Veterans' Employment and Training (DVET). Applications will be accepted up to six (6) months prior to the event. Please allow up to 60 days to process your application. Grant applicants cannot obligate grant funding toward Stand Down expenses prior to receiving a Notice of Award from the Grant Officer; any such expenses will be disallowed.
Solicitation of Nominations for Appointment to the Advisory Committee on Veterans' Employment, Training, and Employer Outreach
In accordance with section 4110 of Title 38, U.S. Code, and the provisions of the Federal Advisory Committee Act (FACA) and its implementing regulations issued by the U.S. General Services Administration (GSA), the Secretary of Labor (the Secretary), is seeking nominations of qualified candidates to be considered for appointment as a member of the Advisory Committee on Veterans' Employment, Training, and Employer Outreach (ACVETEO, or the Committee). The ACVETEO's responsibilities are to: (a) Assess employment and training needs of veterans and their integration into the workforce; (b) determine the extent to which the programs and activities of the Department are meeting such needs; (c) assist the Assistant Secretary for Veterans' Employment and Training (ASVET) in conducting outreach to employers with respect to the training and skills of veterans and the advantages afforded employers by hiring veterans; (d) make recommendations to the Secretary of Labor, through the ASVET, with respect to outreach activities and the employment and training needs of veterans; and (e) carry out such other activities deemed necessary to making required reports and recommendations under section 4110(f) of Title 38, U.S. Code. Per section 4110(c)(1) of Title 38, U.S. Code, the Secretary shall appoint at least twelve, but no more than sixteen, individuals to serve as Special Government Employees of the ACVETEO as follows: Seven individuals, one each from the following organizations: (i) The Society for Human Resource Management; (ii) the Business Roundtable; (iii) the National Association of State Workforce Agencies; (iv) the United States Chamber of Commerce; (v) the National Federation of Independent Business; (vi) a nationally recognized labor union or organization; and (vii) the National Governors Association. The Secretary shall appoint not more than five individuals nominated by veterans' service organizations that have a national employment program and not more than five individuals who are recognized authorities in the fields of business, employment, training, rehabilitation, or labor and who are not employees of DOL. The term of membership for all Committee members is February 1, 2016 through January 31, 2018.

The Veterans' Employment and Training Service (VETS) is announcing an opportunity for the public to comment on the proposed collection of certain information by the agency. Under the Paperwork Reduction Act (PRA) of 1995, Federal agencies are required to publish notice in the Federal Register concerning each proposed collection of information and to allow 60 days for public comment in response to the notice. This notice solicits comments on one (1) collection of information: VETS 201 entitled ``Vocational Rehabilitation and Employment (Chapter 31) Tracking Report'' and identified by VETS ICR No. 1293-0009 and OMB Control No. 1293-0009. The information collection contained in this notice is an extension without revision. VETS is soliciting comments on the continuation of the approved information collections.
Annual Report From Federal Contractors
The Veterans' Employment and Training Service (VETS or the Agency) is issuing this Final Rule to revise the regulations implementing the reporting requirements under the Vietnam Era Veterans' Readjustment Assistance Act of 1974, as amended (VEVRAA). Generally, VEVRAA requires Federal contractors and subcontractors to annually report on the total number of their employees who belong to the categories of veterans protected under VEVRAA, and the total number of those protected veterans who were hired during the period covered by the report. This Final Rule rescinds the regulations that prescribe the reporting requirements applicable to Government contracts and subcontracts entered into before December 1, 2003, because those regulations are now obsolete. In addition, this Final Rule revises the regulations that prescribe the reporting requirements applicable to Government contracts and subcontracts of $100,000 or more entered into or modified after December 1, 2003, by changing the manner in which Federal contractors report on their employment of veterans. The Final Rule renames the annual report required under those regulations the Federal Contractor Veterans' Employment Report VETS-4212. Further, the Final Rule revises regulations that address the definitions of terms used in the regulations, the text of the reporting requirements clause included in Government contracts and subcontracts, and the methods of filing the annual report on veterans' employment. Contractors and subcontractors will have to comply with the reporting requirements in the Final Rule beginning with the annual report filed in 2015.
