Agency Information Collection Activity Under OMB Review
The Federal Transit Administration invites public comment about our intention to request the Office of Management and Budget's (OMB) approval to renew the following information collection: Transit Research, Development, Demonstration and Deployment Projects The information collected is necessary to determine eligibility of applicants and ensure mass transportation service at a minimum cost. The Federal Register notice with a 60-day comment period soliciting comments was published on July 9, 2012 (Citation 77 FR 40409). No comments were received from that notice.
Americans With Disabilities Act: Proposed Circular Chapter, Vehicle Acquisition
The Federal Transit Administration (FTA) has placed in the docket and on its Web site proposed guidance in the form of a circular chapter to help transportation providers ensure that the buses and rail cars they acquire meet the requirements of the U.S. Department of Transportation's (DOT) Americans with Disabilities Act (ADA) regulations. This proposed chapter on vehicle acquisition is the first in a series of approximately 12 chapters that will compose a complete ADA circular. By public notice, FTA invites public comment on this proposed circular chapter and suggestions for specific issues to cover in future chapters.
Clean Fuels Grant Program, Augmented With Discretionary Bus and Bus Facilities Program Funds
The U.S. Department of Transportation's (DOT) Federal Transit Administration (FTA) announces the selection of projects for the Clean Fuels Grant program enhanced with Section 5309 Bus and Bus Facilities program funds. On February 7, 2012, FTA published a Notice of Funding Availability (NOFA) for its Clean Fuels Grant program (77 FR 6178). The NOFA explained the requirements and procedures for eligible applicants to apply for the funds made available by the Surface and Air Transportation Programs Extension Act of 2011. In sum, the FY 2012 Clean Fuels Grant Program made available approximately $51.5 million in unallocated Section 5308 Clean Fuels Grant Program funds. As outlined in the NOFA, the Section 5308 funds would be awarded to fund projects in non-attainment and maintenance areas in achieving or maintaining the National Ambient Air Quality Standards for ozone and carbon monoxide and supports emerging clean fuel and advanced propulsion technologies for transit buses and markets for those technologies. Projects in attainment areas were also eligible to apply and if funding was available, would be funded with Section 5309 Bus and Bus Facilities funds.
Environmental Impact and Related Procedures
This NPRM provides interested parties with the opportunity to comment on proposed changes to the Federal Highway Administration (FHWA) and the Federal Transit Administration (FTA) joint procedures that implement the National Environmental Policy Act (NEPA). The revisions are prompted by enactment of Public Law 112-141, 126 Stat. 405, the Moving Ahead for Progress in the 21st Century Act (MAP-21). This NPRM proposes to modify an existing categorical exclusion (CE) for emergency repair projects under 23 U.S.C. 125 to include emergency projects as described in Section 1315 of MAP-21. This NPRM also requests comments on whether additional activities ought to be expressly included in the CE, consistent with the principles underlying emergency projects and sound transportation asset management. The FHWA and the FTA seek comments on the proposals contained in this notice.
Notice of Intent To Prepare an Environmental Impact Statement for a Light Rail Operations and Maintenance Satellite Facility, King and Snohomish Counties, Washington
The Federal Transit Administration (FTA) and the Central Puget Sound Regional Transit Authority (Sound Transit) are planning to prepare an Environmental Impact Statement (EIS) for Sound Transit's proposed new Light Rail Operations and Maintenance Satellite Facility (OMSF). The OMSF would allow Sound Transit to meet future maintenance and storage needs of an expanded fleet of light rail vehicles identified in the Sound Transit 2 (ST2) Plan. The EIS will be prepared in accordance with the National Environmental Policy Act (NEPA) and Washington's State Environmental Policy Act (SEPA). This Notice of Intent initiates scoping for the EIS, invites interested parties to participate in the EIS process, provides information about the preliminary purpose and need for the proposed transit project, includes site alternatives being considered for evaluation in the EIS, and identifies potential environmental effects to be considered. The notice invites public comments on the scope of the EIS and announces the public scoping meetings that will be conducted. Alternatives being considered for evaluation include a No-Build alternative and five sites where the OMSF could be built.
