Shipping and Transportation; Technical, Organizational, and Conforming Amendments
This final rule makes non-substantive changes throughout Titles 46 and 49 of the Code of Federal Regulations. The purpose of this rule is to make conforming amendments and technical corrections to Coast Guard shipping and transportation regulations. This rule will have no substantive effect on the regulated public. These changes are provided to coincide with the annual recodification of Titles 46 and 49 on October 1, 2011.
Special Local Regulations for Marine Events, Wrightsville Channel; Wrightsville Beach, NC
The Coast Guard is establishing temporary special local regulations for the swim portions of ``Beach 2 Battleship Full and Half Iron Distance Triathlon'', to be held on the waters adjacent to Wrightsville Beach, North Carolina. These special local regulations are necessary to provide for the safety of life on navigable waters during the event. This action is intended to restrict vessel traffic on Banks, Motts, and Wrightsville Channels during the swimming portion of this event.
Safety Zone; Mississippi River, Mile Marker 230 to Mile Marker 234, in the Vicinity of Baton Rouge, LA
The Coast Guard is establishing a temporary safety zone for all waters of the Mississippi River beginning at mile marker 230 and ending at mile marker 234, in the vicinity of Baton Rouge, Louisiana. The temporary safety zone is needed to protect persons and vessels from the potential safety hazards associated with a maritime salvage operation. Entry into this zone is prohibited unless vessels have met the specified instructions or are specifically authorized by the Captain of the Port New Orleans or a designated representative.
Drawbridge Operation Regulation; Chickasaw Creek, AL
The Commander, Eighth Coast Guard District, issued a temporary deviation from the regulation governing the operation of the CSX Railroad Swing Span Bridge across Chickasaw Creek, mile 0.0, at Mobile, Alabama. The deviation is necessary to repair structural members of the bridge. This deviation allows the bridge to remain closed for ten consecutive hours for repairs to structural members of the bridge.
Drawbridge Operation Regulations; Narrow Bay, Smith Point, NY
The Commander, First Coast Guard District, has issued a temporary deviation from the regulation governing the operation of the Smith Point Bridge, 6.1, across Narrow Bay, between Smith Point and Fire Island, New York. The deviation is necessary to facilitate bridge rehabilitation. This deviation allows the bridge to open only one of the two moveable spans for the passage of vessel traffic.
Drawbridge Operation Regulations; Navesink (Swimming) River, NJ
The Commander, First Coast Guard District, has issued a temporary deviation from the regulation governing the operation of the Oceanic Bridge at mile 4.5 across the Navesink (Swimming) River between Oceanic and Locust Point, New Jersey. The deviation is necessary to facilitate bridge rehabilitation. This deviation allows the bridge to open only one of the two moveable spans for the passage of vessel traffic.
Inflatable Personal Flotation Devices
On March 30, 2011, the Coast Guard published a direct final rule that notified the public of the Coast Guard's intent to harmonize structural and performance standards for inflatable recreational personal flotation devices (PFDs) with current voluntary industry consensus standards, and to slightly modify regulatory text in anticipation of a future rulemaking addressing the population for which inflatable recreational PFDs are approved (76 FR 17561). As discussed below, we have received an adverse comment on the direct final rule, and have withdrawn the direct final rule in a notice of withdrawal published separately in this issue of the Federal Register. The Coast Guard seeks comment on the issues raised by the commenters and proposes to make the same changes to the current regulatory text, as modified below.
Amendment of Marine Safety Manual, Volume III
The Coast Guard is considering cancelling its policy concerning the issuance of Merchant Mariner Credentials endorsed as Able Seaman-Mobile Offshore Units. The policy is currently found in Chapter 16 of the Marine Safety Manual, Volume III. The Coast Guard will accept comments from the public on whether to cancel the policy and on any impacts the cancellation may have.
Lower Mississippi River Waterway Safety Advisory Committee; Vacancies
The Coast Guard is reopening the period for accepting applications for membership to the Lower Mississippi River Waterway Safety Advisory Committee. This Committee provides advice and recommendations to the Department of Homeland Security on matters relating to communications, surveillance, traffic management, anchorages, development and operation of the New Orleans Vessel Traffic Service (VTS), and other related topics dealing with navigation safety on the Lower Mississippi River as required by the U.S. Coast Guard.
