Presidential Academies for American History and Civics Education; Congressional Academies for Students of American History and Civics Education
The Secretary announces a waiver of the requirements in 34 CFR 75.250 and 75.261(c)(2) of the Education Department General Administrative Regulations (EDGAR), as they apply to projects funded under the Presidential Academies for American History and Civics Education, and 34 CFR 75.261(c)(2), as it applies to the project funded under the Congressional Academies for Students of American History and Civics Education program. These regulations, respectively, generally prohibit project periods exceeding five years and any project period extensions involving the obligation of additional Federal funds. A waiver will extend the project period for 24 months through fiscal year (FY) 2012 for the two current five-year grants funded under the Presidential Academies for American History and Civics Education program and the one current three-year grant funded under the Congressional Academies for Students of American History and Civics Education program. These grantees will continue to receive additional Federal funds (from the FY 2010 appropriation for the program).

Impact Aid Programs
The Secretary proposes to amend the regulations governing the Impact Aid Discretionary Construction Program, which is authorized under section 8007(b) of the Elementary and Secondary Education Act of 1965, as amended (ESEA). Through this program, the Department provides competitive grants for emergency repairs and modernization of school facilities to certain eligible local educational agencies (LEAs) that receive Impact Aid formula funds. The proposed regulations amend a provision regarding the submission of applications for these Federal funds, which the Department believes will improve the administration and distribution of funds under this program. The proposed regulations would apply to the grant competitions after the competition for fiscal year (FY) 2009 funds.
Office of Postsecondary Education; Asian American and Native American Pacific Islander-Serving Institutions (AANAPISI), Native American-Serving Nontribal Institutions (NASNTI), Hispanic Serving Institutions-STEM and Articulation (HSI-STEM), and Predominantly Black Institutions (PBI) Programs
On December 7, 2009, we published in the Federal Register (74 FR 64059-64062) a notice inviting applications for eligibility for the programs authorized under Titles III and Title V of the Higher Education Act of 1965, as amended (FY 2010 Eligibility Notice). The FY 2010 Eligibility Notice established a January 6, 2010 deadline date for applicants to apply for designation as an eligible institution under the Title III and Title V programs.

The Assistant Secretary for Special Education and Rehabilitative Services establishes a priority under the Special Demonstration Programs to fund a project to identify, develop, and implement a model demonstration project to improve outcomes for individuals receiving Social Security Disability Insurance (SSDI) served by State vocational rehabilitation (VR) agencies. The Assistant Secretary may use this priority for competitions in fiscal year (FY) 2010 and later years. We take this action to improve employment outcomes for SSDI beneficiaries receiving services from State VR agencies.

The Assistant Secretary for Vocational and Adult Education announces a final priority, requirements, and selection criteria for the Promoting Rigorous Career and Technical Education Programs of Study program. Secretary's Priorities for Discretionary Grant Programs
The Secretary of Education proposes priorities that the Department of Education (Department) may use for any appropriate discretionary grant program in fiscal year (FY) 2011 and future years. We take this action to focus Federal financial assistance on expanding the number of programs and projects Department-wide that support activities in areas of greatest educational need. We are establishing these priorities on a Department-wide basis. This action will permit all offices in the Department to use, as appropriate for particular discretionary grant programs, one or more of these priorities in any discretionary grant competition. We also propose definitions of key terms used in these proposed priorities.
