On December 10, 2010 (75 FR 77380-77447), DoD published a notice of approval of a personnel management demonstration project for eligible ONR employees. Within that notice, there were several typographical errors discovered. Additionally, after the publication of the notice and implementation of the demonstration project, ONR determined that for effective personnel management practices, amendments need to be made to provide better consistency in the use of the extended probationary periods for newly hired employees, and to more thoroughly cite the waivers to regulations required to apply these extended probationary periods. Amendments must also be made to better define minimally successful performance for assignments involving displacement, and to remove the requirement that advancements in certain Pay Bands need Executive Director's approval. This notice makes the required corrections and amendments.

It establishes policy for the use of supplemental educational assistance (hereafter referred to as ``kickers'') for Service members with critical skills or specialties, or for members serving additional service; for authorizing the transferability of education benefits (TEB); and the DoD Office of the Actuary to perform determinations in support of DoD funding responsibilities.

This proposed rule would establish an exception to the usual rule that TRICARE Prime enrollment fees are uniform for the group of retirees and their dependents. Survivors and medically retired members are part of the retiree group under TRICARE rules. This exception would allow Survivors of Active Duty Deceased Sponsors and Medically Retired Uniformed Services Members and their Dependents enrolled in Prime to be exempt from future increases in TRICARE Prime enrollment fees. The Prime beneficiaries in these categories prior to 10/1/2013 would have their annual enrollment fee frozen at their current annual rate (FY 2011 rate $230 per single or $460 per family, FY 2012 rate $260 or $520, or the FY 2013 rate $269.38 or $538.56). The beneficiaries added to these categories on or after 10/1/2013 would have their fee frozen at the rate in effect at the time they are classified in either category and enroll in Prime or, if not enrolling, at the rate in effect at the time of enrollment. The fee remains frozen as long as at least one family member remains enrolled in Prime and there is not a break in enrollment. The fee charged for the dependent(s) of a Medically Retired Uniformed Services Member would not change if the dependent(s) was later re-classified a Survivor.

Revocation of Statement of Policy on Public Participation in Rule Making

The U.S. Department of Agriculture (USDA) is proposing to rescind the Statement of Policy titled ``Public Participation in Rule Making,'' published in the Federal Register on July 24, 1971 (36 FR 13804) that requires agencies in USDA to follow the Administrative Procedure Act's (APA) notice-and-comment rulemaking procedures even in situations where the APA does not require it. The Statement of Policy implemented a 1969 recommendation by the Administrative Conference of the United States (ACUS), which urged Congress to amend the APA to remove the exemption from the notice-and-comment requirement for rulemakings relating to ``public property, loans, grants, benefits, or contracts,'' adding that agencies should follow the notice-and-comment procedures pending amendment of the APA. In proposing to rescind the Statement of Policy, USDA notes that in the more than 40 years since ACUS made its recommendation, Congress has not amended the APA to implement it. Moreover, USDA has determined in this time that the advantages of implementing the ACUS recommendation do not outweigh the disadvantages, such as increased costs and delayed implementation imposed on USDA programs. The proposed change would not result in USDA forgoing notice-and-comment rulemaking for all regulatory actions relating to public property, loans, grants, benefits, or contracts, rather the proposed change would grant USDA agencies the discretion to determine the appropriateness of notice-and- comment rulemaking for this class of rulemakings.

Section 342(b) of the National Defense Authorization Act (NDAA) for Fiscal Year (FY) 1995, as amended by section 1109 of NDAA FY 2000 and section 1114 of NDAA FY 2001, authorizes the Secretary of Defense to conduct personnel demonstration projects at Department of Defense (DoD) laboratories designated as Science and Technology Reinvention Laboratories (STRLs). The above-cited legislation authorizes DoD to conduct demonstration projects to determine whether a specified change in personnel management policies or procedures would result in improved Federal personnel management. This notice makes changes to the ECBC Personnel Management Demonstration Project. It includes revisions to the annual review for supervisory/team leader base pay adjustments and adds clarification of the waiver to 5 U.S.C. 7512(4), amends procedures for recruiting and filling positions above the minimum of the pay band; and eliminates within grade increase (WGI) buy-ins for certain personnel actions.

