Removal of Low-Activity Contamination

The Defense Logistics Agency announces the availability of the Finding of No Significant Impact (FONSI) for the removal of low- activity contamination resulting from storage of radioactive source material in the National Defense Stockpile of strategic and critical materials. Stockpiles of commodities containing source material have been removed from DNSC depots at Curtis Bay, MD and Hammond, IN. At the Curtis Bay Depot, the commodities containing source material (columbium/tantalum, thorium nitrate, tungsten ore and concentrates, thorium hydroxide, thorium oxide, monazite sand, uranium pitchblende ore, and sodium sulfate) were previously stored in 16 of the original 59 warehouses. Since the middle 1980s, over 19,000 drums of thorium nitrate were stored in three warehouses. Previously the thorium nitrate stockpile was stored for short periods in six other warehouses on the site. At the Hammond Depot, the commodities containing source material (columbium/tantalum, thorium nitrate, monazite sands, sodium sulfate, and tungsten ore and concentrates) were previously stored in two of the three warehouses on the site. Cleanup of any residual contamination from storage of the commodities containing source material is one task DNSC must complete before its Nuclear Regulatory Commission license can be terminated. Following evaluation of reasonable alternatives conducted by Oak Ridge National Laboratory on behalf of DNSC, DNSC will remove residual contamination and transfer the contaminants to a regulated disposal site. This disposal will be performed in a manner that will be safe, secure, and environmentally sound and minimizes radiation exposure and potential for risk to workers, the public, and the environment.

Realistic Bomber Training Initiative

On March 20, 2007, the United States Air Force signed a Record of Decision for the Realistic Bomber Training Initiative Supplemental Environmental Impact Statement. This decision was based on information, analysis, and public comments contained in both the Environmental Impact Statement for the Realistic Bomber Training Initiative (Federal Register Notice of Availability February 4, 2000) and the Supplemental Environmental Impact Statement for the Realistic Bomber Training Initiative (Federal Register Notice of Availability published August 11, 2006), along with other relevant factors. After carefully considering the issues addressed in the Supplemental Environmental Impact Statement and the comments submitted, the Air Force decided not to change the decision described in the initial Record of Decision and to continue implementation of Alternative B of the Realistic Bomber Training Initiative. This alternative includes the use of appropriate training assets associated with Instrument Route IR-178/Lancer Military Operations Area. As indicated above, a Notice of Availability of the Final Supplemental Environmental Impact Statement was published in the Federal Register on August 11, 2006 (Volume 71, Number 155, Page 46220). The required 30-day waiting period for a Record of Decision has been completed.

Designates the Secretary of Army as the DoD executive agent for: Support to Boy Scout and Girl Scout local councils and organizations in areas outside of the United States; support for the national Boy Scout jamboree; the annual DoD audit of the American Red Cross (ARC) accounts and the subsequent report to Congress; and necessary ARC deployment support. It also designates the Secretary of the Air Force as the DoD Executive Agent for conducting the Armed Forces Entertainment program. It will have minimal impact on the public.

TRICARE; Expansion of Geographic Scope of the TRICARE Retiree Dental Program (TRDP)

This proposed rule expands the geographic scope of the TRICARE Retiree Dental Program (TRDP) to overseas locations not currently covered by the program. At this time, TRDP is only applicable in the 50 United States and the District of Columbia, Canada, Puerto Rico, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and the U.S. Virgin Islands. Expanding the geographic scope of the program will ensure that all TRICARE-eligible retirees are eligible for the same dental benefits, regardless of their location. There are no additional Government costs associated with this proposed expansion of TRDP overseas as TRDP costs are borne entirely by enrollees through premium payments.

The Department of Defense manages the CCR on behalf of the IAE. The primary objective of the CCR is to provide a web-based application that provides a single source of vendor information in support of the contract award and the electronic payment process of the Federal Government. The CCR is also a registration system for grants and assistance awards. The Department of the Navy is amending its certifications and exemptions under the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), to reflect that the Deputy Assistant Judge Advocate General (Admiralty and Maritime Law) has determined that USS SAMPSON (DDG 102) is a vessel of the Navy which, due to its special construction and purpose, cannot fully comply with certain provisions of the 72 COLREGS without interfering with its special function as a naval ship. The intended effect of this rule is to warn mariners in waters where 72 COLREGS apply.

