Navistar petitioned NHTSA on December 16, 2021, for a decision that the subject noncompliance is inconsequential as it relates to motor vehicle safety. This interim final rule provides procedures to implement certain provisions of the National Defense Authorization Act for Fiscal Year 2021 (FY21 NDAA) and the National Defense Authorization for Fiscal Year 2022 (FY22 NDAA). The FY21 NDAA authorized the Secretary of Transportation to establish the Tanker Security Program (TSP) comprised of a fleet of active, commercially viable, militarily useful, privately owned product tank vessels of the United States. The fleet will meet national defense and other security requirements and maintain a United States presence in international commercial shipping. The FY22 NDAA made minor adjustments related to the participation of long-term charters in the TSP. The Maritime Administration solicits written comments on this rulemaking.
Update to Air Carrier Definitions

The FAA proposes to amend the regulatory definitions of certain air carrier and commercial operations. This proposed rule would add powered-lift to these definitions to ensure the appropriate sets of rules apply to air carriers' and certain commercial operators' operations of aircraft that FAA regulations define as powered-lift. The FAA also proposes to update certain basic requirements that apply to air carrier oversight, such as the contents of operations specifications and the qualifications applicable to certain management personnel. In addition, this proposed rule would apply the rules for commercial air tours to powered-lift. This proposed rule is an important step in the FAA's integration of new entrant aircraft in the National Airspace System (NAS).

Notice is being given that the FAA is considering a request from Golden Triangle Regional Airport Authority (GTRAA) to release and dispose of 143.95 acres of airport property in exchange for 236.14 acres of agricultural land to be used for future aeronautical development. The property proposed for release is made up of three parcels. Parcel 7A is approximately 31.16 acres, Parcel 7B is approximately 58.9 acres, and Parcel 7C is approximately 73.2 acres. These three parcels are currently undeveloped and not needed for aeronautical use. The property is planned to be developed into an airport compatible industrial use aluminum mill. While no money will exchange hands in this transaction, the land to be given to the airport in exchange for the property in question is higher in acreage, value, and utility in accordance with FAA's Policy and Procedures Concerning the Use of Airport Revenue.

In accordance with the Paperwork Reduction Act of 1995, FAA invites public comments about our intention to request the Office of Management and Budget (OMB) approval for a new information collection. The initial Federal Register Notice with a 60-day comment period soliciting comments on the following collection of information was published on April 26, 2022. The collection involves the possibility for airplane manufacturers, for which a newly built airplane is subject to the applicability of Annex 16, Volume III of the Convention on Civil Aviation (hereinafter the ``Chicago Convention''), to submit an electronic datasheet to the FAA for posting to the CO2 Certification Database (CO2DB). The information to be collected will be necessary because of FAA's commitment to help (a) provide publicly available data on the CO2 Metric Value (MV) which represents a measure of fuel burn performance of airplane types against CO2 technology/design standards, (b) track and communicate the improvement in airplane CO2 MVs over time and (c) provide an incentive to improve the CO2 MV of airplane types.

On November 8, 2022, the FAA published in the Federal Register a notice of proposed airworthiness criteria (87 FR 67399) that announced the availability of, and requested comments on, the proposed airworthiness criteria for the Joby Aero, Inc. (Joby) Model JAS4-1 powered-lift. The comment period for this document expires on December 8, 2022. By email dated November 14, 2022, the European Union Aviation Safety Agency (EASA) requested that the FAA extend the public-comment deadline December 22, 2022 to facilitate harmonizing FAA and EASA criteria for powered-lift. The FAA agrees to the request and announces an extension of the comment period to December 22, 2022.
Safety Advisory 22-4 Suicide Prevention Signage on Public Transit

The FAA proposes to adopt a new airworthiness directive (AD) for all Bombardier, Inc., Model CL-600-1A11 (600), CL-600-2A12 (601), and CL-600-2B16 (601-3A, 601-3R, and 604 Variants) airplanes. This proposed AD was prompted by a determination that, due to a lack of flightcrew awareness, smoke hoods with a certain part number installed throughout the airplane could be mistaken for protective breathing equipment (PBE). This proposed AD would require an inspection or records review to determine if any smoke hood with a certain part number is installed in any location on the airplane and, depending on the results, removing the smoke hood and associated placards and installing new placards. The FAA is proposing this AD to address the unsafe condition on these products.

