Tris(2-chloroethyl) Phosphate (TCEP); Draft Risk Evaluation under the Toxic Substances Control Act (TSCA); Letter Peer Review; Request for Nominations of Expert Reviewers
The Environmental Protection Agency (EPA) is seeking public nominations of scientific and technical experts to review the draft Risk Evaluation for Tris(2-chloroethyl) Phosphate (TCEP) conducted under the Toxic Substances Control Act (TSCA). The draft risk evaluation will be released for public review and comment in December 2023 through a separate Federal Register document and subsequently submitted for letter peer review by the expert reviewers.

The Environmental Protection Agency (EPA) is planning to submit an information collection request (ICR), Materials Management Information Collection Request (EPA ICR Number 2789.01, OMB Control Number 2050- NEW) to the Office of Management and Budget (OMB) for review and approval in accordance with the Paperwork Reduction Act. Before doing so, EPA is soliciting public comments on specific aspects of the proposed information collection as described below. This is a request for approval of a new collection. This notice allows for 60 days for public comments.
Air Plan Approval; Washington; Southwest Clean Air Agency, General Air Quality Regulations
The Environmental Protection Agency (EPA) is approving revisions to the Washington State Implementation Plan (SIP) that were submitted on June 22, 2023, by the Department of Ecology in coordination with the Southwest Clean Air Agency (SWCAA). In 2017, the EPA approved a comprehensive update to SWCAA 400 General Regulations for Air Pollution Sources in the SIP, which includes new source review permitting requirements as well as other general requirements for sources regulated under SWCAA's jurisdiction. In this action, the EPA is approving minor updates to SWCAA 400 promulgated since our comprehensive approval in 2017.
Federal “Good Neighbor Plan” for the 2015 Ozone National Ambient Air Quality Standards; Response to Additional Judicial Stays of SIP Disapproval Action for Certain States
The Environmental Protection Agency (EPA) is taking interim final action to stay, for emissions sources in Alabama, Minnesota, Nevada, Oklahoma, Utah, and West Virginia only, the effectiveness of the Federal Implementation Plan (FIP) requirements established to address the obligations of these and other States to mitigate interstate air pollution with respect to the 2015 national ambient air quality standards (NAAQS) for ozone (the Good Neighbor Plan). The EPA is also revising certain other regulations to ensure the continued implementation of previously established requirements to mitigate interstate air pollution with respect to other ozone NAAQS while the Good Neighbor Plan's requirements are stayed. The stay and the associated revisions to other regulations are being issued in response to judicial orders that partially stay, pending judicial review, a separate EPA action which disapproved certain State Implementation Plan (SIP) revisions submitted by these and other States.
Air Plan Approval; Indiana; ArcelorMittal and NIPSCO Sulfur Dioxide Revisions
The Environmental Protection Agency (EPA) is approving, under the Clean Air Act (CAA), revisions to the sulfur dioxide (SO2) portion of the Indiana State Implementation Plan (SIP). The state of Indiana is requesting revisions to emission limits at the Northern Indiana Public Service Company Bailly Station (NIPSCO) facility reflecting permanently shut down units. Indiana is also requesting SIP revisions for two facilities formerly owned by ArcelorMittal USA LLC and currently owned by Cleveland-Cliffs LLC (the Indiana Harbor East and Indiana Harbor West facilities). The Indiana Harbor East facility is required to demonstrate continuous compliance with final SO2 emission limits as a daily (24-hour) average. These revisions will result in decreases in allowable SO2 emissions at all three facilities, maintaining SO2 attainment/unclassifiable designations for the 2010 1-hour SO2 national ambient air quality standards (NAAQS). EPA proposed to approve this action on June 26, 2023, and received no adverse comments.
Hazardous Waste Management System; Identification and Listing of Hazardous Waste;Proposed Rule
The Environmental Protection Agency (EPA) is proposing to grant an exclusion from the list of hazardous wastes to WRB Refining LP (Petitioner) located in Borger, Texas. This action responds to a petition to exclude (or ``delist'') up to 7,000 cubic yards per year of solids removed from four stormwater tanks from the list of federal hazardous wastes when disposed of in a Resource Conservation Recovery Act (RCRA) Subtitle D Landfill. The EPA is proposing to grant the petition based on an evaluation of waste-specific information provided by the Petitioner. A previous proposed action was published in the Federal Register on November 23, 2022, that proposed to grant this petition (see Docket ID Number EPA-R06-RCRA-2022-0653). However, after the proposed rule was published, EPA received notification during the public comment period from the Petitioner that the table detailing the delisting constituents and levels was incorrect. After review, EPA agreed that the information contained in the table in question was incorrect. EPA has corrected the table to reflect the appropriate constituents and values and is withdrawing the previously published proposed rule from November 23, 2022. EPA is issuing a new action proposing to grant the petition, which will include a new 30-day comment period.
