This regulation establishes an exemption from the requirement of a tolerance for residues of 2-propenoic acid, 2- methyl-, polymer with ethenylbenzene, 2-ethylhexyl 2-propenoate, 2-hydroxyethyl 2- propenoate, N-(hydroxymethyl) -2-methyl-2-propenamide and methyl 2- methyl-2-propenoate, ammonium salt when used as an inert ingredient in a pesticide chemical formulation. E. I. du Pont de Nemours and Company, Inc. submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA) requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of 2-propenoic acid, 2-methyl-, polymer with ethenylbenzene, 2-ethylhexyl 2-propenoate, 2-hydroxyethyl 2- propenoate, N-(hydroxymethyl) -2-methyl-2-propenamide and methyl 2- methyl-2-propenoate, ammonium salt.

The Agency's risk assessments and other related documents also are available in the piperonyl butoxide Docket. Piperonyl butoxide (PBO) is a pesticide active ingredient that acts as a synergist. Synergists are chemicals which, while lacking pesticidal properties of their own, enhance the pesticidal properties of other active ingredients including pyrethrins and pyrethroids. PBO is used in four general ways: Preharvest and postharvest uses on many agricultural crops; direct and indirect treatments of livestock animals and premises; treatments of commercial and industrial facilities and storage areas where raw and processed food/feed commodities are stored or processed; and mosquito abatement areas. EPA has reviewed piperonyl butoxide through the public participation process that the Agency uses to involve the public in developing pesticide reregistration and tolerance reassessment decisions. Through these programs, EPA is ensuring that all pesticides meet current health and safety standards.

This notice announces the availability of the amendment to the Propanil Reregistration Eligibility Decision (RED) and completion of the comment period for the propanil RED. The Agency has reviewed the public comments submitted and has responded to those that relate specifically to the propanil RED. As a result of its review of the public comments and review of additional data submitted by the Propanil Task Force, the Agency is amending the Propanil RED, where appropriate. EPA develops reregistration decisions pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), and tolerance reassessment decisions under provisions of the Federal Food, Drug and Cosmetic Act (FFDCA). Through these programs, EPA ensures that all pesticides meet current health and safety standards.

In accordance with the requirements of section 122(h)(1) of the Comprehensive Environmental Response Compensation, and Liability Act of 1980, as amended (``CERCLA''), 42 U.S.C. 9622(h)(1), notice is hereby given of the proposed administrative settlement under section 122(h) of CERCLA, 42 U.S.C. 9622(h) between the U.S. Environmental Protection Agency (``EPA'') and Mineral County Montana; the Town of Superior, Montana; and the Superior School District, Montana (collectively, ``Settling Parties''). The Settling Parties will consent to and will not contest the authority of the United States to enter into this Agreement or to implement or enforce its terms. In return, the Settling Parties receive a Covenant Not to Sue from EPA. The EPA has incurred response costs totaling approximately $1,109,446.43 through February 28, 2006, and any additional Response Costs through the present date. EPA alleges that Settling Parties are Potentially Responsible Parties pursuant to Section 107(a) of CERCLA, 42 U.S.C. 9607(a), and are jointly and severally liable for Response Costs incurred and to be incurred at or in connection with the Site. EPA has reviewed the financial information submitted by Settling Parties and based upon this information, EPA has determined that none of the three Settling Parties has the financial ability to pay for Response Costs incurred and to be incurred at the Site. The Settling Parties agree to provide EPA access at all reasonable times to the Site and to any other property owned or controlled by the Settling Parties for the purpose of conducting any response activity related to the Site. The Settling Parties shall refrain from using the Site, or such other property, in any manner that would interfere with or adversely affect the implementation, integrity, ongoing operations and maintenance of the containment cell or protectiveness of the Site response. Such restrictions are defined as Institutional Controls, and are part of the subject Agreement. The Settling Parties agree to fulfill all Notice and Recording requirements associated with the terms of the subject Agreement. The Settling Parties have executed and recorded certain Institutional Controls in the Office of the Clerk and Recorder of Mineral County, Montana and provided EPA with a certified copy of the original recorded Institutional Controls, showing the clerk's recording stamps. Notwithstanding any provision of this Agreement, EPA retains all of its access authorities and rights, including enforcement authorities related thereto, under CERCLA, the Resource Conservation and Recovery Act (RCRA), and any other applicable statutes or regulations. EPA's covenant not to sue is conditioned upon the satisfactory performance by the Settling Parties of their obligations under this Agreement. This covenant not to sue is also conditioned upon the veracity and completeness of the Financial Information provided to EPA by the Settling Parties. The Settling Parties recognize that this Agreement has been negotiated in good faith and that this Agreement is entered into without the admission or adjudication of any issue of fact or law.

