This Notice is to advise interested parties of a Military Health System (MHS) demonstration project, under the authority of Title 10, U.S. Code, Section 1092, entitled Web-Based TRICARE Assistance Program. The demonstration project will use existing managed care support contracts (MCSC) to provide a Web-based employee assistance program (EAP) including counseling and advice services to Active Duty Service members, their families members and their dependents enrolled in TRICARE Reserve Select, and those eligible for the Transition Assistance Management Program (TAMP) who reside in the continental United States. We are testing the effectiveness of providing this care.

The Department is publishing this proposed rule to implement section 703 of the National Defense Authorization Act (NDAA) for Fiscal Year 2007 (FY07), Public Law 109-364. Specifically, that legislation authorizes breast cancer screening and cervical cancer screening for female beneficiaries of the Military Health System, instead of constraining such testing to mammograms and Papanicolaou smears. The rule allows coverage for ``breast cancer screening'' and ``cervical cancer screening'' for female beneficiaries of the Military Health System, instead of constraining such testing to mammograms and Papanicolaou tests. This rule ensures new breast and cervical cancer screening procedures can be added to the TRICARE benefit as such procedures are proven to be a safe, effective, and nationally accepted medical practice. This amends the cancer specific recommendations for breast and cervical cancer screenings to be brought in line with the processes for updating other cancer screening recommendations.

This proposed rule revises the definition of rare diseases to adopt the definition of a rare disease as promulgated by the National Institutes of Health, Office of Rare Diseases. The rule modification will result in the definition used by the TRICARE program for a rare disease to be consistent with the definition used by the National Institutes of Health and the Food and Drug Administration. TRICARE has generally been applying the broader National Institutes of Health and Food and Drug Administration definitions when making coverage decisions for treatments; therefore, there will be no practical changes for beneficiaries.

Pursuant to the provisions of the Federal Advisory Committee Act (FACA), as amended, 5 U.S.C., App., notice is hereby given of a meeting of the Invasive Species Advisory Committee (ISAC). The purpose of ISAC is to provide advice to the National Invasive Species Council (NISC), as authorized by Executive Order 13112, on a broad array of issues related to preventing the introduction of invasive species and providing for their control and minimizing the economic, ecological, and human health impacts that invasive species cause. NISC is co- chaired by the Secretary of the Interior, the Secretary of Agriculture, and the Secretary of Commerce. NISC provides national leadership regarding invasive species issues. A meeting of ISAC will be held on August 11, 2009 from 1 p.m. until 3 p.m. EDT. Members of the public are invited to attend. A teleconference call-in number will be established. The purpose of this meeting is to convene the full ISAC to discuss, modify, and consider for adoption the ISAC position paper concerning the use of plant species that may be invasive in Federal biofuel programs. Meeting space is limited to fifteen individuals and the number of telephone call-in lines is limited to seventy. In accordance with the Privacy Act of 1974, the Department of Homeland Security proposes to establish a new Department of Homeland Security system of records notice titled, DHS/ALL-028 Complaint Tracking System. Complaint Tracking System is a correspondence workflow management system that assists the DHS Privacy Office in responding to complaints, comments and requests for redress from the public, other government agencies, and the private sector. Complaint Tracking System provides the capacity to handle correspondence that requires analysis, storage, categorization, and response from DHS Privacy Office personnel. It allows users to manage correspondence tracking with pre- defined routing inside workflow templates. This newly established system will be included in the Department of Homeland Security's inventory of record systems.

There are two mandatory requirements for filing of applications, both of which must be completed for a community's application to be deemed timely and considered by the Department. The first requirement is the filing of an Application for Federal Domestic Assistance (SF424) through https:// www.grants.gov. The second is the submission of the community's proposal as an attachment to its SF424. Applicants must complete a one- time registration at https://www.grants.gov, a process required by grants.gov that can take up to three weeks to complete. For this reason, applicants should register with grants.gov as soon as possible to ensure they can meet the application deadline.

This final rule implements section 701 of the John Warner National Defense Authorization Act for FY 2007, Public Law 109-364. Section 701 amends Title 10 of the United States Code (U.S.C.), Chapter 55, Section 1079(a) by authorizing coverage for forensic examinations following a sexual assault or domestic violence for eligible beneficiaries. This authorizes forensic examinations provided in civilian health care facilities (e.g., civilian rape crisis facilities) following sexual assault or domestic violence, which is consistent with the services that are authorized in Military Medical Treatment Facilities for all beneficiaries who are victims of sexual assault or domestic violence.

It also assigns responsibilities and establishes procedures for incident reporting, use of and accountability for equipment, rules for the use of force, and a process for administrative action or the removal, as appropriate, of PSCs and PSC personnel. For the Department of Defense, this IFR supplements DoD Instruction 3020.41, ``Contractor Personnel Authorized to Accompany the U.S. Armed Forces,'' which provides guidance for all DoD contractors operating in contingency operations.
