The Department of the Navy is reinstating an exemption rule that was inadvertently deleted for system of records notice N03834-1, entitled ``Special Intelligence Personnel Access File (April 28, 1999, 64 FR 22840)''. This direct final rule makes nonsubstantive changes to the Department of the Navy Privacy Program rules. These changes will allow the Department to exempt records from certain portions of the Privacy Act. This will improve the efficiency and effectiveness of DoD's program by preserving the exempt status of the records when the purposes underlying the exemption are valid and necessary to protect the contents of the records. This rule is being published as a direct final rule as the Department of Defense does not expect to receive any adverse comments, and so a proposed rule is unnecessary.

The Department of the Navy (DoN) is amending its certifications and exemptions under the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), to reflect the conversion of several Navy vessels from ballistic missile submarines (SSBN) to guided missile submarines (SSGN). The Deputy Assistant Judge Advocate General (DAJAG) (Admiralty and Maritime Law) has determined that certain vessels of the SSGN Class are vessels of the Navy which, due to their special construction and purpose, cannot fully comply with certain provisions of the 72 COLREGS without interfering with their special function as naval ships. The intended effect of this rule is to warn mariners in waters where 72 COLREGS apply.

The Department of the Navy (Navy) is extending the public comment period for the Draft Supplemental Environmental Impact Statement (SEIS) for the Disposal and Reuse of Hunters Point Naval Shipyard (HPS), San Francisco, California until Friday, May 6, 2011. A Notice of Availability (NOA) and Notice of Public Hearing (NOPH) for the Draft SEIS were published in the Federal Register on Wednesday, February 23, 2011 (Federal Register/Vol. 76, No. 36, Pages 10012-10014/ Wednesday, February 23, 2011/Notices). Those notices announced the initial public comment period, including a public hearing that took place on Tuesday, March 15, 2011, and also provided additional information on the background and scope of the Draft SEIS. The initial public comment period requested the submission of all comments on the Draft SEIS to the Navy by Tuesday, April 12, 2011. In response to a request from the U.S. Environmental Protection Agency (EPA), the Navy is extending the public comment period until Friday, May 6, 2011.

The U.S. Army Corps of Engineers (USACE) and the National Marine Fisheries Service (NMFS) are cooperating agencies for the EIS. The Navy will conduct three public hearings to receive oral and written comments on the Draft EIS. Federal, State, and local agencies, elected officials, and other interested individuals and organizations are invited to be present or represented at the public hearings. This notice announces the dates and locations of the public hearings for this Draft EIS. Dates and Addresses: Public hearings will be held on the following dates and locations: 1. The Department of the Navy (Navy), after carefully weighing the operational and environmental consequences of the proposed action, announces its decision to conduct Navy Atlantic Fleet training; research, development, testing, and evaluation (RDT&E) activities; and associated range capabilities enhancements in the Corpus Christi, New Orleans, Pensacola, and Panama City Operating Areas (OPAREAs) and associated airspace, land and overland components, hereafter referred to as the Gulf of Mexico (GOMEX) Range Complex. Title 10, United States Code (U.S.C.) Part 5062 directs the Chief of Naval Operations (CNO) to train all naval forces for combat. The CNO meets that direction, in part, by conducting at-sea training exercises and ensuring naval forces have access to ranges, OPAREAs and airspace where the Navy can develop and maintain skills for wartime missions and conduct RDT&E of naval weapons systems. The proposed action will be accomplished as set forth in Alternative 2, described in the Final Environmental Impact Statement (EIS)/Overseas Environmental Impact Statement (OEIS) as the Preferred Alternative. The purpose for the proposed action is to: (1) Achieve and maintain Fleet readiness using the GOMEX Range Complex to support and conduct current, emerging, and future training and RDT&E; (2) Expand warfare missions supported by the GOMEX Range Complex; and (3) Upgrade and modernize existing range capabilities to enhance and sustain Navy training and RDT&E. The need for the proposed action is to provide range capabilities for training and equipping combat-capable naval forces ready to deploy worldwide.

Pursuant to Section 102(2)(C) of the National Environmental Policy Act (NEPA) of 1969, as implemented by the Council on Environmental Quality regulations (40 CFR parts 1500-1508), the Department of the Navy (Navy) has prepared and filed the Draft Supplemental Environmental Impact Statement (SEIS) evaluating the potential environmental consequences associated with the disposal and reuse of Hunters Point Naval Shipyard (HPS), San Francisco, California. The Navy is required to dispose of HPS per Public Law 101-510, the Defense Base Closure and Realignment Act of 1990, as amended. A public hearing will be held to provide information and receive oral and written comments on the Draft SEIS. Federal, State, and local agencies and interested individuals are invited to be present or represented at the hearing. Dates and Addresses: One public hearing will be held. The hearing will be preceded by an open information session to allow interested individuals to review information presented in the Draft SEIS. Navy representatives will be available during the information session to provide clarification as necessary related to the Draft SEIS. The public hearing is scheduled as follows: Tuesday, March 15, 2011, from 6:30 p.m. to 8:30 p.m. at the Southeast Community Facility Community Center, Alex L. Pitcher, Jr. Community Room, 1800 Oakdale Avenue, San Francisco, California 94124. The open information session will be held on the same date and at the same location, from 5:30 p.m. to 6:30 p.m.

The Department of the Navy (DoN) is amending its certifications and exemptions under the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), to reflect that the Deputy Assistant Judge Advocate General (DAJAG) (Admiralty and Maritime Law) has determined that USS SPRUANCE (DDG 111) is a vessel of the Navy which, due to its special construction and purpose, cannot fully comply with certain provisions of the 72 COLREGS without interfering with its special function as a naval ship. The intended effect of this rule is to warn mariners in waters where 72 COLREGS apply.

Under this proposal, a total of seven active-duty F/A-18C Hornet aircraft squadrons and one fleet replacement squadron (FRS) will progressively transition from F/A-18C Hornet aircraft to the more advanced F-35C JSF beginning in 2015. This transition will occur as a one-for-one replacement. The aging FA-18C Hornet aircraft are expected to be replaced with F-35C aircraft by 2025. The Navy will evaluate two basing options (plus a no action alternative) to efficiently and economically transition the F-35C aircraft into the fleet. This basing action is consistent with past Navy strike-fighter homebasing actions. Dates and Addresses: Public scoping meetings are scheduled to receive oral and/or written comments on environmental concerns that should be addressed in the EIS, as follows: 1.