Special Local Regulation, Hydroplane Races, Lake Sammamish, WA
The Coast Guard will enforce the Special Local Regulation, Hydroplane Races within the Captain of the Port Puget Sound Area of Responsibility for the 2011 Fall Championship hydroplane event in Lake Sammamish, WA from 11 a.m. until 4:30 p.m. from September 30, 2011 through October 2, 2011. This action is necessary to restrict vessel movement in the vicinity of the race courses thereby ensuring the safety of participants and spectators during these events. During the enforcement period non-participant vessels are prohibited from entering the designated race areas. Spectator craft entering, exiting or moving within the spectator area must operate at speeds which will create a minimum wake.
Anchorage Regulations; Newport, RI
The Coast Guard proposes to change the shape and expand the dimensions of anchorage ``D'' at Newport, Rhode Island, to better accommodate increasing cruise ship visits to Newport and to improve navigation safety.
Towing Safety Advisory Committee; Meeting
The Towing Safety Advisory Committee (TSAC) will hold a public meeting on Thursday, October 20, 2011, in Newport News, Virginia. Two TSAC sub-committees will meet the day before, October 19, 2011.
Merchant Marine Personnel Advisory Committee, Correction
On August 16, 2011 (76 FR 50744), the Coast Guard published a notice of meeting for the Merchant Marine Personnel Advisory Committee in the Federal Register. The Merchant Marine Personnel Advisory Committee was unable to complete all agenda items during a two day working group meeting on September 8-9, 2011 therefore, Coast Guard is adding a day to the meeting. This notice corrects the August 16, 2011 (76 FR 50744) Federal Register notice.
Drawbridge Operation Regulations; Hutchinson River, Bronx, NY
The Commander, First Coast Guard District, has issued a temporary deviation from the regulation governing the operation of the Amtrak Pelham Bay Railroad Bridge at mile 0.5, across the Hutchinson River at the Bronx, New York. The deviation is necessary to facilitate scheduled maintenance at the bridge. This deviation allows the bridge to remain in the closed position for two days followed by a two hour advance notice requirement for 20 days.
National Boating Safety Advisory Council; Meeting
The National Boating Safety Advisory Council (NBSAC) will meet on October 14, 2011, in Washington, DC. NBSAC discusses issues relating to recreational boating safety. This meeting will be open to the public.
Information Collection Requests to Office of Management and Budget
In compliance with the Paperwork Reduction Act of 1995, the U.S. Coast Guard intends to submit Information Collection Requests (ICRs) to the Office of Management and Budget (OMB), Office of Information and Regulatory Affairs (OIRA), requesting approval of revisions to the following collections of information: 1625-0067, Claims under the Oil Pollution Act of 1990; and 1625-0068, State Access to the Oil Spill Liability Trust Fund for Removal costs under the Oil Pollution Act of 1990. Our ICRs describe the information we seek to collect from the public. Before submitting these ICRs to OIRA, the Coast Guard is inviting comments as described below.
Safety Zone; Swim Around Charleston, Charleston, SC
The Coast Guard is establishing a temporary moving safety zone during the Swim Around Charleston, a swimming race occurring on waters of the Wando River, the Cooper River, Charleston Harbor, and the Ashley River, in Charleston, South Carolina. The Swim Around Charleston is scheduled to take place on Sunday, October 23, 2011. The temporary safety zone is necessary for the safety of the swimmers, participant vessels, spectators, and the general public during the event. Persons and vessels are prohibited from entering, transiting through, anchoring in, or remaining within the safety zone unless authorized by the Captain of the Port Charleston or a designated representative.
Safety Zone; M/V DAVY CROCKETT, Columbia River
The U.S. Coast Guard is extending the enforcement period of a safety zone established on the waters of the Columbia River surrounding the remaining cofferdam at the M/V DAVY CROCKETT removal sight at approximate river mile 117. The original safety zone was established on January 28, 2011. The safety zone is necessary to help ensure the safety of the response workers and maritime public from the hazards associated with the ongoing worksite cleanup operations. All persons and vessels are prohibited from entering or remaining in the safety zone unless authorized by the Captain of the Port, Columbia River or his designated representative.
Safety Zone; Giannangeli Wedding Fireworks, Lake St. Clair, Harrison Township, MI
The Coast Guard is establishing a temporary safety zone on Lake St. Clair, Harrison Township, MI. This zone is intended to restrict vessels from a portion of Lake St. Clair during the Giannangeli Wedding Fireworks.
Safety Zone; Ryder Cup Captain's Duel Golf Shot, Chicago River, Chicago, IL
The Coast Guard is establishing a temporary safety zone on the Chicago River near Chicago, Illinois. This zone is intended to restrict vessels from a portion of the Chicago River during a golfing event that will involve hitting golf balls from land onto a stationary barge in the river. This temporary safety zone is necessary to protect the public and their vessels from the hazards associated with golf balls being hit from land onto a stationary barge in the river.
