The U.S. Army Corps of Engineers (USACE), St. Louis District, is issuing this notice to advise Federal, state, and local government agencies, affected Tribes, and the public that USACE has signed a Record of Decision (ROD) for Final Supplement I to the Final Environmental Statement, Mississippi River between the Ohio and Missouri Rivers (Regulating Works). The ROD was rendered to declare that, after careful consideration of the purpose of and need for the Regulating Works Project, the analysis contained in Final Supplement I, input from the public, affected Tribes, state and Federal agencies, and other interested parties, and based on the Regulating Works Project's Congressional authority and continued benefit of remaining construction, USACE has determined that the public interest will best be served by implementing the Continue Construction Alternative (hereafter, the Selected Plan).

On July 20, 2017, the U.S. Army Corps of Engineers (the Corps) published a document in accordance with Executive Order 13777, ``Enforcing the Regulatory Reform Agenda.'' In that document, the United States Army, Corps of Engineers Subgroup to the DoD Regulatory Reform Task Force said it is seeking input on its existing regulations that may be appropriate for repeal, replacement, or modification. The Corps is extending the comment period by 30 days. The extension of the comment period is a result of requests from a number of entities to allow more time to submit their comments.
Intent To Prepare an Environmental Impact Statement for the Combined Operational Plan, Broward, Miami-Dade Counties, Florida
The Jacksonville District, U.S. Army Corps of Engineers (Corps) is beginning preparation of a National Environmental Policy Act (NEPA) assessment for the Combined Operational Plan (COP). The purpose of the COP is to define operations for the constructed features of the Modified Water Deliveries to Everglades National Park (MWD) and Canal 111 (C-111) South Dade Projects, while maintaining the congressionally authorized purposes of the Central and Southern Florida (C&SF) Project to include flood control; water supply for agricultural irrigation, municipalities and industry; regional groundwater control and prevention of saltwater intrusion; enhancement of fish and wildlife; and recreation.
Definition of “Waters of the United States”-Schedule of Public Meetings
The Environmental Protection Agency (EPA) and the U.S. Department of the Army (the agencies) will hold ten teleconferences to hear from stakeholders their recommendations to revise the definition of ``Waters of the United States'' under the Clean Water Act (CWA). Nine of the teleconferences will be tailored to a specific sector, i.e., agriculture (row crop, livestock, silviculture); conservation (hunters and anglers); small entities (small businesses, small organizations, small jurisdictions); construction and transportation; environment and public advocacy (including health and environmental justice); mining; industry (energy, chemical, oil/gas); scientific organizations and academia; and stormwater, wastewater management, and drinking water agencies. One of the teleconferences will be open to the public at large. The teleconferences will run throughout the fall on Tuesdays from 1:00 p.m.-3:00 p.m. eastern time, beginning on September 19, 2017. In addition, the agencies will hold an in-person meeting with small entities on October 23, 2017 from 9:00 a.m.-11 a.m., and will accept written recommendations from any member of the public.

Definition of “Waters of the United States”-Recodification of Pre-Existing Rules
The Environmental Protection Agency and the Department of the Army (``the agencies'') are publishing this proposed rule to initiate the first step in a comprehensive, two-step process intended to review and revise the definition of ``waters of the United States'' consistent with the Executive Order signed on February 28, 2017, ``Restoring the Rule of Law, Federalism, and Economic Growth by Reviewing the `Waters of the United States' Rule.'' This first step proposes to rescind the definition of ``waters of the United States'' in the Code of Federal Regulations to re-codify the definition of ``waters of the United States,'' which currently governs administration of the Clean Water Act, pursuant to a decision issued by the U.S. Court of Appeals for the Sixth Circuit staying a definition of ``waters of the United States'' promulgated by the agencies in 2015. The agencies would apply the definition of ``waters of the United States'' as it is currently being implemented, that is informed by applicable agency guidance documents and consistent with Supreme Court decisions and longstanding practice. Proposing to re-codify the regulations that existed before the 2015 Clean Water Rule will provide continuity and certainty for regulated entities, the States, agency staff, and the public. In a second step, the agencies will pursue notice-and-comment rulemaking in which the agencies will conduct a substantive re-evaluation of the definition of ``waters of the United States.''

