Section 5 of the Toxic Substances Control Act (TSCA) requires any person who intends to manufacture (defined by statute to include import) a new chemical (i.e., a chemical not on the TSCA Inventory) to notify EPA and comply with the statutory provisions pertaining to the manufacture of new chemicals. Under sections 5(d)(2) and 5(d)(3) of TSCA, EPA is required to publish a notice of receipt of a premanufacture notice (PMN) or an application for a test marketing exemption (TME), and to publish periodic status reports on the chemicals under review and the receipt of notices of commencement to manufacture those chemicals. This status report, which covers the period from June 16, 2006 to July 28, 2006, consists of the PMNs and TMEs, both pending or expired, and the notices of commencement to manufacture a new chemical that the Agency has received under TSCA section 5 during this time period.
Clean Water Act Section 303(d): Availability of List Decisions

This action announces the availability of and requests public comment on EPA decisions identifying water quality limited segments and associated pollutants in Massachusetts to be listed pursuant to Clean Water Act section 303(d)(2). Section 303(d)(2) requires that states submit and EPA approve or disapprove lists of waters for which existing technology-based pollution controls are not stringent enough to attain or maintain state water quality standards and for which total maximum daily loads (TMDLs) must be prepared. On June 21, 2006, EPA partially approved and partially disapproved Massachusetts' 2004 submittal. Specifically, EPA approved Massachusetts' listing of 734 water body segments, associated pollutants and priority rankings. EPA disapproved Massachusetts' decision not to list ninety (90) water quality limited segments impaired for mercury. EPA identified these additional water body segments, pollutants, and priority rankings for inclusion on the 2004 section 303(d) list. EPA is providing the public the opportunity to review its decision to add waters and pollutants to Massachusetts' 2004 section 303(d) list, as required by EPA's Public Participation regulations. EPA will consider public comments in reaching its final decision on the additional water bodies and pollutants identified for inclusion on Massachusetts' final list.

In addition, the State made revisions to the Prevention of Significant Deterioration program, which has been delegated to the State. The intended effect of this action is to make these revisions federally enforceable. We are also announcing that on March 23, 2005, we updated the delegation of authority for the implementation and enforcement of the New Source Performance Standards to the State of South Dakota. These actions are being taken under sections 110 and 111 of the Clean Air Act.

A detailed rationale for the approval is set forth in the preamble to the direct final rule. If EPA receives no adverse comments, EPA will not take further action on this proposed rule. If EPA receives adverse comments, EPA will withdraw the direct final rule and it will not take effect. EPA will address all public comments in a subsequent final rule based on this proposed rule. EPA will not institute a second comment period on this action. Any parties interested in commenting must do so at this time. Please note that if EPA receives adverse comment on an amendment, paragraph, or section of this rule and if that provision may be severed from the remainder of the rule, EPA may adopt as final those provisions of the rule that are not the subject of an adverse comment.

The EPA is extending the public comment period and rescheduling an external peer review panel meeting to review selected sections of the final draft document titled, ``Toxicological Review of Dichlorobenzenes: In Support of Summary Information on the Integrated Risk Information System (IRIS)'' (EPA/635/R-03/015), related to the inhalation reference concentration (RfC) and inhalation cancer assessment for 1,4-dichlorobenzene. The document was prepared by the National Center for Environmental Assessment (NCEA) within EPA's Office of Research and Development. On July 11, 2006, EPA published a Federal Register notice (71 FR 39113) announcing a comment period that ended August 9 and an external peer review panel meeting that was scheduled for August 16. EPA is extending the public comment period to October 10, 2006, in response to requests. The external peer review panel meeting will be held on October 30, 2006. As previously stated in 71 FR 39113, EPA is releasing this draft document solely for the purpose of pre-dissemination peer review under applicable information quality guidelines. This document has not been formally disseminated by EPA. It does not represent and should not be construed to represent any Agency policy or determination. EPA will consider any public comments submitted in accordance with this notice when revising the document.

EPA is revoking eight exemptions from the requirement of a tolerance that are associated with six food-contact surface sanitizing solutions because these specific tolerance exemptions correspond to uses no longer current or registered in the United States under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), and because there are insufficient data to make the determination of safety required by the Federal Food, Drug, and Cosmetic Act (FFDCA). These ingredients are subject to reassessment by August 2006 under section 408(q) of FFDCA, as amended by the Food Quality Protection Act of 1996 (FQPA). The eight tolerance exemptions are considered ``reassessed'' for purposes of FFDCA's section 408(q) and count as a tolerance reassessment toward the August 2006 review deadline.

