The Assistant Secretary for Postsecondary Education announces requirements under the PPOHA Program. The Assistant Secretary may use one or more of these requirements for competitions in fiscal year (FY) 2010 and later years. We take this action to establish appropriate requirements for the PPOHA Program. We have based these requirements on existing rules for the Hispanic-Serving Institutions (HSI) Program, authorized by title V of the Higher Education Act of 1965, as amended (HEA), because the PPOHA Program and the HSI Program are governed by some common provisions and support similar institutions.

The Secretary waives the requirements in 34 CFR 75.261(c)(2) of the Education Department General Administrative Regulations (EDGAR), as they apply to projects funded under the DC School Choice Incentive Program (DC Choice program). This regulation generally prohibits any project period extensions involving the obligation of additional Federal funds. A waiver of this regulation would allow the one-year grant funded with fiscal year (FY) 2009 funds under the DC Choice Program to be continued beyond its original project period with FY 2010 funds. Additionally, this grantee will be able to receive additional Federal funds notwithstanding the limitation in 34 CFR 75.261(c)(2) that prohibits extension of a project period if it involves the obligation of additional Federal funds.

In accordance with the Privacy Act of 1974, as amended (Privacy Act), the Department of Education (Department) publishes this notice proposing to revise the system of records notice for the Hotline Complaint Files of the Inspector General (18-10-04), 64 FR 30157-59 (June 4, 1999). The U.S. Secretary of Education (Secretary) establishes requirements to implement section 458(a)(7) of the Higher Education Act of 1965, as amended (HEA), as added by section 2212(b)(1) of the SAFRA Act, title II of the Health Care and Education Reconciliation Act of 2010 (SAFRA). Under this provision of the law, the Secretary provides payments to student loan servicers in Federal fiscal year (FY) 2010 and FY 2011 for retaining jobs at locations in the United States where such servicers were operating under title IV, part B of the HEA (the Federal Family Education Loan Program) on January 1, 2010.

The Secretary announces the requirements, definitions, eligibility criteria, and procedures for the implementation of the Civil Legal Assistance Attorney Student Loan Repayment Program, authorized under section 428L of the Higher Education Act of 1965, as amended (HEA), 20 USC 1078-12. Under this program, civil legal assistance attorneys who meet certain qualifications may have a portion of their Federal Perkins Loan (Perkins Loan), Federal Family Education Loan (FFEL), and William D. Ford Federal Direct Loan (Direct Loan) program loans repaid by the Secretary based on qualifying full-time employment for at least three years.

The PBI Notice incorrectly indicated that this program was subject to intergovernmental review under Executive Order 12372 and 34 CFR part 79, and established deadlines for the completion of intergovernmental review.
