Pyraclostrobin; Objections to Pesticide Tolerances; Notice of Availability

This notice announces the availability of objections filed with respect to the establishment and increase of various pyraclostrobin tolerances under section 408 of the Federal Food, Drug, and Cosmetic Act (FFDCA). The objections were filed on June 5, 2006 by the Natural Resources Defense Council (NRDC). NRDC's objections assert that EPA unlawfully removed the additional 10X safety factor for the protection of infants and children. Additionally NRDC claims that EPA's action was arbitrary and capricious for failure to provide an inadequate explanation for its decision on the children's safety factor, and because EPA never received information EPA deemed necessary to its review of the pesticide. This Notice seeks comment on the NRDC objections.

The U.S. Environmental Protection Agency is inviting nominations for membership on the Coastal Elevations and Sea Level Rise Advisory Committee (CESLAC). The purpose of the Committee is to provide advice on the conduct of a study titled Coastal Elevations and Sensitivity to Sea Level Rise to be conducted as part of the U.S. Climate Change Science Program (CCSP). The draft prospectus for the study titled Coastal Elevations and Sensitivity to Sea Level Rise is on the CCSP Web site at https://www.climatescience.gov/Library/sap/sap4-1/ sap4-1prospectus-draft.htm Committee membership will total approximately fifteen persons and will include a balanced representation of individuals from the Federal Government, State and/or local governments, the scientific community, non-governmental organizations and the private sector, with expertise, experience, knowledge and interests essential to, or affected by, the successful completion of the study. Nominations should be received within twenty-one days of the date of this Federal Register notice. Any interested person or organization may submit a nomination. Nominations must include a complete resume of the nominee's background, experience and expertise, and any other information considered relevant. Additional avenues and resources will be utilized by EPA in the solicitation of nominees.
Public Water Supply Supervision Program; Program Revision for the State of Idaho

Notice is hereby given that the State of Idaho has revised its approved State Public Water Supply Supervision (PWSS) Primacy Program. Idaho has revised its PWSS program with respect to administrative penalty authority, has adopted a revised definition of public water system, and has adopted drinking water regulations requiring consumer confidence reports from all community water systems. Idaho has also adopted regulations for the Interim Enhanced Surface Water Treatment Rule, the Stage 1 Disinfectants and Disinfection Byproducts Rule, the Lead and Copper Rule Minor Revisions, the Public Notification Rule, the Radionuclides Rule, the Filter Backwash Recycling Rule, the Long Term 1 Enhanced Surface Water Treatment Rule, and the Arsenic Rule. EPA has determined that these revisions are no less stringent than the corresponding federal regulations. Therefore, EPA intends to approve these State program revisions. By approving these rules, EPA does not intend to affect the rights of Federally recognized Indian tribes within ``Indian country'' as defined by 18 U.S.C. 1151, nor does it intend to limit existing rights of the State of Idaho. All interested parties may request a public hearing. A request for a public hearing must be submitted by August 18, 2006 to the Regional Administrator at the address shown below. Frivolous or insubstantial requests for a hearing may be denied by the Regional Administrator. However, if a substantial request for a public hearing is made by August 18, 2006, a public hearing will be held. If no timely and appropriate request for a hearing is received and the Regional Administrator does not elect to hold a hearing on his own motion, this determination shall become final and effective on August 18, 2006. Any request for a public hearing shall include the following information: (1) The name, address, and telephone number of the individual, organization, or other entity requesting a hearing; (2) a brief statement of the requesting person's interest in the Regional Administrator's determination and a brief statement of the information that the requesting person intends to submit at such hearing; (3) the signature of the individual making the request, or, if the request is made on behalf of an organization or other entity, the signature of a responsible official of the organization or other entity.

EPA is proposing to determine that the San Joaquin Valley nonattainment area (SJV) in California has attained the National Ambient Air Quality Standards (NAAQS) for particulate matter with an aerodynamic diameter less than or equal to a nominal 10 micrometers (PM-10). This proposed determination is based upon monitored air quality data for the PM-10 NAAQS during the years 2003-2005. The SJV continues to attain the PM-10 NAAQS in 2006; no exceedances of the 24 hour NAAQS have been recorded at any of the SJV monitoring sites from January 1, 2006 through March 31, 2006. EPA is also proposing to determine that, because the SJV has attained the PM-10 NAAQS, certain Clean Air Act (CAA or the Act) requirements are not applicable for as long as the SJV continues to attain the PM-10 NAAQS.

