FTA Supplemental Fiscal Year 2009 Apportionments and Allocations
Division I of the ``Omnibus Appropriations Act, 2009'' (Pub. L. 111-8), signed into law by President Barack Obama on March 11, 2009, made funds available for all of the surface transportation programs of the Department of Transportation (DOT) for the Fiscal Year (FY) ending September 30, 2009. This notice supplements the December 18, 2008 Federal Register notice. The notice apportions formula funds made available under the Omnibus Appropriations Act and allocates FY 2009 funds to congressionally designated projects that were contained in the accompanying committee report and the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU). Notice of Intent To Rule on Request To Release Airport Property at the Gatlinburg/Pigeon Forge Airport, Sevierville, TN
The Federal Aviation Administration is requesting public comment on the release of land at the Gatlinburg/Pigeon Forge Airport in the city of Sevierville, Tennessee. This property, approximately .5 acres, will change to a non-aeronautical use. This action is taken under the provisions of Section 125 of the Wendell H. Ford Aviation Investment Reform Act for the 21st Century (AIR 21).
Proposed Establishment of Class D Airspace; Fort Worth, TX
This action proposes to establish Class D airspace at Fort Worth Spinks Airport, Fort Worth, TX. Establishment of an air traffic control tower at Fort Worth Spinks Airport has made this action necessary for the safety and management of Instrument Flight Rules (IFR) aircraft operations at Fort Worth Spinks Airport.
Noise Exposure Map Notice; Receipt of Noise Compatibility Program and Request for Review; Westfield-Barnes Airport, Westfield, MA
The Federal Aviation Administration (FAA) announces its determination that the noise exposure map for Westfield-Barnes Airport, as submitted by the City of Westfield under the provisions of Title I of the Aviation Safety and Noise Abatement Act of 1979 (Pub. L. 96-193) and 14 CFR Part 150, is in compliance with applicable requirements. The FAA also announces that it is reviewing a proposed noise compatibility program that was submitted for Westfield-Barnes Airport under Part 150 in conjunction with the noise exposure map, and that this program will be approved or disapproved on or before October 19, 2009.
Notice of Availability of Final Guidance on the Application of 49 U.S.C. 5324(c), Railroad Corridor Preservation
By this notice the FTA announces the availability of final guidance on the application of a provision of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) concerning the acquisition of railroad right-of-way for transit projects. The guidance explains FTA's interpretation of the provision, which allows the acquisition of pre-existing railroad right- of-way, under certain conditions, before the completion of the environmental review for a transit project that would use the right-of- way. On December 22, 2008, FTA announced in the Federal Register the availability of the draft guidance and requested public comment. Several comments were received, and responses thereto are presented in this notice. The final guidance is available on the U.S. Government electronic docket site and on the FTA Web site.
Noise Exposure Map Notice and Receipt of Noise Compatibility Program and Request for Review for Van Nuys Airport, Van Nuys, CA
The Federal Aviation Administration (FAA) announces its determination that the noise exposure maps submitted by the City of Los Angeles for Van Nuys Airport under the provisions of 49 U.S.C. 47501 et seq. (Aviation Safety and Noise Abatement Act) and 14 CFR Part 150 are in compliance with applicable requirements. The FAA also announces that it is reviewing a proposed noise compatibility program that was submitted for Van Nuys Airport under Part 150 in conjunction with the noise exposure map, and that this program will be approved or disapproved on or before October 16, 2009.

The Federal Aviation Administration is requesting public comment on the release of land at the Cincinnati/Northern Kentucky International Airport in the city of Hebron, Kentucky. This property, approximately 1.99 acres, will change to a non-aeronautical use. This action is taken under the provisions of Section 125 of the Wendell H. Ford Aviation Investment Reform Act for the 21st Century (AIR 21).
Airworthiness Directives; International Aero Engines (IAE)
The FAA proposes to adopt a new airworthiness directive (AD) for IAE V2500-A1, V2527E-A5, V2527M-A5, V2528-D5, V2530-A5, and V2533- A5 turbofan engines. This proposed AD would require a onetime inspection of certain vortex reducers for cracks, and replacing the reducer and high-pressure (HP) compressor stage 3-8 drum if the reducer is cracked. This proposed AD results from reports of fractured vortex reducers found at shop visits. We are proposing this AD to inspect for cracks in the vortex reducer. Cracks in the vortex reducer could cause an uncontained failure of the HP compressor stage 3-8 drum, which could result in damage to the airplane.

