The Susquehanna River Basin Commission will hold its regular business meeting on March 15, 2012, in Harrisburg, Pennsylvania. Details concerning the matters to be addressed at the business meeting are contained in the Supplementary Information section of this notice.

This document contains final rules that would amend the project review regulations of the Susquehanna River Basin Commission (Commission) to include definitions for new terms and an amended definition; provide for administrative approval of interbasin transfers of flowback and production fluids between drilling pad sites that are isolated from the waters of the basin; provide for administrative approval of out-of-basin transfers of flowback or produced fluids from a Commission approved hydrocarbon development project to an out-of- basin treatment or disposal facility; insert language authorizing renewal of expiring approvals, including Approvals by Rule (ABRs); delete specific references to geologic formations that may be the subject of natural gas development using hydrofracture stimulation and replace with a generic category``unconventional natural gas development;'' broaden the scope of ABRs issued to include hydrocarbon development of any kind utilizing the waters of the basin, not just unconventional natural gas well development; memorialize the current practice of requiring post-hydrofracture reporting; and provide further procedures for the approval of water sources utilized at projects subject to the ABR process.

The Susquehanna River Basin Commission will hold a public hearing on February 16, 2012, in Harrisburg, Pennsylvania. At this public hearing, the Commission will hear testimony on the projects listed in the Supplementary Information section of this notice. Such projects are intended to be scheduled for Commission action at its next business meeting, tentatively scheduled for March 15, 2012, which will be noticed separately. Included in the list of projects scheduled for comment at the public hearing are both new projects and certain projects that were acted upon at the Commission's December 15, 2011, public hearing held in Wilkes-Barre, Pennsylvania. The Commission is affording this opportunity for additional comment due to the disruptive behavior of certain individuals that prevented many interested persons from being able to offer testimony at the December 15, 2011, public hearing. To give due consideration of any new oral or written comment received on such projects, the Commission will reconsider, at its March 2012, meeting, the actions taken on December 15, 2011. Details concerning the list of all projects that are the subject of the public hearing are contained in the Supplementary Information section of this notice. The public should take note that this public hearing will be the only opportunity to offer oral comment to the Commission for the listed projects. There will be no opportunity for further comment on these projects at the Commission's business meeting in March 2012, where the Commission is expected to take action thereon. The deadline for written comments on all such projects is February 27, 2012.

At the public hearing, the Commission will consider: (1) A compliance matter involving one project; (2) the rescission of two docket approvals; (3) action on certain water resources projects; (4) action on seven projects involving a diversion; (5) an administrative appeal of Docket Nos. 20110316, 20110317, and 20110318, by the Allegheny Defense Project; (6) amendments to the Regulatory Program Fee Schedule; and (7) amendment of the Comprehensive Plan for Management of the Water Resources of the Susquehanna River Basin.