This notice announces the availability of EPA's Reregistration Eligibility Decision (RED) for the pesticide DCNA (Dicloran), and opens a public comment period on this document. The Agency's risk assessments and other related documents also are available in the DCNA (2,6- dichloro-4-nitroaniline) Docket. DCNA, also referred to as Dicloran, is a fungicide used to control pathogenic species such as Botrytis, Monilinia, Rhizopus, Sclerotinia and Sclerotium. DCNA is registered for agriculture and horticulture uses. Its registered formulations include dusts, wettable powders, and flowable concentrates. These products can be applied using aerial, airblast, groundboom, chemigation, and hand- application methods. EPA has reviewed DCNA through the public participation process that the Agency uses to involve the public in developing pesticide reregistration and tolerance reassessment decisions. Through these programs, EPA is ensuring that all pesticides meet current health and safety standards.

EPA is proposing to approve State Implementation Plan (SIP) revisions submitted by the State of Montana on October 25, 2005. The revisions are to the Administrative Rules of Montana and update the citations and references to Federal documents and addresses where copies of documents can be obtained, and delete three definitions. The intended effect of this action is to make federally enforceable those provisions that EPA is proposing to approve. This action is being taken under section 110 of the Clean Air Act. In the ``Rules and Regulations'' section of this Federal Register, EPA is approving the State's SIP revision as a direct final rule without prior proposal because the Agency views this as a noncontroversial SIP revision and anticipates no adverse comments. A detailed rationale for the approval is set forth in the preamble to the direct final rule. If EPA receives no adverse comments, EPA will not take further action on this proposed rule. If EPA receives adverse comments, EPA will withdraw the direct final rule and it will not take effect. EPA will address all public comments in a subsequent final rule based on this proposed rule. EPA will not institute a second comment period on this action. Any parties interested in commenting must do so at this time. Please note that if EPA receives adverse comment on an amendment, paragraph, or section of this rule and if that provision may be severed from the remainder of the rule, EPA may adopt as final those provisions of the rule that are not the subject of an adverse comment.

Chapter 6 (Staff Conclusions on the Primary Ozone National Ambient Air Quality Standards) of the Draft Staff Paper will be made available on or about July 25, 2006. The purpose of the Staff Paper is to evaluate the policy implications of the key scientific and technical information contained in a related EPA document, Air Quality Criteria for Ozone and Related Photochemical Oxidants, required under sections 108 and 109 of the Clean Air Act (CAA) for use in the periodic review of the national ambient air quality standards (NAAQS) for ozone. National Primary Drinking Water Regulations for Lead and Copper: Short-Term Regulatory Revisions and Clarifications

This proposal strengthens the implementation of the Lead and Copper Rule (LCR) in the following areas: monitoring, treatment processes, customer awareness, and lead service line replacement. These changes will provide more effective protection of public health by reducing exposure to lead in drinking water. The proposed changes do not affect the basic requirements of the LCR, the lead or copper maximum contaminant level goals, or the lead and copper action levels.

This regulation establishes a temporary exemption from the requirement of a tolerance for residues of the Bacillus Thuringiensis Cry2Ab2 protein and the genetic material necessary for its production in corn on field corn, sweet corn, and popcorn when applied/used as a plant-incorporated protectant. Monsanto Company submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA), requesting the temporary/tolerance exemption. This regulation eliminates the need to establish a maximum permissible level for residues of Bacillus Thuringiensis Cry2Ab2 protein and the genetic material necessary for its production in corn. The temporary tolerance exemption will expire on June 30, 2009.
National Management Measures To Control Nonpoint Source Pollution From Hydromodification

EPA is requesting comment on draft technical guidance for managing nonpoint source pollution from hydromodification. The term hydromodification refers to an activity that alters the geometry and physical characteristics of a stream or river in such a way that the flow patterns change. This guidance is intended to provide technical assistance to states, territories, authorized tribes, and the public for managing hydromodification and reducing nonpoint source pollution of surface and ground water. The guidance provides background information about nonpoint source pollution from activities associated with channelization and channel modification, dams, and streambank and shoreline erosion. It discusses the broad concepts of assessing and addressing water quality problems on a watershed level, and it presents up-to-date technical information about how to reduce nonpoint source pollution from hydromodification. Implementation of the guidance will result in increased use of scientifically sound, cost-effective hydromodification management measures, and will support states in their efforts to implement their Nonpoint Source Control Programs.

