The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) have agreed on a final rule amending the Federal Acquisition Regulation (FAR) to implement section 1432 of the National Defense Authorization Act for Fiscal Year 2004. Title XIV of the Act, referred to as the Services Acquisition Report Act of 2003 (SARA), amended section 8002(d) of the Federal Acquisition Streamlining Act of 1994 (FASA) to expressly authorize the use of time-and-materials (T&M) and labor-hour (LH) contracts for certain commercial services under specified conditions.

The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) are proposing to amend the Federal Acquisition Regulation (FAR) to address implementation of Section 104 of the Energy Policy Act of 2005.

The General Services Administration (GSA) is providing notice of a new record system, Excluded Parties List System (GSA/GOVT-8). The system contains information entered by Federal agencies that identifies individuals excluded from Federal Government procurement and nonprocurement programs and the applicable authority for the exclusion. System functions include Web Service capability, ad hoc search and report capabilities, integration with the Central Contractor Registration system to allow Data Universal Numbering System (DUNS) and data sharing capabilities for Debar Maintenance users, and a new data field to accept the reporting of cage codes.

The General Services Administration (GSA), Public Buildings Service (PBS) proposes to establish a system of records subject to the Privacy Act of 1974, 5 U.S.C. 552a. The system of records, eLease (GSA/PBS-5), is an electronic system for managing Federal real property leases and for tracking leasing projects and associated documents. The system will ensure that the leasing program collects, assembles, and maintains information necessary for efficient and cost effective operation, control, and management of Federal leasing by PBS. The system will include personal information of individuals who engage in leasing activities with PBS.

The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) have agreed to convert the interim rule published in the Federal Register at 71 FR 208 on January 3, 2006, to a final rule with changes. This final rule is amending the Federal Acquisition Regulation (FAR) to add the contractor personal identification requirements identified in the Homeland Security Presidential Directive (HSPD) 12, ``Policy for a Common Identification Standard for Federal Employees and Contractors,'' and Federal Information Processing Standards (FIPS) Number 201, ``Personal Identity Verification (PIV) of Federal Employees and Contractors,'' as amended.

The General Services Administration (GSA) is publishing a final notice for the Government-wide system of records, GSA SmartPay[reg] Purchase Charge Card Program (GSA/GOVT-6). This final notice incorporates changes from feedback received to the notice originally published for public comment on June 16, 2006, proposing the establishment of the SmartPay[reg] Purchase Charge Care Program as a system of records under the Privacy Act of 1974, 5 U.S.C. 552a. The feedback was provided by Federal agencies' program coordinators and were minor in nature, consisting of requests for clarification of terms and inclusion of certain examples, i.e., an explanation of what constitutes an ``expert, consultant, or contractor'' in routine use h., and inclusion of ``Approving Agency Officials and Federal agency/ organization program coordinators'' to clarify the types of Federal employees covered by the system. Additionally, minor editorial changes were made to ensure clarity. All changes were agreed to by the individuals who provided the feedback. SUPPLEMENTARY INFORMATION: The GSA SmartPay[reg] Purchase Charge Card Program (GSA/GOVT-6) system of records, for which GSA has Government-wide responsibility, assembles and maintains charge card related information and ensures the efficient and cost effective operation, control, and management of commercial purchasing activities by Federal agencies. The system includes personal information of individuals to enhance the Federal government's ability to monitor official purchases, payments, and expenses involving purchase charge card transactions.

The General Services Administration is reopening the comment period for the subject proposed rule. The proposed rule pertains to amending the Federal Management Regulation (FMR) by revising coverage on personal property and moving it into Subchapter B of the FMR. A proposed rule was published in the Federal Register on September 12, 2006 (71 FR 53646).

The General Services Administration (GSA) is providing notice of a new record system, GSA/PPFM-11 (Pegasys). Pegasys is a commercial- off-the-shelf based financial management system. Effective Date: The system of records will become effective without further notice on November 27, 2006 unless comments received on or before that date result in a contrary determination.

The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) are proposing to amend the Federal Acquisition Regulation (FAR) to implement recommendations to change the regulations related to the administration of the Cost Accounting Standards (CAS).

Pursuant to the Privacy Act of 1974, the General Services Administration (GSA) proposes to establish a new system of records titled the Federal Personal Identity Verification Identity Management System (PIV IDMS) (GSA-GOVT-7). This system will support the implementation of Homeland Security Presidential Directive 12 (HSPD-12) by providing a GSA managed shared infrastructure and services for participating Federal agencies. HSPD-12 requires the use of a common identification credential for both logical and physical access to federally controlled facilities and information systems. This system will enhance security, increase efficiency, reduce identity fraud, and protect personal privacy.