This action corrects the effective date for the 8-hour ozone attainment designation for the Montgomery County, Tennessee portion of the Clarksville-Hopkinsville 8-hour ozone nonattainment area. The effective date for this attainment designation, which appears in title 40 Code of Federal Regulation (CFR) 81.343, was erroneously identified as October 24, 2005, in the Part 81 chart at the end of EPA's September 22, 2005, direct final redesignation rulemaking (70 FR 55559). This error is being corrected to reflect an effective date of November 21, 2005, for Montgomery County, Tennessee's 8-hour ozone attainment designation.

Final NAFTA Guidance for Conducting Terrestrial Field Dissipation Studies

Under the North American Free Trade Agreement (NAFTA), EPA and the Canadian Pest Management Regulatory Agency (PMRA) have agreed to harmonize their testing guidelines so that one set of tests can be used for the registration of pesticides in Canada and the United States. The NAFTA harmonized guidance for terrestrial field dissipation (TFD) studies are conducted to demonstrate the transformation, transport, and fate of pesticides under representative actual use conditions. These field studies are needed to substantiate the physicochemical, mobility, and biotransformation data from laboratory studies. Environmental fate studies have shown that pesticide dissipation may proceed at different rates under field conditions and may result in degradates forming at levels different from those observed in laboratory studies. The objective of this guidance document is to help ensure that TFD studies are conducted in a manner that will provide risk assessors and risk managers with more confidence in the data generated and with a better understanding of the assumptions and limitations of the data and estimated half-lives of the pesticide. The proposed guidance document for TFD studies was published in the Federal Register on June 15, 2005 (FRL-7713-7). After reviewing the public comments for this Notice, EPA developed a final guidance document, which can be found at: https:// www.epa. gov/oppefed1/ecoriskders/terrestrial field dissipation guidance.pdf. Bedoukian Research, Inc. submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA), requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of biochemicals classified as lepidopteran pheromones.

Inorganic Bromide; Tolerance Actions

EPA is revoking twelve specific inorganic bromide tolerances because they are no longer needed. These twelve tolerances are for residues of inorganic bromide from pre-plant (non-food) use in or on raw agricultural commodities grown in soil fumigated with combinations of chloropicrin, methyl bromide, and propargyl bromide. Although methyl bromide is used as an agricultural pesticide, the Agency considers its application as a soil fumigant to be a non-food use because it is quickly degraded or metabolized in the soil, and subsequently incorporated into natural plant constituents. Methyl bromide is also emitted to the atmosphere. Residues of the parent compound are not likely to be found in foods as a result of prior treatment of fields. While residues of inorganic bromide may be present, these residues are indistinguishable from background because of inorganic bromide's ubiquity in the environment. Consequently, EPA is revoking them because no tolerances are needed for those non-food uses. Furthermore, since methyl bromide, when applied as a pre-plant soil fumigant is a non-food use, the Agency is adding it as an entry to 40 CFR 180.2020 noting the non-food use determination.
Final Extension of the Deferred Effective Date for 8-Hour Ozone National Ambient Air Quality Standards for Early Action Compact Areas

The EPA is proposing a final extension of the deferred effective date of air quality designations for certain areas of the country that have entered into Early Action Compacts. Early Action Compact areas have agreed to reduce ground-level ozone pollution earlier than the Clean Air Act (CAA) requires. On April 30, 2004, EPA published a notice designating all areas of the country for the 8-hour ozone National Ambient Air Quality Standards (NAAQS). In the designation rule, EPA deferred the effective date of the nonattainment designation for 14 areas that had entered into Early Action Compacts. The current effective date of the nonattainment designation for these areas is December 31, 2006. The EPA is now proposing to extend the deferral of the effective date for all 14 Early Action compact areas until April 15, 2008.

This notice announces the availability of EPA's Reregistration Eligibility Decision (RED) for the organic arsenical herbicides MSMA, DSMA, CAMA, and cacodylic acid, and opens a public comment period on this document. The Agency has determined that all products containing MSMA, DSMA, CAMA, and cacodylic acid are not eligible for reregistration. The Agency's risk assessments and other related documents also are available in the organic arsenical herbicides docket. MSMA, DSMA, CAMA, and cacodylic acid are collectively referred to as the ``organic arsenical herbicides.'' The organic arsenic herbicides are used primarily on cotton and turf, including golf courses, home lawns, recreational areas such as school yards and athletic fields, and rights-of-way. Overall, use in the United States appears to be declining. While EPA has identified some risk associated with the direct use of these herbicides, the Agency's primary concern is the potential for applied organic arsenical products to transform to a more toxic inorganic form of arsenic in soil with subsequent transport to drinking water. EPA has reviewed the organic arsenical herbicides through the public participation process that the Agency uses to involve the public in developing pesticide reregistration and tolerance reassessment decisions. Through these programs, EPA is ensuring that all pesticides meet current health and safety standards.
Pesticides; Procedural Regulations for Registration Review

