Defense Federal Acquisition Regulation Supplement; Contractor Personnel Authorized To Accompany U.S. Armed Forces (DFARS Case 2005-D013)
DoD has adopted as final, with changes, an interim rule amending the Defense Federal Acquisition Regulation Supplement (DFARS) to implement DoD policy regarding contractor personnel authorized to accompany U.S. Armed Forces deployed outside the United States.
Charter Amendment of Department of Defense Federal Advisory Committees
Under the provisions of the Federal Advisory Committee Act of 1972, (5 U.S.C. Appendix, as amended), the Government in the Sunshine Act of 1976 (5 U.S.C. 552b, as amended), and 41 CFR 102-3.85, the Department of Defense gives notice that it is amending the charter for the Board of Regents Uniformed Services University of the Health Sciences (hereafter referred to as the Board of Regents). The Board of Regents is a non-discretionary federal advisory committee established by 10 U.S.C. 2166(e) to assist the Secretary of Defense in an advisory capacity in carrying out the Secretary's responsibility to conduct the business of the Uniformed Services University of the Health Sciences. Section 956 of Public Law 110-181 (National Defense Authorization Act for Fiscal Year 2008) amended the Board's membership provisions of 10 U.S.C. 2113(a). All other provisions of 10 U.S.C. 2113(a) remained unchanged. Pursuant to 10 U.S.C. 2113(a), the Board of Regents shall be composed of fifteen members: 1. Nine persons outstanding in the fields of health and health education who shall be appointed from civilian life by the Secretary of Defense; 2. The Secretary of Defense, or his designee, who shall be an ex officio member; 3. The surgeons general of the uniformed services, who shall be ex officio members; and 4. The President of the University, who shall be a non-voting ex officio member. The terms of office for each member of the Board of Regents (other than ex officio members shall be six years except that: 1. Any member appointed to fill a vacancy occurring before the expiration of the term for which his predecessor was appointed shall be appointed for the remainder of such term; and 2. Any member who term of office has expired shall continue to serve until his successor is appointed. One of the appointed members of the Board of Regents shall be designated as Chairman by the Secretary of Defense. The Chairman shall be the presiding officer of the Board. Members of the Board of Regents appointed by the Secretary of Defense, who are not federal officers or employees, shall serve as Special Government Employees under the authority of 5 U.S.C. 3109, and pursuant to 10 U.S.C. 2113(e), shall receive compensation at a rate fixed by the Secretary of Defense, in addition to travel expense and per diem for official travel. The Board of Regents shall be authorized to establish subcommittees, as necessary and consistent with its mission, and these subcommittees or working groups shall operate under the provisions of the Federal Advisory Committee Act of 1972, the Government in the Sunshine Act of 1976, and other appropriate federal regulations. Such subcommittees or workgroups shall not work independently of the chartered Board, and shall report all their recommendations and advice to the Board of Regents for full deliberation and discussion. Subcommittees or workgroups have no authority to make decisions on behalf of the chartered Board nor can they report directly to the Department of Defense or any federal officers or employees who are not Board of Regents members.

Notice of Cancellation of Intent To Prepare a Draft Environmental Impact Statement for Expansion of the Tampa Harbor (Hilisborough County) FL
The Jacksonville District, U.S. Army Corps of Engineers hereby cancels its Notice of Intent to prepare a Draft Environmental Impact Statement as published in FR, Vol. 66, No. 105, Pages 29557 and 29558, May 31, 2001.
Military Recruiting and Reserve Officer Training Corps Program Access to Institutions of Higher Education
The Department of Defense revises the current rule addressing military recruiting and Reserve Officer Training Corps program access at institutions of higher education. This final rule implements 10 U.S.C. 983, as amended by the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005 (Pub. L. 108-375 (October 28, 2004)). As amended, 10 U.S.C. 983 clarifies access to campuses, access to students and access to directory information on students for the purposes of military recruiting, and now states that access to campuses and students on campuses shall be provided in a manner that is at least equal in quality and scope to that provided to any other employer. The prohibition against providing Federal funds when there is a violation of 10 U.S.C. 983 has an exception for any Federal funds provided to an institution of higher education, or to an individual, that are available solely for student financial assistance, related administrative costs, or costs associated with attendance. Such funds may be used for the purpose for which the funding is provided. A similar provision in section 8120 of the Department of Defense Appropriations Act of 2000 (Pub. L. 106-79; 113 Stat. 1260) has been repealed. This rule also rescinds the previous policy that established an exception that would limit recruiting on the premises of the covered school only in response to an expression of student interest when the covered school certified that too few students had expressed interest to warrant accommodating military recruiters.