Notice of Meeting of the Transit Rail Advisory Committee for Safety (TRACS)
This notice announces a public meeting of the Transit Rail Advisory Committee for Safety (TRACS). TRACS is a Federal Advisory Committee established by the Secretary of Transportation in accordance with the Federal Advisory Committee Act to provide information, advice, and recommendations to the Secretary and the Federal Transit Administrator on matters relating to the safety of public transportation systems.
Notice of Request To Rescind Buy America Waiver for Minivans and Minivan Chassis; Extension of Comment Period
Chrysler Group LLC has requested that the comment period be extended for thirty (30) days, until October 4, 2012, on the Vehicle Production Group LLC's (VPG) request for the Federal Transit Administration (FTA) to rescind the Buy America non-availability waiver it issued on June 21, 2010, for minivans and minivan chassis. FTA disagrees that a 30-day extension is necessary to adequately provide comments on VPG's request. However, in order to ensure that FTA obtains a comprehensive and in-depth understanding of a potential rescission of this Buy America waiver and its effects, which necessarily involves input from all interested and affected parties, FTA is extending the comment period until September 11, 2012.
Intent To Prepare an Environmental Impact Statement and Environmental Assessment for the I-20 East Transit Initiative in the City of Atlanta and DeKalb County, GA
The Federal Transit Administration (FTA) and the Metropolitan Atlanta Rapid Transit Authority (MARTA) intend to prepare an Environmental Impact Statement (EIS) for MARTA's I-20 East Transit Initiative project, which would extend the existing east-west rail line from the Indian Creek Station to the Mall at Stonecrest in eastern DeKalb County and an Environmental Assessment (EA) for a new Bus Rapid Transit (BRT) service along I-20 between downtown Atlanta and a new station at Wesley Chapel Road, east of I-285 in DeKalb County. The EIS and EA will be prepared in accordance with the National Environmental Policy Act (NEPA), provisions of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), and will also address the requirements of other federal and state environmental laws. The extension of the existing MARTA east-west rail line and the new BRT service along I-20 were selected as the Locally Preferred Alternative (LPA) based on a two year Detailed Corridor Analysis (DCA) completed in April 2012. The DCA revisited the analysis and conclusions of the I-20 East Corridor Study Alternatives Analysis (AA) completed in 2004 and complied with FTA's New Starts project development process. The purpose of this Notice of Intent (NOI) is to advise interested agencies and the public regarding the plan to prepare the EIS and EA, to provide information on the nature of the proposed transit project, to invite participation in the NEPA process, including comments on the scope of the EIS and EA proposed in this notice, and to announce where and when public scoping meetings will be conducted. Scoping meetings are an opportunity for government agencies, affected stakeholders, and the general public to provide input and feedback on the project Purpose and Need, the alternatives to be studied, as well as to identify any significant physical, cultural, natural, and social environmental issues within the study area.
FY 2012 Discretionary Funding Opportunity: Paul S. Sarbanes Transit in Parks Program
The Federal Transit Administration (FTA) announces the availability of approximately $12 million in Paul S. Sarbanes Transit in Parks Program (Transit in Parks Program) discretionary funds in Fiscal Year (FY) 2012. FTA announced the allocation of $13.5 million in FY 2012 Transit in Parks Program funds in the Federal Register on February 3, 2012. This notice solicits proposals to compete for program funds that have been appropriated since that date and may include additional funds made available after this notice is published. The Transit in Parks Program was established by Section 3021 of SAFETEA-LU, as amended (49 U.S.C. 5320), and was repealed, effective October 1, 2012, by the most recent transportation authorization, Moving Ahead for Progress in the 21st Century (MAP-21). This announcement solicits proposals for the final allocation of program funding, as defined above. The program is administered by FTA in partnership with the Department of the Interior and the U.S. Department of Agriculture's Forest Service. The Transit in Parks Program funds capital and planning expenses for alternative transportation systems such as buses, trams and non- motorized trails in federally managed parks and public lands. Federal land management agencies, as well as State, tribal and local governments, acting with the consent of a Federal land management agency, are eligible to apply. DOI, after consultation with and in cooperation with FTA, will determine the final selection and funding of projects. Geographic diversity will be considered when allocating funds. This announcement is available on the FTA Web site at: https:// www.fta.dot.gov. FTA will announce final selections on the Web site and in the Federal Register. A synopsis of this funding opportunity will be posted in the FIND module of the government-wide electronic grants Web site at https://www.grants.gov.