The Department of Defense (the Department or DoD) proposes to amend our regulations by adding a new part to implement the consumer protections covered by Public Law 109-364, the John Warner National Defense Authorization Act for Fiscal Year 2007, section 670, ``Limitations on Terms of Consumer Credit Extended to Service Members and Dependents'' (October 17, 2006). Section 670 of Public Law 109-364 created 10 U.S.C. 987 and requires the Secretary of Defense to prescribe regulations to carry out the new section. The proposed regulation is intended to regulate the terms of consumer credit extended by creditors to active duty service members and their dependents.

Time: 9 a.m. to 3 p.m. Proposed Agenda: The actions that will take place include the approval of minutes from the Board of Regents Meeting held February 5, 2007; acceptance of administrative reports; approval of faculty appointments and promotions; and the awarding of post-baccalaureate degrees as follows: Doctor of Medicine, Masters of Science in Nursing, and masters and doctoral degrees in the biomedical sciences and public health. The President, USU; Dean, USU School of Medicine; Acting Dean, USU Graduate School of Nursing; and Director, Armed Forces Radiobiology Research Institute will also present reports. These actions are necessary for the University to remain an accredited medical school and to pursue its mission, which is to provide outstanding health care practitioners and scientists to the uniformed services.

The Strategic Advisory Group (SAG) will meet in closed session on 8-10 May 2007. The mission of the SAG is to provide timely advice on scientific, technical, intelligence, and policy-related issues to the Commander, U.S. Strategic Command, during the development of the Nation's strategic war plans. Full development of the topics will require discussion of information classified in accordance with Executive Order 12958, dated April 17, 1995. Access to this information must be strictly limited to personnel having requisite security clearances and specific need-to- know. Unauthorized disclosure of the information to be discussed at the SAG meeting could have exceptionally grave impact upon national defense. In accordance with Section 10(d) of the Federal Advisory Committee Act (5 U.S.C. App.), it has been determined that this SAG meeting concerns matters listed in 5 U.S.C. Section 552b(c)(1), and that, accordingly, this meeting will be closed to the public.

Under the provisions of the Federal Advisory Committee Act of 1972, (5 U.S.C. Appendix, as amended), the Sunshine in the Government Act of 1976 (5 U.S.C. 552b, as amended), and 41 CFR 102-3.65, the Department of Defense gives notice that it is renewing the charter for the Board of Regents of the Uniformed Services University of the Health Sciences (hereafter referred to as the Board of Regents). The Board of Regents, pursuant to 10 U.S.C. 2113, is a non- discretionary Federal advisory committee established to assist the Secretary of Defense in an advisory capacity in carrying out the Secretary's responsibility to conduct the business of the Uniformed Services University of the Health Sciences. While 10 U.S.C. 2113(a) does not provide precise objectives and scope for the Board of Regents' assistance to the Secretary of Defense, past practice has been for the Board of Regents to assist in the areas of advice on academic and administrative matters that are critical to the full accreditation and successful operation of the University. Specific DoD expectations are outlined in DoD Instruction 5105.45 and in bylaws and policies developed by the Board of Regents. Pursuant to 10 U.S.C. 2113(a), the Board of Regents is composed of: (a) Nine persons in the fields of health and health education who shall be appointed from civilian life by the President, by and with the advice and consent of the Senate; (b) the Secretary of Defense, or his designee, who shall be an ex officio member; (c) the surgeons general of the uniformed services, who shall be ex officio members; and (d) the Dean of the University, who shall be a nonvoting ex officio member. The terms of the office for those members appointed by the President pursuant to 10 U.S.C. 2113(b) shall be six years except that: (a) any member appointed to fill a vacancy occurring before the expiration of the term for which his predecessor was appointed shall be appointed for the remainder of such term; (b) the terms of office of the members first taking office shall expire, as designated by the President at the time of the appointment; and (c) any member whose term of office has expired shall continue to serve until his successor is appointed. The President shall designate one appointed member of the Board of Regents to serve as Chair. Members of the Board of Regents who are not full-time or permanent part-time Federal employees shall serve as Special Government Employees under the authority of 5 U.S.C. 3109, and, pursuant to 10 U.S.C. 2113(e), shall receive compensation of no more than $100 per day, as determined by the Secretary of Defense, in addition to travel expenses and per diem while serving away from their place of residence. The Board of Regents shall meet at the call of the Designated Federal Officer, in consultation with the Chair and the President of the University. The Designated Federal Officer shall be a full-time or permanent part-time DoD employee, and shall be appointed in accordance with established DoD policies and procedures. The Designated Federal Officer or Alternate Designated Federal Officer shall attend all Board of Regents' meetings and subcommittee meetings. The Board of Regents is authorized to establish subcommittees and workgroups, as necessary and consistent with its mission. Board of Regents subcommittees and workgroups shall operate under the provisions of 5 U.S.C., Appendix, as amended, the Sunshine in the Government Act of 1976 (5 U.S.C. 552b, as amended) and other appropriate Federal regulations. Board of Regents subcommittees and workgroups shall not work independently of the Board of Regents and shall report all their recommendations and advice to the Board of Regents for full deliberation and discussion. Board of Regents subcommittees and workgroups have no authority to make decisions on behalf of the Board of Regents and may not report directly to the Department of Defense or any Federal officers or employees who are not Board of regents members. Pursuant to 41 CFR 102-3.105(j) and 102-3.140, the public or interested organizations may submit written statements to the Board of Regents about its mission and functions. Written statements should be submitted to the advisory committee's Designated Federal Officer for consideration by the membership of the Board of Regents. In accordance with Section 204 of the 1950 Flood Control Act (Pub. L. 516, 81st Congress, 2nd Session), as recommended by the Chief of Engineers in House Document Number 585, 81st Congress, 2nd Session, the Coyote Dam (also known as the ``Lake Mendocino Project''), Ukiah, CA, is authorized to be raised 36 feet to a total storage capacity of 199,000 acre-feet (ac-ft) when the need for additional water supply arises. Since construction of Coyote Dam, increased development of Mendocino County and the accelerated rate of sedimentation in Lake Mendocino have resulted in the need for additional water supply. The additional storage capacity achieved by raising the dam would address future demands on water supply and also increase flood damage reduction functions. This is a notice of intent to prepare a joint environmental Impact Statement/Environmental Impact Report (EIS/EIR), and to consider all reasonable alternatives, evaluate potential impacts of the proposed action, and identify appropriate mitigation measures. The U.S. Army Corps of Engineers (Corps) is the lead agency for this project under the National Environmental Policy Act (NEPA), and the Mendocino County Inland Water and Power Commission (IWPC) is the lead agency and local sponsor under the California environmental quality Act (CEQA).

