The Moving Ahead for Progress in the 21st Century Act established the Surface Transportation Project Delivery Program (referred to as National Environmental Policy Act (NEPA) Assignment Program), which allows a State to assume FHWA's environmental responsibilities for environmental review, consultation, and compliance under NEPA. When a State assumes these Federal responsibilities, the State becomes solely responsible and liable for carrying out the responsibilities it has assumed, in lieu of FHWA. This program mandates annual audits during each of the first 4 years of State participation to ensure compliance with program requirements. This is the third audit of the Arizona Department of Transportation's (ADOT) performance of its responsibilities under the NEPA Assignment Program. This notice announces the final third audit report for ADOT.

NHTSA has received almost identical petitions from 13 final- stage manufacturers of "entertainer-type motorcoaches," seeking renewal of temporary exemptions from a shoulder belt requirement of Federal Motor Vehicle Safety Standard (FMVSS) No. 208, "Occupant crash protection," for side-facing seats on motorcoaches. The petitioners seek to renew their exemptions that allow them to install Type 1 seat belts (lap belt only) at side-facing seating positions, instead of Type 2 seat belts (lap and shoulder belts) required by FMVSS No. 208. Each petitioner states that, absent the requested exemption, it will otherwise be unable to sell a vehicle whose overall level of safety or impact protection is at least equal to that of a nonexempted vehicle. NHTSA is publishing this document to notify the public of the receipt of the petitions and to request comment on them, in accordance with statutory and administrative provisions.

This notice sets forth the reasons for the denial of a petition, DP21-002, submitted by Mr. Gerald James to the Administrator of NHTSA by a letter dated September 30, 2021. The petition requests that NHTSA initiate an investigation into "severe oil leaks" from the oil pressure switch that could lead to engine failures experienced by operators of Model Year (MY) 2015-2017 Kia Sorento vehicles equipped with 3.3L V6 engines. After conducting a technical review of: customer complaints submitted by the petitioner; an inspection of petitioner's vehicle; consumer complaint information in NHTSA's database; information provided by Kia North America (Kia) in response to our requests regarding vehicle design and complaints/claims received by Kia; and component testing performed by NHTSA's Vehicle Research and Test Center, NHTSA's Office of Defects Investigation has concluded that it is unlikely that any investigation opened by granting this petition would result in an order concerning the notification and remedy of a safety-related defect. Therefore, upon full consideration of the information presented in the petition and the potential risks to safety, the petition is denied.
FY 2024 Competitive Funding Opportunity: Enhancing Mobility Innovation

The Federal Transit Administration (FTA) announces the opportunity to apply for a total of $1,936,000 in Fiscal Year (FY) 2023 Public Transportation Innovation funds in competitive cooperative agreement awards for projects that enhance mobility innovations for transit. Funds will be awarded for projects that advance emerging technologies, strategies, and innovations in traveler-centered mobility in two distinct areas. Of the total available funds, $968,000 is available for projects to accelerate innovations that improve mobility and enhance the rider experience with a focus on innovative service delivery models, creative financing, novel partnerships, and integrated payment solutions. Another $968,000 is available for projects to develop software solutions that facilitate the provision of integrated demand-response public transportation service that dispatches public transportation fleet vehicles through riders' mobile devices or other means. Projects will be selected based on the criteria outlined in this notice. FTA may award additional funding that is made available to the program prior to the announcement of project selections.

The FAA proposes to adopt a new airworthiness directive (AD) for all Airbus SAS Model A350-941 and A350-1041 airplanes. This proposed AD was prompted by a report the thrust reverser and pylon thermal blankets were found damaged due to air leaking from the pre- cooler exchanger (PCE). This proposed AD would require repetitively testing the PCE for air leaks and reporting the results, and depending on findings, replacing the PCE and inspecting the thermal blankets for damage, as specified in a European Union Aviation Safety Agency (EASA) AD, which is proposed for incorporation by reference. The FAA is proposing this AD to address the unsafe condition on these products.

FMCSA denies the application from Clym Environmental Services LLC (Clym) requesting an exemption from the hours-of-service (HOS) regulations to allow its drivers up to 14 hours of drive time within the work shift or, in the alternative, up to 12 hours. Clym indicated that, due to the nature of its operations, complying with the 11-hour driving time limit in the HOS regulations places a strain on the company's drivers and its overall operating costs. The FAA proposes to adopt a new airworthiness directive (AD) for Lycoming Engines (Lycoming) model engines that have a certain connecting rod assemblies installed. This proposed AD was prompted by several reports of connecting rod failures, which resulted in uncontained engine failure and in-flight shutdowns (IFSDs). This proposed AD would require repetitive oil inspections for bronze metal particulates and, if found, additional inspections of the connecting rod bushings for damage, proper fit, movement, and wear, and replacement if necessary. As terminating action to the connecting rod bushing inspections, this proposed AD would require replacement of the connecting rod bushings with parts eligible for installation. The FAA is proposing this AD to address the unsafe condition on these products.

In accordance with the Paperwork Reduction Act of 1995, FAA invites public comments about our intention to request the Office of Management and Budget (OMB) approval to renew an information collection. The Federal Register Notice with a 60-day comment period soliciting comments on the following collection of information was published on March 25, 2024. The collection involves two distinct methods of collecting. The first method of collecting uses the traditional paper/hardcopy forms which is limited in scope. The second method is more expansive and uses online web-based forms or Application Programming Interface (API) upload functionality. The information can then be shared with a potential employer to aid them in their hiring decision-making process. The information collected can be release to a hiring employer by the pilot. Disclosure of their information is not possible unless the pilot first authorizes the release. The information to be collected will be used to and/or is necessary because before allowing an individual to begin service as a pilot, and air carrier or operator shall receive and evaluate all relevant information pertaining to the individual.

