Readiness and Emergency Management for Schools Grant Program

The Assistant Deputy Secretary for Safe and Drug-Free Schools proposes priorities and requirements for the Readiness and Emergency Management for Schools (REMS) grant program. The Assistant Deputy Secretary may use one or more of these priorities or requirements for competitions in fiscal year (FY) 2009 and later years. The REMS program was established in FY 2003 to provide resources to local educational agencies (LEAs) to supportimproving and enhancing emergency management plans. Since the initial competition, the program has undergone several program refinements designed to respond to changes in the emergency management field and the identification of key emergency management priorities. In an effort to continue to refine the REMS program, we are publishing these revised priorities and requirements. We propose this action in order to focus Federal financial assistance on supporting grants that will increase the capacity of LEAs to prevent and mitigate, prepare for, respond to, and recover from emergencies. This action is also intended to focus funding on LEAs that have not previously received funding under this program and to establish other core program requirements.

The Assistant Deputy Secretary for Innovation and Improvement announces selection criteria under the Teaching American History Grant (TAH) Program. The Assistant Secretary may use these selection criteria for competitions in fiscal year (FY) 2009 and later years. We take this action to provide the Secretary with the flexibility to use selection criteria (i) Established for the TAH Program in the notice of final selection criteria and other application requirements, published in the Federal Register on April 15, 2005 (70 FR 19939) (2005 Notice); (ii) from the menu of general selection criteria in the Education Department General Administrative Regulations (EDGAR) in 34 CFR 75.210; (iii) based on statutory provisions in accordance with 34 CFR 75.209; or (iv) from any combination of (i) through (iii) for competitions in fiscal year (FY) 2009 and in subsequent years. We intend that this choice of selection criteria will provide greater flexibility to evaluate TAH Program applications.

On December 2, 2008, the Department of Education, the Department of the Treasury, and the Office of Management and Budget (collectively, ``Secretaries and Director'') jointly published a notice in the Federal Register (73 FR 73263) announcing the terms and conditions under which the Department will purchase loans pursuant to section 459A of the Higher Education Act of 1965, as amended (HEA), enacted by the Ensuring Continued Access to Student Loans Act of 2008 (Pub. L. 110-227) and amended by Public Law 110-315 and Public Law 110- 350 (December 2 Notice). The terms and conditions announced in the December 2 Notice apply to the purchase of Federal Family Education Loan Program (``FFELP'') loans made for the 2007-2008 academic year (the ``Short-term Purchase Program''). Included as an appendix to the December 2 Notice was the Master Loan Sale Agreement under which these purchases will be made. This notice makes three corrections to the December 2 Notice.

Family Educational Rights and Privacy

The Secretary amends our regulations implementing the Family Educational Rights and Privacy Act (FERPA), which is section 444 of the General Education Provisions Act. These amendments are needed to implement a provision of the USA Patriot Act and the Campus Sex Crimes Prevention Act, which added new exceptions permitting the disclosure of personally identifiable information from education records without consent. The amendments also implement two U.S. Supreme Court decisions interpreting FERPA, and make necessary changes identified as a result of the Department's experience administering FERPA and the current regulations. These changes clarify permissible disclosures to parents of eligible students and conditions that apply to disclosures in health and safety emergencies; clarify permissible disclosures of student identifiers as directory information; allow disclosures to contractors and other outside parties in connection with the outsourcing of institutional services and functions; revise the definitions of attendance, disclosure, education records, personally identifiable information, and other key terms; clarify permissible redisclosures by State and Federal officials; and update investigation and enforcement provisions.

Federal Family Education Loan Program (FFELP)

Under the authority of section 459A of the Higher Education Act of 1965, as amended (``HEA''), as enacted by the Ensuring Continued Access to Student Loans Act of 2008 (Pub. L. 110-227) and amended by Pub. L. 110-315 and Pub. L. 110-350, the Department of Education (``Department'') may purchase, or enter into forward commitments to purchase, Federal Family Education Loan Program (``FFELP'') loans made under sections 428 (subsidized Stafford loans), 428B (PLUS loans), or 428H (unsubsidized Stafford loans) of the HEA, on such terms as the Secretary of Education (``Secretary''), the Secretary of the Treasury, and the Director of the Office of Management and Budget (collectively, ``Secretaries and Director'') jointly determine are ``in the best interest of the United States'' and ``shall not result in any net cost to the Federal Government (including the cost of servicing the loans purchased).'' The Secretary initially exercised this authority in accordance with a notice published in the Federal Register on July 1, 2008 (73 FR 37422). This notice (a) establishes the terms and conditions that will govern certain additional loan purchases made under section 459A of the HEA, as extended by Pub. L. 110-350 (Short-term Purchase Program), (b) outlines the methodology and factors that have been considered in evaluating the price at which the Department will purchase these additional FFELP loans, and (c) describes how the use of those factors and methodology will ensure that the additional loan purchases do not result in any net cost to the Federal Government. The Secretaries and Director concur in the publication of this notice and have jointly determined that the purchase of additional loans as described in this notice is in the best interest of the United States and shall not result in any net cost to the Federal Government (including the cost of servicing the loans purchased).

Notice Inviting Proposals for Ownership and Operation of the Online English Literacy Portal, “U.S.A. Learns Web Portal”

The President announced, as one of his initiatives to address border security and immigration challenges in the United States, a plan to have the U.S. Department of Education (Department) develop and launch a free, web-based portal to help immigrants learn English to help them expand their opportunities and make effective contributions to American society. To implement the President's plan, the Department's Office of Vocational and Adult Education (OVAE), as authorized by the Adult Education and Family Literacy Act and through a contract, has developed and created the U.S.A. Learns Web Portal, an online learning environment designed for limited English proficient (LEP) adults whose level of English proficiency is at a low level. The portal was launched on November 7, 2008, on the Internet and is available for use by the public at no cost. The portal is available at the following Web address: https://www.usalearns.org. The Department plans to turn over ownership and operation of the portal to one or more entities outside of the Federal Government that would, with its or their own resources, continue the maintenance and upkeep of the portal, make improvements to it, and continue to make the portal available at no cost to the public. Through this notice, we are inviting proposals from entities interested in owning and operating the portal.

The Secretary issues final regulations governing the Assistance to States for Education of Children with Disabilities Program and the Preschool Grants for Children with Disabilities Program. These regulations are needed to clarify and strengthen current regulations in 34 CFR Part 300 governing the Assistance to States for the Education of Children with Disabilities Program and Preschool Grants for Children with Disabilities Program, as published in the Federal Register on August 14, 2006, in the areas of parental consent for continued special education and related services; non-attorney representation in due process hearings; State monitoring, technical assistance, and enforcement; and allocation of funds. The regulations also incorporate a statutory requirement relating to positive efforts to employ and advance in employment individuals with disabilities that was inadvertently omitted from the 2006 regulations.