Title VI; Final Circular
The Federal Transit Administration (FTA) has placed in the docket and on its Web site, guidance in the form of a Circular to assist grantees in complying with Title VI of the Civil Rights Act of 1964. The purpose of this Circular is to provide recipients of FTA financial assistance with instructions and guidance necessary to carry out the U.S. Department of Transportation's Title VI regulations (49 CFR part 21).

Early Scoping Notification for the Alternatives Analysis of the Tacoma Link Expansion in Tacoma, WA
The Federal Transit Administration (FTA) and the Central Puget Sound Regional Transit Authority (Sound Transit) issue this early scoping notice to advise other agencies and the public that they intend to explore potential alternatives for expanding the existing Tacoma Link light rail transit system in Tacoma, Pierce County Washington, in order to improve connections to the regional transit system and major activity centers. This notice invites the public to help frame the upcoming alternatives analysis by commenting on: the project's purpose and need, the transportation problems to be addressed by the study, potential solutions to the problems, the relevant transportation and community impacts and benefits to be considered, the appropriate extent of the study area, and ways for the public to participate in the alternatives analysis process. The alternatives analysis is likely to conclude with the identification of a preferred mode and corridor. If preparation of an environmental Impact Statement (EIS) is warranted following completion of the planning alternatives analysis, FTA will publish a Notice of Intent to prepare an EIS. This early scoping process is intended to support the alternatives analysis and a future National Environmental Policy Act (NEPA) scoping process, as appropriate. In addition, it supports FTA planning requirements associated with the New Starts (``Section 5309'') funding program for certain kinds of major capital investments. While recent legislation may lead to changes in the New Starts process, Sound Transit will comply with relevant FTA requirements relating to planning and project development to help it analyze and screen alternatives in preparation for NEPA. Public meetings are described immediately below. Following that is a more detailed discussion of the project and this early scoping process.
The National Center for Mobility Management Under FTA's National Research Program
Federal Transit Administration (FTA), as the primary staff agency to the Federal Interagency Coordinating Council on Access and Mobility (CCAM), is releasing an Announcement of Funding Opportunities (Announcement) to promote mobility managementa customer-focused approach to transportation service delivery. FTA, under its National Research Program, plans to fund a National Center for Mobility Management (NCMM) which will carry-out activities to further mobility management and to improve and enhance the coordination of Federal resources for human service transportation.
Notice of Request to Rescind Buy America Waiver for Minivans and Minivan Chassis
The Vehicle Production Group LLC (VPG) has asked the Federal Transit Administration (FTA) to rescind the Buy America non- availability waiver it issued on June 21, 2010, for minivans and minivan chassis. According to VPG, it manufactures minivans and minivan chassis that comply with all Buy America requirements under 49 CFR 661.11, including the final assembly requirement that was the subject of the June 2010 waiver. FTA seeks public comment before deciding whether to grant the request. If granted, the waiver would no longer apply; all minivans and minivan chassis purchased with federal funds would have to comply with the final assembly requirement of 49 CFR 661.11.
Preparation of an Environmental Impact Statement for the Redlands; Passenger Rail Project in the Cities of San Bernardino and Redlands, CA
FTA and San Bernardino Associated Governments (SANBAG) intend to prepare an EIS/EIR for the Redlands Passenger Rail Project (RPRP or Project). Early in 2012, FTA and SANBAG began the preparation of an Environmental Assessment (EA)/EIR for the RPRP and conducted two scoping meetings; one on April 24 in the City of Redlands and the other on May 2 in the City of San Bernardino. Based on the input received from the community, including written comment letters, and preliminary findings from ongoing technical studies, FTA determined that an EIS is required. The EIS/EIR will be prepared in accordance with regulations implementing the National Environmental Policy Act (NEPA: 42 U.S.C. 4321 et seq.) of 1969 and the regulations implementing NEPA set forth in 40 CFR Parts 1500-1508 and 23 CFR Part 771, as well as provisions of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU). The purpose of this Notice is to: Advise the public that FTA is the lead Federal agency; Provide information about the proposed project, purpose and need for the project, and alternatives to be considered; and Invite public and agency participation in the EIS process. The EIS/EIR will examine alternatives to provide a cost-effective, alternative travel option for communities located along the Redlands Corridor in a way that improves transit mobility, travel times, and corridor safety.
