This notice solicits applications for the truck parking initiative for which funding is available under section 1305 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU). SAFETEA-LU directed the Secretary to establish a pilot program to address the shortage of long-term parking for commercial motor vehicles on the National Highway System. States, metropolitan planning organizations (MPOs) and local governments are eligible for the funding available for fiscal years (FY) 2006-2009. Section 1305 allows for a wide range of eligible projects, ranging from construction of spaces and other capital improvements to using intelligent transportation systems (ITS) technology to increase information on the availability of both public and private commercial vehicle parking spaces. For purposes of this program, long-term parking is defined as parking available for 10 or more consecutive hours.

The actions relate to a proposed highway project, the Newberg Dundee Transportation Improvement Project (Tier 1), Oregon 99W, extending approximately 11 miles from the eastern terminus east of Newberg in the Rex Hill area, to the western terminus where Oregon 99W intersects with OR18 (McDougal Corner) west of Dundee, near Dayton in the County of Yamhill, State of Oregon. The Federal actions, taken as a result of a tiered environmental review process under the National Environmental Policy Act, 42 U.S.C. 4321-4351 (NEPA), and implementing regulations on tiering, 40 CFR 1502.20, 40 CFR 1508.28, and 23 CFR part 771, determined certain issues related to the proposed project. Those Tier 1 decisions will be used by Federal agencies in subsequent proceedings, including decisions whether to grant licenses, permits, and approvals for the highway project. Tier 1 decisions also may be relied upon by State and local agencies in proceedings on the proposed project.

The FHWA is revising its regulation that establishes the general requirements for quality assurance procedures for construction on all Federal-aid highway projects on the National Highway System (NHS).\1\ Specifically, the FHWA will require accreditation of laboratories that conduct crash tests on roadside hardware by an accrediting body that is recognized by the National Cooperation for Laboratory Accreditation (NACLA) or is a signatory to an International Laboratory Accreditation Cooperation (ILAC) Mutual Recognition Arrangement (MRA), an Asia Pacific Laboratory Accreditation Cooperation (APLAC) MRA, or another comparable accreditation body approved by FHWA. This rule will improve the agency's ability to determine that crash test laboratories are qualified to conduct and evaluate tests intended to determine the crashworthiness of roadside safety features. Laboratory accreditation is widely recognized as a reliable indicator of technical competence.

As required under section 1604(b)(6) of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), this proposed rule specifies the interoperability requirements for automated toll collection systems for the facilities that are tolled under any of the tolling programs contained in section 1604 of SAFETEA-LU. Specifically, this notice proposes to require facilities operating with authority under section 1604 of SAFETEA-LU to use electronic toll collection systems and for these systems to address their interoperability with other toll facilities. Although a nationwide interoperability standard has not yet been established, this proposed rule seeks to accelerate progress toward achieving nationwide interoperability by requiring these facilities to upgrade their electronic toll collection systems to the national standards whenever adopted. This document also provides notice of public meetings on this proposed regulation.

The FHWA is issuing this notice to advise the public that the Notice of Intent (NOI) issued on August 25, 2000 has been modified. The August, 2000 NOI advised that an Environmental Impact Statement would be prepared in accordance with the National Environmental Policy Act for the proposed highway reconstruction in Teton County, Wyoming. The project limits were comprised of three segments and identified as beginning approximately 6.1 miles south of Jackson along U.S. highway 191/26/89/189 then running south approximately 7.2 miles to Hoback Junction. At Hoback Junction the project branches to the southwest, along U.S. 26/89, and to the east along U.S. 191/189. The Hoback Junction segment, along U.S. 26/89, is approximately 0.6 miles in length and includes the Snake River Bridge. The east segment, along U.S. 191/189, is approximately 2.9 miles in length. Due to the independent utility of the three project segments, project limits for the EIS have been modified to include only the 7.2 mile segment of U.S. 26/89/189/191 from Hoback Junction to 6.1 miles south of Jackson (Jackson South) as described under supplementary information.

The FHWA invites public comments about our intention to request the Office of Management and Budget's (OMB) approval for renewal and change of title of an existing information collection that is summarized below under Supplementary Information. We are required to publish this notice in the Federal Register by the Paperwork Reduction Act of 1995. As part of FHWA's ongoing effort to reduce the overall burden on the public, four currently approved information collections associated with the accommodation or relocation of utility facilities in the right-of-way of highway facilities are being combined into a single collection (2125-0519) with a new title of Utility Adjustments, Agreements, Eligibility Statements, and Accommodation Policies. Since each collection involves information regarding Federal regulations on utilities, this request will allow FHWA to streamline the collection process for the respondents with the ultimate goal of lowering the overall information collection burden. In addition to the proposed burden-hour reductions, by combining these collections, FHWA will be in a position to communicate collection activity from the respondents in one process, thus allowing for greater efficiency for both FHWA and the public. The FHWA hereby gives notice that it intends to prepare an EIS for the proposed preservation of right-of-way for the construction of projects that would increase surface transportation capacity (additional travel lanes, intersection improvements) and improve operating conditions and safety (access management improvements) for both near-term and long-term needs. This EIS is being prepared and considered in accordance with the National Environmental Policy Act (NEPA) of 1969, regulations of the Council on Environmental Quality (40 CFR parts 150-1508), and FHWA regulations, guidance and policy. Anticipated Federal approvals/actions needed for this project to be constructed include permits for sections 401 and 404 of the Clean Water Act (U.S. Army Corps of Engineers) and compliance with section 4(f) of the Department of Transportation Act, section 7 of the Endangered Species Act and section 106 of the national Historic Preservation Act.