We are adopting a new airworthiness directive (AD) for certain Cessna Aircraft Company (Type Certificate previously held by Columbia Aircraft Manufacturing (previously The Lancair Company)) Models LC40- 550FG, LC41-550FG, and LC42-550FG airplanes. This AD requires you to repetitively inspect the rudder hinges and the rudder hinge brackets for damage, i.e., cracking, deformation, and discoloration. If damage is found during any inspection, this AD also requires you to replace the damaged rudder hinge and/or rudder hinge bracket. This AD results from reports that cracked lower rudder hinge brackets were found on two of the affected airplanes. We are issuing this AD to detect and correct damage in the rudder hinges and the rudder hinge brackets, which could result in failure of the rudder. This failure could lead to loss of control.
Agency Information Collection Activity Seeking OMB Approval
The FAA invites public comments about our intention to request the Office of Management and Budget's (OMB) revision of a current information collection. The Federal Register Notice with a 60-day comment period soliciting comments on the following collection of information was published on December 3. 2008, vol. 73, no. 233. pages 73687-73688. Standards have been established for the operation of agricultural aircraft and for the dispensing of chemicals, pesticides and toxic substances. Information collected shows applicant compliance and eligibility for certification by the FAA.
Environmental Impact Statement: Final and Gila Counties, AZ
The FHWA is issuing this notice to advise the public that an environmental impact statement will be prepared for a proposed highway project in Pinal and Gila counties, Arizona.
Airworthiness Directives; Airbus Model A318-100 and A319-100 Series Airplanes; A320-111 Airplanes; A320-200 Series Airplanes; and A321-100 and A321-200 Series Airplanes
The FAA is superseding an existing airworthiness directive (AD), which applies to certain Airbus Model A318-100 and A319-100 series airplanes; A320-111 airplanes; A320-200 series airplanes; and A321-100 and A321-200 series airplanes. That AD currently requires a one-time inspection of the horizontal hinge pin of the 103VU electrical panel in the avionics compartment to determine if the hinge pin can move out of the hinge, and related investigative and corrective actions if necessary. This new AD instead requires installing a hinge pin stopper on the internal door of the 103VU electrical panel. This AD results from a report indicating that electrical wire damage was found in the 103VU electrical panel due to contact between the hinge pin and the adjacent electrical wire harness. We are issuing this AD to prevent contact between the horizontal hinge pin and the adjacent electrical wire harness, which could result in damage to electrical wires, and consequent arcing and/or failure of associated systems.
Pipeline Safety: Agency Information Collection Activities: Notice of Request for Extension of Currently Approved Information Collections
In compliance with the Paperwork Reduction Act of 1995 (PRA), this notice announces that the Information Collection Requests (ICRs) abstracted below will be forwarded to the Office of Management and Budget (OMB) for review and comments. The ICRs describe the nature of the information collections and their expected burden. A Federal Register Notice with a 60-day comment period soliciting comments on ICRs was published in the Federal Register on February 20, 2009 (73 FR 7955) under Docket No. PHMSA-2009-0057. Two comments were received. The purpose of this notice is to allow the public an additional 30 days to submit comments on the information collections described below and respond to comments submitted to the 60-day notice.
Notice of Policy Statement for Eligible New Freedom Projects
The Federal Transit Administration (FTA) is expanding the type of projects it considers to be ``beyond the ADA'' and thus increase the types of projects eligible for funding under the New Freedom program. Under this interpretation, new and expanded fixed route and demand responsive transit service planned for and designed to meet the needs of individuals with disabilities are eligible projects.
Public Transportation on Indian Reservations Program; Tribal Transit Program
This notice announces the availability of $15 million in funding provided by the Public Transportation on Indian Reservations Program (Tribal Transit Program (TTP)), a program authorized by the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), Section 3013 (c). This notice is a national solicitation for grant applicants to be selected on a competitive basis, and it includes the grant terms and conditions; grant application procedures; and selection criteria for Fiscal Year (FY) 2009 projects. The Federal Transit Administration (FTA) announced the availability of, and competition for, the FY 2009 American Recovery and Reinvestment Act (ARRA) TTP funding in a separate notice published on March 23, 2009.

