Freedom of Information Act Regulations
On July 1, 2022, the Central Intelligence Agency (CIA or the Agency) submitted a proposed rule for comment on its public regulations governing its implementation of the Freedom of Information Act (FOIA), as amended by the FOIA Improvement Act of 2016. The CIA has reviewed and carefully considered all of the comments that were submitted in response to its proposal. As a result of that review, the CIA hereby issues its final rule on its FOIA regulations concerning the requirements for filing FOIA requests and CIA's procedures for processing and reviewing such requests.
Conduct on Agency Installations
The Central Intelligence Agency (CIA) is amending its installation security regulations to include Office of the Director of National Intelligence (ODNI) property in the definition of Agency installation, which reflects the Agency's authority to provide security on ODNI installations. The CIA is also removing the exemption for Federal officials or members of the Armed Forces from its prohibition on carrying weapons on Agency installations, except when such persons are either authorized by the CIA Director of Security or otherwise authorized by law for the performance of official law enforcement duties. This amendment also revises the definition of weapon to permit small amounts of irritant gas on Agency installations and revises the penalties provision to clarify that the penalty for a violation of these regulations is up to a Class C misdemeanor.
Privacy Act of 1974; System of Records
Notice is hereby given that the Central Intelligence Agency (``CIA'' or ``the Agency'') is submitting to the Federal Register a total of forty two (42) System of Records Notices (SORNs), and nineteen (19) General Routine Uses. Of the total package, CIA has significantly modified seven (7) existing SORNs, rescinded five (5) SORNs, created two (2) new SORNs. With respect to CIA's routine uses, the Agency modified one (1) General Routine Use, and created five (5) new General Routine Uses. (CIA-33) is not reissued and remains in effect as published on July 22, 2005. The remaining SORNs and General Routine Uses contain updates with respect to organizational changes at CIA, as well as new requirements set by OMB.
Privacy Act of 1974; System of Records and Routine Uses
Pursuant to the Privacy Act of 1974, as amended, and Office of Management and Budget (OMB) Circular No. A-108, notice is hereby given that the Central Intelligence Agency (CIA or ``the Agency'') is modifying one of its system of records notices, CIA-21, Applicant Records, to reflect the Agency's maintenance of records on prospective applicants.
Access to Classified Information by Historical Researchers and Certain Former Government Personnel
Consistent with Executive Order 13526, the Central Intelligence Agency (CIA) is providing greater clarity about the procedures under which it may provide historical researchers and certain former Government personnel with access to classified CIA information. This rule is being issued as a final rule without prior notice of proposed rulemaking as allowed by the Administrative Procedure Act for rules of agency procedure and interpretation.
Special Procedures for Discretionary Access to Classified Historical Central Intelligence Agency Records Requested by Other Federal Agencies in Furtherance of Historical Research
Consistent with the National Security Act of 1947, as amended, the Central Intelligence Agency Act of 1949, as amended, and Executive Order 13526, as amended (or successor Orders), and section 1.6 of Executive Order 12333, as amended (or successor Orders), CIA is providing greater clarity about the procedures under which, as a matter of discretion, it may provide access to classified historical CIA records requested by other Federal agencies in furtherance of historical research when such access is not expressly required by statute. This rule is being issued as a final rule without prior notice of proposed rulemaking as allowed by the Administrative Procedure Act for rules of agency procedure and interpretation.
Notice of Decennial Review of Operational Files Designations
The Central Intelligence Agency (CIA or Agency) is soliciting comments regarding the historical value of, or other public interest in, the CIA files designated by the Director of the Central Intelligence Agency (DCIA) pursuant to the CIA Information Act of 1984.
Access by Historical Researchers and Certain Former Government Personnel; Correction
On September 23, 2011, the Central Intelligence Agency published a final rule resulting from a review of its public regulations on access by historical researchers and certain former government personnel. As a result of the review, the Agency has revised its access regulations to more clearly reflect the current CIA organizational structure and policies and practices, and to eliminate ambiguous, redundant and obsolete regulatory provisions. Due to a technical error in the review process, an amendment was worded inaccurately. This document corrects that error.
Information Security Regulations
The Central Intelligence agency is removing certain information security regulations which have become outdated. The Executive Order upon which the regulations are based has been superseded, and the regulations are no longer needed.

