Privacy Act of 1974; System of Records
In accordance with the Privacy Act of 1974, as amended (Privacy Act), 5 U.S.C. 552a, the Department of Education (Department) publishes this notice of a new system of records entitled ``Indian EducationIndividual Reporting on Regulatory Compliance Related to the Indian Education Professional Development Program's Service Obligation and the Government Performance and Results Act of 1993 (GPRA)'' (18-14- 05). The Indian Education Professional Development program, authorized under title VII, part A of the Elementary and Secondary Education Act of 1965, as amended (ESEA), is designed to increase the number of, provide training to, and improve the skills of American Indian or Alaska Natives serving as teachers and school administrators in schools serving American Indian or Alaska Native students. Section 7122(h) of the ESEA (20 U.S.C. 7442(h)) requires that individuals who receive financial assistance through the Indian Education Professional Development program subsequently complete a service obligation equivalent to the amount of time for which the participant received financial assistance. Participants who do not satisfy the requirements of the regulations must repay all or a pro- rated part of the cost of assistance, in accordance with 20 U.S.C. 7442(h) and 34 CFR 263.8(a)(3). The regulations in part 263 implement requirements governing, among other things, the service obligation and reporting requirements of the participants in the Indian Education Professional Development program, and repayment of financial assistance by these participants. In order for the Federal Government to ensure that the goals of the program are achieved, certain data collection, recordkeeping, and documentation are necessary. In addition, GPRA requires Federal agencies to establish performance measures for all programs, and the Department has established performance measures for the Indian Education Professional Development program. Data collection from participants who have received financial assistance under the Indian Education Professional Development program is a necessary element of the Department's effort to evaluate progress on these measures. The Department tracks participants who are receiving or have previously received support through the Indian Education Professional Development program. Participants must sign a payback agreement that includes contact information. Additionally, the Department receives information about participants from institutions of higher education (IHEs) and other eligible grantees when participants are no longer receiving assistance through the Indian Education Professional Development program. When the performance period is complete, the participant data are collected from the grantee and also from the participants. Records in the system pursuant to this notice may include the name, social security number, date of birth, mailing address, telephone number, e-mail address, and alternate contact information for each participant in the grant, as well as the name and contact information of a person through whom the participant can be contacted, the number of semesters or months for which the participant needs to provide service in order to satisfy the service payback obligation, the total amount of financial assistance the participant received, the time period during which the participant must satisfy the service payback obligation, eligible employment to fulfill the service payback obligation, contact information for employers, and grant identification numbers. In addition, participants may request an educational deferment, which requires verification of acceptance in a university/ college program, enrollment as a full-time student, registration each semester, timely submission of semester transcripts, and documentation of the participant as a student in good standing. Participants also provide information about specific areas of training, certifications or licensures obtained, reasons for leaving the program before completion, gender, ethnic origin, and education history. Participants are responsible for obtaining letters signed by the participant's supervisor that verify the employment information provided by the participant. These letters must be submitted to the Department every six months until service payback is completed.

Arbitration Panel Decision Under the Randolph-Sheppard Act
The Department of Education (Department) gives notice that on March 31, 2010, an arbitration panel rendered a decision in the matter of Daniel Czubak v. Illinois Department of Human Services, Division of Rehabilitation Services, Case no. R-S/08-5. This panel was convened by the Department under 20 U.S.C. 107d-1(a), after the Department received a complaint filed by the petitioner, Daniel Czubak.
Proposed Waiver and Extension of Project Period
The Secretary proposes to waive the requirements in 34 CFR 75.250 and 75.261(c)(2) of the Education Department General Administrative Regulations (EDGAR) that, respectively, generally prohibit project periods exceeding five years and project period extensions involving the obligation of additional Federal funds. The FY 2010 appropriation provided the fifth year of funding for 60 of the 62 Parental Information and Resource Center (PIRC) grants that were funded in FY 2006, and the fourth year of funding for the remaining two grants that were funded in FY 2007. The proposed waivers would enable 60 of the 62 current grantees under the PIRC program to continue to receive Federal funding beyond the five-year limitation contained in 34 CFR 75.250 and enable the Department to obligate an additional year of Federal funds for all 62 current eligible grantees notwithstanding the limitation in 34 CFR 75.261(c)(2), which prohibits the extension of a project period if it involves the obligation of additional Federal funds. This additional year of Federal funds would be contingent on final Congressional action on the FY 2011 budget.
