Submission for OMB Review; Request for Review of a Revised Information Collection
In accordance with the Paperwork Reduction Act of 1995 (Pub. L. 104-13, May 22, 1995), this notice announces that the Office of Personnel Management (OPM) has submitted to the Office of Management and Budget (OMB) a request for review of a revised information collection. ``Verification of Who is Getting Payments'' (OMB Control No. 3206-0197; Form RI 38-107) is designed for use by the Retirement Inspection Branch when OPM, for any reason, must verify that the entitled person is indeed receiving the monies payable. ``Verification of Who is Getting Payments'' (OMB Control No. 3206-0197; Form RI 38- 147) collects the same information and is used by other groups within Retirement Services Program. Failure to collect this information would cause OPM to pay monies absent the assurance of a correct payee.
Federal Employees Health Benefits Program: Medically Underserved Areas for 2010
The U.S. Office of Personnel Management (OPM) has completed its annual determination of the States that qualify as Medically Underserved Areas under the Federal Employees Health Benefits (FEHB) Program for calendar year 2010. This is necessary to comply with a provision of the FEHB law that mandates special consideration for enrollees of certain FEHB plans who receive covered health services in States with critical shortages of primary care physicians. Accordingly, for calendar year 2010, the following states are Medically Underserved Areas under the FEHB Program: Alabama, Arizona, Idaho, Illinois, Kentucky, Louisiana, Mississippi, Missouri, Montana, New Mexico, North Dakota, South Carolina, South Dakota, and Wyoming. For the 2010 calendar year, no new States have been added.
Proposed Collection; Request for Comment Extension of a Currently Approved Information Collection
In accordance with the Paperwork Reduction Act of 1995 (Pub. L. 104-13, May 22, 1995), this notice announces that the Office of Personnel Management (OPM) intends to submit to the Office of Management and Budget (OMB) a request for extension of a currently approved information collection. ``This information collection, Initial Certification of Full-Time School Attendance'' (OMB Control No. 3206- 0099; Form RI 25-41), is used to determine whether a child is unmarried and a full-time student in a recognized school. OPM must determine this in order to pay survivor annuity benefits to children who are age 18 or older.
Revision of Information Collection: Combined Federal Campaign Applications
In accordance with the Paperwork Reduction Act of 1995 (Pub. L. 104-13, May 22, 1995), this notice announces that the Office of Personnel Management intends to submit to the Office of Management and Budget a request for clearance to revise information collection Combined Federal Campaign Applications OMB Control No. 3206-0131, which include OPM Forms 1647 A-E. Combined Federal Campaign Eligibility Applications are used to review the eligibility of national, international, and local charitable organizations that wish to participate in the Combined Federal Campaign. The proposed revisions reflect changes in eligibility guidance from the Office of Personnel Management and recommendations from a review conducted by the Government Accountability Office.

This information collection, ``Reinstatement of Disability Annuity Previously Terminated Because of Restoration to Earning Capacity'' (OMB Control No. 3206-0138; Form RI 30-9), informs former disability annuitants of their right to request restoration under title 5, U.S.C. Section 8337. It also specifies the conditions to be met and the documentation required for a person to request reinstatement.
Changes in the Federal Employees Dental and Vision Insurance Program
The U. S. Office of Personnel Management (OPM) is issuing proposed regulations on changes in the Federal Employees Dental and Vision Insurance Program (FEDVIP). We are amending the regulations to authorize retroactive enrollment changes when an enrollee has lost his or her spouse through death or divorce or the enrollee's last eligible child dies, marries, or reaches age 22. We are also amending the regulations to add that an individual may enroll 31 days before the enrollee or an eligible family member loses other dental and/or vision coverage. We are also amending the regulations to clarify the reference to excluded positions in 5 U.S.C. 8901(1). We are also including in the regulations certain Senate restaurant employees who are employees of the Architect of the Capitol as individuals who are eligible to elect to continue enrollment in FEDVIP if they are eligible and elect to continue their retirement coverage.

Comment Request for Review of Information Collection: Agency Generic Survey Plan OMB #3206-0236
In accordance with the Paperwork Reduction Act of 1995 (Pub. L. 104-13, May 22, 1995), this notice announces that the Office of Personnel Management (OPM) intends to submit to the Office of Management and Budget a request for review of a revised information collection. The agency Generic Survey Plan is an umbrella for all OPM customer satisfaction surveys used to measure satisfaction with OPM programs and services. This Plan satisfies the requirements of Executive Order 12862 and the guidelines set forth in OMB's ``Resource Manual for Customer Surveys''.