The U.S. Army Corps of Engineers (COE), Wilmington District, Wilmington Regulatory Division has received a request for Department of the Army authorization, pursuant to Section 404 of the Clean Water Act, from Western Wake Partners to construct Western Wake Regional Wastewater Management Facilities. This project will be a regional wastewater pumping, conveyance, treatment, and discharge project to serve the Towns of Apex, Cary, Holly Springs and Morrisville, as well as the Wake County portion of Research Triangle Park (service area), NC. The project is being proposed by the Western Wake Partners to provide wastewater service for planned growth and development in the project service area and to comply with two regulatory mandates. One regulatory mandate has been issued by the North Carolina Environmental Management Commission (EMC), and the second regulatory mandate has been issued by the North Carolina Department of Environment and Natural Resources (NC DENR). In accordance with the two regulatory mandates, the proposed Project must be operational and discharging effluent to the Cape Fear River Basin by January 1, 2011.

The Transformation Advisory Group (TAG) will meet in closed session on 6-8 June 2007. The establishment date was already published in the Federal Register on 28 May 2003, in accordance with 41 CFR 102- 3.150. The mission of the TAG is to provide timely advice on scientific, technical and policy-related issues to the Commander, U.S. Joint Forces Command as he develops and executes the DOD transformation strategy. Full development of the topics will require discussion of information classified in accordance with Executive Order 12958, dated 17 April 1995, as amended March 2003. Access to the information must be strictly limited to personnel having the requisite clearances and specific need-to-know. Unauthorized disclosure of the information to be discussed at the TAG meetings could cause serious damage to our national defense. The meeting will be closed for security reasons, pursuant to 5 U.S.C. 552, Exemption(b)1, Protection of National Security, and Exemption(b)3 regarding information protected under the Homeland Security Act of 2002. In accordance with Section 10(d) of the Federal Advisory Committee Act and 41 CFR 102-3.155 this meeting will be closed.

The purpose of the Committee meeting is to introduce new members and conduct briefings for the Commissioners. The meeting is open to the public, subject to the availability of space. Interested persons may submit a written statement for consideration by the Committee and make an oral presentation of such. Persons desiring to make an oral presentation or submit a written statement to the Committee must notify the point of contact listed below no later than 11 April 2007. Oral presentations by members of the public will be permitted only on 14 April at 1 to 2:45 p.m. before the full Committee. Presentations will be limited to 5 minutes.