Notice of Intent To Prepare a Draft Environmental Impact Statement (DEIS) in Cooperation With the North Carolina Department of Transportation and South Carolina Department of Transportation for Extending SC 31 (Carolina Bays Parkway), in Horry County, South Carolina, To Connect to US 17, in Brunswick County, North Carolina
The U.S. Army Corps of Engineers, Wilmington District, Wilmington Regulatory Division and the U.S. Army Corps of Engineers, Charleston District, Charleston Regulatory Division (collectively COE) are issuing this notice to advise the public that a State (North Carolina Department of Transportation [NCDOT] and South Carolina Department of Transportation [SCDOT]) funded Draft Environmental Impact Statement (DEIS) will be prepared for improvements to SC 31 starting near Little River, Horry County, South Carolina and running northeast to US 17, in an area between Calabash and Shallotte, Brunswick County, North Carolina. This project is called the ``Carolina Bays Parkway Extension'' and is NCDOT Project 44604 and SCDOT Project P029554. In accordance with the National Environmental Policy Act (NEPA), the COE is the lead Federal agency responsible for the preparation of the DEIS. Information included in the DEIS will serve as the basis for the COE's evaluation of the proposed project pursuant to Section 404 of the Clean Water Act (CWA). As directed by CEQ regulations implementing NEPA, the COE will cooperate with the NCDOT to the fullest extent possible to reduce duplication between NEPA and the North Carolina Environmental Policy Act of 1971 (SEPA). Therefore, the DEIS will also serve as the basis for the NCDOT's evaluation of the proposed project pursuant to SEPA. The DEIS will assess the potential effects of the proposed project and a range of reasonable project alternatives on impacts to navigable waters and other waters of the United States, including wetlands. The DEIS will also provide information for Federal, State, and local agencies having other jurisdictional responsibility.

The Final Feasibility Study/EIS evaluates alternatives to manage flood risk within the Ala Wai watershed, which includes the neighborhoods of Makiki, Manoa, Palolo, Kapahulu, Moiliili, McCully, and Waikiki. It also documents the existing condition of environmental resources in areas considered for locating flood risk management features and potential impacts on those resources that could result from implementing each alternative. Supplemental Notice of Intent To Prepare a Draft Environmental Impact Statement (DEIS) for the Proposed Mid-Barataria Sediment Diversion, in Plaquemines Parish, Louisiana
The Coastal Protection and Restoration Authority of Louisiana (CPRA) has requested approval from the U.S. Army Corps of Engineers, New Orleans District (USACE-MVN) to construct, maintain, and operate a sediment diversion structure off the right descending bank of the Mississippi River, at approximately 60.7 miles above ``Head of Passes'' in Plaquemines Parish, Louisiana. The proposed project, referred to as the Mid-Barataria Sediment Diversion (MBSD), would be designed to deliver sediment, freshwater, and nutrients from the Mississippi River into Barataria Basin. USACE-MVN intends to serve as the lead federal agency in preparing an Environmental Impact Statement (EIS) in accordance with the National Environmental Policy Act (NEPA). At this time, Cooperating Agencies on the EIS includes the: Environmental Protection Agency (EPA), Department of the Interior (DOI), National Oceanic and Atmospheric Administration (NOAA), National Marine Fisheries Service (NMFS), U.S. Fish and Wildlife Service (USFWS), and U.S. Department of Agriculture (USDA). The EIS for CPRA's proposed MBSD project will inform a permit decision for a Department of Army (DA) permit pursuant to Section 404 of the Clean Water Act (Section 404) and Section 10 of the Rivers and Harbors Act of 1899 (Section 10), and permissions under Section 14 of the Rivers and Harbors Act of 1899 (Section 408). In addition to informing USACE-MVN's decisions, the EIS will inform decisions made by the Deepwater Horizon Natural Resource Damage Assessment Louisiana Trustee Implementation Group (NRDA LA TIG) regarding restoration evaluation and related funding decisions relevant to the Deepwater Horizon natural resource damage settlement, any decision by the National Oceanic and Atmospheric Administration's National Marine Fisheries Service (NOAA NMFS) that may be required under the Marine Mammal Protection Act (MMPA), and any additional regulatory or permit processes that may be required for the MBSD Project, to the extent practicable. USACE-MVN filed an original Notice of Intent (NOI) to prepare a DEIS for the MBSD project which was published in the Federal Register on October 4, 2013 (78 FR 61843). This Supplemental NOI serves to supplement the original NOI to update the MBSD project details, contact information for the proposed MBSD project, scoping provisions, and other pertinent information.