The U.S. Office of Personnel Management is issuing a final rule to redefine the geographic boundaries of the Fresno and Stockton, CA, appropriated fund Federal Wage System (FWS) wage areas. The final rule redefines Mariposa and Merced Counties and the Yosemite National Park portion of Madera and Tuolumne Counties, CA, to the Stockton wage area. These changes are based on recent consensus recommendations of the Federal Prevailing Rate Advisory Committee to best match the counties proposed for redefinition to a nearby FWS survey area.
Revocation of Final Rule Eliminating Time-in-Grade Requirements Pending Policy Review; Extension of Effective Date During Rulemaking
The U.S. Office of Personnel Management (OPM) proposes to revoke the final rule, titled Time-in-Grade Rule Eliminated, published in the Federal Register on November 7, 2008, pending OPM's review and consideration of additional public comments received in response to a March 9, 2009 Federal Register notice which extended the final rule's effective date. OPM also proposes to extend the final rule's effective date for an additional 90 days, from May 18, 2009 until August 16, 2009, to avoid the unnecessary expense of allowing a rule to take effect that may later be amended or revoked as a result of the rulemaking proceeding. OPM seeks comments, with a 30-day comment period, on the merits of revoking, retaining, or amending OPM's November 7, 2008 final rule. OPM also seeks comments, with a 5-day comment period, on the merits of extending the final rule's effective date pending the completion of the rulemaking proceeding.

Submission for OMB Review; Comment Request for Revised Information Collection: Fingerprint Charts: Standard Form (SF) 87 AND SF 87A
In accordance with the Paperwork Reduction Act of 1995 (Pub. L. 104-13) this notice announces that the U.S. Office of Personnel Management (OPM) has submitted to the Office of Management and Budget (OMB) a request for review and clearance of the revised collection of information collection (Fingerprint Charts SF 87 and SF 87A; OMB No. 3206-0150). The Fingerprint Charts are used in processing fingerprint checks submitted to the Federal Bureau of Investigation (FBI) to assist in determining whether an applicant is suitable for Federal employment or should be granted a security clearance.
Prevailing Rate Systems; Redefinition of the New Haven-Hartford and New London, CT, Appropriated Fund Federal Wage System Wage Areas
The U.S. Office of Personnel Management (OPM) is issuing a proposed rule that would define the New Haven-Hartford and New London, CT, appropriated fund Federal Wage System (FWS) wage areas by county rather than by city and town boundaries. Defining the New England FWS wage areas by primarily considering county boundaries would provide greater consistency in how OPM defines FWS wage areas and would improve the ability to make direct data comparisons with Census Bureau data. The proposed rule would define the New Haven-Hartford wage area to include Hartford and New Haven Counties, CT, as the survey area and Fairfield, Litchfield, Middlesex, and Tolland Counties, CT, as the area of application and the New London wage area to include New London County, CT, as the survey area and Windham County, CT, as the area of application.

Emergency Leave Transfer Program
The U.S. Office of Personnel Management (OPM) issued final regulations on November 4, 2008 on the Emergency Leave Transfer Program (73 FR 65496). This notice corrects an omission in the final regulations that would permit an agency's leave bank to donate annual leave to an emergency leave transfer program administered by another agency during a Governmentwide transfer of emergency leave coordinated by OPM. This language was dropped inadvertently in the final rule when this section was rewritten slightly.

The U.S. Office of Personnel Management is issuing a final rule to abolish the Santa Clara, California, nonappropriated fund (NAF) Federal Wage System (FWS) wage area and redefine Santa Clara County, CA, to the Monterey, CA, NAF wage area and Alameda, Contra Costa, and San Francisco Counties, CA, to the Solano, CA, NAF wage area. San Mateo County, CA, will no longer be defined to a wage area. These changes are necessary because the closure of the Moffett Federal Airfield Navy Exchange left the Santa Clara wage area without an activity having the capability to conduct a local wage survey.

These changes are based on recent consensus recommendations of the Federal Prevailing Rate Advisory Committee to best match the counties proposed for redefinition to a nearby FWS survey area. No other changes are proposed for the Lake Charles-Alexandria and New Orleans FWS wage areas.

The proposed rule would redefine Franklin County, ID, from the Boise wage area to the Utah wage area. These changes are based on recent consensus recommendations of the Federal Prevailing Rate Advisory Committee to best match the counties proposed for redefinition to a nearby FWS survey area. No other changes are proposed for the Boise and Utah FWS wage areas.