Notice of Intent To Prepare a Draft Environmental Impact Statement (EIS) for the Potable Water Supply for Washington Parish Reservoir, Project
The study area comprises Washington Parish in southeast Louisiana. Washington Parish currently consumes approximately 40 million gallons of water daily, 70 percent of which is supplied by groundwater. Decreasing groundwater levels (quantity) and groundwater quality, in combination with forecasted growth within the Parish require alternative water supplies to be developed. The purpose of the project is to identify a new water supply to address the current and future potable water demands of Washington Parish. The Local Project Sponsor is the Washington Parish Reservoir Commission.
Notice of Public Hearing for the Draft Environmental Impact Statement for the Proposed Homeporting of Additional Surface Ships at Naval Station Mayport, Florida
Pursuant to section 102(2)(c) of the National Environmental Policy Act (NEPA) of 1969, as implemented by the Council on Environmental Quality Regulations (40 Code of Federal Regulations Parts 1500-1508 the U.S. Department of the Navy (Navy) has prepared and filed with the U.S. Environmental Protection Agency (EPA) a Draft Environmental Impact Statement (DEIS) on March 28, 2008, which evaluates the potential environmental consequences of homeporting additional surface ships at Naval Station (NAVSTA) Mayport, Florida. A Notice of Intent for this DEIS was published in the Federal Register on November 14, 2006 (FR14NO06-25). A public hearing will be held to provide information and receive oral and written comments on the DEIS. A preferred alternative has not been selected or identified in the DEIS. The Navy seeks comments from the public or interested parties regarding the sufficiency of the DEIS and the choice of a preferred alternative. Federal, state, and local agencies and interested individuals are invited to be present or represented at the hearing. Date and Address: One public hearing will be held. The hearing will be preceded by an open house session to allow interested individuals to review information presented in the DEIS DON representatives will be available during the open house session to provide clarification as necessary related to the DEIS. The open house session will occur from 4:30 p.m. to 6:30 p.m. followed by the formal public hearing from 6:30 p.m. to 8:30 p.m. The public hearing is scheduled for the following date and location: Wednesday, April 16, 2008 at the Florida Community College, Deerwood Center, B1204 9911 Old Baymeadows Road, Jacksonville, FL 32256.
Intent To Prepare an Environmental Impact Statement for the Proposed Sierra Vista Specific Plan Project, Corps Permit Application Number 200601050
The Sierra Vista Landowner Group proposes to implement a large-scale, mixed-use, mixed-density master planned community with residential, commercial, office, public/quasi-public, and open space land uses, and parks. The Sierra Vista Specific Plan would include approximately 1,148 acres of residential uses; 281 acres of commercial, office, and commercial-mixed uses; 162 acres of parks and paseos; 83 acres of public/quasi-public land uses; 31 acres of urban reserve; and 190 acres of roadways and landscape corridors. The Specific Plan would also include 244 acres of open space; of these, 38 acres would be graded as part of the project and the remaining 206 acres would be preservation areas. The Specific Plan would include 9,995 dwelling units (in a mix of low, medium, and high densities) and approximately 2,419,113 square feet of retail and office uses. The project would also provide four elementary schools, one middle school, and a fire station. The proposed project is expected to generate about 25,219 new residents and 5,821 jobs. It is anticipated that construction would begin in spring 2010. The duration of construction would depend on market conditions; full buildout would likely be completed within 20 years from construction commencement. The proposed project site is approximately 2,138 acres and contains 51.87 acres of waters of the United States. The project, as proposed, would result in direct impacts to approximately 37.74 acres of waters of the United States. These acreages do not include indirect impacts from the proposed action or impacts anticipated to result from offsite infrastructure that may be determined to be required as part of the project through the Environmental Impact Statement (EIS) process.
