Notice of Meeting for the Denali National Park and Preserve Aircraft Overflights Advisory Council Within the Alaska Region
The National Park Service (NPS) announces a meeting of the Denali National Park and Preserve Aircraft Overflights Advisory Council. The purpose of this meeting is to discuss mitigation of impacts from aircraft overflights at Denali National Park and Preserve. This meeting is open to the public and will have time allocated for public testimony. The public is welcomed to present written or oral comments. The meeting will be recorded and a summary will be available upon request from the Superintendent for public inspection approximately six weeks after each meeting. The Aircraft Overflights Advisory Council is authorized to operate in accordance with the provisions of the Federal Advisory Committee Act.
Outer Continental Shelf (OCS), Headquarters, Cape Wind Energy Project 2008
The Minerals Management Service hereby gives notice that it is extending the public comment period for the Cape Wind Energy Project Draft Environmental Impact Statement (DEIS), which was published in the Federal Register on January 18, 2008, (Volume 73, No. 13) for an additional 30 days. Please see the Notice of Availability of the DEIS (73 FR 3482) for more detailed information related to the Cape Wind Energy Project. In response to requests for additional time, the MMS will extend the comment period from March 20, 2008, to April 21, 2008. Federal, State, tribal, and local governments and other interested parties are requested to comment on the DEIS. Comments will be accepted through the MMS Web site, by mail or in person at the public hearings as stated below. 1. Notice To Establish Special Recreation Permit Application, Renewal and Transfer Fees for Commercial, Competitive, or Organized Group Activities and Events; Colorado
The Colorado State Office of the Bureau of Land Management (BLM) plans to implement Special Recreation Permit (SRP) fees. The fees will establish standard statewide application, transfer, and renewal fees for SRPs. The fees apply to commercial, competitive, or organized group activities and events on BLM lands, and revenues will be used to help offset the cost of processing SRPs. Field offices will also be allowed to keep more revenues that would benefit on-the-ground work, including an increased law enforcement presence, hiring seasonal employees, and site improvements. Currently, there is no statewide SRP fee. This new fee will not affect cost recovery charges when the 50- hour cost recovery threshold is anticipated to be exceeded. The fees are:
Notice of Proposed Withdrawal and Opportunity for Public Meeting; New Mexico
The Department of Homeland Security (DHS) has filed an application requesting the Secretary of the Interior to withdraw 20 acres of public land from the mining laws for a period of 20 years to protect a Border Patrol Forward Operating Base in Luna County, New Mexico, and to convey jurisdiction of the land to the DHS. This notice temporarily segregates the land for up to 2 years from location and entry under the mining laws while the 20-year withdrawal application is being processed.
Tribal Energy Resource Agreements Under the Indian Tribal Energy Development and Self-Determination Act
The Secretary of the Interior (Secretary) is promulgating final regulations providing that Indian tribes, at their discretion, may enter into business agreements and leases for energy resource development and grant rights-of-way for pipelines or electric transmission or distribution lines on tribal land without the Secretary's review and approval. Indian tribes entering into such business agreements, leases, and grants of rights-of-way must execute them under an approved tribal energy resource agreement (TERA) between the Secretary and the tribe. These final regulations provide the process under which a tribe may apply for, and the Secretary may grant, authority for an Indian tribe to review and approve leases and business agreements and grant rights-of-way for specific energy development activities on tribal lands through an approved TERA. The regulations also cover processes for implementation of TERAs, including periodic review and evaluation of a tribe's activities under a TERA, enforcement of TERA provisions, and administrative appeals. The regulations also include a process for a tribe's voluntarily rescinding a TERA.
Public Land Order No. 7691; Extension of Public Land Order No. 6665; Wyoming
This order extends the withdrawal created by Public Land Order No. 6665 for an additional 20-year period. This extension is necessary to continue protection of the Bureau of Land Management's Britton Springs Administrative Site and Crooked Creek Natural Area in Big Horn County, Wyoming which would otherwise expire on March 6, 2008.

Fike timely filed a petition for reinstatement of oil and gas lease CAS 019806B for lands in Kern County, California, and it was accompanied by all required rentals and royalties accruing from November 1, 2006, the date of termination.

