U.S. Travel and Tourism Advisory Board: Meeting of the U.S. Travel and Tourism Advisory Board
The U.S. Travel and Tourism Advisory Board (Board) will hold a meeting to discuss a Gulf Coast Recovery Plan and a Travel and Tourism Strategic Plan. The Board was established on October 1, 2003, and reconstituted on October 1, 2005, to advise the Secretary of Commerce on matters relating to the travel and tourism industry.
Dynamic Random Access Memory Semiconductors from the Republic of Korea: Final Results of Countervailing Duty Administrative Review
On September 15, 2005, the Department of Commerce (``the Department'') published in the Federal Register its preliminary results of administrative review of the countervailing duty order on dynamic random access memory semiconductors (``DRAMS'') from the Republic of Korea (``Korea'') for the period April 7, 2003, through December 31, 2003. This review covers one company, Hynix Semiconductor, Inc. (``Hynix''). We gave interested parties an opportunity to comment on the preliminary results. Based on information received since the preliminary results and our analysis of the comments received, the Department has revised the net subsidy rate for Hynix. The final net subsidy rate for the reviewed company is listed below in the section entitled ``Final Results of Review.''
Certain Frozen Fish Fillets From the Socialist Republic of Vietnam: Final Results of the First Administrative Review
On September 13, 2005, the Department of Commerce (the ``Department'') published in the Federal Register the preliminary results of the first administrative review of the antidumping duty order on certain frozen fish fillets from the Socialist Republic of Vietnam (``Vietnam''). See Certain Frozen Fish Fillets From the Socialist Republic of Vietnam: Preliminary Results and Preliminary Partial Rescission of Antidumping Duty Administrative Review, 70 FR 54007 (September 13, 2005) (``Preliminary Results''). We gave interested parties an opportunity to comment on the Preliminary Results. As a result, we made changes to the dumping margin calculations for the final results. Market Economy Inputs Practice in Antidumping Proceedings involving Non-Market Economy Countries
The Department of Commerce (``the Department'') is considering amending its regulations with respect to the use of market economy inputs in the calculation of normal value in antidumping proceedings involving non-market economy (``NME'') countries. Specifically, in cases where an NME producer sources an input from both market-economy suppliers and from within the NME, this regulatory change would increase the Department's flexibility to value the input by weight- averaging the market economy purchase price with an appropriate surrogate value. The Department also intends to introduce an interim change in its practice that is consistent with the Department's regulations. Interested parties are invited to comment on these proposals.
Notice of Initiation and Preliminary Results of Changed Circumstances Antidumping Duty Review: Stainless Steel Wire Rod from Italy
The Department of Commerce (the Department) has received information sufficient to warrant initiation of a changed circumstances review of the antidumping duty order on stainless steel wire rod (SSWR) from Italy. Based on this information, we preliminarily determine that: 1) Acciaierie Valbruna S.p.A. (Valbruna S.p.A.) is the successor-in- interest to Acciaierie Valbruna S.r.l. (Valbruna S.r.l.) and its subsidiary Acciaierie Bolzano S.p.A. (Bolzano S.p.A.), a respondent in the less-than-fair-value (LTFV) investigation; and 2) merchandise from Acciaierie Valbruna S.p.A. should be excluded from the antidumping duty order. Interested parties are invited to comment on these preliminary results.
Notice of Amended Final Results of the Eleventh Administrative Review of the Antidumping Duty Order on Certain Corrosion-Resistant Carbon Steel Flat Products from the Republic of Korea.
On February 13, 2006, the Department of Commerce (the Department) published its final results of the eleventh administrative review for certain corrosion-resistant carbon steel flat products (CORE) from the Republic of Korea (Korea) for the period from August 1, 2003 through July 31, 2004. See Notice of Final Results of the Eleventh Administrative Review of the Antidumping Duty Order on Certain Corrosion-Resistant Carbon Steel Flat Products from the Republic of Korea, 71 FR 7513 (February 13, 2006), (Final Results). We are amending our Final Results to correct a ministerial error made in the calculation of the dumping margin for Union Steel Manufacturing Co., Ltd. (Union), pursuant to section 751 (h) of the Tariff Act of 1930, as amended (the Act).