Approval of Air Quality Implementation Plans; New Jersey; Exemptions To Improve Resiliency, Air Toxics Thresholds, PM2.5 and Ammonia Emission Statement Reporting, and PM2.5 in Air Permitting
The Environmental Protection Agency (EPA) is proposing to approve adoptions, repeals, and amendments to the New Jersey State Implementation Plan (SIP) concerning exemptions to improve resiliency during emergency situations, updates to hazardous air pollutant (HAP) reporting thresholds, updates to the certification and submission of emission statements, and the addition of Federal New Source Review (NSR) requirements for fine particles (PM2.5). The intended effect of New Jersey's revisions are to enable government and business entities to be more resilient during and following disruptions from natural and human-caused disasters; update HAP unit risk factors and reference concentrations to reflect current research, scientific, and technological advancements; update provisions to require the reporting of PM2.5 and ammonia (NH3) emissions at the source level and update the electronic reporting of emission statements to adapt with advancements and Federal requirements; and conform the State's rules on air permits to the EPA's NSR requirements for PM2.5 to ensure a source does not adversely impact the EPA established National Ambient Air Quality Standards (NAAQS). Other revisions New Jersey made, which the EPA is proposing to approve with this notice of proposed rulemaking, will conform administrative penalties to the proposed rules and correct errors and inconsistencies throughout the State's SIP.
Metamitron; Receipt of Application for Emergency Exemption, Solicitation of Public Comment
EPA has received specific exemption requests from the Colorado and Nebraska Departments of Agriculture to use the pesticide metamitron (CAS No. 41394-05-2) to treat up to 69,596 acres of sugar beets to control the invasive weed, Palmer amaranth. The applicants propose the use of a new chemical which has not been registered by EPA. EPA is soliciting public comment before making the decision whether or not to grant the exemptions, in accordance with the regulation at 40 Code of Federal Regulations (CFR) part 166.24(a)(1).

Air Plan Approval; Washington; Southwest Clean Air Agency; Emission Standards and Controls for Sources Emitting Gasoline Vapors
The Environmental Protection Agency (EPA) is approving a revision to the Washington State Implementation Plan (SIP) for the Southwest Clean Air Agency (SWCAA) jurisdiction as it relates to the ozone National Ambient Air Quality Standard. This revision updates SWCAA's requirements in the SIP for Stage I and Stage II vapor recovery systems at gasoline dispensing facilities including: decommissioning existing Stage II systems incompatible with onboard refueling vapor recovery systems on or before January 1, 2023; allowing removal from service of Stage II vapor recovery equipment compatible with onboard refueling vapor recovery on or after January 1, 2023; and removing the requirement for Stage II vapor recovery at new installations. The revisions to the SIP also include, among other changes, revised requirements for installation of enhanced conventional nozzles, installation of low permeation hoses, and annual testing based on facility throughput. SWCAA's submittal, in coordination with the Washington Department of Ecology, included a demonstration that such removal of Stage II requirements is consistent with the Clean Air Act and EPA guidance.
Air Plan Approval; WA; Yakima County Outdoor and Agricultural Burning Rule Revisions
The Environmental Protection Agency (EPA) is approving into the Washington State Implementation Plan (SIP) the Yakima Regional Clean Air Agency's (YRCAA) revised outdoor and agricultural burning rule submitted by the State of Washington (Washington or the State) on October 14, 2021. The submitted revisions improve stringency, clarity and enforceability of the rule. The EPA is proposing to approve the SIP submission as consistent with Clean Air Act (Act or CAA) requirements.
Review of Final Rule Reclassification of Major Sources as Area Sources Under Section 112 of the Clean Air Act
The EPA is proposing to add requirements for sources to reclassify from major source status to area source status under the National Emission Standards for Hazardous Air Pollutants (NESHAP) program. The requirements of this proposal would apply to all sources that choose to reclassify, including any sources which have reclassified since January 25, 2018. The EPA is proposing that sources reclassifying from major source status to area source status under the NESHAP program must satisfy the following criteria: any permit limitations taken to reclassify from a major source of hazardous air pollutants (HAP) under the Clean Air Act to an area source of HAP must be federally enforceable, any such permit limitations must contain safeguards to prevent emission increases after reclassification beyond the applicable major source NESHAP requirements at time of reclassification, and reclassification will only become effective once a permit has been issued containing enforceable conditions reflecting the requirements proposed in this action and electronic notification has been submitted to the EPA. Additionally, we are proposing clarifications to reporting requirements and updating language regarding submittal of confidential business information.