This rule establishes procedures for conducting the pesticide registration review program mandated by the Federal Insecticide, Fungicide, and Rodenticide Act. Under this rule, EPA will review existing pesticide registrations to determine whether they continue to meet the statutory standard for registration. The registration review program will begin in the fall of 2006. This rule provides for the establishment of pesticide cases for review, the scheduling of reviews, the initiation, completion and documentation of reviews, and associated public participation procedures. The registration review program established by this regulation is intended to ensure that all pesticide registrations are systematically reviewed in a manner that is based on sound science and provides for public participation, transparency and efficiency to protect public health and the environment. In addition, in order to display the OMB control number for the information collection requirements contained in this final rule, EPA is amending the table of OMB approval numbers for EPA regulations.

The Agency's risk assessments and other related documents also are available in the methyl bromide docket. Methyl bromide is a broad- spectrum fumigant chemical that can be used as an acaricide, antimicrobial, fungicide, herbicide, insecticide, nematicide, and vertebrate control agent. This reregistration decision document covers the methyl bromide uses that have accompanying food residue tolerances such as post-harvest fumigation of food commodities in chambers at ports or specialized structural fumigations at food processing facilities, as well as some uses without tolerances that are performed in similar facilities. EPA has reviewed the methyl bromide commodity uses through the public participation process that the Agency uses to involve the public in developing pesticide reregistration and tolerance reassessment decisions. Through these programs, EPA is ensuring that all pesticides meet current health and safety standards. EPA is currently assessing risks and will develop risk management decisions for five soil fumigant pesticides: Chloropicrin, dazomet, metam sodium, methyl bromide, and a new active ingredient, iodomethane. Risks of a sixth soil fumigant, 1, 3-D (Telone), will be discussed for comparative purposes because the risk management decision was completed in 1998. A decision on the reregistration of methyl bromide's non-commodity uses that do not have food tolerances (e.g., pre-plant soil, greenhouse, residential) is scheduled to be completed in 2007 with the other soil fumigants.

This comment period is intended to provide an additional opportunity for public input; in particular, the Agency is seeking comments regarding what additional measures, beyond emission control techniques, are available to protect bystanders from unsafe exposure to PPO resulting from use in vacuum- sealed pressurized chambers. PPO is an insecticidal fumigant/sterilant used both to control bacteria contamination, mold contamination, insect infestations, and microbial spoilage of food products as well as to control stored product insects in nonfood products. PPO also has nonfood uses for cosmetic articles, gums, ores, packaging, pigments, pharmaceutical materials, and discarded nutshells prior to disposal. Inert Ingredients; Revocation of Tolerance Exemptions with Insufficient Data for Reassessment

This final rule revokes under section 408(e)(1) of the Federal Food, Drug, and Cosmetic Act (FFDCA) the existing exemptions from the requirement of a tolerance for residues of certain inert ingredients because there are insufficient data to make the determination of safety required by FFDCA section 408(b)(2), or because they are redundant and, therefore, are not necessary. In addition, EPA has identified substances within certain of these tolerance exemptions that meet the definition of low-risk polymers and is establishing new tolerance exemptions for them. The revocation actions in this document contribute towards the Agency's tolerance reassessment requirements under FFDCA section 408(q), as amended by the Food Quality Protection Act (FQPA) of 1996. By law, EPA is required by August 2006 to reassess the tolerances that were in existence on August 2, 1996. The regulatory actions in this document pertain to the revocation of 130 tolerance exemptions which are counted as tolerance reassessment toward the August 2006 review deadline.

Notice of Draft Guidance for Implementing the January 2001 Methylmercury Water Quality Criterion

EPA announces the availability of draft guidance for implementing the water quality criterion for methylmercury and requests comments on the draft guidance. The draft document provides technical guidance to states, territories, and authorized tribes exercising responsibility under Clean Water Act (CWA) section 303(c) on how to use EPA's fish tissue-based methylmercury criterion recommendation in developing their own water quality standards for methylmercury and in implementing these standards in Total Maximum Daily Loads (TMDLs) and National Pollutant Discharge Elimination System (NPDES) permits. The guidance document does not impose any legally binding requirements on any entity. It provides various technical and policy approaches to implementing the criterion. These approaches are recommendations only. States, territories and authorized tribes may choose to implement other technically-sound approaches that are consistent with the CWA and EPA's implementing regulations.