Intent To Prepare an Environmental Impact Statement for Proposed Transit Improvements to the North Red and Purple Lines, Cook County, IL
On January 3, 2011, the Federal Transit Administration (FTA), as the lead federal agency, and the Chicago Transit Authority (CTA) published a Notice of Intent (NOI) to prepare an Environmental Impact Statement (EIS) for the North Red and Purple Line Modernization (RPM) Project in Cook County, Illinois. The purpose of this supplemental NOI is to inform interested parties that the EIS will no longer be a Tier 1 EIS as originally proposed. The methodology and format will now be a standard project-level EIS. All other aspects (Location, Purpose and Need, Alternatives, Scoping, and Possible Effects) of the original NOI remain unchanged. Activities conducted to date pursuant to the original NOI will not be impacted or reexamined. The proposed project, described more completely in the January 3, 2011 NOI, would bring the North Red and Purple lines up to a state of good repair from the track structure immediately north of Belmont Station in Chicago to the Linden terminal in Wilmette, Illinois. Materials describing the project purpose and need and the alternatives proposed for analysis are available on the CTA Web site www.transitchicago.com/rpmproject. The CTA operates the rapid transit system in metropolitan Chicago, Illinois.

Designation of Transportation Management Areas
The Federal Transit Administration (FTA) and the Federal Highway Administration (FHWA) are announcing that all urbanized areas (UZAs) with populations greater than 200,000 as determined by the 2010 Census are hereby designated as Transportation Management Areas (TMAs). The FTA and FHWA are taking this action in compliance with the agencies' authorizing statutes, 23 U.S.C. 134, and 49 U.S.C. 5303. This action supersedes the agencies' designations of TMAs made in the Federal Register on July 8, 2002, at 67 FR 45173.

Environmental Justice: Final Circular
The Federal Transit Administration (FTA) has placed in the docket and on its Web site final guidance in the form of a Circular (hereinafter ``EJ Circular'') on incorporating environmental justice principles into plans, projects, and activities that receive funding from FTA. This final guidance provides recommendations to State Departments of Transportation, Metropolitan Planning Organizations, public transportation providers, and other recipients of FTA funds on how to fully engage environmental justice populations in the public transportation decision-making process; how to determine whether environmental justice populations would be subjected to disproportionately high and adverse human health or environmental effects as a result of a transportation plan, project, or activity; and how to avoid, minimize, or mitigate these effects.

Supplemental Draft Environmental Impact Statement for the Central Corridor Light Rail Transit Project, Minneapolis and Saint Paul, MN
The Federal Transit Administration (FTA) as the federal lead agency, in cooperation with the Metropolitan Council, is issuing this notice of intent (NOI) to advise interested parties that it proposes to prepare a Supplemental Draft Environmental Impact Statement (SDEIS) for the Central Corridor Light Rail Transit (LRT) Project, located in Minneapolis and Saint Paul, Minnesota (Project). The Project is 10.9 miles long and consists of 23 Central Corridor Light Rail Transit (LRT) stations. The SDEIS will evaluate potential impacts on the loss of business revenue during construction of the Central Corridor LRT Project and will be prepared in accordance with the National Environmental Policy Act (NEPA), its implementing regulations, and provisions of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU).

FTA seeks public comment before deciding whether to grant the requests.