Notice of Rescission of Antidumping Duty Administrative Review; Oil Country Tubular Goods, Other Than Drill Pipe, from Argentina
In response to a request from the petitioner, the Department of Commerce (the Department) initiated an administrative review of the antidumping duty order on oil country tubular goods (OCTG) from Argentina. This review covers one manufacturer/exporter of the subject merchandise, Siderca S.A.I.C. (Siderca). The Department is now rescinding this review based on record evidence indicating that the respondent had no entries of subject merchandise during the period of review (POR). The POR is August 1, 2004 through July 31, 2005.
Freshwater Crawfish Tail Meat From the People's Republic of China: Notice of Postponement of Time Limits for New Shipper Antidumping Duty Reviews in Conjunction With Administrative Review
On February 16, 2006, and February 21, 2006, in accordance with 19 CFR 351.214(j)(3), Xuzhou Jinjiang Foodstuffs Co., Ltd. (``Jinjiang'') and Xiping Opeck Food Co. Ltd. (``Opeck''), respectively, agreed to waive the time limits in section 351.214(i) of the Department of Commerce's (``the Department'') regulations so that the Department may conduct the new shipper reviews of freshwater crawfish tail meat from the People's Republic of China (``PRC''), for the period September 1, 2004, through August 31, 2005, concurrently with the administrative review for the same period. Therefore, pursuant to Opeck and Jinjiang's requests and in accordance with the Department's regulations, we will conduct the administrative and new shipper reviews concurrently. The deadline for the preliminary results for the new shipper reviews, originally scheduled for May 1, 2006, will now be June 2, 2006, and the estimated deadline for the finals results will now be September 30, 2006.
Notice of Final Results of Antidumping Duty Changed Circumstances Review: Certain Softwood Lumber Products from Canada
The Department of Commerce (the Department) has determined, pursuant to section 751(b) of the Tariff Act of 1930, as amended (the Act), that the post-acquisition West Fraser Mills Ltd. (West Fraser) is the successor-in-interest to pre-acquisition West Fraser and, as a result, should continue to be accorded the same treatment previously accorded with regard to the antidumping order on certain softwood lumber products from Canada as of the date of publication of this notice in the Federal Register.
Certain Corrosion-Resistant Carbon Steel Flat Products from Canada: Final Results of Antidumping Duty Administrative Review
On September 9, 2005, the Department of Commerce (Department) published the preliminary results of its administrative review of the antidumping duty order on certain corrosion-resistant carbon steel flat products (CORE) from Canada. See Certain Corrosion-Resistant Carbon Steel Flat Products from Canada: Preliminary Results of Antidumping Duty Administrative Review, 70 FR 53621 (September 9, 2005) (Preliminary Results). The review covers shipments of this merchandise to the United States for the period August 1, 2003, through July 31, 2004, made by Dofasco Inc., Sorevco Inc. (Sorevco), and Do Sol Galva Ltd. (collectively Dofasco), and by Stelco Inc. We gave interested parties an opportunity to comment on our Preliminary Results. Based on our analysis of comments, we have made changes in the margin calculations. Therefore, the final results differ from the preliminary results. For the final dumping margins, see the ``Final Results of Review'' section below.
Notice of Final Results of Antidumping Duty Changed Circumstances Review, and Determination To Revoke Order in Part: Certain Cased Pencils From the People's Republic of China
On August 30, 2005, the Department of Commerce (the Department) published a notice of initiation of an antidumping duty changed circumstances review of the antidumping duty order on certain cased pencils (pencils) from the People's Republic of China (PRC). See Notice of Initiation of Antidumping Duty Changed Circumstances Review: Certain Cased Pencils from the People's Republic of China, 70 FR 51336 (August 30, 2005) (Initiation). The Department published the preliminary results of this review on January 3, 2006. See Notice of Preliminary Results of Antidumping Duty Changed Circumstances Review and Intent to Revoke Order in Part: Certain Cased Pencils from the People's Republic of China, 71 FR 92 (January 3, 2006) (Preliminary Results). We are now revoking this order, in part, with respect to pencils meeting the specifications described below, based on the fact that domestic interested parties \1\ have expressed no objection to exclusion of these pencils from the order.