Notice of Public Meeting of the Environmental Financial Advisory Board (EFAB) With Webcast
The Environmental Protection Agency (EPA) announces a public meeting with a webcast of the Environmental Financial Advisory Board (EFAB). The meeting will be shared in real-time via webcast and public comments may be provided in writing in advance or virtually via webcast. Please see SUPPLEMENTARY INFORMATION for further details. The purpose of the meeting will be for the EFAB to discuss possible future advisory charges, provide updates on previous EFAB deliverables, and to understand and consider environmental finance issues in the Great Lakes region and Michigan. The meeting will be conducted in a hybrid format of in-person and virtual via webcast.
Approval and Promulgation of Delegation of Authority for Designated Facilities and Pollutants; New Hampshire; Delegation of Authority
The Environmental Protection Agency (EPA) is approving delegation of authority to the New Hampshire Department of Environmental Services (NHDES) for implementing and enforcing the Clean Air Act (CAA) Federal Plan Requirements for Municipal Solid Waste Landfills That Commenced Construction on or Before July 17, 2014, and Have Not Been Modified or Reconstructed Since July 17, 2014. This action amends regulatory text to promulgate the delegation of authority and is taken in accordance with the CAA.
Clean Water Act Section 401 Water Quality Certification Improvement Rule
Following careful reconsideration of the water quality certification rule the U.S. Environmental Protection Agency (EPA or the Agency) promulgated in 2020, the Agency is finalizing a rule revising and replacing the 2020 regulatory requirements for water quality certification under Clean Water Act (CWA) section 401. This final rule updates the existing regulations to better align with the statutory text and purpose of the CWA; to clarify, reinforce, and provide a measure of consistency with elements of section 401 certification practice that have evolved over the more than 50 years since EPA first promulgated water quality certification regulations; and to support an efficient and predictable certification process that is consistent with the water quality protection and cooperative federalism principles central to CWA section 401. An Executive order signed on January 20, 2021, entitled ``Protecting Public Health and the Environment and Restoring Science to Tackle the Climate Crisis,'' directed the Agency to review the water quality certification rule EPA promulgated in 2020, and this final rule culminates that review. The Agency is also finalizing conforming amendments to the water quality certification regulations for EPA-issued National Pollutant Discharge Elimination System (NPDES) permits.
Pesticides; Concept for a Framework To Assess the Risk to the Effectiveness of Human and Animal Drugs Posed by Certain Antibacterial or Antifungal Pesticides; Notice of Availability and Request for Comment
The Environmental Protection Agency (EPA) is announcing the availability of and soliciting public comment on the concept for developing a framework to improve assessments of potential risks to human and animal health where the use of certain pesticides could potentially result in antimicrobial resistance (AMR) that compromises the effectiveness of medically important antibacterial and antifungal drugs. EPA is also seeking feedback on research gaps and other information to help inform the risk assessment and mitigation processes. The concept document was developed in collaboration with the U.S. Department of Health and Human Services (HHS), the U.S. Department of Agriculture (USDA), and offices within the White House Executive Office of the President. A pesticide must be registered with the EPA under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) before it can be legally sold or distributed in the United States. During the registration process, EPA considers whether the pesticide will cause unreasonable adverse effects on people or the environment. Because resistance is considered an adverse effect under FIFRA, the U.S. government is working to develop a structured and coordinated approach to assess and manage these risks. EPA is seeking public comment on a concept document for a proposed framework and on potential solutions, research, or mitigation approaches to reduce the spread of AMR. The agencies will consider feedback in developing a proposed framework that will also be shared for public review and comment.
Notice of Proposed Administrative Settlement Agreement for Recovery of Past Response Costs for the Klamath Falls Motel Mercury Spill Response Site, Klamath County, Oregon
In accordance with the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended (CERCLA), notice is hereby given that the Environmental Protection Agency (EPA) has entered into a proposed settlement, embodied in an Administrative Settlement Agreement for Recovery of Past Response Costs (Settlement Agreement), with the following settling party: Sugar Pine Hotel, Inc. Under the Settlement Agreement, the settling party agrees to pay a total of $44,192 plus interest to reimburse the EPA for costs the EPA has incurred at the Klamath Falls Motel Mercury Spill Response Site (Site).
