Notice of Rail Energy Transportation Advisory Committee Vacancies
The Surface Transportation Board (Board) hereby gives notice of nine vacancies on its Rail Energy Transportation Advisory Committee (RETAC) for three representatives from coal producers; one representative from electric utilities; one representative from biofuel feedstock growers or providers and biofuel refiners, processors, and distributors; one representative from private car owners, car lessors, or car manufacturers; two representatives from renewable energy sources; and one representative from a labor organization. The Board is soliciting nominations from the public for candidates to fill these vacancies.

Oversight Hearing Pertaining to Union Pacific Railroad Company's Embargoes
The Surface Transportation Board (Board) will hold an in- person public hearing on December 13 and 14, 2022, with Union Pacific Railroad Company (UP), pertaining to the significant increase in its use of embargoes. The hearing will be held in the Hearing Room of the Board's headquarters, located at 395 E Street SW, Washington, DC 20423-0001. The Board will direct the following executive-level officials of UP to appear in person: Lance M. Fritz, Chairman, President, and Chief Executive Officer; Kenny Rocker, Executive Vice PresidentMarketing and Sales; Eric Gehringer, Executive Vice PresidentOperations; and Bradley Moore, Vice PresidentCustomer Care and Support. UP may bring additional personnel to the hearing who may be able to provide helpful information to the Board. In addition, the Board invites testimony from shippers and other stakeholders who can contribute to the Board's understanding of the cause and/or impact of the embargoes.
60-Day Notice of Intent To Seek Extension of Approval of Collection: Statutory Authority To Preserve Rail Service
As part of its continuing effort to reduce paperwork burdens, and as required by the Paperwork Reduction Act of 1995 (PRA), the Surface Transportation Board (Board) gives notice of its intent to request from the Office of Management and Budget (OMB) approval without change of the existing collection, Preservation of Rail Service, OMB Control No. 2140-0022, as described below.
WeDriveU, Inc.-Acquisition of Control-TransAction Corporate Shuttle, Inc.
On October 13, 2022, WeDriveU, Inc. (WeDriveU or Applicant), a noncarrier, filed an application for WeDriveU to acquire direct control of an interstate passenger motor carrier, TransAction Corporate Shuttle, Inc. (TCS), from its sole shareholder, Cynthia C. Fren[eacute] (Seller). The Board is tentatively approving and authorizing this transaction. If no opposing comments are timely filed, this notice will be the final Board action.
Application of the National Railroad Passenger Corporation Under 49 U.S.C. 24308(e)-CSX Transportation, Inc., and Norfolk Southern Railway Company
The evidentiary hearing phase of this proceeding, involving the National Railroad Passenger Corporation (Amtrak), CSX Transportation, Inc. (CSXT), Norfolk Southern Railway Company (NSR), and the Alabama State Port Authority and its rail carrier division, the Terminal Railway Alabama State Docks (collectively, the ``Port''; and with Amtrak, CSXT, and NSR, the ``Parties''), will continue on November 17 and 18, 2022. On December 7, 2022, the Board will hold a voting conference, at which Board members will discuss among themselves, and may vote on, the outcome of the case. The evidentiary hearing and voting conference will both take place in the hearing room of the Board's headquarters. The hearing and voting conference will also be available for public viewing on YouTube.
60-Day Notice of Intent To Seek Extension and Modification of an Existing Collection: Urgent Rail Service Issues
As part of its continuing effort to reduce paperwork burdens, and as required by the Paperwork Reduction Act of 1995 (PRA), the Surface Transportation Board (Board) gives notice of its intent to seek approval from the Office of Management and Budget (OMB) for an extension and modification of an existing and approved information collection, as described below. An emergency approval was granted for this collection (OMB Control Number 2140-0041), expiring on January 31, 2023. The Board is now seeking to extend and modify that collection with a submission through OMB's regular PRA clearance process.

Quarterly Rail Cost Adjustment Factor
The Board has approved the fourth quarter 2022 Rail Cost Adjustment Factor (RCAF) and cost index filed by the Association of American Railroads. The fourth quarter 2022 RCAF (Unadjusted) is 1.295. The fourth quarter 2022 RCAF (Adjusted) is 0.527. The fourth quarter 2022 RCAF-5 is 0.503.

Notice is hereby given of a meeting of the Rail Energy Transportation Advisory Committee (RETAC), pursuant to the Federal Advisory Committee Act.
Railroad Revenue Adequacy-2021 Determination
On September 6, 2022, the Board served a decision announcing the 2021 revenue adequacy determinations for the nation's Class I railroads. Five Class I railroads (BNSF Railroad Company, CSX Transportation, Inc., Norfolk Southern Combined Railroad Subsidiaries, Soo Line Corporation, and Union Pacific Railroad Company) were found to be revenue adequate.
Fees for Services Performed in Connection With Licensing and Related Services-2022 Update
The Board updates for 2022 the fees that the public must pay to file certain cases and pleadings with the Board. Pursuant to this update, 84 of the Board's 135 fees will increase and 51 fees will remain at their current levels.
Van Pool Transportation, LLC-Acquisition of Control-DS Bus Lines, Inc.
On July 21, 2022, Van Pool Transportation LLC (Van Pool or Applicant), a noncarrier, filed an application for Van Pool to acquire indirect control of an interstate passenger motor carrier, DS Bus Lines, Inc. (DS Bus), by acquiring Kincaid Group Holdings, Inc. (Holdings), from the shareholders of Holdings. The Board is tentatively approving and authorizing the transaction, and, if no opposing comments are timely filed, this notice will be the final Board action.