Oil Country Tubular Goods, Other Than Drill Pipe, from Korea: Final Results of Antidumping Duty Administrative Review
On September 8, 2005, the Department of Commerce (``the Department'') published the preliminary results of its administrative review of the antidumping duty order on oil country tubular goods (OCTG), other than drill pipe, from Korea. Certain Cut-to-Length Carbon-Quality Steel Plate Products From the Republic of Korea: Final Results of Antidumping Duty Administrative Review
On November 7, 2005, the Department of Commerce (the ``Department'') published the preliminary results of the administrative review of the antidumping duty order on certain cut-to-length carbon- quality steel plate products (steel plate) from the Republic of Korea. See Certain Cut-to-Length Carbon-Quality Steel Plate Products From the Republic of Korea: Preliminary Results and Rescission in Part of Antidumping Duty Administrative Review, 70 FR 67428 (November 7, 2005) (``Preliminary Results''). This review covers one producer/exporter of steel plate. The period of review (POR) is February 1, 2004, through January 31, 2005. Based on our analysis of the comments received, we have made changes to the margin calculation. Therefore, these final results differ from the Preliminary Results. The final weighted-average dumping margin for the reviewed firm is listed below in the section entitled ``Final Results of Review.''
Antifriction Bearings (Other Than Tapered Roller Bearings) and Parts Thereof from France, Germany, Italy, and the United Kingdom; Amended Final Results of Antidumping Duty Administrative Reviews Pursuant to Final Court Decisions
On October 19, 2005, in response to its action in SNR Roulements et al. v. United States, Consol. Court No. 97-10-01825, Slip Op. 05-67 (June 13, 2005), the United States Court of International Trade (CIT) affirmed the Department of Commerce's (the Department's) remand redetermination concerning the final assessment rates for the administrative review of the antidumping duty order on antifriction bearings and parts thereof (AFBs) from France. On October 28, 2005, in response to its actions in NTN Bearing Corp. of America et al. v. United States, Court No. 97-10-01800 (July 7, 2005), and FAG Italia S.p.A. et al. v. United States, Court No. 97-02-00260-S (July 7, 2005), the CIT affirmed the Department's remand redetermination concerning the final assessment rates for the administrative reviews of the antidumping duty orders on AFBs from Germany and Italy. On November 4, 2005, in response to its action in FAG Kugelfischer Georg Schafer AG et al. v. United States, Court No. 97-02-00260 (July 7, 2005), the CIT affirmed the Department's remand redetermination concerning the final assessment rates for the administrative reviews of the antidumping duty orders on AFBs from Germany. On April 27, 2001, the CIT affirmed the Department's remand redetermination with respect to the antidumping duty orders on AFBs from France. See SKF USA Inc. et al. v. United States, Consol. Court No. 97-02-00269-S1, Slip. Op. 01-54 (April 27, 2001). On December 21, 2000, the CIT affirmed the Department's remand redetermination with respect to the antidumping duty orders on AFBs from the United Kingdom. See RHP Bearings Ltd. et al v. United States, Consol. Court No. 97-02- 00217, Slip Op. 00-168 (December 21, 2000). The periods covered by these administrative reviews are May 1, 1994, through April 30, 1995, and May 1, 1995, through April 30, 1996. The merchandise covered by these reviews are ball bearings and parts thereof (BBs), cylindrical roller bearings and parts thereof (CRBs), and spherical plain bearings and parts thereof (SPBs). Because the time period for filing an appeal has expired and there are now final and conclusive court decisions in these actions, we are amending our final results of the reviews and we will instruct U.S. Customs and Border Protection to liquidate entries subject to these reviews.
Stainless Steel Butt-Weld Pipe Fittings From Korea; Notice of Final Results of Antidumping Duty Administrative Review
On November 7, 2005, the Department of Commerce (the Department) published the preliminary results of administrative review of the antidumping order covering stainless steel butt-weld pipe fittings from Korea. See Stainless Steel Butt-Weld Pipe Fittings from Korea; Notice of Preliminary Results of Antidumping Duty Administrative Review, 70 FR 67444 (November 7, 2005) (Preliminary Results). The merchandise covered by this order is stainless steel butt-weld pipe fittings as described in the ``Scope of the Order'' section of this notice. The period of review (POR) is February 1, 2004, through January 31, 2005. We invited parties to comment on our Preliminary Results. We received no comments. Therefore, the final results are unchanged from those presented in the preliminary results. The final weighted-average dumping margin for the reviewed firm is listed below in the section entitled ``Final Results of the Review.''
