Environmental Impact Statement: Wayne County, MI
Pursuant to the National Environmental Policy Act (NEPA) of 1969, the Federal Highway Administration has made available for public review and comments a Draft Environmental Impact Statement (DEIS) for the Detroit River International Crossing Study. The DEIS describes and presents the environmental effects of the No-Build Alternative and nine Build Alternatives. Two public hearings will be held to receive comments from individuals and organizations on the DEIS.
Parks, Recreation Areas, Wildlife and Waterfowl Refuges, and Historic Sites
This final rule modifies the procedures for granting Section 4(f) approvals in several ways. First, the final rule clarifies the factors to be considered and the standards to be applied when determining if an alternative for avoiding the use of Section 4(f) property is feasible and prudent. Second, the final rule clarifies the factors to be considered when selecting a project alternative in situations where all alternatives would use some Section 4(f) property. Third, the final rule establishes procedures for determining that the use of a Section 4(f) property has a de minimis impact on the property. Fourth, the final rule updates the regulation to recognize statutory and common-sense exceptions for uses that advance Section 4(f)'s preservation purpose, as well as the option of applying a programmatic Section 4(f) evaluation. Fifth, the final rule moves the Section 4(f) regulation out of the agencies' National Environmental Policy Act regulation, ``Environmental Impact and Related Procedures,'' into its own part with a reorganized structure that is easier to use.

Notice of Final Federal Agency Actions on a Proposed U.S. Highway Project in California
This notice announces actions taken by the FHWA and other Federal agencies that are final within the meaning of 23 U.S.C. 139(l) (1). These actions relate to a proposed highway project to widen a two- lane conventional highwayState Route 12 in Napa and Solano Counties in the State of Californiato four lanes and to convert its western terminus into an interchange. The State Route 12 widening portion of the project is between kilo post 0.0 and R4.2 (post miles 0.0 and R2.6) in Solano County, and between kilo post 0.4 and 5.3 (post mile 0.2 and 3.3) in Napa County. The interchange portion of the project is in Napa County between kilo post 0.0 and 0.4 (post mile 0.0 and 0.2) on State Route 12 and between kilo post 6.7 and 8.7 (post mile 4.2 and 5.4) on State Route 29.
Advance Construction of Federal-Aid Projects
The FHWA is proposing to revise the regulation for advance construction of Federal-aid projects by: Removing the restriction that a State must obligate all of its allocated or apportioned funds, or demonstrate that it will use all obligation authority allocated to it for Federal-aid highways and highway safety construction, prior to the approval of advance construction projects; and clarifying that advance construction procedures may be used for all categories of Federal-aid highway funds, and that any available Federal-aid funds for which a project is eligible may be used when a project is converted to a Federal-aid project. These revisions will make the regulation consistent with the advance construction statute, which was amended by a provision enacted in the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU).

Rural Safety Innovation Program
The goal of the Rural Safety Innovation Program is to improve rural road safety by assisting rural communities in addressing highway safety problems and by providing rural communities the opportunity to compete for project funding to address these problems. The program will encourage States and rural communities to develop creative, locally crafted solutions to roadway safety problems, document their efforts and outcomes, and share the results with other communities across the country. Through the Rural Safety Innovation Program, the Department aims to heighten awareness and interest in rural safety issues, and promote the benefits of rural safety countermeasures which can reduce rural crashes and fatalities nationwide. By providing technical assistance and best practice guidance from the program we will give States and rural road owners better tools to improve road safety in their communities. The primary objectives of the Rural Safety Innovation Program are to: i. Improve safety on local and rural roads with innovative approaches in which rural communities develop and design local solutions to their roadway safety problems. ii. Provide best practices and lessons learned on innovative safety technologies to assist local and rural road owners and operators in the development and implementation of infrastructure-based rural safety countermeasures that complement behavioral safety efforts. iii. Promote national awareness and interest in addressing rural safety issues. iv. Promote the use of Intelligent Transportation Systems (ITS) technologies to improve safety on rural roads.