The Release of the Draft Environmental Impact Statement (DEIS) for the Bogue Banks Master Beach Nourishment Plan (BBMBNP), on Bogue Banks Barrier Island, Carteret County, NC
The U.S. Army Corps of Engineers (COE), Wilmington District, Wilmington Regulatory Field Office has received a request for Department of the Army authorization, pursuant to Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbor Act, from Carteret County to implement, under an inter-local agreement between the towns on Bogue Banks barrier island, a comprehensive 50-year beach and inlet management plan for the protection of approximately 25 miles of Bogue Banks shoreline. In order to address ongoing shoreline erosion in a more effective manner, the County and island municipalities (Towns of Atlantic Beach, Pine Knoll Shores, Indian Beach, and Emerald Isle) are proposing to combine their shore protection efforts under a more efficient comprehensive 50-year beach and inlet management plan known as the Bogue Banks Master Beach Nourishment Plan (BBMBNP).
Proposals by Non-Federal Interests, for Feasibility Studies and for Modifications to an Authorized Water Resources Development Project or Feasibility Study, for Inclusion in the Annual Report to Congress on Future Water Resources Development
Section 7001 of Water Resources Reform and Development Act (WRRDA) 2014 requires that the Secretary of the Army annually submit to the Congress a report (Annual Report) that identifies feasibility reports, proposed feasibility studies submitted by nonFederal interests, and proposed modifications to an authorized water resources development project or feasibility study that meet certain criteria. The Annual Report is to be based, in part, upon requests for proposals submitted by non-Federal interests.
Gulf of Mexico, Apalachicola Bay, East Bay, St. Andrew Bay and St. Andrew Sound at Tyndall Air Force Base, Florida; Restricted Areas
The U.S. Army Corps of Engineers (Corps) is amending its regulations by revising an existing restricted area regulation and establishing a new restricted area along portions of the Tyndall Air Force Base (AFB) facility shoreline that will be activated on a temporary basis. The duration of temporary restricted area activations will be limited to those periods where it is warranted or required by specific and credible security threats and will be inactive at all other times. The restricted area will be partitioned using 23 pairs of coordinates to facilitate quick geographic recognition. Tyndall AFB is surrounded on three sides by water with approximately 129 miles of unprotected coastline. This includes several areas where the lack of security or lack of restriction on access to these areas leaves Tyndall AFB personnel and resources vulnerable to security threats. This amendment is necessary to implement an enhanced threat security plan for Tyndall AFB which will allow temporary activation of one or more portions of the restricted area as necessary to provide the appropriate level of security required to address the specific and credible threat triggering the need for activation.
Availability of the Revised Draft Environmental Impact Statement for the Lower Bois d'Arc Creek Reservoir Project, Fannin County, TX
The U.S. Army Corps of Engineers (USACE) Tulsa District has prepared a Revised Draft Environmental Impact Statement (RDEIS) to analyze the direct, indirect and cumulative effects of the construction of the proposed Lower Bois d'Arc Creek Reservoir (LBCR) and related actions proposed by the North Texas Municipal Water District (NTMWD) in Fannin County, Texas. The Proposed Action is a regional water supply project intended to provide up to 175,000 acre-feet/year (AFY), with an estimated firm yield of 120,665 AFY, of new water for NTMWD's member cities and direct customers in all or portions of nine counties in northern TexasCollin, Dallas, Denton, Fannin, Hopkins, Hunt, Kaufman, Rains and Rockwall. Construction of the reservoir and related facilities would result in permanent impacts to approximately 5,874 acres of wetlands and 651,140 linear feet of streams, and 78 acres of open waters. This action requires authorization from the USACE under Section 404 of the Clean Water Act (CWA). The Section 404 of the CWA permit applicant is the NTMWD. The RDEIS was prepared in accordance with the National Environmental Policy Act (NEPA) of 1969, as amended, and the USACE's regulations for NEPA implementation (33 Code of Federal Regulations [CFR] parts 230 and 325 (with associated Appendices B and C). The USACE, Tulsa District, Regulatory Office is the lead federal agency responsible for the RDEIS and information contained in the EIS will serve as the basis for a decision whether or not to issue a Section 404 of the CWA permit. It also provides information for Federal, State and local agencies having jurisdictional responsibility for affected resources.

