Department of Defense Program for Construction, Renovation, Repair or Expansion of Public Schools Located on Military Installations
This notice describes a one-time DoD program, administered by OEA, to distribute $250 million made available by Congress to construct, renovate, repair, or expand elementary and secondary public schools on military installations in order to address capacity or facility condition deficiencies at such schools.
Selection Criteria-Transportation Infrastructure Improvements Associated With Medical Facilities Related to Recommendations of the 2005 Defense Base Closure and Realignment Commission
This notice responds to comments on the selection criteria to be used to select grant applicants for funding from the Office of Economic Adjustment (OEA) for construction of Transportation Infrastructure Improvements associated with medical facilities related to recommendations of the 2005 Defense Base Closure and Realignment Commission. The July 21, 2011, Federal Register notice announced proposal requirements, the deadline for submitting proposals, and the criteria that will be used to select proposals. Because this is a new one-time program, however, the July 21, 2011, notice also requested comments on the proposed selection criteria for these grants, as provided in Section V, paragraph 1, of that notice. This notice responds to the comments that were received and issues the final selection criteria for the program.
Industrial Relations Promotion Project, Phase II in Vietnam
The U.S. Department of Labor (USDOL), Bureau of International Labor Affairs (ILAB), intends to award a sole source award to DAI/Nathan Group LLC (DAI) for the purpose of implementing a program to strengthen compliance with international labor standards in Vietnam, focusing specifically on improving labor administration, freedom of association, collective bargaining and dispute resolution. Total Estimated Value of the Grant/Agreement Action: $1,500,000. Anticipated Length of Agreement: Two (2) years (9/30/2011 to 9/30/ 2013). Grant Authority: Department of Labor Manual Series (DLMS)-2, Chapter 830(g)(3): The Recipient, DAI, has unique qualifications to perform the type of activity to be funded.. DAI, through its Industrial Relations Promotion Project (IRRP), is the only organization that has the recognized authority and capacity to fulfill the intent of the IRRP Phase II in Vietnam. DAI/IRRP has worked closely with the Government of Vietnam and worker and employer organizations. Given the complexity of building working relationships and trust with Vietnamese counterparts, DAI has made great strides on that front and, as a result, is uniquely positioned to be an effective implementing partner, particularly in building labor inspectorate capacity. DAI/IRRP is the only organization that can continue these efforts without interruption in support of the implementation of Vietnam's new legislation and consistent with USG trade and Labor Dialogue-related efforts. The Project will continue to work in coordination with other USAID funded DAI projects in Vietnam. DAI's Support for Trade Acceleration Project (STAR Plus) supports the Government of Vietnam's efforts to implement trade and investment reform to attract investment and promote private sector growth and has worked with the Ministry of Justice on law and judicial reform. DAI's Vietnam Competitiveness Initiative Phase II Project (VNCI) works with STAR Plus and the Government of Vietnam to improve government administration, reduce the regulatory burden on the private sector, and generate new employment. In Phase I, IRRP has engaged in a number of activities that directly support Phase II objectives. The US embassy provided a letter in support of continued funding of DAI/IRRP based, on part, on the importance of the objectives and DAI/IRRP unique qualifications to achieve them. Recipient Involvement: DAI will: Strengthen the effectiveness of Vietnam's labor administration, with a focus on the labor inspection system, its management, regulations, data collection, training, research and related areas. Promote collective bargaining and the prevention and resolution of collective disputes and sound industrial relations by developing approaches in cooperation with trade unions/worker organizations, employers and MOLISA. Help develop dispute resolution systems in new legislation for interest-based and rights-based disputes. Strengthen capacity in worker organizations to organize and effectively represent workers in the private sector. Key Dates: This notice will remain open for approximately three days from posting in the Federal Register. The Cooperative Agreement is projected for award on or before September 30, 2011. Meeting of the Defense Advisory Committee on Women in the Services (DACOWITS)
Pursuant to Section 10 (a), Public Law 92-463, as amended, notice is hereby given of a forthcoming meeting of the Defense Advisory Committee on Women in the Services (DACOWITS). The purpose of the meeting is for the Committee to receive a follow-up briefing from the Sexual Assault Prevention and Response Office and the Services on the Committee's requests for information concerning sexual assault and sexual harassment. Additionally, the Committee will develop and approve recommendations for the 2011 report. The meeting is open to the public, subject to the availability of space. Interested persons may submit a written statement for consideration by the Defense Advisory Committee on Women in the Services. Individuals submitting a written statement must submit their statement to the Point of Contact listed below at the address detailed below no later than 5 p.m., Tuesday, September 20, 2011. If a written statement is not received by Tuesday, September 20, 2011, prior to the meeting, which is the subject of this notice, then it may not be provided to or considered by the Defense Advisory Committee on Women in the Services until its next open meeting. The Designated Federal Officer will review all timely submissions with the Defense Advisory Committee on Women in the Services Chairperson and ensure they are provided to the members of the Defense Advisory Committee on Women in the Services. If members of the public are interested in making an oral statement, a written statement should be submitted as above. After reviewing the written comments, the Chairperson and the Designated Federal Officer will determine who of the requesting persons will be able to make an oral presentation of their issue during an open portion of this meeting or at a future meeting. Determination of who will be making an oral presentation is at the sole discretion of the Committee Chair and the Designated Federal Officer and will depend on time available and if the topics are relevant to the Committee's activities. In accordance with the Privacy Act of 1974, the Department of Homeland Security is providing an update notice relating to the Department of Homeland Security system of records titled, ``Department of Homeland Security National Protection and Programs Directorate001 National Infrastructure Coordinating Center Records System of Records.'' Meeting of the Uniform Formulary Beneficiary Advisory Panel; Amended Meeting Notice
Under the provisions of the Federal Advisory Committee Act of 1972 (5 U.S.C. Appendix 2) and the Government in the Sunshine Act of 1976 (5 U.S.C. 552b), and 41 CFR 102-3.150 the Department of Defense announces a change to the previously announced meeting of the Uniform Formulary Beneficiary Advisory Panel. The meeting notice published in the August 16, 2011 edition of the Federal Register (76 FR 50720) is changed to reflect a change in the meeting agenda. The current agenda item, Multiple Sclerosis is replaced with Phosphodiesterase-5 Inhibitors (PDE-5s). The Panel will review and comment on the Phosphodiesterase-5 Inhibitors, Non-Steroidal Anti-Inflammatory Drugs, Contraceptives, Designated Newly Approved Drugs in already reviewed classes and Pertinent Utilization Management Issues. All other aspects of the previously announced meeting agenda remain valid.

