Release of Official Information and Appearance of Witnesses in Litigation
The Department of the Army proposes to amend its regulation concerning policies and procedures for release of official information and testimony of Army witnesses in federal and state courts where the Army or Department of Defense (DoD) has an interest in the matter. This regulation was last published in the Federal Register on July 29, 1994 (59 FR 38236). At that time, a complete Army Regulation was codified. This revision removes a large portion of the currently codified part that does not apply to the public, and is now included in DoD internal guidance. Army Regulation 27-40, Litigation, dated 19 September 1994, is the corresponding document where the internal guidance is located.
Record of Decision for the Final Environmental Impact Statement for Short-Term Projects and Real Property Master Plan Update for Fort Belvoir, Virginia
The Department of the Army announces the decision to implement the Preferred Alternative identified in the Final Environmental Impact Statement (FEIS) for Short-Term Projects and Real Property Master Plan (RPMP) Update for U.S. Army Garrison Fort Belvoir, VA. The RPMP identifies potential future development and management of real propertyland, facilities, resources, and infrastructureand consequent population changes on Fort Belvoir through 2030. The Record of Decision (ROD) explains the potential environmental impacts associated with the selected action, which includes 52 short-term demolition, construction, and renovation projects; four short-term transportation improvement projects; and 19 long-term facility and transportation improvement projects. The short-term projects are programmed for construction through 2017; the long-term projects are intended for implementation between 2018 and 2030. The ROD also adopts mitigation measures that will minimize or eliminate adverse impacts in land, infrastructure, transportation, and environment.
Intent To Grant an Exclusive License of U.S. Government-Owned Patents

Programmatic Environmental Assessment for Construction and Operation of Solar Photovoltaic Renewable Energy Projects on Army Installations
The Department of the Army has completed a Programmatic Environmental Assessment (PEA) for construction, operation, and maintenance of solar photovoltaic (PV) renewable energy projects on Army installations and is making the PEA and a draft Finding of No Significant Impact (FNSI) available for public comment. The draft FNSI incorporates the PEA, which does not identify any significant environmental impacts from the proposed action or any of the alternatives. The draft FNSI concludes that preparation of an environmental impact statement (EIS) is not required, and therefore will not be prepared. The PEA is programmatic and nationwide in scope. For years, the Army has analyzed and implemented solar PV projects at Army installations across the country. In the PEA, the Army leveraged this experience with the goal of streamlining the National Environmental Policy Act process for future solar PV proposals, as appropriate, in a manner consistent with Council on Environmental Quality and Department of the Army regulations.

Privacy Act of 1974; System of Records
Pursuant to the Privacy Act of 1974 and Office of Management and Budget (OMB) Circular No. A-130, notice is hereby given that the Department of the Army proposes to alter a system of records, A0037- 104-3 USMA, entitled ``USMA Cadet Account System,'' last published at 65 FR 3219, January 20, 2000. This system of records exists to enable Cadets to receive income (salary, scholarship, individual deposits, etc.) and pay for expenses (uniforms, books, a computer, activity fees, etc.) while attending the United States Military Academy (USMA) at West Point. The program is managed by the USMA Treasurer who is charged with ensuring all cadets meet their USMA financial obligations. This revision reflects considerable administrative changes that in sum warrant an alteration to the system of records notice. There are two significant changes: The categories of records has been updated to provide additional details on the information collected; and the applicable DoD Routine Uses have been incorporated in the notice to provide clarity for the public. There are also modifications to the system name, authorities, purpose, storage, retrievability, safeguards, notification and record access procedures, contesting record procedures, and records source categories to improve readability and update the notice to meet current departmental standards.

Law Enforcement Reporting
The Department of the Army is amending its Law Enforcement Regulation. Specifically, Army is clarifying language for contractors who are required to register as sex offenders on Army installations. This change will allow the Department to collect information from registered sex offenders in accordance with their contract requirements. This ensures contractors meet the government requirements under the terms and conditions of the contract.
Law Enforcement Operations and Investigations
The Department of the Army proposes to revise its regulation concerning policies and procedures for the conduct of Army law enforcement operations and investigations. This regulation was last published in the Federal Register on June 22, 2005 (70 FR 36029). At that time, the entire regulation was codified. The proposed revisions remove a large portion of the currently codified part that does not apply to the public and is now included in DoD internal guidance. The proposed revision also adds guidance on the requirements for the detention of civilians by Army law enforcement to fill a void in published guidance.