Notice of Intent To Prepare a Draft Supplemental Environmental Impact Statement, Mill Creek Project Operation and Maintenance, Walla Walla County, in the State of Washington
The U.S. Army Corps of Engineers (Corps) intends to prepare a Supplemental Environmental Impact Statement (SEIS), in compliance with the National Environmental Policy Act (NEPA), for the continued operation and maintenance (O&M) of the federally managed portion of the Mill Creek Flood Control Project (Project) at Walla Walla, Washington, and implementation of actions to avoid or minimize potential effects to Endangered Species Act (ESA)listed fish and/or associated critical habitat. The SEIS will supplement the June 1975, Mill Creek Project, Walla Walla, Washington, Final Environmental Impact Statement (FEIS), prepared by the Corps for the operation, maintenance, and improvement of the federally managed portion of the Project. The SEIS will identify and evaluate current O&M actions that may not have been adequately addressed in the 1975 FEIS or have been implemented since completion of the 1975 FEIS, and actions that are proposed for the future. It will also identify and evaluate operational and structural measures the Corps has proposed to improve fish passage through the Project. The 1975 FEIS did not adequately address the effects of the Project on fish species, particularly Mid-Columbia River steelhead and Columbia Basin bull trout. These species were listed under the ESA in the 1990's, and both Mill Creek and Yellowhawk Creek (a distributary of Mill Creek) have been designated as critical habitat.

