SUPPLEMENTARY INFORMATION: Requests
to speak at the hearing may be
submitted in writing or by telephone.
The Board asks that commentators
describe the nature and scope of their
oral presentation. Those who contact
the Board prior to close of business on
December 4, 2008, will be scheduled for
time slots, beginning at approximately
12 p.m. The Board will post a schedule
for those speakers who have contacted
the Board before the hearing. The
posting will be made at the entrance to
the Public Hearing Room at the start of
the 9 a.m. hearing and meeting. Anyone
who wishes to comment or provide
technical information or data may do so
in writing, either in lieu of, or in
addition to, making an oral
presentation. The Board Members may
question presenters to the extent
deemed appropriate. Documents will be
accepted at the meeting or may be sent
to the Board’s Washington, DC office.
The Board will hold the record open
until January 6, 2009, for the receipt of
additional materials. A transcript of the
meeting will be made available by the
Board for inspection by the public at the
Board’s Washington office and at DOE’s
public reading room at the DOE Federal
Building, 1000 Independence Avenue,
SW., Washington, DC 20585. The Board
specifically reserves its right to further
schedule and otherwise regulate the
course of the meeting and hearing, to
recess, reconvene, postpone, or adjourn
the meeting and hearing, conduct
further reviews, and otherwise exercise
its power under the Atomic Energy Act
of 1954, as amended.

3506 of the Paperwork Reduction Act of
1995 (44 U.S.C. Chapter 35) requires
that the Office of Management and
Budget (OMB) provide interested
Federal agencies and the public an early
opportunity to comment on information
collection requests. OMB may amend or
waive the requirement for public
consultation to the extent that public
participation in the approval process
would defeat the purpose of the
information collection, violate State or
Federal law, or substantially interfere
with any agency’s ability to perform its
statutory obligations. The IC Clearance
Official, Regulatory Information
Management Services, Office of
Management, publishes that notice
containing proposed information
collection requests prior to submission
of these requests to OMB. Each
proposed information collection,
grouped by office, contains the
following: (1) Type of review requested,
e.g. new, revision, extension, existing or
reinstatement; (2) Title; (3) Summary of
the collection; (4) Description of the
need for, and proposed use of, the
information; (5) Respondents and
frequency of collection; and (6)
Reporting and/or Recordkeeping
burden. OMB invites public comment.
The Department of Education is
especially interested in public comment
addressing the following issues: (1) Is
this collection necessary to the proper
functions of the Department; (2) will
this information be processed and used
in a timely manner; (3) is the estimate
of burden accurate; (4) how might the
Department enhance the quality, utility,
and clarity of the information to be
collected; and (5) how might the
Department minimize the burden of this
collection on the respondents, including
through the use of information
technology.