Establishment of Historically Black Colleges and Universities (HBCUs) and Minority Serving Institutions (MSIs) Advisory Council
As required by the Federal Advisory Committee Act (FACA), the United States Environmental Protection Agency (EPA) is giving notice that it is establishing the Historically Black Colleges and Universities and Minority Serving Institutions Advisory Council. The purpose of this committee is to provide advice and recommendations to the EPA Administrator on critical policy and technical issues to advance equity in economic and social opportunities for all Americans and strengthen the capacity of HBCUs and MSIs to provide the highest- quality education, participate in and benefit from federal programs, and support key Administration policies. The EPA has determined that this federal advisory committee is necessary and in the public interest to provide critical advice and recommendations to assist the EPA in increasing outreach to underrepresented and underserved communities by developing a stronger partnership with HBCUs and MSIs.
Air Plan Revisions; California; Placer County Air Pollution Control District; General Permit Requirements, New Source Review
The Environmental Protection Agency (EPA) is taking final action on two permitting rules submitted as a revision to the Placer County Air Pollution Control District (PCAPCD or ``District'') portion of the California State Implementation Plan (SIP). We are finalizing an approval of one rule and finalizing a limited approval and limited disapproval of the second rule. These revisions concern the District's New Source Review (NSR) permitting program for new and modified sources of air pollution under title I of the Clean Air Act (CAA or ``Act''). This final action stops all sanction and federal implementation plan clocks started by our April 20, 2020 limited approval and limited disapproval. This action also adds regulatory text to clarify that Placer County is no longer subject to the Federal Implementation Plan related to protection of visibility.

The purpose of this notice of funding availability (NOFA) is to solicit letters of interest (LOIs) from prospective borrowers seeking credit assistance from the U.S. Environmental Protection Agency (EPA) under the Water Infrastructure Finance and Innovation Act (WIFIA) program. Wyoming: Final Authorization of State Hazardous Waste Management Program Revisions and Incorporation by Reference
The State of Wyoming Department of Environmental Quality has applied to the Environmental Protection Agency (EPA) for final authorization of the changes to its hazardous waste program under the Resource Conservation and Recovery Act (RCRA). The EPA has determined that these changes satisfy all requirements needed to qualify for final authorization and is authorizing the State's changes through this direct final action. The EPA uses the regulations entitled ``Approved State Hazardous Waste Management Programs'' to provide notice of the authorization status of State programs and to incorporate by reference those provisions of State statutes and regulations that will be subject to the EPA's inspection and enforcement. This rule also codifies in the regulations the approval of Wyoming's hazardous waste management program and incorporates by reference authorized provisions of the State's regulations.
Wyoming: Authorization of State Hazardous Waste Management Program Revisions and Incorporation by Reference
The Environmental Protection Agency (EPA) is proposing to grant authorization to the State of Wyoming for the changes to its hazardous waste program under the Solid Waste Disposal Act, as amended, commonly referred to as the Resource Conservation and Recovery Act (RCRA). The EPA has determined that these changes satisfy all requirements needed to qualify for final authorization and is authorizing the State's changes through a direct final action, which can be found in the ``Rules and Regulations'' section of this Federal Register. In addition, the EPA is proposing to codify in the regulations entitled, ``Hazardous Waste Rules and Regulations, Chapter 1, General Provisions,'' Wyoming's authorized hazardous waste program. The EPA will incorporate by reference into the Code of Federal Regulations (CFR) those provisions of the State regulations that are authorized and that the EPA will enforce under RCRA.
Air Quality Plans; Approvals and Promulgations: California; Amador Air District; New Source Review
The Environmental Protection Agency (EPA) is proposing to approve a permitting rule submitted as a revision to the Amador Air District (AAD or ``District'') portion of the California State Implementation Plan (SIP). This revision concerns the District's New Source Review (NSR) permitting program for new and modified sources of air pollution under part D of Title I of the Clean Air Act (CAA or ``Act''). This action will update the District's applicable SIP with a rule revised to address deficiencies identified in a previous limited disapproval action. This action also proposes to revise regulatory text to clarify that the District is not subject to the Federal Implementation Plan related to protection of visibility. We are taking comments on this proposal and plan to follow with a final action.