Agency Information Collection Activities: Extension of Existing Information Collection; Comment Request
The Department of Labor, as part of its continuing effort to reduce paperwork and respondent burden, conducts a preclearance consultation program to provide the general public and Federal agencies with an opportunity to comment on proposed and/or continuing collections of information in accordance with the Paperwork Reduction Act of 1995 (PRA95) [44 U.S.C. 3506(c)(2)(A)]. This program helps to ensure that requested data can be provided in the desired format, reporting burden (time and financial resources) is minimized, collection instruments are clearly understood, and the impact of collection requirements on respondents can be properly assessed. Currently, the Veterans' Employment and Training Service (VETS) is soliciting comments concerning the proposed extension of the currently approved information collection request for the ``Federal Contractor Veterans' Employment Report VETS-100'' and the ``Federal Contractor Veterans' Employment Report VETS-100A.'' A copy of the proposed information collection request can be obtained by contacting the office listed below in the ADDRESSES section of this Notice. There have been no changes to the current VETS-100 and the VETS-100A Reports. Each report has the same number of reporting elements.

The NPRM also proposes renaming the annual report prescribed by the regulations the Federal Contractor Veterans' Employment Report VETS-4212 (``VETS-4212 Report''). Further, the NPRM proposes to revise regulations that address the definitions of terms used in the regulations, the text of the reporting requirements clause included in Government contracts and subcontracts, and the methods of filing the annual report on veterans' employment. VETS proposes that contractors begin complying with the reporting requirements in the revised regulations one year after the effective date of the final rule.

Uniform National Threshold Entered Employment Rate for Veterans
The purpose of this Final Rule is to establish the uniform national threshold entered employment rate (UNTEER) for veterans, as required of the Secretary in 38 U.S.C. 4102A(c)(3)(B), for use in evaluating States' performance in assisting veterans to meet their employment needs. The Final Rule also explains how the threshold will be used in the process of identifying those States to be reviewed by comparing the actual entered employment rate (EER) achieved for veterans with the threshold EER, and it identifies certain factors, in addition to the threshold, that will be included in the Department's review to determine whether an EER below the threshold reflects a deficiency in the State's performance, or is attributable to other factors beyond the State's control. Finally, in those cases in which a State's EER is determined to reflect a deficiency in a State's performance, this Final Rule identifies the procedure for the submission and review of a corrective action plan (CAP), the delivery of technical assistance (TA), and the initiation of the necessary steps to implement corrective actions to improve the State's performance in assisting veterans to meet their employment needs.

A Stand Down is an event held in a local community where homeless Veterans are provided with a wide variety of social services. VETS is now accepting applications for grant awards to fund Stand Down events in FY 2011. Stand Down funding is a non-competitive grant awarded on a first-come, first-served basis until available funding is exhausted. Under this announcement, VETS anticipates that up to $600,000 will be available to award approximately seventy grants in each of the three fiscal years covered by this solicitation. The Federal fiscal year is the accounting period of the federal government. It begins on October 1st and ends on September 30th of the next calendar year. A maximum of $10,000 per multi-day event or $7,000 for a one-day event can be awarded. Availability of Stand Down grant funding each fiscal year will be dependent upon Congressional appropriation. Stand Down grant funding is awarded for a specific event on a specific date. Organizations planning Stand Down events in subsequent fiscal years must submit a complete, new application for grant funding if desired, and should not assume the application will automatically be approved. Applications for Stand Down funds will be accepted from State Workforce Agencies, State and local Workforce Investment Boards, Veterans Service Organizations (VSOs), local public agencies, and non- profit organizations including community and faith-based organizations. The USDOL is not authorized to award grant funds to organizations that are registered with the Internal Revenue Service (IRS) as a 501(c)(4) organization. All applications for Stand Down grant funding must be submitted to the appropriate State Director for Veterans' Employment and Training (DVET) at least ninety (90) days prior to the event. Events approved for grant funding in any fiscal year must be held prior to December 31st of the following fiscal year. For example, all Stand Down events awarded funding for FY 2011 (October 1, 2010 through September 30, 2011) must be held on or before December 31, 2011. Stand Down grant awards are contingent upon a Federal appropriation or a continuing resolution each Federal fiscal year. Therefore, applications submitted after July 1st for events to be held after September 30th may be held for consideration for funding contingent upon Federal funding availability. Grant applicants should not obligate requested grant funding toward Stand Down expenses unless officially notified of a grant award.
Uniform National Threshold Entered Employment Rate for Veterans
The Veterans' Employment and Training Service (VETS) of the Department of Labor (the Department) is proposing a rule to implement a uniform national threshold entered employment rate for veterans applicable to State employment service delivery systems. The Department undertakes this rulemaking in accordance with the Jobs for Veterans Act, which requires the Department to implement that threshold rate by regulation.

