2010 Tax Information for Use in the Revenue Shortfall Allocation Method
The Board is publishing, and providing the public an opportunity to comment on, the 2010 weighted average state tax rates for each Class I railroad, as calculated by the Association of American Railroads (AAR), for use in the Revenue Shortfall Allocation Method (RSAM).
Regulations Governing Fees for Services
The Board is amending the regulations governing user fees for
CSX Transportation, Inc.-Lease Exemption-Consolidated Rail Corporation
Under 49 U.S.C. 10502, the Board is granting a petition for exemption from the prior approval requirements of 49 U.S.C. 11323-25, for CSX Transportation, Inc. (CSXT), to lease from Consolidated Rail Corporation (Conrail) approximately 1,303 feet of rail line (the Line) in the South Jersey/Philadelphia Shared Assets Area between mileposts 5.20 and 5.45 in Philadelphia, PA. Under the lease, CSXT proposes to construct an additional connection between its Trenton Subdivision Line (Trenton Line) and the Line. The new connection would facilitate operations on the Trenton Line and an Amtrak-owned, Conrail-operated line (the Delair Branch).
Quarterly Rail Cost Adjustment Factor
The Board has approved the third quarter 2011 Rail Cost Adjustment Factor (RCAF) and cost index filed by the Association of American Railroads. The third quarter 2011 RCAF (Unadjusted) is 1.206. The third quarter 2011 RCAF (Adjusted) is 0.534. The third quarter 2011 RCAF-5 is 0.506.

As part of a Federal Government-wide effort to streamline the process to seek feedback from the public on service delivery, the Surface Transportation Board has submitted a Generic Information Collection Request (Generic ICR): ``Generic Clearance for the Collection of Qualitative Feedback on Agency Service Delivery '' to OMB for approval under the Paperwork Reduction Act (PRA) (44 U.S.C. 3501 et. seq.).
The New Brunswick Railway Company; Notices of Exemptions
In Docket No. 35520, the Board grants an exemption, under 49 U.S.C. 10502, from the prior approval requirements of 49 U.S.C. 11323- 25 for The New Brunswick Railway Company (NBRC) to continue in control of Maine Northern Railway Company (MNRC) and Eastern Maine Railway once MNRC becomes a Class III carrier. The Board makes the exemption effective on June 15, 2011. Additionally, in related Docket Nos. FD 35518 and FD 35519, the Board makes MNRC's authority to exercise trackage rights granted by the Montreal, Maine & Atlantic Railway, Ltd. effective on June 15, 2011.
Adrian & Blissfield Rail Road Company-Continuance in Control-Charlotte Southern Railroad Company, Detroit Connecting Railroad Company, and Lapeer Industrial Railroad Company
The Surface Transportation Board (Board) is accepting for consideration the application filed by Adrian & Blissfield Rail Road Company (ADBF) seeking Board authority under 49 U.S.C. 11321-26 for continuance in control of Charlotte Southern Railroad Company (CHS), Detroit Connecting Railroad Company (DCON), and Lapeer Industrial Railroad Company (LIRR). ADBF seeks authorization for its previously consummated control, through stock ownership and management, of those 3 entities when they became Class III short line railroads. The Board finds that this transaction is a ``minor transaction'' under 49 CFR 1180.2(c) and adopts a procedural schedule for consideration of the application, providing for the Board's final decision to be issued on August 19, 2011, and to become effective on September 18, 2011.