Defense Science Board
The Defense Science Board (DSB) Task Force on the National Nuclear Security Administration Strategic Plan for Advanced Computing will meet in closed session on April 16-17, 2008; in the Washington DC metro area. The exact meeting location is still to be determined. The mission of the Defense Science Board is to advise the Secretary of Defense and the Under Secretary of Defense for Acquisition, Technology & Logistics on scientific and technical matters as they affect the perceived needs of the Department of Defense. At the meeting, the task force shall conduct an evaluation of the strategic plan for advanced computing of the National Nuclear Security Administration and assess the impact of using the planned capability for other National Security issues. The task force's findings and recommendations, pursuant to 41 CFR 102-3.140 through 102-3.165, will be presented and discussed by the membership of the Defense Science Board prior to being presented to the Government's decision maker. Pursuant to 41 CFR 102-3.120 and 102-3.150, the Designated Federal Officer for the Defense Science Board will determine and announce in the Federal Register when the findings and recommendations of the April 16-17, 2008 meeting are deliberated by the Defense Science Board. Interested persons may submit a written statement for consideration by the Defense Science Board. Individuals submitting a written statement must submit their statement to the Designated Federal Official at the address detailed below, at any point; however, if a written statement is not received at least 10 calendar days prior to the meeting that is the subject of this notice, then it may not be provided to or considered by the Defense Science Board. The Designated Federal Official will review all timely submissions with the Defense Science Board Chairperson, and ensure they are provided to members of the Defense Science Board before the meeting that is the subject of this notice.
TRICARE; Relationship Between the TRICARE Program and Employer-Sponsored Group Health Plans
This proposed rule implements Section 1097c of Title 10, United States Code. This law prohibits employers from offering incentives to TRICARE-eligible employees to not enroll, or to terminate enrollment, in an employer-offered Group Health Plan (GHP) that is or would be primary to TRICARE. Cafeteria plans that comport with section 125 of the Internal Revenue Code will be permissible so long as the plan treats all employees the same and does not illegally take TRICARE eligibility into account.

Under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), the Federal Acquisition Regulation (FAR) Secretariat has submitted to the Office of Management and Budget (OMB) a request to review and approve an extension of a currently approved information collection requirement concerning value engineering requirements. A request for public comments was published in the Federal Register at 72 FR 62445, on November 5, 2007. No comments were received. The clearance currently expires on May 31, 2008. Public comments are particularly invited on: Whether this collection of information is necessary for the proper performance of functions of the FAR, and whether it will have practical utility; whether our estimate of the public burden of this collection of information is accurate, and based on valid assumptions and methodology; ways to enhance the quality, utility, and clarity of the information to be collected; and ways in which we can minimize the burden of the collection of information on those who are to respond, through the use of appropriate technological collection techniques or other forms of information technology.
Notice of Closed Meeting of the Chief of Naval Operations (CNO) Executive Panel
The CNO Executive Panel will report on the findings and recommendations of the Navy Medicine to the Chief of Naval Operations. The meeting will consist of discussions of the organization, training, and equipping of Navy medical forces; standards of care for Navy members and their dependents; care for wounded members of the Naval service; the optimal level of ``jointness'' in Navy medicine; public policy recommendations to control the rising cost of Navy health care.

Renewal of Department of Defense Federal Advisory Committees
Under the provisions of the Federal Advisory Committee Act of 1972, (5 U.S.C. appendix, as amended), the Government in the Sunshine Act of 1976 (5 U.S.C. 552b, as amended), and 41 CFR 102-3.65, the Department of Defense gives notice that it is renewing the charter for the Defense Science Board (hereafter referred to as the Board). The Board is a discretionary federal advisory committee established by the Secretary of Defense to provide the Department of Defense independent advice and recommendations on scientific, technical, manufacturing, acquisition process, and other matters of special interest to the Department of Defense. The Board is not established to advise on individual DoD procurements, but instead shall be concerned with the pressing and complex technology problems facing the Department of Defense in such areas as research, engineering, and manufacturing, and will ensure the identification of new technologies and new applications of technology in those areas to strengthen national security. No matter shall be assigned to the Board for its consideration that would require any Board Member to participate personally and substantially in the conduct of any specific procurement or place him or her in the position of acting as a ``procurement official,'' as that term is defined pursuant to law. The Board shall be composed of approximately 35 members and approximately six Senior Fellow members, who are eminent authorities in the fields of scientific, technical, manufacturing, acquisition process, and other matters of