In accordance with the Privacy Act of 1974, the Department of Homeland Security proposes to establish a new Department of Homeland Security system of records titled, ``Department of Homeland Security/ ALL034 Emergency Care Medical Records System of Records Notice.'' This system of records will allow the Department of Homeland Security Office of Health Affairs to collect and maintain records on individuals who receive emergency care from Department Emergency Medical Services providers. Individuals in this system include anyone who experiences a medical emergency and is treated by an on-duty Departmental Emergency Medical Services medical care provider. In accordance with the Privacy Act of 1974, the Department of Homeland Security proposes to update and reissue a current Department of Homeland Security system of records titled, ``Department of Homeland Security/Federal Emergency Management Agency001 National Emergency Family Registry and Locator System of Records.'' This system of records allows the Department of Homeland Security/Federal Emergency Management Agency to collect and maintain records on adults displaced from their homes or pre-disaster location after a Presidentially-declared emergency or disaster. This system of records has been updated to include Law Enforcement Officials in categories of records, individuals, routine uses, and record source categories. This updated system will be included in the Department of Homeland Security's inventory of record systems.

Nondisplacement of Qualified Workers Under Service Contracts
In this final rule, the Department of Labor (Department or DOL) issues final regulations to implement Executive Order 13495, Nondisplacement of Qualified Workers Under Service Contracts. The Executive Order establishes a general policy of the Federal Government concerning service contracts and solicitations for service contracts for performance of the same or similar services at the same location. This policy mandates the inclusion of a contract clause requiring the successor contractor and its subcontractors to offer those employees employed under the predecessor contract, whose employment will be otherwise terminated as a result of the award of the successor contract, a right of first refusal of employment under the successor contract in positions for which they are qualified.

