The Department of the Army announces the availability of an updated ROD for Army Growth and Force Structure Realignment. This ROD explains that the Army has modified previous decisions made in December 2007 to support Army growth and force structure realignment. The Army's decision at the time grew the Army by six Infantry Brigade Combat Teams (IBCTs), eight active component support brigades, and associated growth in smaller combat support and combat service support units required to complement the U.S. Army's overall force structure growth. The decision also relocated two Heavy Brigade Combat Teams (HBCTs) from Europe to the continental United States. This updated ROD details how the Army has modified growth and realignment decisions to better meet operational mission requirements. Specifically, the original decision is being modified by this updated ROD in the following ways:

The Department of the Army proposes to revise its regulations concerning radiation sources on Army land. The Army requires Non-Army agencies (including their civilian contractors) to obtain an Army Radiation Permit (ARP) from the garrison commander to use, store or possess ionizing radiation sources on an Army Installation. For the purpose of this proposed rule, ``ionizing radiation source'' means any source that, if held or owned by an Army organization, would require a specific Nuclear Regulatory Commission (NRC) license or Army Radiation Authorization (ARA). The purpose of the ARP is to protect the public, civilian employees and military personnel on an installation from potential exposure to radioactive sources. The U.S. Army Safety Office which is the proponent for the Army Radiation Safety Program is revising the regulation to reflect the Nuclear Regulatory Commission changes to licensing of Naturally-Occurring and Accelerator-Produced Radioactive Material (NARM). Executive Order 12866 Regulatory Planning and Review and Executive Order 13422 Further Amendment to Executive Order 12866 on Regulatory Planning and Review were followed to rewrite this rule.

In April 2009, the U.S. Army Corps of Engineers, Los Angeles District, Regulatory Division (Corps) in coordination with the Port of Long Beach (POLB) completed and published a joint Final Environmental Impact Statement/Environmental Impact Report (EIS/EIR) for the Middle Harbor Redevelopment Project (Project) in the POLB, including a Draft General Conformity Determination, for the Federal action associated with the Project. Comments were received on the Final EIS and Draft General Conformity Determination until May 3, 2009. A General Conformity Determination was required because Project construction would require Federal action (i.e., issuance of a Corps permit for work and structures in and over navigable waters and discharges of fill into waters of the U.S.) and not all the Federal action's direct and indirect air emissions would be below specified de minimis thresholds (40 CFR 93.153(b)). Preparation of a Programmatic Environmental Impact Statement (PEIS) for the Stationing and Operation of Joint High Speed Vessels (JHSVs)

The Army intends to prepare a PEIS for the proposed stationing and operation of up to 12 JHSVs. The JHSV is a strategic transport vessel that is designed to support the rapid transport of Army Soldiers, other military personnel and equipment in the U.S. and abroad. The PEIS will assess the potential environmental impacts associated with the proposed stationing of JHSVs at the following military port locations: Virginia Tidewater area; San Diego, CA area; Seattle-Tacoma, WA area; Pearl Harbor, HI area; and Guam. These locations were selected based on the following criteria: sites have existing military port facilities that do not require new infrastructure construction or improvements; sites have existing maintenance facilities for up to, but not including, depot level facilities for major JHSV repairs and maintenance; and sites are capable of supporting the strategic needs of the nation's Combatant Commanders. Not all of the proposed ports will receive JHSVs and other viable locations raised during public scoping may be considered as stationing sites. The Army's Record of Decision will make the determination as to which of the potential sites will serve as home port locations.