North American Free Trade Agreement (NAFTA), Article 1904 Binational Panel Reviews: Notice of Consent Motion To Dismiss Panel Review
Pursuant to the Notice of Consent Motion to Dismiss the Panel Review by the complainants, the panel review is dismissed as of March 6, 2006. Pursuant to Rule 71(2) of the Rules of Procedure for Article 1904 Binational Panel Review, this panel review is dismissed.
Gray Portland Cement and Clinker from Mexico: Agreement Between the Office of the United States Trade Representative, The United States Department of Commerce and Secretaria de Economia of Mexico on Trade in Cement
The Office of the United States Trade Representative (USTR) and the United States Department of Commerce (Commerce) have entered into an agreement with the Secretaria de Economia of Mexico pertaining to imports of gray portland cement and clinker from Mexico (Mexican Cement). The Agreement Between the Office of the United States Trade Representative and the Department of Commerce of the United States of America and the Ministry of Economy of the United Mexican States (Secretaria de Economia) on Trade in Cement (Agreement) provides for the settlement or suspension of ongoing litigation before North American Free Trade Agreement (NAFTA) and World Trade Organization (WTO) panels challenging various antidumping duty determinations involving Mexican Cement. In addition, Commerce has agreed to compromise its claims for duties with respect to entries of Mexican Cement not currently in litigation. Finally, the Agreement creates a system whereby Mexican Cement imports will be subject to regional export limits, which will be monitored by both Commerce and Secretaria de Economia through export license and import license systems. The Agreement provides that, if Mexican Cement producers successfully abide by the terms of the Agreement for three years, then the antidumping duty order will be revoked with respect to those producers.
Notice of Preliminary Results of Antidumping Duty Changed Circumstances Review; Certain Forged Stainless Steel Flanges From India
On January 4, 2006, the Department of Commerce (the Department) published a notice of initiation of changed circumstances review of the antidumping duty order on certain forged stainless steel flanges (flanges) from India to determine whether Hilton Metal Forging Ltd. (HMFL) is the successor-in-interest company to Hilton Forge. See Notice of Initiation of Antidumping Duty Changed Circumstances Review: Certain Forged Stainless Steel Flanges from India, 71 FR 327 (January 4, 2006). We have preliminarily determined that HMFL is the successor- in-interest to Hilton Forge for purposes of determining antidumping liability in this proceeding. Interested parties are invited to comment on these preliminary results.
Ball Bearings and Parts Thereof from France, Germany, Italy, Japan, and the United Kingdom: Preliminary Results of Antidumping Duty Administrative Reviews
In response to requests from interested parties, the Department of Commerce (the Department) is conducting administrative reviews of the antidumping duty orders on ball bearings and parts thereof from France, Germany, Italy, Japan, and the United Kingdom. The merchandise covered by these orders are ball bearings and parts thereof (ball bearings) from France, Germany, Italy, Japan, and the United Kingdom. The reviews cover 14 manufacturers/exporters. The period of review is May 1, 2004, through April 30, 2005. We have preliminarily determined that sales have been made below normal value by various companies subject to these reviews. If these preliminary results are adopted in our final results of administrative reviews, we will instruct U.S. Customs and Border Protection (CBP) to assess antidumping duties on all appropriate entries. We invite interested parties to comment on these preliminary results. Parties who submit comments in these reviews are requested to submit with each argument (1) a statement of the issue and (2) a brief summary of the argument.