Air Plan Approval; Texas; Updates to Public Notice and Procedural Rules and Removal of Obsolete Provisions
The Environmental Protection Agency (EPA) is correcting a final rule that appeared in the Federal Register on August 24, 2023. The document issued a final rule approving portions of three revisions to the Texas State Implementation Plan (SIP) submitted by the Texas Commission on Environmental Quality (TCEQ) on July 9, 2021, and January 21, 2022, that update the air permitting program by removing obsolete provisions and enhancing public notice requirements of the air permitting program. This correction addresses errors in the amendatory language instructions published on August 24, 2023.
Pesticides; Request for Stakeholder Input on the Proposed Design of a New Grant Program Regarding the Health Care Provider (HCP) Training Program; Notice of Availability and Opportunity for Comment
The Environmental Protection Agency (EPA) is announcing the availability of a Request for Information (RFI) that seeks public comment on a proposed design for the new grant program related to the Health Care Provider (HCP) Training Program, a cooperative agreement to help medical professionals better prevent, recognize, treat, and manage pesticide-related illness. The Pesticide Registration Improvement Act of 2022 (referred to as PRIA 5) included set-asides of up to $2.5 million for fiscal years 2023-2027 to fund the HCP Training Program. PRIA 5 also requires EPA to seek input from persons who conduct farmworker education and training, or technical assistance and training of healthcare providers, to inform the design of the grant program. EPA has previously solicited input on the HCP Training Program design through its Federal advisory committees, which include representatives of these stakeholders. The purpose of this RFI is to solicit additional stakeholder feedback from a broad array of individuals and organizations with knowledge and expertise related to the goals of the HCP Training Program. Additional public input, including environmental justice perspectives, will help the Agency refine the HCP Training Program and design a grant program to more effectively support populations that have historically been at high risk from pesticide-related illness.
Notice of Availability of Draft NPDES Non-Contact Cooling Water General Permit
The Director of the Water Division, U.S. Environmental Protection Agency, Region 1 (EPA), is providing a Notice of Availability for the Draft National Pollutant Discharge Elimination System (NPDES) Non-Contact Cooling Water General Permit (Draft NCCW GP) for discharges to certain waters of the Commonwealth of Massachusetts and the State of New Hampshire. This Draft NCCW GP establishes effluent limitations and requirements, effluent and ambient monitoring requirements, reporting requirements, and standard conditions for existing facilities with non-contact cooling water discharges. The Draft NCCW GP is available on EPA Region 1's website at https:// www.epa.gov/npdes-permits/noncontact-cooling-water-general-pe rmit-nccw- gp-massachusetts-new-hampshire. Second 10-Year Maintenance Plan for the 24-Hour PM10 Standards; Sacramento County Planning Area, California
The Environmental Protection Agency (EPA) is proposing to approve the ``Second 10-Year PM10 Maintenance Plan for Sacramento County'' (``Second 10-Year Maintenance Plan'' or ``Plan'') as a revision to the state implementation plan (SIP) for the State of California (``State''). The Second 10-Year Maintenance Plan includes, among other elements, a base year emissions inventory, a maintenance demonstration, contingency provisions, and motor vehicle emissions budgets for use in transportation conformity determinations, to ensure the continued maintenance of the national ambient air quality standards (NAAQS) for particulate matter of 10 microns or less (PM10). With this proposed rulemaking, the EPA is beginning the adequacy process for the 2024, 2027, and 2033 motor vehicle emissions budgets. Additionally, as part of the technical basis for this approval, the EPA is taking comment on our August 1, 2022 concurrence on the wildfire exceptional events demonstration submitted by the California Air Resources Board (CARB) on April 26, 2021.

In compliance with the Paperwork Reduction Act (PRA), this document announces the availability of and solicits public comment on the following Information Collection Request (ICR) that EPA is planning to submit to the Office of Management and Budget (OMB): ``Notification of Chemical ExportsTSCA Section 12(b),'' identified by EPA ICR No. 0795.17 and OMB Control No. 2070-0030. This ICR represents the renewal of an approved ICR that is currently scheduled to expire on May 31, 2024. Before submitting the ICR to OMB for review and approval under the PRA, EPA is soliciting comments on specific aspects of the information collection that is summarized in this document. The ICR and accompanying material are available in the docket for public review and comment.

This regulation establishes tolerances for residues of flonicamid in or on multiple crops listed later in this document. Interregional Research Project Number 4 (IR-4) requested these tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA).
