The purpose of this collection is to provide information to the public about ADS testing operations in the United States and applicable State and local laws, regulations, and guidelines. A Federal Register Notice with a 60-day comment period soliciting comments on the information collection was published on April 6, 2023 (83 FR 20608). NHTSA received 3 comment submission and a brief summary and NHTSA's response to those comments is provided in this document.

Federal Motor Vehicle Safety Standards: Automatic Emergency Braking Systems for Light Vehicles

This NPRM proposes to adopt a new Federal Motor Vehicle Safety Standard to require automatic emergency braking (AEB), including pedestrian AEB (PAEB), systems on light vehicles. An AEB system uses various sensor technologies and sub-systems that work together to detect when the vehicle is in a crash imminent situation, to automatically apply the vehicle brakes if the driver has not done so, or to apply more braking force to supplement the driver's braking. The AEB system proposed in this NPRM would detect and react to an imminent crash with a lead vehicle or pedestrian. This NPRM promotes NHTSA's goal to equip vehicles with AEB and PAEB, and advances DOT's January 2022 National Roadway Safety Strategy that identified requiring AEB, including PAEB technologies, on new passenger vehicles as a key Departmental action to enable safer vehicles. This NPRM also responds to a mandate under the Bipartisan Infrastructure Law directing the Department to promulgate a rule to require that all passenger vehicles be equipped with an AEB system.

This notice requests comment on a proposal to update the National Highway Traffic Safety Administration's New Car Assessment Program (NCAP) to provide consumers with information about crashworthiness pedestrian protection of new vehicles. The proposed updates to NCAP would provide valuable safety information to consumers about the ability of vehicles to protect pedestrians and could incentivize vehicle manufacturers to produce vehicles that provide better protection for vulnerable road users such as pedestrians. (``BTS'') has petitioned NHTSA for a temporary exemption from a shoulder belt requirement of Federal Motor Vehicle Safety Standard (FMVSS) No. 208, ``Occupant crash protection,'' for side-facing seats on motorcoaches. The petitioner seeks to install Type 1 seat belts (lap belt only) at side-facing seating positions instead of Type 2 seat belts (lap and shoulder belts) required by FMVSS No. 208. The petitioner states that, absent the requested exemption, it will otherwise be unable to sell a vehicle whose overall level of safety or impact protection is at least equal to that of a nonexempted vehicle. NHTSA is publishing this document to notify the public of the receipt of the petition and to request comment on it, in accordance with statutory and administrative provisions.

This ANPRM responds to Section 23011(c) of the November 2021 Infrastructure Investment and Jobs Act (IIJA), commonly referred to as the Bipartisan Infrastructure Law (BIL), which directs the Secretary to conduct research on side underride guards to better understand their overall effectiveness, and assess the feasibility, benefits, costs, and other impacts of installing side underride guards on trailers and semitrailers. The BIL further directs the Secretary to report the findings of the research in a Federal Register notice to seek public comment. In addition, this ANPRM also responds to a petition for rulemaking from Ms. Marianne Karth and the Truck Safety Coalition (TSC).
Implementing the Whistleblower Provisions of the Vehicle Safety Act

Whistleblowers are an important source of information on motor vehicle safety, as Congress recognized in enacting the Motor Vehicle Safety Whistleblower Act (Whistleblower Act). NHTSA is proposing rules, including forms, to implement the Whistleblower Act and seeking comment from interested stakeholders. The Whistleblower Act authorizes the Secretary of Transportation to pay an award, subject to certain limitations, to eligible whistleblowers who voluntarily provide original information relating to any motor vehicle defect, noncompliance, or any violation or alleged violation of any notification or reporting requirement, which is likely to cause unreasonable risk of death or serious physical injury, if the information provided leads to the successful resolution of a covered action. The Whistleblower Act also contains protections relating to the whistleblower's identity. This proposed rule will help to facilitate the Agency's identification of information provided by whistleblowers to ensure that whistleblowers receive the protections afforded under the statute. It also describes those limited situations where information that could reasonably be expected to reveal the identity of a whistleblower may be disclosed.

On November 15, 2021, Congress passed the Bipartisan Infrastructure Law (BIL). Under Sec. 24108(e) Congress authorizes the Secretary of Transportation to enhance the collection of crash data by upgrading the Crash Investigation Sampling System (CISS) to include (1) additional program sites; (2) an expanded scope that includes all crash types; and (3) on-scene investigation protocols. The NHTSA is conducting a comprehensive review of the Crash Investigation Sampling System (CISS) sample design and data collection methods as part of a major effort to upgrade CISS. Users of CISS and other crash data may comment as to the future utility of current CISS, recommend ways to upgrade current CISS, and indicate their anticipated data needs. All comments should be submitted via Docket number NHTSA-2023-0016.

NHTSA published an RFC notice announcing the draft of MMUCC on February 2, 2023. The comment period for the RFC notice was scheduled to end on April 3, 2023. NHTSA is extending the comment period for the February 2, 2023 RFC notice by 30 days.

The Model Minimum Uniform Crash Criteria (MMUCC) provides States a guideline for describing crashes involving motor vehicles in- transport to generate the information necessary to improve traffic safety. The primary benefit of using MMUCC is increased crash data uniformity so traffic safety insights can be developed more quickly. Since its inception in 1998, MMUCC has been a voluntary guideline for States; however, standardization of crash data is essential to NHTSA and its safety stakeholders. The crash data that NHTSA obtains from the States supports several of NHTSA's efforts such as the Fatality Analysis Reporting System (FARS) and the Crash Report Sampling System (CRSS), which are essential to NHTSA's traffic safety activities as well other Federal, State, and local agencies. Therefore, it is critical that the recommended MMUCC data elements be designed with clarity, purpose, and feasibility. NHTSA is revising the Model Minimum Uniform Crash Criteria (MMUCC) 5th Edition and requests comments on the draft MMUCC Guideline, Sixth Edition available at Regulations.gov, to inform appropriate improvements and identify stakeholder concerns. For example, crash data collectors may wish to comment on the feasibility of collecting data elements and attributes from the scene of a crash. Crash database administrators, managers, and technicians may wish to comment on the challenges and concerns with implementation and data governance. Crash data users may wish to comment on the utility of the draft MMUCC Guideline, Sixth Edition data elements as well as other guidance and suggest additional changes. Feedback will be reviewed by NHTSA and the Chartered MMUCC Committee to inform updates to the forthcoming Sixth Edition of the MMUCC guideline, anticipated in 2024.

The agency is denying the petition because the requested amendment would compromise the enforcement of the rear impact guard standard.
