The Secretary proposes to amend the Department's regulations regarding the production of information pursuant to demands in judicial or administrative proceedings. The changes are intended to promote consistency in the Department's assertion of privileges and objections, and thereby prevent harm that may result from inappropriate disclosure of confidential information or inappropriate allocation of agency resources. These changes would apply only where employees are subpoenaed in litigation to which the agency is not a party. Former Department employees would be expressly required to seek the Secretary's approval prior to responding to subpoenas that seek non- public materials and information acquired during their employment at the Department.
Models of Exemplary, Effective, and Promising Alcohol or Other Drug Abuse Prevention Programs on College Campuses

The Assistant Deputy Secretary for Safe and Drug-Free Schools proposes a priority, definitions, requirements, and selection criteria under the Models of Exemplary, Effective, and Promising Alcohol or Other Drug Abuse Prevention Programs on College Campuses grant competition. The Assistant Deputy Secretary may use the priority, definitions, requirements, and selection criteria for competitions in fiscal year (FY) 2008 and later years. The Assistant Deputy Secretary intends to use the priority, definitions, requirements, and selection criteria to identify exemplary, effective, and promising campus-based alcohol or other drug abuse prevention programs and to disseminate information about exemplary and effective programs to other colleges and universities where similar efforts may be adopted.

Developing Hispanic-Serving Institutions Program

The Secretary intends to use the grant slate developed for the HSI Program authorized by Title V of the Higher Education Act of 1965, as amended, in FY 2007 to make new Individual Development grant awards in FY 2008. The Secretary takes this action because a significant number of high-quality applications remain on last year's grant slate. The Administration has requested $94,914,000 for the HSI program for FY 2008, of which we intend to use an estimated $13,408,000 for new awards. The actual level of funding for the FY 2008 program, if any, depends on final Congressional action. No Cooperative Development grant awards will be made from the FY 2008 appropriation for this program. The College Cost Reduction and Access Act of 2007 (CCRAA) has provided $100 million for grants to Hispanic-serving institutions for Science, Technology, Engineering, or Mathematics (STEM) and articulation programs in each of the FYs 2008 and 2009. Further information about the criteria and priorities applicable to these awards and the Secretary's plans for conducting the FY 2008 competition under the CCRAA, including workshops, will be forthcoming.

The Secretary of Education requests comments on a modified 2008-2009 Application for Federal Student Aid (FAFSA). The College Cost Reduction and Access Act of 2007 establishes, effective with the 2008- 2009 award year, the Teacher Education Assistance for College and Higher Education (TEACH) Grant program, which provides up to $4,000 a year in grant assistance to students who plan on being a teacher and meet certain specified requirements. Through an updated FAFSA, Federal Student Aid will assure that students are aware of the TEACH Grant program, the program's eligibility criteria, and that students will indicate their plans to pursue a teaching career. The Department proposes to accomplish this by asking the following question on the FAFSA on the Web: ``Are you planning on completing coursework, now or in the future, necessary for you to become an elementary or secondary school teacher? A `YES' response to this question will allow your school to provide you with additional information on a new federal program for students who meet certain conditions and plan on becoming teachers.'' The FAFSA is completed by students and their families and the information submitted on the form is used to determine the students' eligibility and financial need for financial aid under the student financial assistance programs authorized under Title IV of the Higher Education Act of 1965, as amended (Title IV, HEA Programs).

The Assistant Secretary for Special Education and Rehabilitative Services may use this priority for competitions in fiscal year (FY) 2008 and later years. We take this action to focus attention on an area of national need. We intend this priority to improve postsecondary education and other outcomes for individuals with intellectual disabilities.

In the chart on page 66150, ninth column, the ``Project Period'' for the 84.325D Preparation of Leadership Personnel competition is incorrectly listed as ``up to 60 months''. The project period for this competition is corrected to read ``up to 48 months''.

Privacy Act of 1974; System of Records-Migrant Student Information Exchange

In accordance with the Privacy Act of 1974, as amended (Privacy Act), the Department of Education (Department) publishes this notice of a new system of records entitled ``Migrant Student Information Exchange'' (MSIX) (18-14-04). MSIX will contain information on migrant students who participate in the Migrant Education Program (MEP) authorized under Title I, Part C of the Elementary and Secondary Education Act of 1965 (ESEA), as amended by the No Child Left Behind Act of 2001 (Pub. L. 107-110). Section 1308(b)(2) of ESEA (20 U.S.C. 6398(b)(2)) specifically authorizes the implementation of MSIX and its associated minimum data elements (MDEs). This statutory provision requires the Secretary to ensure the linkage of migrant student record systems for the purpose of electronically exchanging, among the States, health and educational information regarding all migratory students.
