The FHWA is issuing this notice to advise the public that 12 States have rescinded Notices of Intent (NOI) to prepare 17 Environmental Impact Statements (EISs) for proposed highway projects. FHWA Division Offices, in consultation with the State Departments of Transportation (State DOT), determined that eight projects were no longer viable and have formally cancelled the projects. No resources will be expended on these projects; the environmental review process has been terminated. Seven projects are being reevaluated and, or have been reduced in scope and now meet the criteria for an Environmental Assessment (EA) or a Categorical Exclusion (CE). Two projects rescinded NOIs and will issue new NOIs as the project limits and impacts have changed.

The American Recovery and Reinvestment Act of 2009 (ARRA), provides the State Departments of Transportation and Federal Lands Agencies with $27.5 billion for highway infrastructure investment. With these funds also comes an increased level of data reporting with the stated goal of improving transparency and accountability at all levels of government. According to President Obama, ``Every American will be able to hold Washington accountable for these decisions by going online to see how and where their tax dollars are being spent.'' The Federal Highway Administration (FHWA) in concert with the Office of the Secretary of Transportation (OST) and the other modes within the U.S. Department of Transportation (DOT) will be taking the appropriate steps to ensure that this accountability and transparency is in place for all infrastructure investments.

The Federal Highway Administration (FHWA) and Federal Transit Administration (FTA) issue this final rule that modifies our regulations to make certain changes mandated by the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU). SAFETEA-LU prescribes additional requirements for environmental review and project decisionmaking that are not appropriately reflected in the existing FHWA-FTA joint National Environmental Policy Act (NEPA) procedures. Additionally, this final rule creates certain new categorical exclusions (CE) allowing proposed actions to proceed without an environmental assessment (EA) or environmental impact statement (EIS), and makes other minor changes to the joint procedures in order to improve the description of the procedures or to provide clarification with respect to the interpretation of certain provisions.

Section 6005 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) established the Surface Transportation Project Delivery Pilot Program, codified at 23 U.S.C. 327. To ensure compliance by each State participating in the Pilot Program, 23 U.S.C. 327(g) mandates semiannual audits during each of the first 2 years of State participation. This final report presents the findings from the second FHWA audit of the California Department of Transportation (Caltrans) under the pilot program.

The FHWA is issuing this notice to advise the public that an Environmental Impact Statement will be prepared for the improvement of North Second Street in Memphis, Tennessee. The project begins at Interstate 40 and extends north to the intersection of U.S. 51 and Whitney Avenue. The FHWA issued a notice to advise the public that the Notice of Intent published on November 7, 2002, to prepare an Environmental Impact Statement (EIS) for the proposed North Second Street project in Memphis, Tennessee was being rescinded. This Notice to rescind the previously published Notice of Intent was published in the Federal Register on Wednesday, December 24, at 73 FR 79203. An EIS has not been completed for this proposed project since the original NOI was issued to the Federal Register on November 7, 2002. Since the limits of the project have been extended and other changes have occurred, a new EIS will be prepared.