Certain Hot-Rolled Carbon Steel Flat Products From Japan: Preliminary Results of Antidumping Duty Administrative Review
The Department of Commerce (the Department) is conducting an administrative review of the antidumping duty order on certain hot- rolled carbon steel flat products (hot-rolled steel) from Japan in response to a request by Ispat Inland Inc. (Ispat), a petitioner in the original investigation, and Nucor Corporation (Nucor), a domestic producer of hot-rolled steel (collectively, petitioners). Petitioners requested administrative reviews of Kawasaki Steel Corporation (Kawasaki) and JFE Steel Corporation (JFE). This review covers exports of subject merchandise to the United States during the period June 1, 2004 through May 31, 2005. We preliminarily determine that adverse facts available should be applied to JFE and Kawasaki during the period of review (POR) for declining to participate, and for not cooperating with the Department, in this administrative review. Cut-to-Length Carbon Steel Plate From Belgium, Brazil, Finland, Germany, Mexico, Poland, Romania, Spain, Sweden, and the United Kingdom and Carbon Steel Plate From Taiwan; Second Five-year (Sunset) Reviews of Antidumping Duty Orders and Antidumping Finding; Final Results
On November 1, 2005, the Department of Commerce (the Department) initiated sunset reviews of the antidumping duty orders on cut-to-length carbon steel plate (CTL Plate) from Belgium, Brazil, Finland, Germany, Mexico, Poland, Romania, Spain, Sweden, and the United Kingdom and the antidumping finding on carbon steel plate from Taiwan, pursuant to section 751(c) of the Tariff Act of 1930, as amended (the Act). On the basis of the notices of intent to participate and adequate substantive responses filed on behalf of domestic interested parties and no response or inadequate responses from respondent interested parties, the Department conducted expedited sunset reviews of these antidumping duty orders and antidumping finding. As a result of these sunset reviews, the Department finds that revocation of the antidumping duty orders on CTL Plate from Belgium, Brazil, Finland, Germany, Mexico, Poland, Romania, Spain, Sweden, and the United Kingdom and the antidumping finding on carbon steel plate from Taiwan would likely lead to continuation or recurrence of dumping at the levels listed below in the section entitled ``Final Results of Sunset Reviews.''
Heavy Forged Hand Tools, Finished or Unfinished, With or Without Handles, From the People's Republic of China: Preliminary Results of Administrative Reviews and Preliminary Partial Rescission of Antidumping Duty Administrative Reviews
The Department of Commerce (the ``Department'') is conducting administrative reviews of the antidumping duty orders on heavy forged hand tools, finished or unfinished, with or without handles, from the People's Republic of China (``PRC''). These reviews cover imports of subject merchandise from eighteen manufacturers and/or exporters. We preliminarily find that certain manufacturers and/or exporters sold subject merchandise at less than normal value (``NV'') during the period of review (``POR''). We are preliminarily rescinding the reviews for all four orders for Shanghai Xinike Trading Company (``SXT''), for the order on hammers/sledges for Shandong Huarong Machinery Co., Ltd. (``Huarong'') and Iron Bull Industrial Co., Ltd. (``Iron Bull''), and also for the order on picks/mattocks for Huarong and Iron Bull. In addition, we are preliminarily rescinding the review for Iron Bull with respect to the axes/adzes order. If these preliminary results are adopted in our final results of review, we will instruct U.S. Customs and Border Protection (``CBP'') to assess antidumping duties on all appropriate entries. We will issue the final review results no later than 120 days from the date of publication of this notice.
Large Newspaper Printing Presses and Components Thereof, Whether Assembled or Unassembled, from Japan: Final Results of Changed Circumstances Review
The Department has determined to apply an adverse facts available rate of 59.67 percent to Tokyo Kikai Seisakusho, Ltd. (TKS) in the 1997-1998 administrative review under section 776(b) of the Tariff Act of 1930, as amended (the Act), as a result of TKS' misconduct during this review. We are also rescinding the company- specific revocation with respect to TKS and reinstating the order with respect to TKS from September 1, 2000, through September 3, 2001, the day before the effective date of the sunset revocation. Upon the completion of this review, we will reopen for reconsideration the sunset review that resulted in revocation of this order.