The Department of the Interior and the California Department of Fish and Wildlife have prepared a final environmental impact statement and environmental impact report (EIS/EIR) evaluating the potential effects of removing four privately owned dams on the Klamath River in southern Oregon and northern California should the Secretary of the Interior determine that removal will advance restoration of salmonid fisheries in the Klamath Basin and is in the public interest. The Department of the Interior has released the final EIS/EIR pursuant to the requirements of the National Environmental Policy Act and the Klamath Hydroelectric Settlement Agreement. The California Department of Fish and Wildlife is not releasing the document at this time, therefore there is no action under California Environmental Quality Act at this time. Additionally, no decision on the potential removal of these facilities is being made with the release of this document.

In accordance with the Privacy Act of 1974, the Department of Homeland Security (DHS) proposes to update and reissue a Department of Homeland Security system of records titled Department of Homeland Security/National Protection and Programs Directorate001 Arrival and Departure Information System (ADIS) System of Records (72 FR 47057, August 22, 2007). This system of records allows the Department of Homeland Security to collect and maintain records on individuals throughout the immigrant and non-immigrant pre-entry, entry, status management, and exit processes. With the publication of this updated system of records, the following changes are being made: (1) A new category of records is being added; (2) the record source categories are being updated; and (3) administrative updates are being made globally to comply with the Consolidated and Further Continuing Appropriations Act of 2013, which transfers the United States Visitor Indicator Technology (US-VISIT) program's biometric identity management functions to the Office of Biometric Identity Management (OBIM), a newly created office within DHS/National Protection and Programs Directorate (NPPD). The exemptions for the existing system of records notice will continue to be applicable for this updated system of records notice and this system will be continue to be included in the Department of Homeland Security's inventory of record systems. In accordance with the Privacy Act of 1974, the Department of Homeland Security, U.S. Customs and Border Protection proposes to update and reissue a current Department of Homeland Security system of records titled, ``Department of Homeland Security, U.S. Customs and Border Protection-007Border Crossing Information System of Records.'' This system of records allows U.S. Customs and Border Protection to collect and maintain records on border crossing information for all individuals who enter, are admitted or paroled into, andwhere availableexit from the United States, regardless of method or conveyance. This border crossing information includes certain biographical information; a photograph; certain itinerary information mandated or provided on a voluntary basis by air, sea, bus, and rail carriers or any other forms of passenger transportation; and the time and location of the border crossing. A Final Rule exempting portions of this system from certain provisions of the Privacy Act was published on February 3, 2010 (75 FR 5491). As part of DHS's ongoing effort to increase transparency regarding its collection of information, DHS/CBP is updating (1) the categories of individuals to include persons entering Canada from the United States, (2) the categories of records to include border crossing data from Canada, (3) the sources of information to include data provided by the Canada Border Services Agency (CBSA), and (4) the routine uses to include the sharing of border crossing information with Canada. Additional routine uses were edited for clarity and for ease of use and understanding. In addition, DHS/CBP made non-substantive edits to the exemptions to ensure clarity. DHS/CBP is updating this system of records notice to provide notice of the Beyond the Border (BTB) Entry/Exit Program with Canada. Through the Entry/Exit, the United States and Canada will exchange border crossing information about certain third-country nationals, permanent residents of Canada, and lawful permanent residents of the United States, at all automated land border ports of entry. The exemptions for the existing system of records notice (July 25, 2008, 73 FR 43457) will continue to apply for this updated system of records notice and DHS will include this system in its inventory of record systems. Dates and Comments: Submit comments on or before June 27, 2013. In particular, comments are requested concerning the application of the exemptions to the newly added categories of individuals, categories of records, routine uses, and sources of information for this system. This updated system will be effective June 27, 2013.