This AD was prompted by a report of degraded polyester filled Aramid (Kevlar) load tapes where the Kevlar core was exposed to ultraviolet light, which could compromise the residual strength of the tapes and the structural integrity of the hot air balloon envelope. This AD requires repetitively checking the hot air balloon envelope for damage (degraded, stretched, or frayed load tapes or exposed Kevlar core) and removing any damaged hot air balloon envelope from service. The FAA is issuing this AD to address the unsafe condition on these products.

This proposed AD was prompted by several reports of failed clutch actuators and failed rivets attaching the belt tension clutch actuator brackets (bracket) to the fan scroll housing. This proposed AD would require inspecting each bracket and, depending on the results, accomplishing additional inspections or taking any necessary corrective actions. The FAA is proposing this AD to address the unsafe condition on these products.

This document denies a petition, submitted by Advocates for Highway and Auto Safety, the Truck Safety Coalition, Citizens for Reliable and Safe Highways, and Parents Against Tired Truckers, for reconsideration of a final rule amending Federal Motor Vehicle Safety Standard (FMVSS) No. 223, "Rear impact guards," and FMVSS No. 224, "Rear impact protection." The final rule, published on July 15, 2022, upgraded NHTSA's standards addressing rear underride protection in crashes of passenger vehicles into trailers and semitrailers by requiring rear impact guards to provide sufficient strength and energy absorption to protect occupants of compact and subcompact passenger cars impacting the rear of trailers at 56 kilometers per hour (km/h) (35 miles per hour (mph)).

Airworthiness Directives; Airbus SAS Airplanes

The FAA proposes to supersede Airworthiness Directive (AD) 2023-12-03 and AD 2023-04-05, which apply to certain Airbus SAS Model A350-941 and -1041 airplanes. AD 2023-12-03 and AD 2023-04-05 require revising the existing maintenance or inspection program, as applicable, to incorporate new or more restrictive airworthiness limitations. Since the FAA issued AD 2023-12-03 and AD 2023-04-05, the FAA has determined that new or more restrictive airworthiness limitations are necessary. This proposed AD would continue to require all actions in AD 2023-12-03 and certain actions in AD 2023-04-05 and would require revising the existing maintenance or inspection program, as applicable, to incorporate new or more restrictive airworthiness limitations, as specified in a European Union Aviation Safety Agency (EASA) AD, which is proposed for incorporation by reference (IBR). The FAA is proposing this AD to address the unsafe condition on these products.

The FAA is adopting a new airworthiness directive (AD) for certain Embraer S.A. Model ERJ 170 airplanes. This AD was prompted by a report of a landing gear not locked indication during the final approach, which led the flight crew to declare an emergency. This AD requires reviewing maintenance records of the main landing gear (MLG) assemblies to determine whether the MLG was modified according to a certain service bulletin or restored during overhaul maintenance; inspecting the left and right MLG locking-stay bracket assemblies to verify that the correct attaching hardware is correctly installed on the brackets; replacing nuts having certain part numbers (P/Ns); replacing the locking-stay bracket assembly, if necessary; and prohibits the installation of affected parts on the MLG locking-stay bracket assembly; as specified in an Ag[ecirc]ncia Nacional de Avia[ccedil][atilde]o Civil (ANAC) AD, which is incorporated by reference. The FAA is issuing this AD to address the unsafe condition on these products.

The FAA is adopting a new airworthiness directive (AD) for The Boeing Company Model 757-200 airplanes modified by particular supplemental type certificates. This AD was prompted by reports of cracking in the structure in and around the lavatory service panel. This AD requires repetitively inspecting the lavatory service panel, access pan, and attaching structure for cracks; reinforcing the attaching structure; and if necessary, replacing the access pan or repairing cracked parts. The FAA is issuing this AD to address the unsafe condition on these products.

The FAA proposes to adopt a new airworthiness directive (AD) for certain The Boeing Company Model 767-200, -300, and -400ER series airplanes. This proposed AD was prompted by a report of multiple engine indicating and crew alerting system messages during the potable water servicing for a Model 777 freighter airplane after the water leaked onto the electronics equipment cooling air filter. Since the Model 767 passenger airplanes are similar in design, we are issuing an AD against the Model 767 passenger airplanes. This proposed AD would require installation of hoseducts around the left-side section 43 potable water supply hoses and connections, a potable water system leakage test, and applicable corrective actions. The FAA is proposing this AD to address the unsafe condition on these products.

This notice sets forth the reasons for the denial of a petition submitted to NHTSA on August 18, 2022, requesting that the agency commence an investigation of collisions of passenger vehicles and vulnerable road users (pedestrians, bicyclists, or motorcyclists) with van-type (also known as box) semi-trailers that result in significant injuries or death due to a lack of effective rear impact guards. On January 17, 2023, NHTSA opened Defect Petition DP22-004 to evaluate petitioners' request. After consideration of the petition and other information, NHTSA believes that the issues raised here are best addressed through its recent rulemaking and the ongoing actions under the Bipartisan Infrastructure Law (BIL). Accordingly, the agency has denied the petition.
