PLO No. 6952 withdrew approximately 110 acres of National Forest System land from location and entry under the United States mining laws in order to protect the integrity and functionality of the seed orchards, along with the investment of Federal funds at the Peony, Pole Pick, and Frank Burge Seed Orchards. The withdrawal created by PLO No. 6952 will expire on November 11, 2012, unless extended. This notice also gives an opportunity to comment on the proposed action and to request a public meeting.

The Bureau of Land Management (BLM) is removing portions of two regulations in order to characterize accurately the current status of two programs that have been terminated. In the past, the programs reduced royalty rates for stripper well properties and for heavy oil properties, so that Federal lessees would have incentives to keep economically marginal oil wells in production. This rule provides for record retention and correction of errors in calculation of royalties requirements that enable the Office of Natural Resources Revenue (ONRR) to continue to verify that royalties associated with past production were correctly paid.

In accordance with the National Environmental Policy Act of 1969, as amended (NEPA), the Bureau of Land Management (BLM) has prepared a Record of Decision (ROD) for Vegetation Treatments Using Herbicides on Bureau of Land Management Lands in Oregon and by this notice is announcing its availability. The ROD selects a slightly modified version of Alternative 4 as described in the Final Environmental Impact Statement (EIS) for Vegetation Treatments Using Herbicides on Bureau of Land Management Lands in Oregon, notice of which was published in the Federal Register on July 30, 2010 (75 FR 44981). The selected alternative increases the number of herbicides available for use on BLM-managed lands in Oregon and increases the number of objectives for which they can be used. The herbicides and uses permitted by the selected alternative fall entirely within those approved for use in 17 western states by the BLM in its September 2007 ROD for the Final Programmatic EIS for Vegetation Treatments Using Herbicides on BLM lands in 17 Western States. The Oregon decision incorporates the standard operating procedures and mitigation measures adopted by the BLM's 2007 17 western states decision and adds additional mitigation and monitoring requirements specific to Oregon.

The BLM is also proposing to prohibit the possession of an open alcoholic beverage container by operators or passengers in or on either a vehicle or off-highway vehicle, on public land in Idaho administered by the BLM. These supplementary rules are necessary to protect natural resources and the health and safety of public land users. These supplementary rules will allow BLM Law Enforcement personnel to continue enforcing existing public land regulations pertaining to alcohol and drug use in a manner consistent with current State of Idaho Statutes.

The Bureau of Land Management (BLM) in Idaho is proposing a supplementary rule that would require anyone bringing or anyone feeding or storing forage or straw on BLM-administered land when using BLM public lands in Idaho to use certified noxious-weed-free forage and straw. Restoration, rehabilitation, and stabilization projects also will be required to use weed-free straw bales and mulch for project work. This action is a cooperative effort between the BLM, the U.S. Forest Service (USFS), and the Idaho State Department of Agriculture (ISDA), and supports Idaho State noxious weed laws.

This final rule amends the Bureau of Land Management (BLM) mineral resources regulations to update some fees that cover the BLM's cost of processing certain documents relating to its mineral programs and some filing fees for mineral-related documents. These updates include fees for actions such as lease renewals and mineral patent adjudications. This rule also moves the oil shale cost recovery fee amounts from the rule text to the general cost recovery fee table so that mineral cost recovery fees can be found in one location.

The Assistant Secretary of the Interior for Land and Minerals Management proposes to withdraw, on behalf of the Bureau of Land Management (BLM), approximately 507 acres of reserved Federal minerals from the United States mining laws including the mineral and geothermal leasing and mineral materials laws, and 332,421 acres of Federal lands from settlement, sale, location, and entry under the public land laws, including the United States mining laws, and the mineral and geothermal and mineral materials laws for a period of 5 years. The withdrawal would protect the lands and preserve the status quo of the lands and mineral estate included in the proposed training land acquisition/ airspace establishment project of the United States Marine Corps (USMC) Air Ground Combat Center (MCAGCC), Twenty-nine Palms, California, pending the processing of an application for withdrawal for military purposes under the Engle Act. The application also includes 43,315 acres of non-Federal lands located within the proposed boundaries of the proposed withdrawal areas, and in the event that they return to Federal ownership in the future, the lands would be subject to the terms and conditions described below. The Federal and non-Federal lands are located in San Bernardino County.