Environmental Impact Statement: Tappan Zee Bridge/I-287 Corridor Between Suffern, NY (Rockland County) and Port Chester, NY (Westchester County)
The FHWA and FTA are jointly issuing this Revised Notice of Intent (NOI) to advise the public of modifications to the environmental review process for the Tappan Zee Bridge/I-287 Corridor Environmental Impact Statement (EIS). These revisions include the intent of FHWA and FTA to use a tiered process to facilitate project decision-making, and the intent of FHWA and FTA to utilize the environmental review provisions afforded under Section 6002 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU). The EIS will build upon the extensive alternatives analysis, environmental and technical studies and public comments and outreach conducted to date, which are available online at the project's Web site (www.tzbsite.com). This NOI revises the NOI that was published in the Federal Register on December 23, 2002. The proposed tiering approach will allow the joint lead agencies to focus on both broad overall corridor issues in a Tier 1 transit analysis of general alignment and mode choice while simultaneously assessing site specific impacts, costs and mitigation measures in a Tier 2 bridge and highway analysis. The scope of analysis in the Tier 1 and Tier 2 will be appropriate to the level of detail necessary for those documents and will receive input from the public and reviewing agencies. The intent of the joint lead agencies is for the Tier 1 and Tier 2 analyses to be developed concurrently in order to maximize the efficiencies and potential for multimodal solutions. The Tier 1 transit analysis will provide the basis for a corridor level decision on transit mode(s), alignment(s), and logical termini within the Corridor and sufficient detail of impact assessments and preliminary engineering to allow the Tier 2 highway and bridge elements to proceed to final design and construction. Because the transportation needs of the corridor require a multimodal solution, the highway, bridge, and transit elements are intricately tied to one another and require iterative and concurrent development, analysis and consideration up to the decision on mode and alignment. Once the transit mode and alignment decisions are made, the analysis can focus on the needs of the corridor which includes the structural needs of the existing Tappan Zee Bridge and associated highway network, while preserving the transit corridor within the existing right of way. Additional purposes of this revised NOI are to: Advise the public of lead agency roles. Outline how the provisions of SAFETEA-LU Section 6002 will be met. Update interested parties regarding the current approach to preparing the EIS. Provide updated information on the proposed project, purpose and need for the project, and range of alternatives. Re-invite participation in the EIS process, including comments on the refined scope of the EIS proposed in this notice. Announce the dates, times and locations of upcoming scoping update meetings.

Express Lanes Demonstration Program
Section 1604(b) of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) (Pub. L. 109-59; Aug. 10, 2005), authorizes the Secretary of Transportation (Secretary) to carry out 15 demonstration projects to permit States, public authorities, or public or private entities designated by States, the authority to collect a toll from a motor vehicle on an eligible toll facility. The MUTCD (also referred to as ``the Manual'') is incorporated by our regulations, approved by the Federal Highway Administration, and recognized as the national standard for traffic control devices used on all public roads. The purpose of this notice of proposed amendments is to revise standards, guidance, options, and supporting information relating to the traffic control devices in all parts of the MUTCD. The proposed changes are intended to expedite traffic, promote uniformity, improve safety, and incorporate technology advances in traffic control device application. These proposed changes are being designated as the next edition of the MUTCD.

Notice of Final Federal Agency Actions on Proposed Highway in North Carolina
This notice announces actions taken by FHWA that are final agency actions within the meaning of 23 U.S.C. 139 (I)(1). These final agency actions relate to a proposed highway project, U.S. 64 ImprovementsAsheboro, Randolph County, North Carolina from just east of SR 1424 (Stutts Road) to U.S. 64 east of U.S. 64/Presnell Street, where the Record of Decision (ROD) identifies Alternative 29 as the selected alternative, as it is the Least Environmentally Damaging Practicable Alternative (LEDPA). The Abbreviated Final Environmental Impact Statement (FEIS) was approved and published by FHWA in March, 2007 and a ROD was issued on December 6, 2007. FHWA selects Alternative 29 in the ROD based on public and resource agency input, including the North Carolina Department of Transportation. Selecting Alternative 29 is in the best overall public interest because it was identified as the LEDPA, it avoids controversial and serious neighborhood impacts of other alternative analyzed, has the fourth fewest number of stream crossings, affects the smallest area of wetlands, has the fourth lowest noise receiver impacts of the nine alternatives considered, is supported by local governments including the city of Asheboro, and is supported by many citizens.
National Standards for Traffic Control Devices; the Manual on Uniform Traffic Control Devices for Streets and Highways; Maintaining Traffic Sign Retroreflectivity
The Manual on Uniform Traffic Control Devices (MUTCD) is incorporated by reference in 23 CFR part 655, subpart F, approved by the Federal Highway Administration, and recognized as the national standard for traffic control devices used on all public roads. The purpose of this final rule is to revise standards, guidance, options, and supporting information relating to maintaining minimum levels of retroreflectivity for traffic signs on all roads open to public travel.

Temporary Traffic Control Devices
The FHWA is adding a new Subpart K to 23 CFR part 630 to supplement existing regulations that govern work zone safety and mobility in highway and street work zones to include conditions for the appropriate use of, and expenditure of funds for, uniformed law enforcement officers, positive protective measures between workers and motorized traffic, and installation and maintenance of temporary traffic control devices during construction, utility, and maintenance operations. These regulations are intended to decrease the likelihood of fatalities and injuries to road users, and to workers who are exposed to motorized traffic (vehicles using the highway for purposes of travel) while working on Federal-aid highway projects. The regulations are issued in accordance with section 1110 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), Public Law 109-59, 119 Stat. 1227, codified at 23 U.S.C. 109(e) and 112(g).