Before submitting the ICRs to OMB for review and approval, VETS is soliciting comments on specific aspects of the proposed information collections.
Priority of Service for Covered Persons
The Veterans' Employment and Training Service (VETS) of the Department of Labor (Department or DOL) is issuing this final rule to implement priority of service in qualified job training programs prescribed in section 2(a)(1) of the Jobs for Veterans Act (JVA). DOL issued a notice of proposed rulemaking (NPRM) on August 15, 2008 outlining proposed provisions implementing priority of service for covered persons in qualified DOL job training programs.
Annual Report From Federal Contractors
This final rule revises the regulations in 41 CFR Part 61-250 implementing the requirement under the Vietnam Era Veterans' Readjustment Assistance Act of 1974, as amended, (``VEVRAA'') that Government contractors track and annually report the number of employees in their workforces who are veterans covered under the law. Today's final rule revises the regulations in 41 CFR Part 61-250 to incorporate the amendment to VEVRAA made by the Veterans' Benefit and Health Care Improvement Act of 2000 (``VBHCIA''). The VBHCIA amendment extended the protections of VEVRAA to a category of veterans called ``recently separated veterans.'' In addition, the final rule published today clarifies that the regulations in 41 CFR Part 61-250 implement the reporting requirements under VEVRAA prior to their amendment in 2002 by the Jobs for Veterans Act (``JVA''), and apply to Government contracts entered into before December 1, 2003. The final rule also makes clear that the regulations in 41 CFR Part 61-300 implementing the JVA amendments to VEVRAA's reporting requirements, apply if a contract entered into before December 1, 2003, is modified on or after that date and the contract as modified is for $100,000 or more.
Regulations Under the Uniformed Services Employment and Reemployment Rights Act of 1994; Correction
In this rulemaking, the Veterans' Employment and Training Service (VETS) is correcting and consolidating the text in parts A and B of the appendix to 20 CFR part 1002 (``Notice of Your Rights Under USERRA''). VETS published the appendix on March 10, 2005 in response to the Veterans Benefits Improvement Act of 2004 (VBIA). The VBIA amended the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA) by requiring employers to notify affected employees of the rights, benefits, and obligations of employees and employers under USERRA. As published, the text of the required USERRA rights notice included information about a temporary demonstration project established under the VBIA that called for VETS to transfer to the Office of Special Counsel some claims brought against Federal executive agencies. The demonstration project ended on December 31, 2007. This rulemaking is therefore deleting this outdated reference from the text of the USERRA rights notice. In addition, this rulemaking is consolidating the text in parts A and B of the required USERRA rights notice to eliminate the need for separate notices for Federal and non- Federal agency employers. This rulemaking does not require employers to replace the notices currently in use because, even without this correction and consolidation, the current notices comply with the USERRA employee-notification requirements.
Priority of Service for Covered Persons
The Veterans' Employment and Training Service (VETS) of the Department of Labor (Department or DOL) is proposing a rule to implement priority of service in qualified job training programs prescribed in section 2(a)(1) of the Jobs for Veterans Act (JVA). The Department undertakes this rulemaking in accordance with section 605 of the Veterans' Benefits, Health Care, and Information Technology Act of 2006, which requires the Department to implement priority of service via regulation. The Department seeks comments on this proposed rule.
Fiscal Years (FYs) 2008 Through 2010 Stand Down Grant Award Requests
The U.S. Department of Labor (USDOL), Veterans' Employment and Training Service (VETS) continues to support local Stand Down events that assist homeless veterans and is now accepting applications for Stand Down grant awards. A Stand Down is an event held in a local community where homeless veterans are provided with a wide variety of social services. Under this announcement, VETS anticipates that up to $400,000 will be available in each of the three fiscal years for grant awards of up to a maximum of $10,000 per multi-day event (more than one day), and a maximum of $7,000 for a one (1) day event. VETS expects to award approximately forty-five (45) grants each fiscal year. Availability of Fiscal Year 2009, and Fiscal Year 2010 funds will be dependent upon Congressional appropriations. Applications for Stand Down funds will be accepted from State Workforce Agencies and State and local Workforce Investment Boards, Veterans Service Organizations (VSO), local public agencies, and non-profit organizations, including community and faith- based organizations. USDOL is not authorized to award grant funds to organizations that are registered with Internal Revenue Service (IRS) as a 501(c)(4) organization. Application for Stand Down grant funding are to be submitted to the appropriate State Director of Veterans Employment and Training/ Grant Officer Technical Representative (DVET/GOTR). Address and contact information for each State DVET/GOTR can be found at Web site address: https://www.dol.gov/vets/aboutvets/contacts/main.htm. To be considered for FY-2008 funding, applications must be received within thirty (30) days of this announcement. This will allow for obligation of funds prior to 9/30/08. Any events approved in Fiscal Year 2008 must be held prior to 12/31/08. Applications for other events planned in Fiscal Year 2009 must be received at least sixty (60) days prior to the event and no later than July 30, 2009. Applications for events planned in Fiscal Year 2010 must be received at least sixty (60) days prior to the event and no later than July 30, 2010.