Low Enriched Uranium from France: Preliminary Results of Antidumping Duty Administrative Review
The Department of Commerce (the Department) is conducting an administrative review of the antidumping duty order on Low Enriched Uranium (LEU) from France in response to requests by USEC Inc. and the United States Enrichment Corporation (collectively, petitioners) and by Eurodif, S.A.(Eurodif), Compagnie G[eacute]n[eacute]rale Des Mati[egrave]res Nucl[eacute]aires (COGEMA) and COGEMA, Inc. (collectively, Eurodif/COGEMA or the respondent). This review covers sales of subject merchandise to the United States during the period February 1, 2004 through January 31, 2005. We preliminarily determine that U.S. sales have been made below normal value (NV). If these preliminary results are adopted in our final results, we will instruct U.S. Customs and Border Protection (CBP) to assess antidumping duties based on the difference between the constructed export price (CEP) and the NV. The Department of Commerce (the Department) is conducting an administrative review of the antidumping duty order on certain forged stainless steel flanges (stainless steel flanges) from India manufactured by Echjay Forgings Ltd. (Echjay) and Paramount Forge (Paramount). The period of review (POR) covers February 1, 2004, through January 31, 2005. We preliminarily determine that Echjay did not sell subject merchandise at less than normal value (NV) in the United States during the POR. In addition, we preliminarily determine to apply an adverse facts available (AFA) rate to Paramount's sale. We invite interested parties to comment on these preliminary results. The Department of Commerce (the ``Department'') has determined that three requests for a new shipper review of the antidumping duty order on wooden bedroom furniture from the People's Republic of China (``PRC''), received by January 31, 2006, meet the statutory and regulatory requirements for initiation. The period of review (``POR'') of these new shipper reviews is June 24, 2004, through December 31, 2005.
Certain Preserved Mushrooms from the People's Republic of China: Partial Rescission and Preliminary Results of the Sixth Administrative Review
The Department of Commerce (``the Department'') is currently conducting the sixth administrative review of the antidumping duty order on certain preserved mushrooms from the People's Republic of China (``PRC'') covering the period February 1, 2004, through January 31, 2005. This review covers imports of subject merchandise from four manufacturers/exporters: Raoping Yucun Canned Foods Factory (``Raoping Yucun''), Primera Harvest (Xiangfan) Incorporated (``PHX''), Gerber Food (Yunnan) Co., Ltd. (``Gerber'') and Guangxi Yulin Oriental Food Co., Ltd. (``Guangxi Yulin'') . We are preliminarily rescinding the review with respect to Green Fresh Foods (Zhangzhou) Co., Ltd. (``Green Fresh''). We preliminarily find that Yucun sold subject merchandise at less than normal value (``NV'') during the period of review (``POR''). In addition, we find that adverse facts available (``AFA'') are appropriate for PHX, Gerber and Guangxi Yulin. If these preliminary results are adopted in our final results of review, we will instruct U.S. Customs and Border Protection (``CBP'') to assess antidumping duties on all appropriate entries in accordance with these results. We invite interested parties to comment on these preliminary review results and will issue the final review results no later than 120 days from the date of publication of this notice.
Certain Cut-To-Length Carbon-Quality Steel Plate Products From Italy: Preliminary Results and Partial Rescission of Antidumping Duty Administrative Review
In response to a request by Nucor Corporation (Nucor), the Department of Commerce (the Department) is conducting an administrative review of the antidumping duty order on certain cut-to-length carbon- quality steel plate products (CTL Plate) from Italy. The period of review (POR) is February 1, 2004 through January 31, 2005. This review covers five producers/exporters of subject merchandise. Based upon our analysis of the record evidence, we preliminarily find that the application of adverse facts available (AFA) is warranted with respect to Palini and Bertoli S.p.A. (Palini). Further, we are preliminarily rescinding the review with respect to Trametal S.p.A. (Trametal) because there is no entry against which to collect duties. We are also preliminarily rescinding the review for Ilva S.p.A. (Ilva), Metalcam S.p.A. (Metalcam) and Riva Fire S.p.A. (Riva Fire), because they had no shipments during the POR. If these preliminary results are adopted in our final results of administrative review, we will instruct U.S. Customs and Border Protection (CBP) to assess antidumping duties on all appropriate entries. Interested parties are invited to comment on these preliminary results of review. We will issue the final results of review no later than 120 days from the date of publication of this notice.