This regulation establishes a temporary exemption from the requirement of a tolerance for residues of the Bacillus Thuringiensis Cry1A.105 protein and the genetic material necessary for its production in corn on field corn, sweet corn, and popcorn when applied/used as a plant-incorporated protectant. Monsanto Company submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA), requesting the temporary/tolerance exemption. This regulation eliminates the need to establish a maximum permissible level for residues of Bacillus Thuringiensis Cry1A.105 protein and the genetic material necessary for its production in corn. The temporary tolerance exemption will expire on June 30, 2009.

Dicamba (2-methoxy-3,6-dichlorobenzoic acid) is a selective benzoic acid herbicide registered for pre-emergent control of broadleaf weeds and woody plants. EPA has reviewed dicamba through the public participation process that the Agency uses to involve the public in developing pesticide reregistration and tolerance reassessment decisions. Through these programs, EPA is ensuring that all pesticides meet current health and safety standards.

EPA is proposing to revoke certain tolerances for the fungicide carboxin, the insecticide dipropyl isocinchomeronate, and the fungicide/animal repellent oil of lemon (oil of lemongrass) and oil of orange. Also, EPA is proposing to modify certain tolerances for the herbicide bentazon and the fungicide carboxin. In addition, EPA is proposing to establish new tolerances for the herbicide bentazon. The regulatory actions proposed in this document are part of the Agency's reregistration program under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), and the tolerance reassessment requirements of the Federal Food, Drug, and Cosmetic Act (FFDCA) section 408(q), as amended by the Food Quality Protection Act (FQPA) of 1996. By law, EPA is required by August 2006 to reassess the tolerances that were in existence on August 2, 1996. No tolerance reassessments will be counted at the time of a final rule because tolerances in existence on August 2, 1996 that are associated with actions proposed herein were previously counted as reassessed at the time of the completed Reregistration Eligibility Decision (RED), Report of Food Quality Protection Act (FQPA) Tolerance Reassessment Progress and Risk Management Decision (TRED), or Federal Register.

National Emission Standards for Hazardous Air Pollutants: Miscellaneous Organic Chemical Manufacturing

On November 10, 2003, EPA promulgated national emission standards for hazardous air pollutants for miscellaneous organic chemical manufacturing. Several petitions for judicial review of the final rule were filed in the United States Court of Appeals for the District of Columbia Circuit. Petitioners expressed concern with various requirements in the final rule, including applicability of specific operations and processes, the leak detection and repair requirements for connectors, criteria to define affected wastewater streams requiring control, control requirements for wastewater streams that contain only soluble hazardous air pollutants, the definition of ``process condensers,'' and recordkeeping requirements for Group 2 batch process vents. In this action, EPA amends the final rule to address these issues and to correct inconsistencies that have been discovered during the review process.

Approval and Promulgation of Air Quality Implementation Plans; West Virginia; Redesignation of the Huntington, WV Portion of the Huntington-Ashland 8-Hour Ozone Nonattainment Area to Attainment and Approval of the Maintenance Plan

EPA is proposing to approve a redesignation request and a State Implementation Plan (SIP) revision for the Huntington portion of the Huntington-Ashland, WV-KY (herein referred to as the ``Huntington- Ashland area'') interstate area from nonattainment to attainment of the 8-hour ozone National Ambient Air Quality Standard (NAAQS). The West Virginia Department of Environmental Protection (WVDEP) is requesting that the Cabell and Wayne County, West Virginia (Huntington) portion of the Huntington-Ashland area be redesignated as attainment for the 8- hour ozone NAAQS. The interstate Huntington-Ashland 8-hour ozone nonattainment area is comprised of three counties (Cabell and Wayne Counties, West Virginia and Boyd County, Kentucky). EPA is proposing to approve the ozone redesignation request for the Huntington portion of the Huntington-Ashland area. In conjunction with its redesignation request, the WVDEP submitted a SIP revision consisting of a maintenance plan for Huntington that provides for continued attainment of the 8- hour ozone NAAQS for the next 12 years. EPA is proposing to make a determination that Huntington has attained the 8-hour ozone NAAQS based upon three years of complete, quality-assured ambient air quality ozone monitoring data for 2003-2005. EPA's proposed approval of the 8-hour ozone redesignation request is based on its determination that Huntington has met the criteria for redesignation to attainment specified in the Clean Air Act (CAA). EPA is providing information on the status of its adequacy determination for the motor vehicle emission budgets (MVEBs) that are identified in the Huntington maintenance plan for purposes of transportation conformity, and is also proposing to approve those MVEBs. EPA is proposing approval of the redesignation request and of the maintenance plan revision to the West Virginia SIP in accordance with the requirements of the CAA.