International Maritime Organization Guidelines for Exhaust Gas Cleaning Systems for Marine Engines To Comply with Annex VI to MARPOL 73/78
The United States Coast Guard, in consultation with the United States Environmental Protection Agency, will conduct a public meeting on the International Maritime Organization guidelines for exhaust gas cleaning systems for marine engines. The purpose of this meeting in Washington, DC, is to collect information on how to evaluate exhaust gas cleaning systems to determine under Annex VI regulation 4 of the International Convention for the Prevention of Pollution by Ships, 1973 as modified by the Protocol of 1978 (MARPOL) if such a system should be considered an equivalent that would be at least as effective in reducing sulfur oxide emissions as the requirements of MARPOL Annex VI regulation 14.
Waiver of Citizenship Requirements for Crewmembers on Commercial Fishing Vessels; Correction
This document corrects the Regulatory Identification Number (RIN) to a proposed rule published in the Federal Register on August 18, 2011, entitled ``Waiver of Citizenship Requirements for Crewmembers on Commercial Fishing Vessels.'' This correction provides correct information with regard to the RIN.
Notice of Availability of Draft Programmatic Environmental Assessment for the Nationwide Implementation of the Interagency Operations Centers
The Coast Guard announces the availability of a Draft Programmatic Environmental Assessment (PEA) for the proposed nationwide implementation of the Interagency Operations Centers (IOC) Project.
Regulated Navigation Area; Saugus River, Lynn, MA
The Coast Guard is establishing a Regulated Navigation Area (RNA) on the navigable waters of the Saugus River in Lynn, Massachusetts. This temporary rule allows the Coast Guard to suspend all vessel traffic within the regulated area to allow for stabilization operations that could pose a safety hazard to vessels operating in the area. This temporary rule is necessary to enhance vessel safety, marine environmental protection, and provide for the safety of life on the navigable waters during the removal of a damaged section of the Energy Systems Pipeline Bridge at Mile 2.3 of the Saugus River.
Regulated Navigation Area; Route 24 Bridge Construction, Tiverton and Portsmouth, RI
The Coast Guard is establishing a regulated navigation area (RNA) on the navigable waters of the Sakonnet River under and surrounding construction of the new Route 24 bridge that crosses the Sakonnet River between Tiverton and Portsmouth, Rhode Island. This rule implements certain safety measures including establishment of a temporary channel beneath the bridge, speed restrictions, and suspension of all vessel traffic within the RNA during construction operations that could pose an imminent hazard to vessels operating in the area. This rule is necessary to provide for the safety of life on the navigable waters during construction of the Route 24 bridge over the main channel of the Sakonnet River.

Special Local Regulations for Marine Events; Temporary Change of Dates for Recurring Marine Events in the Fifth Coast Guard District, Wrightsville Channel; Wrightsville Beach, NC; Correction
In the Federal Register published on September 8, 2011, the Coast Guard published a Temporary Final Rule changing the date of the special local regulation for this year's Wilmington YMCA Triathlon. In that Temporary Final Rule, the line number for the temporary line in the Table to Sec. 100.501 was wrong. This Correction fixes that error. The date and all other details in the Final Rule were correct.
Safety Zone; Chicago Harbor, Navy Pier Southeast, Chicago, IL
The Coast Guard will enforce the regulations found in 33 CFR 165.931 for Navy Pier Fireworks in Chicago, Illinois. This event occurs in the Captain of the Port, Sector Lake Michigan's zone from September 10, 2011 through October 29, 2011. This action is necessary and intended to ensure safety of life on the navigable waters of the United States immediately prior to, during, and immediately after fireworks events. During the aforementioned period, restrictions will be enforced upon, and control movement of, vessels in a specified area immediately prior to, during, and immediately after fireworks events. During the enforcement period, no person or vessel may enter the safety zones without permission of the Captain of the Port, Sector Lake Michigan.
Safety Zone; Head of the Cuyahoga, Cuyahoga River, Cleveland, OH
The Coast Guard is establishing a temporary safety zone on the Cuyahoga River, Cleveland, OH. This safety zone is intended to restrict vessels from a portion of the Cuyahoga River during the Head of the Cuyahoga. This temporary safety zone is necessary to protect spectators and vessels from the hazards associated with a rowing regatta.