Over-the-Road Bus Accessibility Program Grants
The U.S. Department of Transportation's (DOT) Federal Transit Administration (FTA) announces the availability of funds in Fiscal Year (FY) 2012 for the Over-the-Road Bus Accessibility (OTRB) Program, initially authorized by Section 3038 of the Transportation Equity Act for the 21st Century (TEA-21). The OTRB program makes funds available to private operators of over-the-road buses to finance the incremental capital and training costs of complying with DOT's over-the-road bus accessibility regulation. The authorizing legislation calls for national solicitation of proposals, with grantees to be selected on a competitive basis. Program funds are available to intercity fixed-route providers and other OTRB providers at up to 90 percent of the project cost. The Surface and Air Transportation Programs Extension Act of 2011, Public Law 112-30, continues the authorization of the Federal transit programs of the U.S. Department of Transportation (DOT) through March 31, 2012, and provides contract authority for this program equal to approximately one half of the amounts available in FY 2011. Approximately $8.8 million is expected to be available for the OTRB program discretionary allocation and may include other discretionary program funds that become available. The total amount of funding available will be contingent on Congressional authorization and appropriation prior to the selection of awardees, and based on the timing of such funding becoming available, may also include funding appropriated for Fiscal Year 2013.
FTA Section 5307 Urbanized Area Formula Program: Allocation of Funding Caps for Treating Fuel and Electric Utility Costs for Vehicle Propulsion as a Capital Maintenance Expense
The Consolidated and Further Continuing Appropriations Act, 2012 (Pub. L. 112-055) permits the Federal Transit Administration (FTA) to treat fuel costs for vehicle operations, including utility costs for the propulsion of electrical vehicles, as a capital maintenance item for grants made in FY 2012 under the Urbanized Area Formula Program, up to a total of $100,000,000. FTA announced this provision and its implementation in the FTA Fiscal Year 2012 Notice of Apportionments, Allocations, and Program Information, published in the Federal Register on January 11, 2012 (Vol. 77, No. 7 1786-1856). Since total obligations for this purpose are limited to $100,000,000, FTA is limiting the use of funds for this purpose to program recipients that responded to an announcement which was posted at www.grants.gov on January 25 and closed on February 29. Based on the $100,000,000 cap on use of this provision, FTA has allocated funding caps to program recipients that responded to this announcement based on their relative share of the FY 2012 Section 5307/5340 formula apportionment. Recipients are advised that this provision does not provide any funding in addition to their Section 5307/5340 program apportionment.
Intent To Prepare an Environmental Impact Statement on the Durham-Orange Light Rail (LRT) Project, Durham and Orange Counties, NC
The Federal Transit Administration (FTA) and the Research Triangle Regional Public Transportation Authority, dba ``Triangle Transit,'' intend to prepare an Environmental Impact Statement (EIS) to study a proposed premium transit service corridor in Durham and Orange Counties, North Carolina. The EIS will be prepared in accordance with the National Environmental Policy Act (NEPA: 42 U.S.C. 4321 et seq.) of 1969 and the regulations implementing NEPA set forth in 40 CFR Parts 1500-1508 and 23 CFR Part 771, as well as provisions set forth in the Safe, Accountable, Flexible, and Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU). The purpose of this Notice is to: (1) Advise the public that FTA is serving as the lead Federal agency; (2) provide information on the proposed project, purpose and need for the project, and alternatives to be considered; and (3) invite public and agency participation in the EIS process.

The FTA and the Georgia Department of Transportation (GDOT) intend to prepare an Environmental Impact Statement (EIS) for a proposed transit terminal project in Atlanta, Fulton County, Georgia. Notice of Proposed Buy America Waivers
The purpose of this notice is to solicit comment a request from Allison Transmission, Inc. to renew a waiver for its hybrid electric propulsion system, Energy Storage Unit subsystem H 49.40 EPSystem, until December 31, 2013 so they may complete their ongoing process to secure a domestic supplier of Lithium Ion batteries. FTA seeks public comment before deciding whether to grant Allison's request.