Change to the Freight Carrier Registration Program (FCRP) Open Season
The Military Surface Deployment and Distribution Command (SDDC) will officially have an Open Season, effective 09 Jan 17 thru 28 Feb 17 (Applications will not be accepted prior to 9 Jan 17). This will affect domestic motor Transportation Service Providers (TSPs) only. TSPs must be registered in the Federal Motor Carrier Safety Administration (FMSCA) and have valid Department of Transportation (DOT) authority for three (3) consecutive years (without a break) prior to the 09 Jan 17. New TSPs will indicate their small business status via the Freight Carrier Registration Program (FCRP) during registration. Registration for other modes will continue to be accepted (barge, ocean, pipeline, and international carriers).

Privacy Act of 1974; System of Records
The Department of the Army proposes to alter a system of records notice A0690-600 SAMR, entitled ``Equal Opportunity and Equal Employment Opportunity Complaint Files.'' This system is used to ensure complaints are properly investigated and appropriate remedial action initiated to correct inequities. It is also used to collect, record, and maintain racial, ethnic group, and gender data; and complaints statistical data.
Army Privacy Program
The Department of the Army is amending the Army Privacy Program Regulation. Specifically, Army is adding exemption rules for Army system of records ``A0600-20 SAMR, Soldiers Equal Opportunity Investigative Files''. This rule provides policies and procedures for the Army's implementation of the Privacy Act of 1974, as amended. This direct final rule makes changes to the Department of the Army's Privacy Program rule. These changes will allow the Department to exempt records from certain portions of the Privacy Act. This will improve the efficiency and effectiveness of the Department of Defense's (DoD's) program by preserving the exempt status of the records when the purposes underlying the exemption are valid and necessary to protect the contents of the records.
Record of Decision for Activities and Operations at Yuma Proving Ground, Arizona
The Department of the Army announces the availability of the Record of Decision (ROD) for implementation of activities and operations at Yuma Proving Ground (YPG), AZ. Pursuant to the National Environmental Policy Act (NEPA), the Department of the Army prepared a Programmatic Environmental Impact Statement (PEIS) that evaluated the potential environmental and socioeconomic effects of proposed construction and demolition of facilities and infrastructure, and proposed changes to current types and levels of testing and training at YPG. The Army selected the Preferred Alternative identified in the Final PEIS. The ROD explains that the Army will proceed with its Preferred Alternative to implement 296 proposed activities, including construction and demolition of facilities and infrastructure, changes to current types and levels of testing and training, and activities conducted under private industry partnerships.

Advisory Committee on Arlington National Cemetery; Request for Nominations
The Advisory Committee on Arlington National Cemetery is an independent Federal advisory committee chartered to provide the Secretary of Defense, through the Secretary of the Army, independent advice and recommendations on Arlington National Cemetery, including, but not limited to cemetery administration, the erection of memorials at the cemetery, and master planning for the cemetery. The Secretary of the Army may act on the Committee's advice and recommendations. The Committee is comprised of no more than nine (9) members. Subject to the approval of the Secretary of Defense, the Secretary of the Army appoints no more than seven (7) of these members. The purpose of this notice is to solicit nominations from a wide range of highly qualified persons to be considered for appointment to the Committee. Nominees may be appointed as members of the Committee and its sub-committees for terms of service ranging from one to four years. This notice solicits nominations to fill Committee membership vacancies that may occur through 31 December, 2016. Nominees must be preeminent authorities in their respective fields of interest or expertise.

The Department of the Army proposes to alter a system of records notice A0145-1 TRADOC, entitled ``Army Reserve Officer's Training Corps (ROTC) and Financial Assistance Programs'' to provide a central database of potential prospects for enrollment in the ROTC and the Senior Army ROTC program, provide training and commissioning of eligible cadets in active Army and to assist prospects by providing information concerning educational institutions having ROTC programs; scholarship information and applications, information on specialized programs such as nursing, Green to Gold and historically Black Colleges and Universities and information regarding other Army enlistment, reserve or National Guard programs. This program also administers the financial assistance program; renders the selection of recipients for 2, 3, and 4 year scholarships; monitor selectees performance (academic and ROTC) and also develop policies and procedures, compile statistics and render reports.