Safety Zone; TriRock Triathlon, San Diego Bay, San Diego, CA
The Coast Guard is establishing a safety zone upon the specified navigable waters of the San Diego Bay, San Diego, California, in support of a bay swim in San Diego Harbor. This safety zone is necessary to provide for the safety of the participants, crew, spectators, participating vessels, and other vessels and users of the waterway. Persons and vessels are prohibited from entering into, transiting through, or anchoring within this safety zone unless authorized by the Captain of the Port, or his designated representative.
Inspection of Towing Vessels
The Coast Guard announces a series of public meetings to receive comments on a notice of proposed rulemaking (NPRM) entitled ``Inspection of Towing Vessels'' that was published in the Federal Register on August 11, 2011. As stated in that document, the regulations proposed in the NPRM would establish safety regulations governing the inspection, standards, and safety management systems of towing vessels. The proposal includes provisions covering: Specific electrical and machinery requirements for new and existing towing vessels, the use and approval of third-party auditors and surveyors, and procedures for obtaining Certificates of Inspection. Without making a specific proposal in the NPRM regarding potential requirements for hours of service or crew endurance management for mariners aboard towing vessels, the Coast Guard also welcomes comments on these two important issues, which are discussed in the NPRM.
Safety Zones; Fireworks Displays and Surfing Events in Captain of the Port Long Island Sound Zone
The Coast Guard is establishing safety zones for marine events within the Captain of the Port (COTP) Long Island Sound Zone for a surfing event and fireworks displays. This action is necessary to provide for the safety of life on navigable waters during the events. Entry into, transit through, mooring or anchoring within this zone is prohibited unless authorized by the COTP Sector Long Island Sound.
Safety Zone; Revolution 3 Triathlon, Sandusky Bay, Lake Erie, Cedar Point, OH
The Coast Guard is establishing a temporary safety zone on Lake Erie, Cedar Point, Sandusky, OH. This zone is intended to restrict vessels from a portion of Lake Erie during the Revolution 3 Triathlon. This temporary safety zone is necessary to protect participants, spectators and vessels from the hazards associated with a triathlon event.
Special Local Regulations for Marine Events; Temporary Change of Dates for Recurring Marine Events in the Fifth Coast Guard District, Wrightsville Channel; Wrightsville Beach, NC
The Coast Guard will temporarily change the enforcement period of one special local regulation for a recurring marine event in the Fifth Coast Guard District, specifically the ``Wilmington YMCA Triathlon'' conducted on the waters of Wrightsville Channel near Wrightsville Beach, North Carolina. This Special Local Regulation is necessary to provide for the safety of life on navigable waters during the event, which has been rescheduled from the last Saturday in September to the second-to-last Saturday in September. This action is intended to restrict vessel traffic on Wrightsville Channel during the swimming portion of this event.
Special Local Regulation for Marine Events; Chesapeake Bay Workboat Race; Back River, Messick Point, Poquoson, VA
The Coast Guard will establish special local regulation during the Chesapeake Bay Workboat Race, a series of boat races to be held on the waters of Back River, Poquoson, Virginia. These special local regulations are necessary to provide for the safety of life on navigable waters during the events. This action is intended to restrict vessel traffic during the power boat races on the Back River in the vicinity of Messick Point, in Poquoson, Virginia.
Special Local Regulation for Marine Events; Temporary Change of Dates for Recurring Marine Events in the Fifth Coast Guard District, John H. Kerr Reservoir, Clarksville, VA
The Coast Guard will temporarily change the enforcement period of special local regulations for one recurring marine event in the Fifth Coast Guard District, specifically, the ``Clarksville Hydroplane Challenge,'' hydroplane races on the waters of the John H. Kerr Reservoir. Because this event will consist of approximately 80 hydroplane powerboats conducting high-speed competitive races in heats counter-clockwise around an oval racecourse on the water of the John H. Kerr Reservoir, this regulation is necessary to provide for the safety of life on navigable waters during the event. This action is intended to restrict vessel traffic in portions of the John H. Kerr Reservoir in Clarksville, Virginia during the event.

Drawbridge Operation Regulation; Steamboat Slough, Grand Island, CA
The Commander, Eleventh Coast Guard District, has issued a temporary deviation from the regulation governing the operation of the California Highway 160 Drawbridge across Steamboat Slough, mile 11.2, at the head of Grand Island, Sacramento County, CA. The deviation is necessary to allow California Department of Transportation to paint and perform routine maintenance on the drawbridge. This deviation allows single leaf operation of the double leaf bascule style drawbridge during the project.
