This notice announces a public notice of the signing of a Memorandum of Understanding (MOU) between the U.S. Department of Defense and the U.S. Fish and Wildlife Service to Promote the Conservation of Migratory Birds. Pursuant to Executive Order 13186 (January 17, 2001), ``Responsibilities of Federal Agencies to Protect Migratory Birds,'' this MOU outlines a collaborative approach to promote the conservation of migratory bird populations. This MOU identifies specific activities where cooperation between the Parties will contribute substantially to the conservation of migratory birds and their habitats. It does not authorize the ``take'' of migratory birds. Take, as defined in 50 CFR 10.12, includes the pursuit, hunting, shooting, wounding, killing, trapping, capturing, collecting, or attempting to pursue, hunt, shoot, wound, kill, trap, capture, or collect. The Corps of Engineers, Nashville District intends to prepare a Draft Environmental Impact Statement (DEIS) for a regional water supply project in Cumberland County, TN. This DEIS is necessary to provide National Environmental Policy Act (NEPA) coverage for a proposed regional water supply system capable of providing the county a reliable water supply for 50 years. The county is currently served by six water systems and development of individual water sources has been problematic from an environmental perspective. The county's current water supply capacity is approximately ten million gallons per day. A regional approach has been recommended to allow more efficient planning to develop future water supplies in an environmentally acceptable manner.
TRICARE Program; TRICARE Prime Remote for Active Duty Family Members and TRICARE Prime Enrollment Period

This final rule implements 10 U.S.C. 1079(p), as added by section 722(b) of the Floyd D. Spence National Defense Authorization Act for Fiscal Year 2001. The rule provides coverage for medical care for active duty family members who reside with an active duty member of the Uniformed Services assigned to remote areas and eligible for the program known as TRICARE Prime Remote. Active duty family members who enroll in TRICARE Prime Remote for Active Duty Family Members (TPRADFM) will enjoy benefits generally comparable to TRICARE Prime enrollees including access standards, benefit coverage, and cost-shares. This final rule also implements Section 702 of the NDAA for FY 2003, which establishes circumstances under which dependents of Reserve Components and National Guard members called to active duty in support of contingency operations may enroll in TRICARE Prime Remote for Active Duty Family Members, and dependents of TRICARE Prime Remote service members may remain enrolled when the service member receives orders for an unaccompanied follow-on assignment. Finally, this final rule establishes circumstances under which eligible beneficiaries may enroll in TRICARE Prime for a period of less than 1 year.

Notice of Intent To Prepare an Environmental Impact Statement for the Transfer of Cannon Air Force Base and Melrose Air Force Range From Air Combat Command to Air Force Special Operations Command

In accordance with the National Environmental Policy Act (NEPA) of 1969 (42 U.S.C. 4321-4347), the Council on Environmental Quality (CEQ) NEPA Regulations (40 Code of Federal Regulations [CFR] parts 1500-1508), and the United States Air Force's (USAF) Environmental Impact Analysis Process (EIAP, 32 CFR part 989), the Air Force is preparing an EIS to consider the proposed action of transferring certain Air Force Special Operations equipment and personnel to Cannon AFB. The Air Force proposes to transfer aircraft and personnel from Hurlburt Field, Florida, or other existing operational locations to Cannon AFB, New Mexico. Potential AFSOC assets to beddown include aircraft, weapons systems, equipment, and personnel. Growth is planned through Fiscal Year 2013 at Cannon AFB, and AFSOC proposes to begin utilizing Melrose Air Force Range (AFR), existing training airspace, and existing Military Training Routes from Cannon AFB. This NOI describes the Air Force's scoping process and identifies the Air Force's point of contact. As part of the proposal, the Air Force will analyze potential environmental impacts associated with the proposed aircraft, equipment, and personnel transfer, beddown, training, and operations. Background: On June 19, 2006, in accordance with the 2005 Defense Base Closure and Realignment Commission Report, the SECDEF designated the AFSOC's establishment of the 16th Special Operations Wing at Cannon AFB, beginning October 2007, as the new mission for that base. The EIS will analyze the impacts of that proposed action on the environment. AFSOC is considering what aircraft and other equipment to base at Cannon AFB, how best to utilize existing facilities, and what facilities will need to be modified or built. The proposed action will consider moving approximately 90 aircraft and approximately 3,500 personnel to the base. It is possible that additional facilities may need to be constructed at Melrose AFR. The impacts from the proposed actions will be considered in the EIS. In addition, the EIS will also address alternatives to the proposed action, including a ``no action'' alternative. Because the proposed action is to be taken as the result of the BRAC directive to the SECDEF to designate a new mission for Cannon AFB, the basing/installation alternative will be limited to the confines of Cannon AFB and Melrose AFR; however, the airspace alternatives will include Melrose AFR, surrounding Military Training Routes and Military Operations Areas (MOAs) including the Mt Dora MOA, Pecos MOA Complex and Bronco MOA.

TRICARE; Reserve and Guard Family Member Benefits

This proposed rule would implement sections 704 and 705 of the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005. These provisions would apply to eligible family members who become eligible for TRICARE as a result of their Reserve Component (RC) sponsor (including those with delayed effective date orders up to 90 days) being called or ordered to active duty for more than 30 days in support of a federal/contingency operation and choose to participate in TRICARE Standard or Extra, rather than enroll in TRICARE Prime. The first provision would provide the Secretary the authority to waive the annual TRICARE Standard (or Extra) deductible, which is set by law (10 U.S.C. 1079(b)) at $150 per individual and $300 per family ($50/$150 for families of members in pay grades E-4 and below). The second provision would provide the Secretary the authority to increase TRICARE payments up to 115 percent of the TRICARE maximum allowable charge, less the applicable patient cost share if not previously waived under the first provision, for covered outpatient health services received from a provider that does not participate (accept assignment) with TRICARE. These provisions would help ensure timely access to health care and maintain clinically appropriate continuity of health care to family members of Reservists and Guardsmen activated in support of a federal/contingency operation; limit the out-of-pocket health care expenses for those family members; and remove potential barriers to health care access by Guard and Reserve families.

The Port of Los Angeles requires authorization pursuant to Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act for wharf and terminal development (142 acres) in three phases, dredging up to 41,000 cubic yards of sediment, construction of two new concrete pile-supported wharves (for a total of 2,500 feet), new terminal buildings and two new terminal bridges.

The Army Installation Management Agency and the Fort Irwin National Training Center will prepare a PEIS to analyze the impacts of mission realignment in support of the Army Transformation, the Army Campaign Plan, and other Army initiatives. Under the proposed action, the 11th Armored Cavalry Regiment will expand to become a full-size, multi-component Heavy Brigade Combat Team (BCT), deployable throughout the world. Other, smaller units will also be stationed at Fort Irwin. Training rotations will increase from 10 per year to 12. The PEIS will evaluate the new construction, new land use, and changes in training, area use necessary to implement the proposed action at Fort Irwin.