Notice of Cancellation of the Environmental Impact Statement for the Proposed Stockbridge-Munsee Casino, Sullivan County, NY
This notice advises the public that the Bureau of Indian Affairs (BIA) intends to cancel work on the Environmental Impact Statement (EIS) for the proposed taking into federal trust of land in Sullivan County, New York, for the StockbridgeMunsee Community Band of Mohican Indians of Wisconsin (Tribe). The Tribe proposed to develop and operate a Class III gaming facility and associated facilities on the trust property. The EIS is no longer needed because the Department of the Interior has decided not to accept the land into trust, on the basis that the proposed action did not adequately meet criteria in 25 CFR 151.3; 151.10(b); 151.10(c); and 151.11(b) for trust acquisition.
Notice of Intent To Prepare an Environmental Impact Statement for the Proposed Manzanita Band of Kumeyaay Indians Fee-to-Trust Transfer and Casino Project, Calexico, Imperial County, CA
This notice advises the public that the Bureau of Indian Affairs (BIA), as lead agency, with the National Indian Gaming Commission, the City of Calexico and the Manzanita Band of Kumeyaay Indians (Tribe) as cooperating agencies, intends to gather information necessary for preparing an Environmental Impact Statement (EIS) for a proposed 60.8-acre fee-to-trust transfer and casino project in Calexico, Imperial County, California. This notice also announces a public scoping meeting to identify potential issues, concerns and alternatives to be considered in the EIS.
Notice of Intent To Prepare an Environmental Impact Statement for the Proposed Trust Acquisition of an Initial Reservation for the Mashpee Wampanoag Tribe in the Town of Mashpee, Barnstable County, and Town of Middleboro, Plymouth County, MA, Including a Gaming Facility at the Middleboro Property
This notice advises the public that the Bureau of Indian Affairs (BIA) as Lead Agency, with the Mashpee Wampanoag Tribe (Tribe) as Cooperating Agency, will be gathering information needed for an Environmental Impact Statement (EIS) for the proposed trust acquisition of approximately 679 acres of land as the Tribe's initial reservation. The proposed acquisition includes approximately 140 acres in the Town of Mashpee, Barnstable County, Massachusetts, and approximately 539 acres in the Town of Middleboro, Plymouth County, Massachusetts. The property in Mashpee would be used for tribal administrative and cultural purposes and housing for tribal members. For the property in Middleboro, the Tribe plans the construction of a gaming facility with related facilities. The purposes of the proposed federal action are to provide a land base for the Tribe and to help meet the economic needs of the Tribe and its members. This notice also announces public scoping meetings to identify potential issues, alternatives and content for inclusion in the EIS.
Endangered and Threatened Wildlife and Plants; Designation of Critical Habitat for the Marbled Murrelet (Brachyramphus marmoratus)
We, the U.S. Fish and Wildlife Service (Service), find that the proposed revision of critical habitat for the marbled murrelet (Brachyramphus marmoratus) pursuant to the Endangered Species Act of 1973, as amended, (Act), should not be made. On September 12, 2006, (71 FR 53840), we proposed to revise the May 24, 1996, designation of critical habitat for the marbled murrelet in Washington, Oregon, and California (61 FR 26256). Under the proposed revision, 3,590,642 acres (ac) (1,363,300 hectares (ha)) were proposed as critical habitat, with 3,368,950 ac (1,363,300 ha) of these lands proposed for exclusion under section 4(b)(2) of the Act. Due to uncertainties regarding Bureau of Land Management (BLM) revisions to its District Resource Management Plans in western Oregon, we have determined that it is not appropriate to revise the designation of critical habitat for the marbled murrelet at this time, as discussed below. Therefore, in accordance with the provisions of section 4(b)(6)(A)(i)(II) of the Act, we find that the proposed revision of critical habitat for the marbled murrelet should not be made. Accordingly, the May 24, 1996, final rule designating critical habitat for the marbled murrelet remains in effect (61 FR 26256).
Endangered and Threatened Wildlife and Plants; Revised Proposed Designation of Critical Habitat for 12 Species of Picture-Wing Flies From the Hawaiian Islands
We, the U.S. Fish and Wildlife Service (Service), announce the reopening of the public comment period and the scheduling of public hearings on the revised proposed rule to designate critical habitat for 12 species of Hawaiian picture-wing flies (Drosophila aglaia, D. differens, D. hemipeza, D. heteroneura, D. montgomeryi, D. mulli, D. musaphilia, D. neoclavisetae, D. obatai, D. ochrobasis, D. substenoptera, and D. tarphytrichia) on the islands of Hawaii, Kauai, Maui, Molokai, and Oahu, under the Endangered Species Act of 1973, as amended (Act). The reopened comment period will provide the public, other concerned governmental agencies, the scientific community, industry, or any other interested parties with an additional opportunity to submit written comments on the revised proposed rule. Comments previously submitted need not be resubmitted as they have already been incorporated into the public record and will be fully considered in any final decisions.
Fee Rate
Notice is hereby given, pursuant to 25 CFR 514.1(a)(3), that the National Indian Gaming Commission has adopted preliminary annual fee rates of 0.00% for tier 1 and 0.057% (.00057) for tier 2 for calendar year 2008. These rates shall apply to all assessable gross revenues from each gaming operation under the jurisdiction of the Commission. If a tribe has a certificate of self-regulation under 25 CFR part 518, the preliminary fee rate on class II revenues for calendar year 2008 shall be one-half of the annual fee rate, which is 0.0285% (.000285)
Notice of Adoption of an Environmental Impact Statement
We, the U.S. Fish and Wildlife Service (Service), give notice of our intent to adopt the National Park Service's existing environmental impact statement/environmental impact report (EIS/EIR) for the Giacomini Wetland Restoration Project in Marin County, California (Project). We are considering a decision to approve a National Coastal Wetlands Conservation Program grant for the California State Coastal Conservancy (SCC) to assist SCC in implementing the Project. The grant would help SCC restore and conserve a 556-acre coastal wetland ecosystem at the head of Tomales Bay. We propose to adopt the existing EIS/EIR, which evaluates the environmental effects of implementing field and construction activities related to restoring tidal and freshwater marsh habitat on the former dairy farm.
Notice of Extension of Comment Period for the Draft San Juan Land Management Plan and Draft Environmental Impact Statement, Colorado
The Bureau of Land Management (BLM) and Forest Service (FS) are announcing an extension of the comment period on the Draft Land Management Plan, Draft Environmental Impact Statement (DLMP/DEIS) for the public and National Forest System Lands under their jurisdiction and by this notice is announcing the extension of the comment period. The original notice published in the Federal Register on December 14, 2007 [72 FR 71148] and provided for a comment period to end on March 12, 2007.
Availability of a Draft Environmental Assessment/Habitat Conservation Plan, and Receipt of Applications for Incidental Take Permits from the Broughton Land Company, Columbia County, Washington
The FWS and the NMFS (collectively, the Services) announce the availability for public review of a combined draft Environmental Assessment/Habitat Conservation Plan (EA/HCP) pertaining to an application by the Broughton Land Company (BLC) for incidental take permits (ITPs) pursuant to the Endangered Species Act of 1973, as amended (ESA). The draft EA/HCP addresses the proposed issuance of ITPs by the Services to the BLC for land management activities in Columbia County, Washington, that are identified in the HCP portion of the draft document. The proposed ITPs would authorize take, incidental to otherwise lawful activities, of the following threatened fish species: the bull trout (Salvelinus confluentus); Snake River spring/summer Chinook salmon and the Snake River fall Chinook salmon (both Oncorhynchus tshawytscha); and the middle Columbia River steelhead trout and the Snake River steelhead trout (both O. mykiss). We request comments from the public on the permit applications and the draft EA/HCP, all of which are available for review. The EA/HCP describes the proposed action and the measures that the BLC will implement to minimize and mitigate take of the threatened fish species discussed above. Endangered and Threatened Wildlife and Plants; Initiation of 5-Year Reviews of 58 Species in California and Nevada; Availability of Completed 5-Year Reviews in California, Nevada and Southern Oregon
We, the U.S. Fish and Wildlife Service, initiate 5-year reviews for 58 species under the Endangered Species Act of 1973, as amended (Act). We request any new information on these species that may have a bearing on their classification as endangered or threatened (see Table 1 below). Based on the results of these 5-year reviews, we will make a finding on whether these species are properly classified under the Act. We also indicate in this notice the 5-year reviews we completed for species in California, Nevada and southern Oregon in FY 2007 and early FY 2008.
Notice of Realty Action: Competitive Sealed Bid Sale of Public Lands in Clark County, NV
The Bureau of Land Management (BLM) proposes to offer 15 parcels of public land of approximately 143.24 acres in the Las Vegas Valley by competitive sealed bid sale procedures at not less than the fair market value (FMV). The sale will be conducted pursuant to the Southern Nevada Public Land Management Act of 1998 (SNPLMA), Public Law 105-263, 112 Stat. 2343, as amended. The SNPLMA sale will be subject to the applicable provisions of Sections 203 and 209 of the Federal Land Policy and Management Act of 1976 (FLPMA), 43 U.S.C. 1713 and 1719, respectively, and BLM land sale and mineral conveyance regulations at 43 CFR 2710 and 2720.

