Proposed Memorandum of Understanding (MOU) Assigning Certain Federal Environmental Responsibilities to the State of California, Including National Environmental Policy Act (NEPA) Authority for Certain Categorical Exclusions (CEs)
This notice announces that the FHWA and the State of California, acting by and through its Department of Transportation (State), propose to enter into a MOU pursuant to 23 U.S.C. 326. The MOU would transfer to the State the FHWA's authority and responsibility for determining whether certain designated activities within the geographic boundaries of the State, as specified in the proposed MOU, are categorically excluded from preparation of an environmental assessment or an environmental impact statement under the National Environmental Policy Act of 1969, 42 U.S.C. 4321 et seq. (NEPA). The MOU also would assign to the State the responsibility for carrying out certain other environmental review, consultation, and related activities for those CE Federal-aid Highway Program projects within the State. The public is invited to comment on any aspect of the proposed MOU, including the types of projects for which CE decision-making authority would be assigned to the State and the scope of the environmental review, consultation, and other activities that would be assigned.

Crash Test Laboratory Requirements for FHWA Roadside Safety Hardware Acceptance
The FHWA proposes to revise its regulation that establishes the general requirements for quality assurance procedures for construction on all Federal-aid highway projects on the National Highway System (NHS).\1\ Specifically, the FHWA proposes to require accreditation of laboratories that conduct crash tests on roadside hardware by an accrediting body that is recognized by the National Cooperation for Laboratory Accreditation (NCLA) or is a signatory to an International Laboratory Accreditation Cooperation (ILAC) Mutual Recognition Arrangement (MRA), an Asia Pacific Laboratory Accreditation Cooperation (APLAC) MRA, or another comparable accreditation body approved by FHWA. The objective of this proposed rule is to improve the agency's ability to determine that crash test laboratories are qualified to conduct and evaluate tests intended to determine the crashworthiness of roadside safety features. Laboratory accreditation is widely recognized as a reliable indicator of technical competence.
Motor Vehicle Registration and Licensed Driver Information
On January 6, 2006, the FHWA published a notice in the Federal Register at 71 FR 969 to solicit public comments on the quality, timeliness, comprehensiveness, and other characteristics of data collected on motor vehicle registration and licensed driver information. Based on public comments received, the FHWA has determined to make a change to the driver's license data definition for teenage drivers, to eliminate the collection of information on disqualified commercial drivers licenses, and to develop enhanced software to receive and process motor vehicle registration and licensed driver data more efficiently.

Solicitation of Applications for Certain Federal-Aid Highway Funding Available in Fiscal Year 2007 Under Federal Highway Discretionary Grant Programs
The purpose of this notice is to solicit applications for Federal grant funding and to issue supplemental notice and information to eligible grantees concerning discretionary grant funds available for obligation in Fiscal Year 2007 under eight discretionary grant programs administered by FHWA. It seeks applications (either new or amended) to the programs that both meet the programs' respective statutory criteria and emphasize the proposed projects' highway safety and congestion reduction benefits. The FHWA will make its funding determinations through a merit-based selection process. Notice of Intent To Prepare an Environmental Impact Statement for the Foothills Parkway Section 8B, Great Smoky Mountains National Park
Pursuant to the National Environmental Policy Act of 1969, 42 U.S.C. 4332(2)(C), the National Park Service (NPS) and the Federal Highway Administration, Eastern Federal Lands Highway Division will serve as joint lead agencies in the preparation of an Environmental Impact Statement (EIS) for the Foothills Parkway Section 8B, Great Smoky Mountains National Park, Tennessee. Section 8B is located in Sevier and Cocke Counties, Tennessee. This effort will analyze the impacts of alternatives for this section of the Foothills Parkway. The public scoping process for this EIS has been initiated with issuance of this notice. The purpose of the scoping process is to elicit public comment regarding the full spectrum of public issues and concern that should be addressed in the EIS process, including a suitable range of alternatives, the nature and extent of potential environmental impacts, and appropriate mitigation strategies. A suitable range of alternatives will be considered along with the no-action alternative, including, but not limited to construction of a road through this section of the Parkway corridor, construction of a trail instead of a road, and construction of a combination road and trail. A scoping newsletter will be prepared in spring 2007 that will detail the issues identified to date. National Safe Routes to School Task Force to the Secretary of Transportation
This document announces a meeting of the National Safe Routes to School Task Force to the Secretary of Transportation. This is the second meeting of the Task Force. The purpose of the Task Force is to advise the Secretary of Transportation, through the Federal Highway Administration (FHWA) Office of Safety, on strategies to advance Safe Routes to School (SRTS) Programs nationwide and to encourage children, including those with disabilities, to walk and bicycle to school pursuant to Section 1404(h) of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) (Pub. L. 109-59, Aug. 10, 2005). This meeting is open to the public and will have time allocated for public testimony. The public is welcome to present written or oral comments to the Task Force.
Revised Record of Decision and Notice of Final Federal Agency Actions on the West 11th Street to Garfield Street, Florence-Eugene Highway: Lane County, OR
The FHWA is issuing this notice to advise the public that a revised record of decision (ROD) has been made for the West 11th Street to Garfield Street, Florence-Eugene-Highway Final Environmental Impact Statement. This notice also announces actions taken by the FHWA that are final agency actions within the meaning of 23 U.S.C. 139(l)(1). These final agency actions relate to a proposed highway project, West 11th Street to Garfield Street, Florence-Eugene Highway in Lane County, Oregon where the revised ROD amends FHWA's April 16, 1990 ROD that had selected Alternative 1 Modified, and selects the no-build alternative. The Final Environmental Impact Statement was approved and published by FHWA in January 1990 and a ROD was issued on April 16, 1990. This revised ROD amends FHWA's April 16, 1990 ROD that had selected Alternative 1 Modified, and selects the no-build alternative. In large part, FHWA selects the no-build alternative in the revised ROD based on: public and resource agency input, including the Oregon DOT; a Lane Council of Governments resolution; and, a conflict assessment report prepared by FHWA and the City of Eugene. While the no-build does not satisfy an existing transportation need in the area, selecting the no- build alternative is in the best overall public interest at this time.