special interest to the Department of Defense. The Board members shall be appointed by the Secretary of Defense, and their appointments will be renewed on an annual basis. Those members, who are not full-time federal officers or employees, shall serve as Special Government Employees under the authority of 5 U.S.C. 3109. The Secretary of Defense, based upon the recommendation of the Under Secretary of Defense (Acquisition, Technology and Logistics), shall appoint the Board's Chairperson. The Under Secretary of Defense (Acquisition, Technology and Logistics) shall appoint the Vice Chairperson. The Board Chairman and Vice Chairman will be appointed for two-year terms and may be reappointed for additional terms. Members may be appointed for terms ranging from one to four years. Such appointments will normally be staggered among the Board membership to ensure an orderly turnover in the Board's overall composition on a periodic basis. With the exception of travel and per diem for official travel, they shall normally serve without compensation, unless otherwise authorized by the appointing authority. The Secretary of Defense may invite other distinguished Government officers to serve as non-voting Observers of the Board, and these appointments shall not count toward the Board's total membership. The Under Secretary of Defense (Acquisition, Technology, and Logistics) may appoint consultants, with special expertise, to assist the Board on an ad hoc basis. All consultants shall serve as Special Government Employees under the authority of 5 U.S.C. 3109. In addition, the Under Secretary of Defense (Acquisition, Technology and Logistics) may identify chairpersons from other advisory committees to serve on the Board. These individuals will sit as observers only and shall not vote on matters before the Board. The Board shall be authorized to establish subcommittees, as necessary and consistent with its mission, and these subcommittees or working groups shall operate under the provisions of the Federal Advisory Committee Act of 1972, the Government in the Sunshine Act of 1976, and other appropriate federal regulations. Such subcommittees or workgroups shall not work independently of the chartered Board, and shall report all their recommendations and advice to the Board for full deliberation and discussion. Subcommittees or workgroups have no authority to make decisions on behalf of the chartered Board nor can they report directly to the Department of Defense or any federal officers or employees who are not Board members.
Revised Non-Foreign Overseas Per Diem Rates
The Per Diem, Travel and Transportation Allowance Committee is publishing Civilian Personnel Per Diem Bulletin Number 257. This bulletin lists revisions in the per diem rates prescribed for U.S. Government employees for official travel in Alaska, Hawaii, Puerto Rico, the Northern Mariana Islands and Possessions of the United States. AEA changes announced in Bulletin Number 194 remain in effect. Bulletin Number 257 is being published in the Federal Register to assure that travelers are paid per diem at the most current rates.

Under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), the Federal Acquisition Regulation (FAR) Secretariat will be submitting to the Office of Management and Budget (OMB) a request to review and approve an extension of a currently approved information collection requirement concerning the Buy American ActConstruction (Grimberg Decision). The clearance currently expires on September 30, 2008. Public comments are particularly invited on: Whether this collection of information is necessary for the proper performance of functions of the FAR, and whether it will have practical utility; whether our estimate of the public burden of this collection of information is accurate, and based on valid assumptions and methodology; ways to enhance the quality, utility, and clarity of the information to be collected; and ways in which we can minimize the burden of the collection of information on those who are to respond, through the use of appropriate technological collection techniques or other forms of information technology.

U.S. Air Force Scientific Advisory Board Notice of Meeting
Under the provisions of the Federal Advisory Committee Act of 1972 (5 U.S.C., Appendix, as amended), the Government in the Sunshine Act of 1976 (5 U.S.C. 552b, as amended), and 41 CFR 102-3.150, the Department of Defense announces that the United States Air Force Scientific Advisory Board meeting will take place on Wednesday, April 9th, 2008, from 8 a.m.-4:15 p.m., at the Offutt Air Force Base Dougherty Conference Center located at 906 SAC Blvd., Offutt AFB, Nebraska 68113. The purpose of the meeting is to hold the United States Air Force Scientific Advisory Board quarterly meeting to introduce information related to the Offutt Air Force Base 55th Wing and U.S. Strategic Command missions. This information will provide board members a valuable perspective of key missions currently being executed by the USAF and how they may relate to the on-going SAB studies: Airborne Tactical Laser Feasibility for Gunship Operations, Kinetic Precision Effects, Implications of Spectrum Management for the Air Force, and Defending and Operating in a Contested Cyber Domain. Pursuant to 5 U.S.C. 552b, as amended, and 41 CFR 102-3.155, the Administrative Assistant of the Air Force, in consultation with the Office of the Air Force General Counsel, has determined in writing that the public interest requires that all sessions of the United States Air Force Scientific Advisory Board meeting be closed to the public because they will be concerned with classified information and matters covered by sections 5 U.S.C. 552b(c)(1), (4), and (9)(b). Any member of the public wishing to provide input to the United States Air Force Scientific Advisory Board should submit a written statement in accordance with 41 CFR 102-3.140(c) and section 10(a)(3) of the Federal Advisory Committee Act and the procedures described in this paragraph. Written statements can be submitted to the Designated Federal Officer at the address detailed below at any time. Statements being submitted in response to the agenda mentioned in this notice must be received by the Designated Federal Officer at the address listed below at least five calendar days prior to the meeting which is the subject of this notice. Notice of Intent (NOI) To Prepare an Environmental Impact Statement (EIS) for Transformation-Related Increased Training at Fort Benning, GA (Maneuver Center of Excellence EIS)