Defense Logistics Agency Revised Regulation 1000.22, Environmental Considerations in Defense Logistics Agency Actions
On May 18, 2011, the Defense Logistics Agency (DLA) published a Notice of Availability (NOA) in the Federal Register (76 FR 28757) announcing the revised Defense Logistics Agency Regulation (DLAR) 1000.22, which was available for a 30-day public comment period. DLA received one comment from the Navy stating that a citation within the technical support documentation should be changed. The change has been incorporated. DLAR 1000.22 will be signed into effect upon completion of this publication into the Federal Register.

Privacy Act of 1974; Notice of a Computer Matching Program
Subsection (e)(12) of the Privacy Act of 1974, as amended, (5 U.S.C. 552a) requires agencies to publish advance notice of any proposed or revised computer matching program by the matching agency for public comment; however, this notification will be completed by the DoD, the recipient agency. The DoD, as the recipient agency under the Privacy Act is hereby giving notice to the record subjects of a computer matching program between the Office of Personnel Management (OPM), the source agency and Defense Manpower Data Center (DMDC) that their records are being matched by computer. In accordance with OMB Memoranda M10-06, ``Open Government Directive,'' the U.S. Department of Transportation (Department or DOT) is evaluating the feasibility and value of a new cloud-based platform to connect citizens, businesses, state and local governments, industry, entrepreneurs, researchers, and investors like never beforecreating a thriving marketplace for digital transportation solutions. The Digital Transportation Exchange (DTE) will be a public exchange where citizens, businesses, state and local governments, industry, entrepreneurs, researchers, and investors will converge to find the best way to develop, fund and market the best digital products and services for the transportation industryfrom very simple to very complex. Recognizing that transportation solutions are often adopted locally, this site will provide a single location for all of these local solutions to be showcased nationally, encouraging reuse, investment and improvement. DOT is seeking partners to develop, build and maintain this portal. As part of this evaluation, the Department invites the public to participate in a comment process designed to help the Department develop a feasible and high value concept for this portal and the partnership model designed to sustain it. The Department also will hold a stakeholder meeting to discuss and consider comments. Comments and suggestions from these two forums may be incorporated into a follow on procurement that will be released in 2011 to solicit partners.

Privacy Act; Implementation
The Defense Intelligence Agency (DIA) is adding a new exemption rule for LDIA 0900, entitled ``Accounts Receivable, Indebtedness and Claims'' to exempt those records that have been previously claimed for the records in another Privacy Act system of records. To the extent that copies of exempt records from those other systems of records are entered into these case records, DIA hereby claims the same exemptions for the records as claimed in the original primary system of records of which they are a part. This direct final rule makes nonsubstantive changes to the Defense Intelligence Agency Program rules. These changes will allow the Department to exempt records from certain portions of the Privacy Act. This will improve the efficiency and effectiveness of DoD's program by preserving the exempt status of the records when the purposes underlying the exemption for the original records are still valid and necessary to protect the contents of the records. This rule is being published as a direct final rule as the Department of Defense does not expect to receive any adverse comments, and so a proposed rule is unnecessary.

The update of the exemption will more accurately describe the basis for exempting the records. The Privacy Act system of records notice, S500.20, entitled ``Defense Logistics Agency Criminal Incident Reporting System Records'', has already been published on June 8, 2009, in the Federal Register. This direct final rule makes nonsubstantive changes to the Defense Logistics Agency Privacy Program rules. These changes will allow the Department to exempt records from certain portions of the Privacy Act. This will improve the efficiency and effectiveness of DoD's program by preserving the exempt status of the records when the purposes underlying the exemption are valid and necessary to protect the contents of the records.This rule is being published as a direct final rule as the Department of Defense does not expect to receive any adverse comments, and so a proposed rule is unnecessary.