Withdrawal of Notice of Intent for the Environmental Impact Statement Process for the Delta Wetlands Project in San Joaquin and Contra Costa Counties, California.
In accordance with the National Environmental Policy Act (NEPA), on February 28, 2013, the U.S. Army Corps of Engineers (Corps), Sacramento District, initiated the Supplemental Environmental Impact Statement (EIS) process to evaluate the effects of the proposed development of two Reservoir Islands (Bacon Island and Webb Tract) and to assist the Corps in deciding whether to approve Delta Wetlands Properties' application under Section 404 of the Clean Water Act. On July 25, 2016, the applicant for the proposed project withdrew their application for a Department of the Army Permit. Therefore, the Corps is terminating the EIS process, and is issuing this Notice of Intent to withdraw the February 28, 2013, Notice of Intent to Prepare an SEIS.
Intent To Prepare an Analysis Under the National Environmental Policy Act for the Port Everglades Navigation Improvements Project, Broward County, Florida
The Jacksonville District, U.S. Army Corps of Engineers (Corps) is beginning preparation of a supplemental National Environmental Policy Act (NEPA) analysis for the Port Everglades Navigation Improvements Project. The Port Everglades Navigation Improvement Project is designed to address future growth of cargo being transported to southeast Florida on post-Panamax ships due to the completion of the Panama Canal expansion, and to ensure safe navigational conditions for those vessels, as well as vessels currently calling at Port Everglades. The Port Everglades Feasibility Study was authorized through House Document 126, 103rd Congress, 1st Session, and House Document 144, 93rd Congress, 1st Session and by a resolution of the House Committee on Transportation dated May 9, 1996. In response to the study authority, the feasibility study was initiated in 2001 and completed with the signature of a Chief's Report and Record of Decision in 2016. The final recommended project was authorized as part of the Water Infrastructure Improvements for the Nation Act signed December 2016. The non-federal sponsor for the project is Broward County. The primary federal objective is to provide for increased navigational safety, efficiency, and improved economic conditions while limiting impacts to the environment to the maximum extent practicable, in accordance with environmental statutes, applicable executive orders, and other federal planning requirements.
Issuance and Reissuance of Nationwide Permits
The U.S. Army Corps of Engineers (Corps) is reissuing 50 existing nationwide permits (NWPs), general conditions, and definitions, with some modifications. The Corps is also issuing two new NWPs and one new general condition. The effective date for the new and reissued NWPs is March 19, 2017. These NWPs will expire on March 18, 2022. The NWPs will protect the aquatic environment and the public interest while effectively authorizing activities that have no more than minimal individual and cumulative adverse environmental effects.
Intent To Prepare an Environmental Impact Statement for the New Haven Harbor (New Haven, Connecticut) Navigation Improvement Project
The U.S. Army Corps of Engineers (USACE), New England District is conducting a feasibility study and Environmental Impact Statement (EIS) to examine navigation-improvements to the existing New Haven Harbor Federal Navigation project. The non-Federal sponsor for the study is the New Haven Port Authority in partnership with the Connecticut State Port Authority. Inadequate channel depths result in navigation inefficiencies in transporting goods into and out of the harbor. To reach the terminals, larger ships must lighter outside the breakwaters and/or experience delays while waiting for favorable tide conditions, or both. United States Navy Restricted Area, SUPSHIP USN, Gulf Coast, Pascagoula, Mississippi

East Pearl River, Within the Acoustic Buffer Area of the John C. Stennis Space Center, and Adjacent to Lands, in Hancock County, Mississippi; Danger Zone
The U.S. Army Corps of Engineers (Corps) is proposing to revise the existing regulations for a danger zone at the Naval Special Warfare Center (NSWC) N31 Branch within the acoustic buffer of the John C. Stennis Space Center on the East Pearl River, in Hancock County, Mississippi. The Navy requested establishment of a danger zone on waterways and tributaries of the East Pearl that are used by Naval Special Warfare units to conduct riverine training. The purpose of the proposed danger zone is to ensure public safety by restricting access within the danger zone during training events. This amendment to the existing regulation is necessary to minimizing potential conflicts between local populace activities and ongoing military training in the subject area.

Intent To Prepare an Environmental Impact Statement for the Jasper Ocean Terminal in Jasper County, South Carolina
The U.S. Army Corps of Engineers (Corps), Charleston District intends to prepare an Environmental Impact Statement (EIS) to assess the potential social, economic, and environmental effects of the proposed construction and operation of a marine container terminal by the Jasper Ocean Terminal (JOT) Joint Venture, a partnership between the Georgia Ports Authority (GPA) and the South Carolina Ports Authority (SCPA). In accordance with the National Environmental Policy Act (NEPA), the Corps is the lead Federal agency responsible for the preparation of the EIS. Information included in the EIS will serve as the basis for the Corps' evaluation of the proposed marine container terminal pursuant to Section 10 of the Rivers and Harbors Act (RHA) and Section 404 of the Clean Water Act (CWA). Notice of Availability of the Draft Environmental Impact Statement for Millennium Bulk Terminals-Longview, LLC Shipping Terminal, in the Columbia River, Near Longview, Cowlitz County, Washington
The U.S. Army Corps of Engineers (Corps) Seattle District has prepared a Draft Environmental Impact Statement (EIS) to analyze the direct, indirect, and cumulative effects of an action proposed by Millennium Bulk TerminalsLongview, LLC (MBTL) involving the Columbia River and adjacent waters of the United States. The Proposed Action is to construct and operate a shipping terminal to export up to 44 million metric tons of coal per year. Construction of the terminal and support facilities would result in the permanent loss of 29.3 acres of waters of the United States, consisting of 24.1 acres of wetlands and 5.2 acres of ditches and other waters. The proposed work requires Department of the Army authorization from the Corps under Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act. The permit applicant is Millennium Bulk TerminalsLongview, LLC. This Draft EIS was prepared in accordance with the National Environmental Policy Act (NEPA) of 1969, as amended, and Corps regulations for implementing NEPA (33 Code of Federal Regulations [CFR] Part 230 and Part 325, Appendix B). The Corps' Seattle District, is the lead federal agency, with the Environmental Protection Agency and U.S. Coast Guard participating as cooperating agencies. Information contained in this EIS will support a future decision regarding issuance of a Department of the Army permit under Sections 10 and 404. This EIS also provides information for state, local, and other Federal agencies having jurisdictional responsibility for the affected resources.