The Federal Transit Administration (FTA) announces the availability of Section 5339 Alternatives Analysis program discretionary funds for Fiscal Year (FY) 2012. FTA will distribute these funds in accordance with the mission of this program, consistent with the eligibility requirements of this program, and in support of the U.S. Department of Transportation's (DOT) livability efforts. The Surface and Air Transportation Programs Extension Act of 2011 (Temporary Authorization, 2012), Public Law 112-30, continues the authorization of the Federal transit programs of the U.S. DOT through March 31, 2012. Subject to action by Congress, FTA will fund the Alternatives Analysis program with approximately $25 million of unallocated Section 5339 funds made available by the Temporary Authorization. This notice solicits proposals to compete for FY 2012 funding under the aforementioned program and livability initiative. Contingent on subsequent appropriations by Congress, FTA may also award FY 2013 funds to proposals submitted pursuant to this notice. This notice includes priorities established by FTA for these discretionary funds, the criteria FTA will use to identify meritorious projects for funding, and describes how to apply for funding. Public Transportation on Indian Reservations Program; Tribal Transit Program
The Federal Transit Administration (FTA) announces the availability of approximately $15 million in funding provided by the Public Transportation on Indian Reservations Program (Tribal Transit Program (TTP)) subject to the availability of funds by Congress, a program authorized by Section 3013(c) of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU). This notice is a national solicitation for project proposals and includes the selection criteria and program eligibility information for FY 2012 projects. Major Capital Investment Projects
This notice of proposed rulemaking (NPRM) proposes a new regulatory framework for FTA's evaluation and rating of major new transit investments seeking funding under the discretionary ``New Starts'' and ``Small Starts'' programs. This notice of proposed rulemaking is being published concurrently with a Notice of Availability of proposed guidance that proposes new measures and methods for calculating the project justification and local financial commitment criteria specified in statute and this proposed rule. FTA seeks public comment on both this proposed rule and the proposed guidance.
Notice of Availability of Proposed New Starts/Small Starts Policy Guidance
This notice announces the availability of the Federal Transit Administration's (FTA) Proposed Policy Guidance on New Starts/Small Starts and requests your comments on it. This document compliments the Notice of Proposed Rulemaking for Major Capital Investment Projects by describing the detailed measures proposed for evaluation of projects seeking New Starts and Small Starts funding and the way these measures would be used in project ratings if adopted. The proposed regulations and appendix are intended to act as a framework for the project evaluation and rating process, and the proposed policy guidance fills in the details.

FTA Fiscal Year 2012 Apportionments, Allocations, and Program Information
The Federal Transit Administration (FTA) annually publishes one or more notices apportioning funds appropriated by law. In some cases, if less than a full year of funds is available, FTA publishes multiple partial apportionment notices. This notice is the first notice announcing partial apportionment for programs funded with Fiscal Year (FY) 2012 contract authority because the current authorization of FTA's programs provides contract authority for the period October 1, 2011 through March 31, 2012. Additionally, the Consolidated and Further Continuing Appropriations Act, 2012, provides full-year funding for FTA's programs funded from the General Fund of the United States Treasury, which are Administrative Expenses, the New Starts and Research programs and grants to the Washington Metropolitan Area Transit Authority. The Appropriations Act, 2012 also provides an obligation limitation for the available contract authority and any additional contract authority that Congress may make available this fiscal year. This notice also provides program guidance and requirements; and provides information on several program issues important under the current program authorization. Also included are tables that show certain discretionary program unobligated (carryover) and reapportioned funding from previous years available for obligation during FY 2012.
Intent To Prepare an Environmental Impact Statement on the Bottineau Transitway Project From Minneapolis to Maple Grove in Hennepin County, MN
The FTA, as the lead federal agency, the Hennepin County Regional Railroad Authority (HCRRA), and the Metropolitan Council intend to prepare an EIS for the proposed Bottineau Transitway project located along the Bottineau Transitway Corridor in Hennepin County, Minnesota. The proposed transitway, approximately 13 miles long, would connect downtown Minneapolis with North Minneapolis and the northwest suburbs of the Twin Cities. The transitway would originate in Minneapolis near the existing Target Field Station, where several existing transit lines converge, and would extend to the following suburbs: Robbinsdale, Golden Valley, Crystal, New Hope, Brooklyn Park, Maple Grove, and Osseo. The EIS will be prepared in accordance with Section 102(2)C of the National Environmental Policy Act of 1969 (NEPA) and pursuant to the Council on Environmental Quality's regulations (40 Code of Federal Regulations [CFR] parts 1500- 08), as well as provisions of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU). The purpose of this notice is to alert interested parties of the intent to prepare the EIS; provide information on the proposed transit project; invite public participation in the EIS process, including comments on the scope of the EIS proposed in this notice; and serve as an announcement of public and agency scoping meetings.