The FHWA, on behalf of Caltrans, is issuing this notice to announce Caltrans' adoption of the Maritime Administration's (MARAD) Combined Final Environmental Impact Statement/Record of Decision and Final Section 4(f) Evaluation, (FEIS/ROD) for the Port of Long Beach (POLB or Port) Pier B On-Dock Rail Support Facility Project (Project). The Final EIS and ROD for the Pier B On-Dock Rail Support Facility Project were approved by MARAD on April 7, 2022. MARAD's Notice of Availability for the Final EIS and ROD was published in the Federal Register on April 15, 2022. Under 49 U.S.C. 304a(b), MARAD issued a single Final EIS and ROD (USEPA, 2022). Therefore, the 30-day wait/ review period under the National Environmental Policy Act (NEPA) did not apply to the action (Federal Register, 2022). Pursuant to 40 CFR 1506.3(b)(2), Caltrans was a cooperating agency on this project. Therefore, recirculation of the document is not necessary under Section 1506.3(c) of the Council on Environmental Quality (CEQ) regulations.

This airplane will have a novel or unusual design feature when compared to the technology envisaged by the airworthiness standards for transport category airplanes. This design feature is an integral rear center tank (RCT). The applicable airworthiness regulations do not contain adequate or appropriate safety standards for this design feature. These special conditions contain the additional safety standards that the Administrator considers necessary to establish a level of safety equivalent to that established by the existing airworthiness standards.

AD 2021-08-19 requires repetitive general visual inspections for disengaged or damaged decompression panels of the bilge barriers located in the forward and aft cargo compartments, reinstallation of disengaged but undamaged panels, and replacement of damaged panels. Since the FAA issued AD 2021-08-19, new procedures for changing or replacing the bilge barrier assembly in the forward cargo compartment have been developed. This proposed AD would retain the requirements of AD 2021-08-19 and require changing or replacing the bilge barrier assembly in the forward and aft cargo compartments, which would terminate the repetitive inspections. The FAA is proposing this AD to address the unsafe condition on these products.

The FAA is adopting a new airworthiness directive (AD) for all Airbus SAS Model A318, A319, A320, and A321 series airplanes. This AD was prompted by a report that damage (including delamination of the work deck, and corroded and cracked retainer blocks) was found during inspection of certain galleys. This AD requires repetitive inspections of certain galleys for corrosion of trolley retainer aluminum blocks and delamination of the upper panel of the trolley compartment, and applicable corrective action, as specified in a European Union Aviation Safety Agency (EASA) AD, which is incorporated by reference. The FAA proposes to adopt a new airworthiness directive (AD) for all Airbus Helicopters Model AS355E, AS355F, AS355F1, AS355F2, and AS355N helicopters. This proposed AD would also require replacing affected parts with serviceable parts unless already accomplished and prohibit installing an affected part on any helicopter, as specified in a European Union Aviation Safety Agency (EASA) AD, which is proposed for incorporation by reference. Amendment to VOR Federal Airway V-436 and Jet Route J-125, and Establishment of United States Area Navigation Route T-399 in the Vicinity of Clear, AK

This action corrects a final rule published by the FAA in the Federal Register on November 1, 2022, that amends Alaskan VHF Omnidirectional Range (VOR) Federal airway V-436 and Jet Route J-125, and establishes United States Area Navigation (RNAV) route T-399 in the vicinity of Clear, AK. In the final rule, the amendments to V-436 addressed in the preamble were incomplete and did not address all of the airway segment amendments being made. Additionally, the final rule referenced the AILEE, AK, route point as a waypoint (WP), in error, in the V-436 and T-399 amendment discussions in the preamble and in the T- 399 route description in the regulatory text. The correct characterization of the AILEE, AK, route point is as a Fix. This action corrects the oversight of not including all of the V-436 amendments addressed in the preamble to match the V-436 description in the regulatory text and changes all references of the AILEE, AK, WP to the AILEE, AK, Fix to match the FAA's National Airspace System Resource (NASR) database information.