Notice of Intent To Prepare a Joint Environmental Impact Statement/Environmental Impact Report for the Proposed Lower Elkhorn Basin Levee Setback Project, Yolo County, CA
The U.S. Army Corps of Engineers (USACE), Sacramento District, as the lead agency under the National Environmental Policy Act (NEPA), and the California Department of Water Resources (DWR), as the lead agency under the California Environmental Quality Act (CEQA), will prepare a joint Environmental Impact Statement/Environmental Impact Report (EIS/EIR) for the Lower Elkhorn Setback Levee Project. DWR is the project proponent and may be referred to as the Applicant or Requester. The EIS/EIR will analyze DWR's proposed action to implement a flood risk management project in the Lower Elkhorn Basin in Yolo County, California. Because the proposed action would alter Federal levees, permission from USACE is required under Section 14 of the Rivers and Harbors Act (Section 408) (33 U.S.C. 408). The proposed action would also affect waters of the United States and require a permit from USACE under Section 404 of the Clean Water Act (33 U.S.C. 1344).
Draft Supplemental Environmental Impact Statement for the Dam Safety Modification Report, Bluestone Dam, Hinton, Summers County, WV
Pursuant to the National Environmental Policy Act (NEPA), the U.S. Army Corps of Engineers (Corps), Huntington District prepared a Supplemental Draft Environmental Impact Statement (SDEIS) to disclose potential impacts to the natural, physical, and human environment resulting from modifications to Bluestone Dam. The original EIS was published in 1998 and a Record of Decision (ROD) was signed in 1999 concluding the NEPA process allowing the Corps to initiate implementation of the Bluestone Dam Safety Assurance (DSA) Project. When completed, the current modifications under construction will strengthen the dam's stability and allow for increased discharge capacity through the use of hydropower penstocks substantially reducing risk. However, physical modeling and expert analysis conducted during project construction indicated the downstream bedrock is vulnerable to an unacceptable degree of erosion during high flow events. The Corps has also recognized potential for unacceptable erosion associated with overtopping of areas of the dam not designed to be overtopped. After a full consideration of alternatives to achieve acceptable risk levels, this SDEIS recommends implementing modifications to the existing stilling basin to prevent scour that could result in spillway instability and thus dam failure. Modification may include alteration to the existing stilling basin to include installation of a concrete apron, larger baffles, and would also include non-structural risk management measures. This SDEIS also addresses the prolonged construction duration of modification features described in the original EIS and ROD.

Intent To Prepare a Draft Environmental Impact Statement for the Proposed Flood Risk Management Project for the Souris River Basin, North Dakota
The St. Paul District, Army Corps of Engineers, in partnership with the Souris River Joint Water Resources Board (SRJB), is conducting a flood risk management feasibility study for the Souris River Basin within the continental United States. The feasibility study will include an Environmental Impact Statement and consider opportunities to reduce flood risk within Bonnineau, McHenry, Ward, and Renville counties, North Dakota. The study will evaluate several alternative measures, including, but not limited to: Levees and floodwalls, diversion channels, non-structural flood proofing, relocation of flood- prone structures, and flood storage.