We propose to adopt a new airworthiness directive (AD) for the products listed above. This proposed AD results from mandatory continuing airworthiness information (MCAI) originated by an aviation authority of another country to identify and correct an unsafe condition on an aviation product. The MCAI describes the unsafe condition as: During operation in icing conditions, an asymmetric configuration of the de-icing boots was detected, occurring during the inflation and deflation check of the de-icing system. This was found to be due to an unexpected failure mode in the pneumatic and de-icing system's control electronic logic. This condition, if not corrected, could affect the de-icing capabilities of the boots installed on the wing and horizontal stabilizers, potentially leading to loss of control of the aircraft. We propose to adopt a new airworthiness directive (AD) for the products listed above. This proposed AD results from mandatory continuing airworthiness information (MCAI) originated by an aviation authority of another country to identify and correct an unsafe condition on an aviation product. The MCAI describes the unsafe condition as: An A340 operator has reported an uncommanded engine N[deg]4 shut down during taxi after landing. The root cause of this event has been identified as failure of the fuel pump Non Return Valve (NRV) preventing the collector cell jet pump from working. This led to engine N[deg]4 collector cell fuel level to drop below the pump inlet and consequently causing engine N[deg]4 flame out. Multiple NRV failures in combination with failure modes trapping fuel could potentially increase the quantity of unusable fuel on aircraft possibly leading to fuel starvation which could result in engine in-flight shut down and would constitute an unsafe condition. We propose to adopt a new airworthiness directive (AD) for the products listed above. This proposed AD results from mandatory continuing airworthiness information (MCAI) originated by an aviation authority of another country to identify and correct an unsafe condition on an aviation product. The MCAI describes the unsafe condition as: An A320 operator experienced difficulties in extending the RAT [ram air turbine] during a deployment testing. During the trouble shooting, the Ejection Jack of the RAT was removed and investigated. The investigation identified excessive wear of the uplock segments against the inner cylinder of the Ejection Jack, due to an incorrect blend radius of the inner cylinder. This Ejection Jack failure may prevent the effective deployment and use of the RAT in emergency conditions. The proposed AD would require actions that are

Voluntary Disclosure Reporting Program; National Wildlife Aircraft Hazard Database
The FAA proposed that bird strike information voluntarily reported to the Agency and entered into the FAA's National Wildlife Aircraft Hazard Database be designated by an FAA order as protected from public disclosure in accordance with the provisions of 14 CFR part 193. After further review and consideration, the FAA has determined not to proceed with an order designating the wildlife database as protected under part 193.
Notice of Renewal of Charter for the National Emergency Medical Services Advisory Council (NEMSAC)
The Secretary of Transportation announces renewal of the National Emergency Medical Services Advisory Council to provide advice and recommendations regarding emergency medical services (EMS) matters to the U.S. Department of Transportation, National Highway Traffic Safety Administration and through NHTSA to the Federal Interagency Committee on Emergency Medical Services. The NHTSA's Office of EMS serves as sponsor of the Advisory Council for the Secretary. Qualification of Drivers; Exemption Applications; Vision
FMCSA announces receipt of applications from 22 individuals for exemption from the vision requirement in the Federal Motor Carrier Safety Regulations. If granted, the exemptions would enable these individuals to qualify as drivers of commercial motor vehicles (CMVs) in interstate commerce without meeting the Federal vision standard.

FMCSA announces its decision to renew the exemptions from the vision requirement in the Federal Motor Carrier Safety Regulations for 24 individuals. FMCSA has statutory authority to exempt individuals from the vision requirement if the exemptions granted will not compromise safety. The Agency has concluded that granting these exemption renewals will provide a level of safety that is equivalent to, or greater than, the level of safety maintained without the exemptions for these commercial motor vehicle (CMV) drivers.

