Notice of Funding Opportunity for the Advanced Transportation and Congestion Management Technologies Deployment Program

The Fixing America's Surface Transportation (FAST) Act directs the DOT to establish an advanced transportation and congestion management technologies deployment (ATCMTD) initiative. The initiative provides grants to eligible entities to develop model deployment sites for large scale installation and operation of advanced transportation technologies to improve safety, efficiency, system performance, and infrastructure return on investment. The ATCMTD program is funded for fiscal years (FY) 2016 through 2020 at $60 million per FY from amounts authorized under sections 6002(a)(1), 6002(a)(2), and 6002(a)(4) of the FAST Act. This notice is the first of annual solicitations for the ATCMTD program and seeks applications from eligible entities to establish the initial set of model technology deployment sites. The DOT intends for these model technology deployments to help demonstrate how emerging transportation technologies, data, and their applications, which also link to Beyond Traffic 2045, can be effectively deployed and integrated with existing systems to provide access to essential services and other destinations. This also includes efforts to increase connectivity to employment, education, services and other opportunities; support workforce development; and contribute to community revitalization, particularly for disadvantaged groups (e.g., low income groups, persons with visible or hidden disabilities, elderly individuals, and minority populations). The DOT will make no fewer than five and no more than 10 awards of up to $12 million each depending on the number of awards and amounts set aside for DOT administrative expenses.
Notice of Funding Opportunity for Surface Transportation System Funding Alternatives Program

Section 6020 of the Fixing America's Surface Transportation (FAST) Act directs the DOT to establish the Surface Transportation System Funding Alternatives (STSFA) program to provide grants to States to demonstrate user-based alternative revenue mechanisms that utilize a user fee structure to maintain the long-term solvency of the Federal Highway Trust Fund. Section 6020 provides $15 million for fiscal year (FY) 2016 and $20 million for each of FYs 2017-2020 out of funds set aside in section 6002(a)(1), which authorizes funds for the Highway Research and Development Program. These grants shall make up no more than 50 percent of total proposed project costs, with the remainder coming from non-Federal sources. This Notice of Funding Opportunity for the STSFA program seeks applications from States or groups of States.

Surface Transportation Project Delivery Program; TxDOT Audit Report

The Surface Transportation Project Delivery Program (23 U.S.C. 327) allows a State to assume FHWA's environmental responsibilities for review, consultation, and compliance for Federal-aid highway projects. When a State assumes these Federal responsibilities, the State becomes solely responsible and liable for carrying out the responsibilities it has assumed, in lieu of FHWA. Prior to the Fixing America's Surface Transportation (FAST) Act of 2015, the program required semiannual audits during each of the first 2 years of State participation to ensure compliance by each State participating in the program. This notice announces and solicits comments on the second audit report for the Texas Department of Transportation's (TxDOT) participation in accordance to these pre-FAST Act requirements.
National Performance Management Measures: Highway Safety Improvement Program

The purpose of this final rule is to establish performance measures for State departments of transportation (State DOT) to use to carry out the Highway Safety Improvement Program (HSIP) and to assess the: Number of motor vehicle crash-related serious injuries and fatalities; number of serious injuries and fatalities of non-motorized users; and serious injuries and fatalities per vehicle miles traveled (VMT). The FHWA issues this final rule based on section 1203 of the Moving Ahead for Progress in the 21st Century Act (MAP-21), which identifies national transportation goals and requires the Secretary to promulgate a rulemaking to establish performance measures and standards in specified Federal-aid highway program areas. The FHWA also considered the provisions in the Fixing America's Surface Transportation Act (FAST Act) in the development of this final rule. The HSIP is a Federal-aid highway program with the purpose of achieving a significant reduction in fatalities and serious injuries on all public roads, including non- State-owned public roads and roads on tribal lands.
Highway Safety Improvement Program

The purpose of this final rule is to incorporate changes to the Highway Safety Improvement Program (HSIP) regulations to address provisions in the Moving Ahead for Progress in the 21st Century Act (MAP-21) as well as to incorporate clarifications to better explain existing regulatory language. The DOT also considered the HSIP provisions in the Fixing America's Surface Transportation Act (FAST Act) in the development of the HSIP final rule. Specifically, this rule removes the requirement for States to prepare a Transparency Report that describes not less than 5 percent of locations that exhibit the most severe safety needs, removes the High Risk Rural Roads (HRRR) set- aside, and removes the 10 percent flexibility provision for States to use safety funding in accordance with Federal law. This rule also establishes a subset of roadway data elements, and creates procedures to ensure that States adopt and use the subset. Finally, this rule adds State Strategic Highway Safety Plan update requirements and requires States to report HSIP performance targets.

