Arbitration Panel Decision Under the Randolph-Sheppard Act
The Department of Education (Department) gives notice that, on August 28, 2008, an arbitration panel rendered a decision in the matter of Teresa Alcorn v. Kentucky Office for the Blind, Case no. R-S/07-3. This panel was convened by the Department under 20 U.S.C. 107d-1(a), after the Department received a complaint filed by the petitioner, Teresa Alcorn.
Discretionary Grant Programs
The Secretary announces the continued usein fiscal year (FY) 2009of priorities that the Department of Education (Department) previously established for use in any discretionary grant program competition in FY 2007 and FY 2008. We take this action in order to continue to focus Federal financial assistance on expanding the number of programs and projects that support activities in areas of greatest educational need. We are continuing the use of these priorities on a Department-wide basis so that Department offices can use one or more of them in any discretionary grant competition, as appropriate.

Impact Aid Programs
The Secretary amends regulations governing the Impact Aid program under Title VIII of the Elementary and Secondary Education Act of 1965 (Act), as amended by the No Child Left Behind Act of 2001. The program, in general, provides assistance for maintenance and operations costs to local educational agencies (LEAs) that are affected by Federal activities. These amended regulations are necessary to clarify and improve the administration of payments under section 8002 of the Act relating to the Federal acquisition of real property.

On June 26, 2008, we published in the Federal Register (73 FR 36305) a notice inviting applications for the Statewide Longitudinal Data Systems FY 2009 competition. That notice established a September 25, 2008, deadline date for eligible applicants to apply for funding under this program. As a result of the notice published on June 26, 2008, 34 eligible entities submitted applications. A number of applicants, however, experienced difficulty with submitting their applications electronically, and, as a result, a few applications were received shortly after the original deadline. In order to ensure fairness and afford as many eligible applicants as possible an opportunity to be considered for funding under this program, we are reopening the Statewide Longitudinal Data Systems FY 2009 competition to eligible applicants that were not able to submit applications by the original deadline date. Thus, we will consider as received timely, all of the applications we received through Grants.gov to this date, and will consider as timely any additional applications or amendments submitted through paper submission by the new deadline date established in this notice. All information in the June 26, 2008 notice remains the same for new applications and revisions to previously submitted applications submitted in response to this reopening notice, except for the following updates to the DATES section and section V. Submission of Applications.

Office of Special Education and Rehabilitative Services; List of Correspondence
The Secretary is publishing the following list pursuant to section 607(f) of the Individuals with Disabilities Education Act (IDEA). Under section 607(f) of the IDEA, the Secretary is required, on a quarterly basis, to publish in the Federal Register a list of correspondence from the U.S. Department of Education (Department) received by individuals during the previous quarter that describes the interpretations of the Department of the IDEA or the regulations that implement the IDEA.
Compliance Agreement
This notice is being published in the Federal Register consistent with section 457(b)(2) of the General Education Provisions Act (GEPA). Section 457 of GEPA authorizes the U.S. Department of Education (the Department) to enter into a compliance agreement with a recipient that is failing to comply substantially with Federal program requirements. In order to enter into a compliance agreement, the Department must determine, in written findings, that the recipient cannot comply with the applicable program requirements until a future date and that a compliance agreement is a viable means of bringing about such compliance. On August 29, 2008, the Department entered into a compliance agreement with the Hawaii Department of Education (HIDOE). Section 457(b)(2) of GEPA requires the Department to publish written findings leading to a compliance agreement, with a copy of the compliance agreement, in the Federal Register.