Committee on Measures of Student Success
This notice sets forth the schedule and proposed agenda of an upcoming meeting of the Committee on Measures of Student Success (Committee). The notice also describes the functions of the Committee. Notice of this meeting is required by section 10(a)(2) of the Federal Advisory Committee Act (FACA) and is intended to notify the public of their opportunity to attend.
National Assessment Governing Board: Proposed Information Collection
In compliance with the requirement of section 3506(c)(2)(A) of the Paperwork Reduction Act of 1995, the National Assessment Governing Board is publishing the following summary of a proposed information collection for public comment. Interested persons are invited to send comments regarding this burden estimate or any other aspect of this collection of information, including any of the following subjects: (1) The necessity and utility of the proposed information collection for the proper performance of the Agency's function; (2) the accuracy of the estimated burden; (3) ways to enhance the quality, utility, and clarity of the information to be collected; (4) ways to minimize the burden of the collection of information on respondents, including through the use of automated collection techniques or other forms of information technology; and (5) estimates of capital or start-up costs and costs of operation, maintenance, and purchase of services to provide information. Type of Information Collection Request: New information collection. Title of Information Collection: Evaluating Student Need for Developmental or Remedial Courses at Postsecondary Education Institutions (formerly titled Survey of Placement Tests and Cut-Scores in Higher Education Institutions). Use: The congressionally authorized National Assessment of Educational Progress (NAEP) reports to the public on the achievement of students at grades 4, 8, and 12 in core subjects. The National Assessment Governing Board oversees and sets policy for NAEP. NAEP and the Governing Board are authorized under the National Assessment of Educational Progress Authorization Act (Pub. L. 107-279). Among the Board's responsibilities is ``to improve the form, content, use, and reporting of [NAEP results].'' Toward this end, the Governing Board plans to enable NAEP at the 12th grade to report on the academic preparedness of 12th grade students in reading and mathematics for entry level college credit coursework. The Governing Board has planned a program of research studies to support the validity of statements about 12th grade student preparedness that would be made in NAEP reports, beginning with the 2009 assessments in 12th grade reading and mathematics. Among the studies planned is a survey of 2-year and 4-year institutions of higher education about the tests and test scores used to place students into entry level college credit coursework leading to a degree and into non- credit remedial or developmental programs in reading and/or mathematics. The data resulting from this survey will be used to help develop valid statements that can be made about the preparedness of 12th grade students in NAEP reports. Frequency: One operational study: one time only; Affected Public: State, Local or Tribal Governments (2-year and 4-year public higher education institutions); Private Sector For-Profit and Not-For-Profit Institutions (2-year and 4-year private higher education institutions); Number of Respondents: 1,700; Total Annual Responses: 1,700; Total Annual Hours: 975. Investing in Innovation Fund; Catalog of Federal Domestic Assistance (CFDA) Numbers: 84.396A, 84.396B and 84.396C
The Assistant Deputy Secretary for Innovation and Improvement proposes to amend the final priorities, requirements, and selection criteria under the Investing in Innovation Fund (i3) program as established in the notice of final priorities, requirements, definitions, and selection criteria (2010 NFP) that was published in the Federal Register on March 12, 2010 (75 FR 12004-12071). The 2010 NFP established specific priorities, requirements, and selection criteria to be used in evaluating grant applications for the i3 program. The changes proposed in this notice reflect lessons learned from the first i3 competition and would provide the Secretary with additional flexibility in using priorities, requirements, and selection criteria for i3 competitions in fiscal year (FY) 2011 and subsequent years.
Enhanced Assessment Instruments
The Secretary of Education proposes priorities, requirements, definitions, and selection criteria under the Enhanced Assessment Instruments Grant (EAG) competition. The Secretary may use one or more of these priorities, requirements, definitions, and selection criteria for competitions using funds from fiscal year (FY) 2010 and later years. We take these actions in order to establish selection criteria that are likely to recognize high-quality proposals and to help focus Federal financial assistance on applications that address pressing needs and promising developments related to developing and implementing assessments under the Elementary and Secondary Education Act of 1965, as amended (ESEA).
Submission of Data by State Educational Agencies
The Secretary announces dates for the submission by State educational agencies (SEAs) of expenditure and revenue data and average daily attendance statistics on ED Form 2447 (the National Public Education Financial Survey (NPEFS)) for FY 2010. The Secretary sets these dates to ensure that data are available to serve as the basis for timely distribution of Federal funds. The U.S. Bureau of the Census (Bureau of the Census) is the data collection agent for the National Center for Education Statistics (NCES). The data will be published by NCES and will be used by the Secretary in the calculation of allocations for FY 2012 appropriated funds.