On June 19, 2006, EPA Region 10 proposed to reissue three general permits to cover aquaculture facilities and associated fish processors in Idaho. 71 FR 35269. In response to requests from the regulated community, EPA is extending the public comment period from August 3 to August 18, 2006.

In accordance with section 122(I) of the Comprehensive Environmental Response, Compensation, and Liability Act, as amended (``CERCLA''), 42 U.S.C. 9622(I), the EPA is hereby providing notice of a proposed administrative order on consent (``AOC'') concerning the Excello Plating Co. facility located at 4057 Goodwin Avenue, Los Angeles, California. Section 122(h) of CERCLA, 42 U.S.C. 9622(g), provides EPA with the authority to enter into administrative settlements. This settlement is intended to resolve the liability of Excello Plating Co. and Glen Harleman for EPA's response costs at the Excello Plating Co. facility. The settling parties will pay a $43,000 (forty-three thousand dollars) to EPA.

EPA is publishing this action to provide the public with notice of the update to the Tennessee State Implementation Plan (SIP) compilation. Under Section 122 (h) (1) of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLS), the United States Environmental Protection Agency has amended the settlement Docket CER-04-2002-3782 concerning the Prestige Chemical Company Superfund Site located in Senoia, Coweta County, Georgia which was first published in the Federal Register on November 18, 2002 (67 FR 69528).

The United States Environmental Protection Agency's (EPA) Environmental Financial Advisory Board (EFAB) will hold an open board meeting. EFAB is an EPA advisory committee chartered under the Federal Advisory Committee Act (FACA) to provide advice and recommendations to EPA on creative approaches to funding environmental programs, projects, and activities. A meeting of the full board will be held to discuss progress with work products under EFAB's current strategic action agenda and develop an action agenda to direct the Board's ongoing and new activities through FY 2007. Topics of discussion include financial assurance mechanisms; innovative environmental financing tools; non-point source (watershed) financing; useful life financing of water facilities; water infrastructure financing; and smartway transportation partnerships. The meeting is open to the public; however, seating is limited. All members of the public who wish to attend the meeting must register in advance, no later than Friday, August 4, 2006.

EPA is proposing to amend the current regulations governing the production and trade of certain ozone-depleting substances to address issues concerning the export of previously imported material, heels, the exemption allowance petition process for HCFC-141b for military and space vehicle applications, and the definition for ``importer.'' We are proposing these minor adjustments to our regulations in response to requests from the regulated community, to ensure equitable treatment of stakeholders, and to reduce burden where the integrity of the requirements can still be sufficiently maintained. These proposed amendments appear in the ``Rules and Regulations'' section of this Federal Register as a direct final rule.

This notice announces the availability for comment of the administrative record files for 85 TMDLs and the calculations for these TMDLs prepared by EPA Region 6 for waters listed in the Red River, Sabine River, and Terrebonne Basins of Louisiana, under section 303(d) of the Clean Water Act (CWA). These TMDLs were completed in response to a court order in the lawsuit styled Sierra Club, et al. v. Clifford, et al., No. 96-0527, (E.D. La.).

The Environmental Protection Agency is approving a revision to the New York State Implementation Plan (SIP) related to the control of oxides of nitrogen (NOX) and volatile organic compounds (VOC) from stationary sources. The SIP revision consists of amendments to Title 6 of the New York Codes, Rules and Regulations, Parts 214, ``Byproduct Coke Oven Batteries,'' and 216, ``Iron and/or Steel Processes.'' The revision was submitted to comply with the 1-hour ozone Clean Air Act reasonably available control technology requirements for major sources of VOC and NOX not covered by Control Techniques Guidelines. The intended effect of this action is to approve control strategies which will result in emission reductions that will help achieve attainment of the national ambient air quality standard for ozone.