Privacy Act of 1974, as Amended; Computer Matching Program
Pursuant to the Privacy Act of 1974, as amended (Privacy Act) (5 U.S.C. 552a), the Office of Management and Budget (OMB) Final Guidance Interpreting the Provisions of Public Law 100-503, the Computer Matching and Privacy Protection Act of 1988, 54 FR 25818 (June 19, 1989), and OMB Circular A-130, Appendix I, notice is hereby given of the renewal of the computer matching program between the U.S. Department of Education (ED) (the recipient agency) and the U.S. Department of Veterans Affairs (VA) (the source agency). After the ED and VA Data Integrity Boards approve a new computer matching agreement (CMA), the computer matching program will begin on the effective date as specified in the CMA and as indicated in paragraph 5 of this notice. In accordance with the Privacy Act and applicable OMB guidance, the following information is provided: 1. Names of Participating Agencies. The U.S. Department of Education and the U.S. Department of Veterans Affairs. 2. Purpose of the Match. The purpose of this matching program between ED and VA is to verify the veteran's status of applicants for financial assistance under Title IV of the Higher Education Act of 1965, as amended, (HEA), who claim to be veterans. The Secretary of Education is authorized by the HEA to administer the Title IV programs and to enforce the terms and conditions of the HEA. Section 480(c)(1) of the HEA defines the term ``veteran'' to mean ``any individual who (A) has engaged in the active duty in the United States Army, Navy, Air Force, Marines, or Coast Guard; and (B) was released under a condition other than dishonorable.'' (20 U.S.C. 1087vv(c)(1)). Under section 480(d)(1)(D) of the HEA, an applicant who is a veteran (as defined in section 480(c)(1)) is considered an independent student for purposes of Title IV, HEA program assistance eligibility, and therefore does not have to provide parental income and asset information to apply for Title IV, HEA program assistance. (20 U.S.C. 1087vv(d)(1)(D)). 3. Authority for Conducting the Matching Program. ED is authorized to participate in the matching program under sections 480(c) and 480(d)(1)(D) of the HEA (20 U.S.C. 1087vv(c)(1) and (d)(1)(D)). VA is authorized to participate in the matching program under 38 U.S.C. 523. 4. Categories of Records and Individuals Covered by the Match. ED will provide the Social Security number and other identifying information of each applicant who indicates that he or she is a veteran. This information will be disclosed from the Federal Student Aid Application File system of records (18-11-01), which was published in the Federal Register (see 64 FR 30106, 30159 (June 4, 1999), as amended by 64 FR 72383, 72407 (December 27, 1999), and corrected by 65 FR 11294 (March 2, 2000) and 66 FR 18758 (April 11, 2001)). ED will disclose this information to VA pursuant to routine use no. 16, as added by the notice correcting this system of records published on April 11, 2001 (66 FR 18758). The ED data will be matched against data in the Veterans and Beneficiaries Identification and Records Location Subsystem-VA (38VA21) system of records, consistent with routine use no. 21, as added to that system of records by a notice published in the Federal Register on June 4, 2001 (66 FR 30049-50). 5. Effective Dates of the Matching Program. The matching program will be effective on the last of the following dates: (1) December 24, 2008, the day after the expiration of the current computer matching agreement; (2) thirty (30) days after notice of the matching program described in the CMA has been published in the Federal Register; or (3) forty (40) days after a report concerning the matching program has been transmitted to OMB and transmitted to Congress along with a copy of the CMA, unless OMB waives 10 days of this 40-day period for compelling reasons shown, in which case 30 days after transmission of the report to OMB and Congress. The matching program will continue for 18 months after the effective date of the CMA and may be extended for an additional 12 months thereafter, if the conditions specified in 5 U.S.C. 552a(o)(2)(D) have been met. 6. Office of Postsecondary Education, International Education Programs Service
The Department expects to hold competitions for grants under the above-referenced Title VI programs for FY 2009 and FY 2010. This notice provides information about a two-day technical assistance workshop to assist institutions of higher education interested in preparing grant applications for new awards under these programs. The International Education Programs Service staff, other Department staff, as well as guest speakers, will present information about the purpose of the Title VI programs, the selection criteria used to evaluate grant applications, data collection and performance reporting requirements, evaluation, the peer review process, submitting applications on the Grants.gov Apply site, guidance for preparing the application narrative and budget, competition priorities, if any, and other technical assistance topics. Although the Department has not yet announced application deadline dates in the Federal Register, the Department is conducting this workshop to provide potential applicants with information they will need for preparing grant applications for competitions we expect to conduct for FY 2009 and FY 2010 new awards. Specific requirements for these competitions will be published in separate Federal Register notices. This notice announces the technical assistance workshop only.