FMCSA announces receipt of applications from 27 individuals for exemptions from the prohibition against persons with insulin- treated diabetes mellitus (ITDM) operating commercial motor vehicles (CMVs) in interstate commerce. If granted, the exemptions would enable these individuals with ITDM to operate commercial motor vehicles in interstate commerce.
Pipeline Safety: Requests for Special Permits
PHMSA is publishing this notice of several special permit requests we have received from pipeline operators, seeking relief from compliance with certain requirements in the Federal pipeline safety regulations. This notice seeks public comments on these requests, including comments on any safety or environmental impacts. At the conclusion of the 30-day comment period, PHMSA will evaluate the requests and determine whether to grant or deny a special permit and the terms and conditions of any grant.

Emission Standards for Turbine Engine Powered Airplanes
This action amends the emission standards for turbine engine powered airplanes to incorporate the standards adopted by the United States Environmental Protection Agency (EPA). This rule also amends certain test procedures for gaseous exhaust emissions, which are based on the standards of the International Civil Aviation Organization (ICAO) for gaseous emissions of oxides of nitrogen (NOX). This rule will bring the standards of 14 CFR part 34 into alignment with 40 CFR part 87 as required.

This action proposes to amend Class E airspace at Ankeny, IA. Cancellation of NDB approaches at Ankeny Regional Airport has made it necessary to reconfigure Class E airspace. Controlled airspace is necessary to accommodate Standard Instrument Approach Procedures (SIAPs) at Ankeny Regional Airport, Ankeny, IA. This action also would update the geographic coordinates of the airport to coincide with the FAA's National Aeronautical Charting Office. The FAA is taking this action to enhance the safety and management of Instrument Flight Rules (IFR) aircraft operations at Ankeny Regional Airport.
Special Conditions: Boeing Model 747-8/-8F Airplanes, Structural Design Requirements for Four-Post Main Landing Gear System
This action proposes special conditions for the Boeing Model 747-8/-8F airplane. This airplane will have novel or unusual design features associated with a four-post main landing gear system. The applicable airworthiness regulations do not contain adequate or appropriate safety standards for this design feature. These proposed special conditions contain the additional safety standards that the Administrator considers necessary to establish a level of safety equivalent to that established by the existing airworthiness standards.

Airworthiness Directives; Rolls-Royce plc RB211 Trent 800 Series Turbofan Engines
The FAA proposes to supersede an existing airworthiness directive (AD) for Rolls-Royce plc RB211 Trent 875-17, Trent 877-17, Trent 884-17, Trent 892-17, Trent 892B-17, and Trent 895-17 turbofan engines with high pressure (HP) compressor rotor rear stage 5 and 6 discs and cone shafts, part numbers (P/Ns) FK25230 and FK27899 installed. This proposed AD would require removing these parts at new reduced cycle limits. This proposed AD results from Rolls-Royce plc reducing the lives of these parts and changing the life calculating method to use ``Standard Duty Cycles'' with ``Multiple Flight Profile Monitoring'' and ``Flight Cycles'' with ``Heavy Flight Profile Monitoring''. We are proposing this AD to prevent stage 5 and 6 disc crack initiation and propagation that might lead to uncontained disc failure and damage to the airplane.

Airworthiness Directives; Sikorsky Aircraft Corporation Model S-92A Helicopters
This document publishes in the Federal Register an amendment adopting Airworthiness Directive (AD) 2009-07-53, which was sent previously to all known U.S. owners and operators of Sikorsky Aircraft Corporation (Sikorsky) Model S-92A helicopters by individual letters. This amendment is prompted by the failure of 2 main gearbox filter bowl assembly studs (studs) that were found broken during a fatal accident investigation in Canada. Prior to the accident, the manufacturer was investigating a July 2008 incident that also involved broken studs. In both cases, the broken studs resulted in rapid loss of oil. The failures have been tied to fretting and galling of the original titanium studs; therefore, this AD requires removing all titanium studs and replacing them with steel studs. The actions specified by this AD are intended to prevent failure of a stud, which could result in rapid loss of oil, failure of the main gearbox, and subsequent loss of control of the helicopter.