Public Land Order No. 7687; Revocation of Coal Classification Order No. 89 Dated July 9, 1962; New Mexico
This order revokes a Geological Survey Order in its entirety as it affects approximately 92,215 acres of public lands withdrawn from surface entry and reserved for coal classification purposes. The lands are no longer needed for the purpose for which they were withdrawn. This order opens the lands to surface entry subject to other segregations of record.

Notice is hereby given of contractual actions that have been proposed to the Bureau of Reclamation (Reclamation) and were pending through December 31, 2007, and contract actions that have been completed or discontinued since the last publication of this notice on November 30, 2007. From the date of this publication, future quarterly notices during this calendar year will be limited to new, modified, discontinued, or completed contract actions. This annual notice should be used as a point of reference to identify changes in future notices. This notice is one of a variety of means used to inform the public about proposed contractual actions for capital recovery and management of project resources and facilities consistent with section 9(f) of the Reclamation Project Act of 1939. Additional announcements of individual contract actions may be published in the Federal Register and in newspapers of general circulation in the areas determined by Reclamation to be affected by the proposed action.

American Basin Fish Screen and Habitat Improvement Project, Sacramento River, California
Pursuant to the National Environmental Policy Act of 1969 (as amended) and the California Environmental Quality Act, the Bureau of Reclamation and the California Department of Fish and Game as lead agencies have made available for public review and comment a joint Draft EIS/EIR for the American Basin Fish Screen and Habitat Improvement Project. The Draft EIS/EIR describes and presents the environmental effects of four alternatives, including no action, to modify the Natomas Mutual Water Company's water division and distribution system, thereby avoiding and minimizing potentially adverse affects to fish, particularly juvenile anadromous fish. A public hearing will be held to receive comments from individuals and organizations on the Draft EIS/EIR.