Annual Report From Federal Contractors
The Veterans' Employment and Training Service is publishing a new set of regulations, and adopting a new Federal Contractor Veterans' Employment Report VETS-100A (``VETS-100A Report'') form, to implement the requirement under the Vietnam Era Veterans' Readjustment Assistance Act of 1974 (``VEVRAA'') that Government contractors track and annually report the number of employees in their workforces who are veterans covered under the law. The final regulations published today implement amendments to the reporting requirements under VEVRAA that were made by the Jobs for Veterans Act (``JVA'') in 2002. The JVA amendments: Raised the dollar amount of the Government contracts that trigger a contractor's obligation to report on veterans' employment; and changed the categories of veterans that contractors are to track and report. The final regulations published today apply only to covered Government contracts entered into or modified on or after December 1, 2003. The existing regulations in 41 CFR part 61-250, which require contractors to use the Federal Contractor Veterans' Employment Report VETS-100 (``VETS-100 Report'') form to provide the information on the covered veterans in their workforces, will continue to apply to Government contracts entered into before December 1, 2003.

(Applicants For a Cooperative Agreement Should Read This Notice In Its Entirety): The U.S. Department of Labor (USDOL), Veterans' Employment and Training Service (VETS), announces a cooperative agreement competition under 38 U.S.C. Section 2021, as added by Section 5 of Public Law 107-95, the Homeless Veterans Comprehensive Assistance Act of 2001 (HVCAA). Section 2021 authorizes programs to expedite the reintegration of homeless veterans into the labor force. In order to assist the USDOL-VETS in carrying out 38 U.S.C. 2021, it is announcing the availability of funds for a cooperative agreement to assist in developing a National Technical Assistance Center (NTAC) for the Homeless Veterans' Reintegration Program (HVRP). The primary objective of the HVRP NTAC will be to provide general technical assistance on veterans' homelessness programs and issues to existing HVRP grantees (approximately 80 grantees nationwide), potential HVRP applicants, employers, Veterans Service Organizations, Federal, State, and local agency partners, non-profit organizations (including faith- based and community organizations), the general public, and other interested stakeholders. Successful applicant(s) will assist USDOL-VETS by providing general technical assistance and guidance to eligible HVRP entities relating to assistance for homeless veterans under the HVRP and related programs that assist homeless veterans. Applicants will also be responsible for developing, conducting, and documenting extensive outreach efforts to national, state, and local employers to increase their awareness of HVRP and its objectives in order to increase job opportunities for homeless veterans. Applicants will also be responsible for assisting USDOL-VETS by contacting current HVRP grantees in order to extract, document, and share at least 20 best HVRP practices with other HVRP grantees and potential applicants. Finally, applicants will assist USDOL-VETS by conducting general research and studies as determined by USDOL-VETS. Entities that are interested in assisting USDOL-VETS in providing technical assistance are to be aware that historically the HVRP annually receives thousands of nationwide inquiries via telephone, written correspondence, and e-mail concerning homeless veterans and HVRP in general. The awardee(s) will be responsible for answering 100 percent of these technical assistance inquiries. Applicants are to be aware of and assist USDOL-VETS and their grantees in implementing the HVRP objectives: (1) To provide services to assist in reintegrating homeless veterans into meaningful employment within the labor force, and (2) to stimulate the development of effective service delivery systems that will address the complex problems facing homeless veterans. Under this solicitation for cooperative agreement(s) covering Program Year (PY) 2007, VETS anticipates that up to $500,000 will be available for a cooperative agreement award(s) up to a maximum total award of $500,000. (Applicants For Grant Funds Should Read This Notice In Its Entirety): The U.S. Department of Labor (USDOL), Veterans' Employment and Training Service (VETS), announces a grant competition under 38 U.S.C. Section 2021, as added by Section 5 of Public Law 107-95, the Homeless Veterans Comprehensive Assistance Act of 2001 (HVCAA). Section 2021 requires the Secretary of Labor to conduct, directly or through grant or contract, such programs as the Secretary determines appropriate to