The Manual on Uniform Traffic Control Devices for Streets and Highways (MUTCD) is incorporated in our regulations, approved by FHWA, and recognized as the national standard for traffic control devices used on all streets, highways, bikeways, and private roads open to public travel. This notice terminates the Interim Approval for Use of Clearview Font for Positive Contrast Legends on Guide Signs (IA-5), issued September 2, 2004, as authorized by Section 1A.10 of the MUTCD, and discontinues the provisional use of an alternative lettering style in traffic control device applications. The result of this termination rescinds the use of letter styles other than the FHWA Standard Alphabets on traffic control devices, except as provided otherwise in the MUTCD. Existing signs that use the provisional letter style and comply with the Interim Approval are unaffected by this action and may remain as long as they are in serviceable condition. This action does not create a mandate for the removal or installation of any sign. This action does not amend any provision of the MUTCD.

This NPRM proposes to revise the FHWA/FTA Environmental Impact and Related Procedures and Parks, Recreation Areas, Wildlife and Waterfowl Refuges, and Historic Sites regulations due to MAP-21 changes to the environmental review process that FHWA and FTA have not previously captured in other rulemakings, such as the use of programmatic agreements and the use of single final environmental impact statement/record of decision documents. In addition, FHWA and FTA propose changes to the regulatory text to improve readability and to reflect current practice, consistent with an Executive order to improve regulations and regulatory review. The FHWA and FTA seek comments on the proposals contained in this notice.

Surface Transportation Project Delivery Program; TxDOT Audit Report

Section 1313 of the Moving Ahead for Progress in the 21st Century Act (MAP-21) established the permanent Surface Transportation Project Delivery Program that allows a State to assume FHWA's environmental responsibilities for review, consultation, and compliance for Federal highway projects. This section mandates semiannual audits during each of the first 2 years of State participation to ensure compliance by each State participating in the Program. When a State assumes these Federal responsibilities, the State becomes solely responsible and liable for carrying out the responsibilities it has assumed, in lieu of FHWA. This permanent program follows a pilot program established by Section 6005 of Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), where the State of California assumed FHWA's environmental responsibilities (from June 29, 2007). This notice presents the findings of the first audit report for the Texas Department of Transportation (TxDOT).
Manual for Assessing Safety Hardware (MASH) Transition

In issuing Federal-aid eligibility letters for roadside safety hardware, FHWA currently makes determinations of continued eligibility for modifications to devices tested to the National Cooperative Highway Research Program Report 350 (NCHRP 350). In an effort to facilitate the implementation of the Manual for Assessing Safety Hardware (MASH), FHWA intends to discontinue issuing eligibility letters for requests received after December 31, 2015, for modified NCHRP 350-tested devices that do not involve full scale crash testing to the MASH. Modifications to NCHRP 350-tested devices that have, in the past, been based on engineering analysis or finite element modeling will no longer receive FHWA eligibility letters. Effective January 1, 2016, all changes to NCHRP 350-tested devices will require testing under MASH in order to receive a Federal-aid eligibility letter from FHWA.
Final Designation of the Highway Primary Freight Network

This notice publishes the final designation of the highway- only Primary Freight Network (highway-only PFN). Section 167(d) of title 23, United States Code (U.S.C.) requires the Secretary of Transportation to establish the highway-only PFN and re-designate it every 10 years, giving consideration to certain factors. This designation meets the requirements of the law, but the Department and a multitude of public comments recognize that the highway-only PFN fails to demonstrate that freight moves through a complex and extensive network of highways, railroads, waterways, pipelines, and airways. While specific commodities are likely to be moved on a particular mode or series of modes, a complex multimodal system is required to carry the growing volume of bulk and high-velocity, high-value goods in the United States. In addition, the 27,000-mile cap required by the law does not yield a PFN representative of all the critical highway elements of the United States freight system. While the Department is designating the highway-only PFN to meet the statutory requirements of the authorizing law, the Department is concurrently and simultaneously proposing a comprehensive Multimodal Freight Network for public comment in the draft National Freight Strategic Plan to identify key infrastructure for all modes that is critical for the efficient movement of freight.

This notice announces that FHWA has received and reviewed an application from the Ohio Department of Transportation (ODOT) requesting participation in the Surface Transportation Project Delivery Program (Program). This Program allows FHWA to assign and States to assume, responsibilities under the National Environmental Policy Act of 1969 (NEPA) (42 U.S.C. 4321, et seq.), and all or part of FHWA's responsibilities for environmental review, consultation, or other actions required under any Federal environmental law with respect to one or more Federal highway projects within the State. The FHWA has determined the application to be complete, and developed a draft MOU with ODOT outlining how the State will implement the program with FHWA oversight. Design Standards for Highways

In issuing the final rule, FHWA incorporates by reference the latest versions of design standards and standard specifications previously adopted and incorporated by reference, and removes the corresponding outdated or superseded versions of these standards and specifications. This rule also makes technical changes to the regulatory text consistent with updated Federal Register procedures.