In order to transform the Army, meet the increased national security and defense requirements of the 21st century, maintain training and operational readiness levels of the force, and preserve a high quality of life for U.S. Army Soldiers and Families, the Army has identified the need to increase its overall size while continuing to restructure its forces in accordance with modular Transformation decisions. On December 19, 2007, the Army signed a Record of Decision (ROD) documenting its decision to proceed with growth of the Active and Reserve components of the Army by 74,200 Soldiers through establishment of several new Brigade Combat Teams (BCTs) and Combat Support and Combat Support Service units (CS/CSS). The growth of the Army would allow for the adjustment of the composition of its forces to continue to accommodate Transformation objectives and create additional unit capabilities in high demand areas where mission requirements exceed current manning authorizations. The Army growth decision will result in increased demands for the use of Fort Benning. Fort Benning will prepare a Maneuver Center of Excellence EIS to analyze Grow the Army (GTA) site-specific requirements and additional actions needed to support Base Realignment and Closure (BRAC) implementation at Fort Benning. In 2007 Fort Benning prepared a Final EIS for proposed Transformation and Base Realignment and Closure activities and signed a ROD selecting an alternative to proceed with several necessary projects and activities (Final EIS for BRAC 05 Realignment and Transformation Actions at Fort Benning, October 2007). Although Fort Benning itself will not experience permanent force structure growth beyond that analyzed in the BRAC 05 Realignment and Transformation EIS, it will be required to increase training of transient student loads in order to achieve and maintain the Army end-strength growth. The Fort Benning Maneuver Center of Excellence EIS will therefore consider a proposed action and reasonable alternatives for the Army to increase facilities at Fort Benning to accommodate training requirements related to BRAC, Global Defense Posture Realignment (GDPR), Army Modular Force Initiatives (AMF), GTA and other related stationing activities.

Notice of Intent To Prepare an Environmental Impact Statement and Overseas Environmental Impact Statement for Navy Training Activities in the Gulf of Alaska
Pursuant to section 102(2)(c) of the National Environmental Policy Act of 1969 (NEPA) as implemented by the Council on Environmental Quality regulations (40 CFR Parts 1500-1508), and Executive Order 12114 (Environmental Effects Abroad of Major Federal Actions), the Department of the Navy (Navy) announces its intent to prepare an Environmental Impact Statement (EIS)/Overseas Environmental Impact Statement (OEIS) to evaluate the potential environmental effects of conducting Navy training in and around the Gulf of Alaska (GOA), including participation in large-scale Joint exercises, to support Fleet training exercise requirements. The Navy will invite the U.S. Fish and Wildlife Service and National Marine Fisheries Service to be cooperating agencies in preparation of this EIS/OEIS.

Appendix, as amended), the Government in the Sunshine Act of 1976 (5 U.S.C. 552b, as amended), and 41 CFR 102-3.65, the Department of Defense gives notice that it is renewing the charter for the Army Education Advisory Committee (hereafter referred to as the Committee). The Committee is a discretionary federal advisory committee established by the Secretary of Defense to provide the Department of Defense, the Secretary of the Army and the Chief of Staff of the U.S. Army independent advice and recommendations in matters pertaining to the educational, doctrinal, and research policies and activities of the U.S. Army's educational programs, including activities of the U.S. Army's joint professional military education programs. The Committee, in accomplishing its mission: (a) Provides advice to their supported schools; (b) assist in the maintenance of the highest academic standards; and (c) ensure that Army educational policies and techniques are current and equal to those used in the finest institutions of higher education. The Committee shall be composed of not more than 15 members, who are distinguished members of the field of defense, management, leadership, and academia. Committee members appointed by the Secretary of Defense, who are not federal officers or employees, shall serve as Special Government Employees under the authority of 5 U.S.C. 3109. Committee members shall be appointed on an annual basis by the Secretary of Defense. The Assistant Secretary of the Army for Manpower and Reserve Affairs or designated representative shall serve as the Chairperson, and shall serve at the discretion of the Secretary of Army or designated representative. In addition, the Secretary of Defense and the Secretary of Army or designated representative may invite other distinguished Government officers to serve as non-voting observers of the Committee, and appoint consultants with special expertise to assist the Committee on an ad hoc basis.