Safety Zone; Corporate Party on Hornblower Yacht, San Francisco, CA
The Coast Guard is establishing a temporary safety zone in the navigable waters near pier 48 in the San Francisco Bay, San Francisco, California in support of the Corporate Party on Hornblower Yacht. This temporary safety zone is established to ensure the safety of participants and spectators from the dangers associated with the pyrotechnics. Unauthorized persons or vessels are prohibited from entering into, transiting through, or remaining in the safety zone without permission of the Captain of the Port or their designated representative.
Safety Zones; Annual Firework Displays Within the Captain of the Port, Puget Sound Area of Responsibility
The Coast Guard will enforce the safety zones for annual firework displays in the Captain of the Port, Puget Sound area of responsibility on September 10, 2011 for the Mukilteo Lighthouse Festival in Possession Sound, WA and on December 3, 2011 for Chimes and Lights in Port Orchard, WA. This action is necessary to prevent injury and to protect life and property of the maritime public from the hazards associated with the firework displays. During the enforcement periods, entry into, transit through, mooring, or anchoring within these zones is prohibited unless authorized by the Captain of the Port, Puget Sound or Designated Representative.
Recreational Vessel Accident Reporting
The Coast Guard has received recommendations from the National Boating Safety Advisory Council (NBSAC) regarding potential ways to improve the recreational boating accident reporting process. NBSAC recommended that the Coast Guard: (1) Use a two-tiered reporting system for boating accidents; and (2) take steps to clarify what, how, and when information is reported. This notice solicits public comment on the NBSAC recommendations, as well as general public comment on the burden involved in reporting accidents, and other alternative means of reporting or collecting information.
Safety Zone; Myrtle Beach Triathlon, Atlantic Intracoastal Waterway, Myrtle Beach, SC
The Coast Guard is establishing a temporary safety zone on the Atlantic Intracoastal Waterway in Myrtle Beach, South Carolina during the Myrtle Beach Triathlon. The Myrtle Beach Triathlon, which is comprised of a series of triathlon races, is scheduled to take place on Saturday, October 8, 2011 and Sunday, October 9, 2011. This temporary safety zone is necessary for the safety of race participants, participant vessels, spectators, and the general public during the swim portions of the triathlon races. Persons and vessels are prohibited from entering, transiting through, anchoring in, or remaining within the safety zone unless authorized by the Captain of the Port Charleston or a designated representative.
International Anti-Fouling System Certificate
The Coast Guard proposes to amend its vessel inspection regulations to add the International Anti-fouling System (IAFS) Certificate to the list of certificates a recognized classification society may issue on behalf of the Coast Guard. This action is being taken in response to recently enacted legislation implementing the International Convention on the Control of Harmful Anti-fouling Systems on Ships, 2001. This proposed rule would enable recognized classification societies to apply to the Coast Guard for authorization to issue IAFS Certificates to vessel owners on behalf of the Coast Guard.
Safety Zone; Suttons Bay Labor Day Fireworks, Suttons Bay, Grand Traverse Bay, MI
The Coast Guard is establishing a temporary safety zone in the Captain of the Port Sault Sainte Marie zone. This zone is intended to restrict vessels from certain portions of water areas within Sector Sault Sainte Marie Captain of the Port zone, as defined by 33 CFR 3.45- 45. This temporary safety zone is necessary to protect spectators and vessels from the hazards associated with fireworks displays.
Safety Zone; Cleveland National Air Show, Lake Erie, Cleveland, OH
The Coast Guard is establishing a temporary safety zone on Lake Erie, Cleveland, OH. This zone is intended to restrict vessels from a portion of Lake Erie during the Cleveland National Air Show. This safety zone is necessary to protect persons and vessels from the potential safety hazards associated with high speed, low altitude acrobatic and military aircraft.
Safety Zone; Labor Day Fireworks, Ancarrows Landing Park, James River, Richmond, VA
The Coast Guard is establishing a 420-foot radius safety zone on the navigable waters of James River in Richmond, VA in support of the Labor Day Fireworks event. This action is necessary to provide for the safety of life on navigable waters during the Labor Day Fireworks show. This action is intended to restrict vessel traffic movement to protect mariners and spectators from the hazards associated with aerial fireworks displays.
Safety Zone; Thunder on the Gulf, Gulf of Mexico, Orange Beach, AL
The Coast Guard is establishing a temporary safety zone for a portion of the Gulf of Mexico for the waters off Orange Beach, Alabama. This action is necessary for the protection of crews, vessels, persons, and spectators on navigable waters during the Thunder on the Gulf high speed boat races. Entry into, transiting or anchoring in this zone is prohibited to all vessels, mariners, and persons unless specifically authorized by the Captain of the Port (COTP) Mobile or a designated representative.