U.S. Institute for Environmental Conflict Resolution; Notice of Final Report of National Outdoor Advertising Control (OAC) Program Assessment and Request for Public Input
In July 2006, the FHWA and the U.S. Institute initiated a neutral assessment of the national Outdoor Advertising Control (OAC) program. The U.S. Institute has submitted the completed assessment report to the FHWA and other interested stakeholders in outdoor advertising, as described in this notice, thereby concluding the assessment process. The FHWA has placed the report in the docket (U.S. Department of Transportation Dockets Management System (DMS), at http:/ /dms.dot.gov, under Docket No. FHWA-2006-25031 and online at https:// www.fhwa.dot.gov/realestate/outad.htm. The FHWA seeks public comment on the assessment report. Comments submitted in response to this notice, together with the assessment report, previously submitted public comments, and other information relevant to the OAC program, will be considered by the FHWA when the agency makes future determinations about OAC program needs and the best methods for addressing those needs.

Size and Weight Enforcement and Regulations
This final rule amends the regulations governing the enforcement of commercial vehicle size and weight to incorporate provisions enacted in the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU); the Energy Policy Act of 2005, and; the Transportation, Treasury, Housing and Urban Development, the Judiciary, the District of Columbia, and Independent Agencies Appropriations Act of 2006. This final rule adds various definitions; corrects obsolete references, definitions, and footnotes; eliminates redundant provisions; amends numerical route changes to the National Highway designations; and incorporates statutorily mandated weight and length limit provisions.

The revision results from the passage of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) (Pub. L. 109-59, August 10, 2005), which also incorporates changes initiated in its predecessor legislation, the Transportation Equity Act for the 21st Century (TEA-21) (Pub. L. 105-178, June 9, 1998) and generally will make the regulations consistent with current statutory requirements.

Surface Transportation Project Delivery Pilot Program
Section 6005 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) established a pilot program to allow the Secretary of Transportation to assign, and the State to assume, the Secretary's responsibilities under the National Environmental Policy Act (NEPA) for one or more highway projects. The Secretary may permit not more than five States (including the States of Alaska, California, Ohio, Oklahoma, and Texas) to participate in the program. Upon assigning NEPA responsibilities, the Secretary may further assign to the State all or part of the Secretary's responsibilities for environmental review, consultation or other action required under any Federal environmental law pertaining to the review of a specific project. In order to be selected for the pilot program a State must submit an application to the Secretary. Section 6005 requires the Secretary to promulgate rules that establish requirements relating to information required to be contained in an application by a State to participate in the pilot program. This final rule establishes these application requirements.

Highway Performance Monitoring System-Reassessment
The FHWA is currently conducting a reassessment of the Highway Performance Monitoring System (HPMS), which is a national highway transportation system database maintained and used primarily by the FHWA as a resource for information about the extent, condition, performance, use, and operating characteristics of the Nation's highways. This notice requests public comment on the draft HPMS Reassessment Recommendations Report, which is available in the docket and via the FHWA Web site at www.fhwa.dot.gov/policy/ohpi/hpms/ index.htm. This draft report documents in detail various issues and proposed changes to specific HPMS data items and the associated collecting and reporting procedures based in part upon customer and data provider needs. The FHWA requests public comments on this draft report. The report would enhance and improve HPMS procedures and incorporate changing data customer needs while building a stronger partnership with the HPMS data user and provider community.

In accordance with 23 U.S.C. 148, as amended by section 1401 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), States are required to submit reports describing at least 5 percent of their public road locations exhibiting the most severe safety needs. In addition, these reports shall be made available to the public through the Department of Transportation's Web site.