Farm, Ranch, and Rural Communities Advisory Committee (FRRCC); Notice of Public Meeting
Pursuant to the Federal Advisory Committee Act (FACA), notice is hereby given that the next meeting of the Farm, Ranch, and Rural Communities Advisory Committee (FRRCC) will be held virtually on September 28, 2023. Clean Air Act Operating Permit Program; Order on Petitions for Objection to State Operating Permit for Suncor Energy, Inc. Plant 2 (East Plant)
The Environmental Protection Agency (EPA) Administrator signed an order dated July 31, 2023, granting in part and denying in part a petition dated October 11, 2022, from Earthjustice on behalf of Elyria and Swansea Neighborhood Association, Cultivando, Colorado Latino Forum, GreenLatinos, Center for Biological Diversity, and Sierra Club, and denying a petition dated October 11, 2022, from 350 Colorado. The petitions requested that the EPA object to a Clean Air Act (CAA) operating permit issued by the Colorado Department of Public Health and Environment (CDPHE) to Suncor Energy, Inc. for its Refinery Plant 2 Facility in Adams County, Colorado.
National Drinking Water Advisory Council; Meeting
The U.S. Environmental Protection Agency's (EPA) Office of Ground Water and Drinking Water is announcing a meeting of the National Drinking Water Advisory Council (NDWAC or Council) as authorized under the Safe Drinking Water Act (SDWA). The purpose of the meeting is to allow members of the NDWAC's Microbial and Disinfection Byproducts (MDBP) Rule Revisions Working Group to present their emergent recommendations to the Council on issues included in EPA's November 2021 charge to the NDWAC on potential revisions to MDBP rules. Additional details will be provided in the meeting agenda, which will be posted on EPA's NDWAC website prior to the meeting. The NDWAC will meet again at a later date to review the Working Group's final report to the Council and to develop advice and recommendations from the Council to EPA. Public Meeting of the Science Advisory Board CASTNet Review Panel
The Environmental Protection Agency (EPA) Science Advisory Board (SAB) Staff Office a public meeting of the Science Advisory Board CASTNet Review Panel. The purpose of the public meeting is to review and discuss the draft report prepared by the review panel. The draft report incorporates briefings and a report from EPA on the CASTNet monitoring network, public comments, and deliberations of the panel on the charge questions posed by the Agency. Additional information, materials, background, meeting agendas, and activities are, and will be, posted on SAB's website at https://sab.epa.gov.
Air Plan Approval; Missouri; Revisions to the Cross-State Air Pollution Rule SO2 Group 1 Trading Program
The Environmental Protection Agency (EPA) is taking final action to approve revisions to the State Implementation Plan (SIP) submitted on November 29, 2021, by the State of Missouri. This final action approves revisions to a state regulation related to the Cross- State Air Pollution Rule SO2 Group 1 Trading Program. The revisions alter the amounts of CSAPR SO2 Group 1 emission allowances that are allocated to two of the state's units from the state's annual emissions budgets. Additionally, the revisions make non- substantive revisions to rule language that excludes certain provisions in the Code of Federal Regulations from incorporation by reference into the state's regulations. Approval of these revisions will ensure Federal enforceability of the State's rules. The EPA's approval of these SIP revisions is being done in accordance with the requirements of the Clean Air Act (CAA).

EPA is required under the Toxic Substances Control Act (TSCA), as amended by the Frank R. Lautenberg Chemical Safety for the 21st Century Act, to make information publicly available and to publish information in the Federal Register pertaining to submissions under TSCA section 5, including notice of receipt of a Premanufacture notice (PMN), Significant New Use Notice (SNUN) or Microbial Commercial Activity Notice (MCAN), including an amended notice or test information; an exemption application (Biotech exemption); an application for a test marketing exemption (TME), both pending and/or concluded; a notice of commencement (NOC) of manufacture (including import) for new chemical substances; and a periodic status report on new chemical substances that are currently under EPA review or have recently concluded review. This document covers the period from 8/1/ 2023 to 8/31/2023.

Certain New Chemicals or Significant New Uses; Statements of Findings for June and July 2023
The Toxic Substances Control Act (TSCA) requires EPA to publish in the Federal Register a statement of its findings after its review of certain TSCA submissions when EPA makes a finding that a new chemical substance or significant new use is not likely to present an unreasonable risk of injury to health or the environment. Such statements apply to premanufacture notices (PMNs), microbial commercial activity notices (MCANs), and significant new use notices (SNUNs) submitted to EPA under TSCA. This document presents statements of findings made by EPA on such submissions during the period from June 1, 2023, to July 31, 2023.