expedite the reintegration of homeless veterans into the labor force. Both Urban and Non-Urban areas serving homeless veterans will be considered for funding under this HVRP solicitation. Urban areas are those that serve a high concentration of homeless veterans in the metropolitan areas of the 75 U.S. cities largest in population and the metropolitan area of San Juan, Puerto Rico, and are listed in Appendix G. Non-Urban areas are those areas that serve homeless veterans that are not listed on Appendix G. Applicants must indicate whether they are applying for an Urban or Non-Urban grant award on their grant application. HVRP grants are intended to address two objectives: (1) To provide services to assist in reintegrating homeless veterans into meaningful employment within the labor force, and (2) to stimulate the development of effective service delivery systems that will address the complex problems facing homeless veterans. Successful applicants will design programs that assist eligible veterans by providing job placement services, job training, counseling, supportive services, and other assistance to expedite the reintegration of homeless veterans into the labor force. Successful programs will also be designed to be flexible in addressing the universal as well as the local or regional problems that have had a negative impact on homeless veterans reentering the workforce. Under this solicitation covering PY 2007, VETS anticipates that up to $8,200,000 will be available, with a maximum award of $300,000 for grants that serve Urban areas and $200,000 for grants that serve Non- Urban areas. VETS expects to award grants in both the Urban and Non- Urban categories. The number of grants to be awarded in each category will be announced after selections are made as the grants are awarded based on merit of the application and the applicants. Awards are expected to range from $75,000 to a maximum of $200,000 for grants that serve Non-Urban areas and from $75,000 to a maximum of $300,000 for grants that serve Urban areas. The Department of Labor, as part of its continuing effort to reduce paperwork and respondent burden, conducts a pre-clearance consultation program to provide the general public and Federal agencies with an opportunity to comment on proposed and/or continuing collections of information in accordance with The Paperwork Reduction Act of 1995 (PRA95) [44 U.S.C. 3506 C (2)(A)]. This program helps to ensure that requested data can be provided in the desired format, reporting burden (time and financial resources) is minimized, collection instruments are clearly understood, and the impact of collection requirements on respondents can be properly assessed. Currently the Veterans' Employment and Training Service (VETS) is soliciting comments concerning the proposed information collection request for the VETS USERRA/VP Form 1010.
Annual Report From Federal Contractors
This proposed rule would create a new part, 41 CFR part 61- 300, to implement certain provisions of the Jobs for Veterans Act (``JVA'') (Pub. L. 107-288) which amended the Vietnam Era Veterans'' Readjustment Assistance Act of 1974, as amended (``VEVRAA''). Prior to amendment by the JVA, VEVRAA and its implementing regulations required all contractors and subcontractors with Federal contracts in excess of $25,000 to use the Federal Contractor Veterans' Employment Report VETS- 100 form (``VETS-100 Report'') to report their efforts toward hiring veterans in four specified categories. The JVA raised the VETS-100 reporting threshold from $25,000 to $100,000, and modified the categories of veterans to be tracked in the reports, for contracts entered on or after December 1, 2003. Prior to amendment by the JVA, VEVRAA required all covered contractors to report on incumbents who fall within the following veteran status categories: Veterans of the Vietnam era; special disabled veterans; other protected veterans; and recently separated veterans. The Jobs for Veterans Act changed the reporting categories to: disabled veterans; other protected veterans; Armed Forces service medal veterans; and recently separated veterans. Additionally, the JVA requires Federal contractors and subcontractors to report the total number of all current employees in each job category and at each hiring location. The JVA made these changes for all contracts entered into on or after December 1, 2003. The Veterans' Employment and Training Service (``VETS'') proposes that the reporting requirements for this rule become effective for the calendar year 2007, which is reported on September 30, 2008. This rule would implement those changes, along with other changes to the VETS-100 Report that either are required by the JVA or will improve the administration of the related veterans' programs.