As a result of this review, the Agency proposes to revise its FOIA regulations to more clearly reflect the current CIA organizational structure, record system configuration, and FOIA policies and practices and to eliminate ambiguous, redundant and obsolete regulatory provisions. As required by the FOIA, the Agency is providing an opportunity for interested persons to submit comments on these proposed regulations.

Classification Challenge Regulations
Consistent with Executive Order 13526, the Central Intelligence Agency (CIA) has undertaken and completed a review of its public Classification Challenge regulations. As a result of this review, the Agency has revised its Classification Challenge regulations to more clearly reflect the current CIA organizational structure and policies and practices, and to eliminate ambiguous, redundant and obsolete regulatory provisions. This rule is being issued as a final rule without prior notice of proposed rulemaking as allowed by the Administrative Procedures Act for rules of agency procedure and interpretation and the CIA Act.
Mandatory Declassification Review
Consistent with Executive Order 13526, the Central Intelligence Agency (CIA) has undertaken and completed a review of its public Mandatory Declassification Review (MDR) regulations that govern certain aspects of its processing of MDR requests. As a result of this review, the Agency has revised its MDR regulations to more clearly reflect the current CIA organizational structure and policies and practices, and to eliminate ambiguous, redundant and obsolete regulatory provisions. This rule is being issued as a final rule without prior notice of proposed rulemaking as allowed by the Administrative Procedure Act for rules of agency procedure and interpretation.

FOIA Processing Fees
On January 8, 2007, the Central Intelligence Agency submitted a proposed rule for public comment on Freedom of Information Act processing fees to the Federal Register. The CIA has reviewed and carefully considered all of the comments that were submitted in response to our proposal. As a result of that review, the CIA hereby issues its final rule on FOIA processing fees.
FOIA Processing Fees
Consistent with the Freedom of Information Act (FOIA) and Executive Order 13392, the Central Intelligence Agency (CIA) has undertaken and completed a zero-based review of its public FOIA regulations governing fees associated with the processing of FOIA requests. As a result of this review, the Agency proposes to revise its fee-related regulations to eliminate unnecessary restrictions on FOIA requesters and to consolidate all regulatory requirements regarding FOIA fees in one subsection of the Code of Federal Regulations. As required by the FOIA, the Agency is providing an opportunity for interested persons to submit comments on these proposed regulations.
Privacy Act of 1974; System of Records and Routine Uses
The Central Intelligence Agency has undertaken and completed an Agency-wide review of its Privacy Act systems of records. As a result of this review, in the May 24 2005 issue of the Federal Register, the Agency solicited public comments on the complete set of proposed revised Privacy Act systems of records notices, the proposed modification of one of its existing routine uses, and the proposed addition of seven new routine uses to its ``Statement of General Routine Uses'' for information subject to the Privacy Act. As required by the Privacy Act, the Agency provided an opportunity for interested persons to submit comments on these notices and routine uses. The Agency did not receive any comments.
Fleet Alternative Fuel Use and Vehicle Acquisition Report for Fiscal Years 2004 and 2005 (Through June 2005)
Pursuant to the Energy Policy Act of 1992 (EPAct) (42 U.S.C. 13218(b)) and Executive Order 13149, the Central Intelligence Agency gives notice of its intention to make its Fleet Alternative Fuel Use and Vehicle Acquisition Report for Fiscal Years 2004 and 2005 (through June 2005) available on-line as of July 14, 2005, at https:// www.cia.gov/cia/reports/afvreports/2005/ and at https:// www.cia.gov/cia/reports/afvreports/2005/report.pdf.