This information collection, ``Designation of Beneficiary (FERS)'' (OMB Control No. 3206-0173; SF 3102), is used by an employee or an annuitant covered under the Federal Employees Retirement System to designate a beneficiary to receive any lump sum due in the event of his/her death. Approximately 3,110 SF 3102 forms are completed annually. Each form takes approximately 15 minutes to complete. The annual estimated burden is 777.50 hours. This information collection occurs electronically via the ``USAJOBS Resume Builder (online application)'' or completion and submission via regular mail, e-mail, fax, or in person of OF 612 ``Optional Form Application for Federal Employment'' or a resume. The USAJOBS Resume Builder and the OF 612 both reflect the minimal critical elements collected across the Federal Government to assess an applicant's qualifications. The online application on USAJOBS captures the essential information Federal agencies require to evaluate applicants for Federal jobs under the authority of sections 1104, 1302, 3301, 3304, 3320, 3361 3393, and 3394 of Title 5 United States Code. This notice also announces that the Office of Personnel Management (OPM) intends to submit to the Office of Management and Budget (OMB) a request to cancel the form, ``Optional Form Application for Federal Employment (OF 612). The OF 612 has been used as an optional form to apply for Federal jobs. Applicants for Federal positions may also submit a resume as an alternative. The information contained in the OF 612 is incorporated in the USAJOBS Resume Builder on the USAJOBS Web site. Individual government agencies are responsible for indicating in the job announcement what minimal critical elements would be required in any job seeker's resume. Therefore, the need to maintain the OF 612 as the only alternative means of applying for Federal positions no longer exists. This action is being taken to facilitate a more seamless employment application process for both Federal agencies and job seekers. Comments are particularly invited on whether this collection of information is necessary for the proper performance of functions of the Office of Personnel Management; and whether it is feasible to discontinue the use of the OF 612 as an alternate means of application; whether this information is necessary for the proper performance of functions of OPM, and whether it will have practical utility; whether our estimates of the public burden of this collection of information is accurate, and based on valid assumptions and methodology; and ways in which we can minimize the burden of the collection of information on those who are to respond, through the use of appropriate technological collection techniques or other forms of information technology. Nonforeign Area Cost-of-Living Allowance Rates; 2007 Interim Adjustments: Puerto Rico
The U.S. Office of Personnel Management (OPM) is increasing the cost-of-living allowance (COLA) rate received by certain white- collar Federal and U.S. Postal Service employees in Puerto Rico. The increase is the result of interim adjustments OPM calculated based on relative Consumer Price Index differences between Puerto Rico and the Washington, DC, area. This increase raises the COLA rate for Puerto Rico from 13 percent to 14 percent.
Federal Employees Health Benefits Program Acquisition Regulation: Miscellaneous Clarifications and Corrections
The U.S. Office of Personnel Management (OPM) is issuing a final rule to amend the Federal Employees Health Benefits Acquisition Regulations (FEHBAR). The rule clarifies the rate-setting process for community-rated carriers with respect to Similarly Sized Subscriber Groups (SSSG) and removes the ban on adjustments based on rate reconciliation for the final year of Federal Employees Health Benefits Program (FEHBP) contracts.

The final rule redefines Crawford and Sebastian Counties, AR, from the Little Rock wage area to the Tulsa wage area and Madison County, AR, and McDonald County, MO, from the Southern Missouri wage area to the Tulsa wage area. These changes are based on recent consensus recommendations of the Federal Prevailing Rate Advisory Committee (FPRAC) to best match the counties proposed for redefinition to a nearby FWS survey area. FPRAC recommended no other changes in the geographic definitions of the Little Rock, Southern Missouri, and Tulsa FWS wage areas.

Personnel Demonstration Project; Alternative Personnel Management System for the U.S. Department of Agriculture, Food Safety and Inspection Service
Chapter 47 of title 5, United States Code, authorizes the U.S. Office of Personnel Management (OPM), directly or in agreement with one or more agencies, to conduct demonstration projects that experiment with new and different human resources management concepts to determine whether changes in human resources policy or procedures result in improved Federal human resources management. The Food Safety and Inspection Service (FSIS), the U.S. Department of Agriculture (USDA), and OPM will test a results-based, competency-linked pay-for- performance system that is combined with a simplified, pay banding classification and compensation system. The final project plan has been approved by FSIS, USDA, and OPM.
January 2009 Pay Adjustments
